declaration about the southern border. white house senior adviser, steven miller, says the president is prepared to veto a congressional legislation disapproving of the declaration and use of $6 billion of taxpayer money to pay for a border wall. >> the president is spending this presidents' day holiday in south florida at his mar-a-lago resort and going to miami today to deliver a speech to the venezuelan american community. mr. trump is expected to reaffirm his support for venezuela's opposition leader, juan guaido. >> the president was busy on twitter last night, retweeting his own tweets criticizing former acting fbi director, andrew mccabe, shortly after mccabe was interviewed on "60 minutes." >> that interview reveals the depth of concern mccabe says he had about the president after the firing of fbi director, james comey. abc's tara palmeiri reports. >> reporter: a stunning admission from the former fbi director, andrew mccabe claiming he and deputy attorney general, rod rosenstein, had discussions about whether president trump was fit to serve and should be removed from office.

>> discussion of the 25th amendment, was simply rod raised the issue and discussed it with me, in the context of thinking about how many other cabinet officials might support such an effort. >> rosenstein was actively openly talking about whether there was a majority of the cabinet that would vote to remove the president. >> that's correct. counting votes or possible votes. >> reporter: in an interview with "60 minutes," mccabe saying the secret conversation took place in 2017, in the days after the fbi director, james comey was fired. >> the deputy attorney general was definitely very concerned about the president, about his capacity and about his intent. >> reporter: rosenstein denies discussing the president's removal. mccabe is now downplaying his own words, his spokesperson saying he never had extended discussions but he participated in a discussion that included a comment by rosenstein regarding the 25th amendment.

mccabe was eventually fired by president trump for leaking to the press, and trump attacking him on twitter saying mccabe is a disgrace to the fbi and our country. republican senator, lindsey graham going as far as to call it an attempted takeover. >> the deputy attorney general was basically trying to do an administrative coup, take the president down through the 25th amendment process, and the deputy attorney general denies it. >> reporter: senator lindsey graham says he plans to subpoena mccabe and rosenstein unless they voluntarily agree to testify before the senate judiciary committee. tara palmeiri, palm beach florida. the community of aurora, illinois is coming together to honor the victims killed in a factory shooting. these five were gunned down by a disgruntled co-worker. turns out, that co-worker was a convicted felon, who was not legally allowed to own a gun. on a snowy and cold day, the community paid respear thekiash

graping with how a long-time employee could walk into this factory and kill five of his co-workers. he knew he was getting fired when he brought a loaded pistol, outfitted with a laser to work on friday, but he shouldn't have had that gun. police revealing that background checks missed his prior felony conviction, which should have stopped him from purchasing a weapon. the company that planned on firing him said pre-employment background checks also missed his criminal past. the community of aurora now united by the shared shock and sorrow. like vincent juarez, his daughter in tears, and clayton parks russell beyer and josh pinkard, also fathers, taken too soon. trevor, a college intern killed on his first day of the job.

bringing snow, sleet, rain and thunderstorms to the deep south. speaking of the deep south, big time problems, excessive rain. travel disruptions and flooding aggravated and we could see ten inches of rain in some areas causing big problems along the mississippi river, tennessee river and green river. janai, devin? our thanks to paul. chicago police want another sit down with actor jussie smollett amid claims the alleged bias attack against him was a hoax. a law enforcement official tells abc news the two brothers seen in this video questioned by the police claim smollett paid them to stage the incident. sources say the men were confronted with evidence they bout the rope found around smollett's neck. the "empire" actor's attorney says smollett is angered and devastated by the suggestion he was involved. his lawyer went on to say anybody making the claim is lying. rapper 50 cent is accusing a new york city police commander of being a dirty cop. the deputy inspector told officers to shoot the rapper on site ahead of a 2017 boxing

match. the nypd says the matter is now under investigation and 50 cent says in a series of posts on instagram, he is considering legal action. the rapper was investigated by the nypd last year for making a threat against an officer on instagram but no charges were filed. the japanese prime minister won't confirm or deny that a japanese newspaper report that he was asked by a white house official to nominate the president, president trump that is, with the nobel peace prize. parliament, earlier today, shinzo abe praised president trump for how he dealt with north korea. and the japanese newspaper said somebody in the trump administration asked abe to do so. and oscar-winning director, steven spielberg is pushing to make movies for theaters instead of streaming services. >> according to "variety," he said there's great writing.

incident that got one passenger thrown off of a jetblue fight in ft. lauderdale. >> take a look. the passenger who melted down accused of spitting at another passenger and hitting an airline employee, and here's abc's stephanie ramos. >> don't touch me. >> reporter: an onboard melt down getting this woman a one-way ticket from her coach seat to the broward county jail. >> making it viral? what did i do? >> reporter: passengers reporting it. >> who's taping this? who's taping this? >> reporter: 32-year-old valerie gonzalez yelling and spitting while in her seat. police say this all started because she didn't want to sit next to a child. according to the incident report, gonzalez is heard shouting i'm not sitting next to a 3-year-old, i've been drinking all day. >> i didn't do anything. i sat down in my seat and i asked to go somewhere else because [ bleep ]. >> reporter: the flight crew called security and the 32-year-old was taken off the aircraft and arrested.
