balloon to land and the group of ten started in sonoma. at some point the winds were so strong, they were force today land. it was neither a crash nor emergency landing. the safety and training association says what happened is called a rip-out or a dry landing. >> in this case, this is an unfortunate not greatly accessible area to retrieve the balloon. it was a safe and appropriate landing spot for the pilot to put the balloon down. that's better than landing in the bay or a lot of houses. >> looked like an emergency to me. but okay. call it what you want. >> no one was hurt. the hot air balloon company says their pilot did everything by the book. >> very good. glad they're okay. >> in san francisco, two businesses affected by the gas line explosion on february 6th are getting help from the city. the sf gate reports hong kong lounge 2 and huckleberry youth programs can access up to $10,000 through the small business disaster relief fund.

the businesses were in a building that suffered fire damage at geary and parker. half have new jobs. the city's office of economic and workforce development helping. the huckleberry employees have been shifted to other locations. firefighters are keeping an eye on the tesla plant in fremont. we were just there after the fire started in a storage area saturday night. crews got it under control in about an hour and a half. it's still not clear what caused the fire or even what burned. haz-mat crews think it may have been lithium batteries. they say fire crews had a problem suppressing the fire with foam. the dpier did not threaten other buildings or employees. audience members who rushed out of a performance of hamilton at the orpheum wited ba here's a look at the scene. the orpheum released a statement saying the audience at friday's performance will be invited to return to see the missed the en

pope francis' summit on preventing clergy sex abuse is under way at the vatican. he's summoned bishops to rome to help him chart a way forward after decades of abuse by priests. it's eroded trust by catholics. organizers will meet this week with a dozen or so survivors. the group traveled to italy to protest the church's response to abuse and demand an end to decades of cover-ups by church leaders. former nfl quarterback colin kaepernick and eric reid reached

reports of debris around north main. sounds like vehicles are hitting that. chp on the way to check that out. we do have a lot of changes with mass transit today due to the holiday. i'll talk about that coming up next. breaking news now. authorities are investigating a deputy involved shooting in a rural part of napa county. >> it happened last night at 11:00 henry road north of highway 12. that's where we find reporter amy hollyfield this morning. amy? >> reporter: hi, good morning. jessica. henry road is still closed. there's a chp officer blocking here not letting any cars through. that's what they're doing in the investigation. this happened just before 11:00 last night. this very rural area here on henry road in napa county. officials say a deputy was patrolling the street last night and the deputy contacted a vehicle and deputy says that shots were fired. the man in the car was killed and the deputy says the man did have a gun.

they have not identified the deputy. they also didn't say what happened to lead up to the deputy contacting the driver in this car or what happened to right before the shots were fired. they say no one else was involved. there's no one else in the car and no witnesses in this very rural area. we're waiting for more details on what happens here. the sheriff's department says at this time no one from the sheriff's department will be making any comments. amy hollyfield, abc 7 news. amy, thank you. right now we want to go to sky 7. let's see if we can get that out there. this is a look from above at where police are out there near where amy is reporting from. you see a live look at that investigation that is now under way. as we've been mentioning and as amy reported, there was a deputy involved shooting overnight. one person was killed. now you can see that area is cordoned off and several police vehicles are out there. we can only assume that that

is the police vehicle the deputy was in at the time of the shooting. this is the first time we're getting a closer look and what this actually -- this investigation actually looks like and you're getting a closer look from sky 7 this morning. as we get more information and understand more about what this scene is, and now that i see that, that looks like that was probably the vehicle of the suspect. >> who died, right. >> and perhaps one of the police vehicles involved as well. we'll get more information and bring that to you as soon as possible. a santa rosa family is furious after a driver hit their 7-year-old girl and took off >> the girl is okay. a warning that the video you're about to see may be disturbing to some. the hit and run happened saturday evening on louis krohn drive. here in this video, it shows the children running across the street and then a black sedan comes into view and hits hazelann launches her into the air about ten feet. she lands on the street, screams and then runs away with her friend and brother. >> she's okay. thank gold.

the issue and discussed it with me in the context of thinking about how many other cabinet officials might support such an effort. >> in a 60 minutes interview mccabe says deputy attorney general rod rosenstein raised the issue in may of 2017 after the firing of then fbi director james comey. >> the deputy attorney general was definitely very concerned about the president, about his capacity and about his intent. >> rosenstein denies the discussions took place but senate judiciary committee chairman lindsey graham says his panel will investigate to determine who is telling the truth. president trump firing back on twitter saying mccabe, quote, is a disgrace to the fbi and our country. >> mccabe has down played his words. his spokesperson saying he never had extended discussions but, rather, participated in a conversation that included a comment from rosenstein about the 25th amendment.

mona kosar abdi, abc news washington. a senior adviser to president trump is hinting that the president might be willing to use his veto power if congress votes to disapprove of his national emergency declaration. steven miller says the president is going to protect his declaration, guaranteed. democrats are planning to introduce a resoluion disapproving the decision. it's likely to pass congress with several republican senators saying they would vote against the president. in the east bay, all eyes are on oakland unified. teachers now say they will strike beginning this thursday. teachers are demanding smaller class sizes and a 12% pay increase over three years. the district says it can only afford a 5% raise over thee years. if there is a strike, oakland unified will hold classes with substitute teachers as well as school administrators at the helm. even though the schools are expected to stay open during a possible strike, the city of oakland says it will open some recreation centers to help out parents. in fact, 15 rec centers will be

open from 8:00 to 3:00 monday through friday and the teachers union will provide volunteers at those centers as well as meals that will be provided for the students. another option for parents are public libraries. they will be open during regular business hours. the city is asking that children 7 and younger be with a parent or care-giver. ac transit may reduce the service to schools, detour routes and temporarily close bus stops during the strike. sausalito planning to hold a meeting this morning to declare an emergency. that's because a mudslide caused this damage thursday. one woman had to be correspond cued and several homes -- rescued and several homes red tagged. new this morning, walmart shoppersoprorihe nth bl hav find another store. video shows several empty shelves inside the walmart on lincoln avenue in napa. in the store say their delivery truck has been delayed due to the bad weather.

jussie smollett. this after a twist in the investigation into his reported attack. sources tell abc news two brothers arrested over the weekend have now been released. they say that smollett paid them to stage it. at least one man appeared as an traex on empire. smollett has released a statement saying he's been further victimized. jussie played a role in his own attack. he goes on to say nothing is further from the truth and anyone claiming otherwise is lying. abc news analyst abrams weighed in on what charges smollett could face if he did stage it. >> illinois filing a false report p. police report is a felony. if they become convinced that this is a hoax that this didn't happen, they're going to throw the book at him. they would try to make sure he served atea connection with this.
