we're in the haight-ashbury section. for around 20 minutes this fire was putting up a lot of black smoke that could make the scene a lot worse. we're seeing at this moment -- we're seeing at this moment firefighters putting out water in the building right next to the one that was on fire around 3:12 p.m. we spoke to one of the ladies that lives inside this building. she told us she is very concerned about what was going on. we're going to bring you the latest. live here in san francisco, luz pena, abc 7 news. >> luz, thanks very much. we'll keep you updated on that story. >> absolutely. now turning to that other top story, that massive mudslide in sausalito. >> my life is gone. i have to build from here every day is a new day. >> a sausalito woman hillside with her in it, leaving her buried up to her neck in the mud. >> can you imagine? abc 7 news reporter wayne freedman is in sausalito for us

this afternoon. wayne? >> good afternoon, ama. four days since this mudslide. well still have five red tagged homes. residents of those homes who can't get in to collect their blo belongings to see what is left. good news today, we had sunny skies, a chance to drain out. >> water draining from the side of l.a. week's sausalito mudslide. it remains constant. no, not as heavy as it has been, but with every drop, uncertainty remains. >> what is your biggest concern at this point? >> more rain coming. >> sausalito mayor joe burns late this morning he visited the place where this slide started. a portion of sausalito avenue where the world appears to have dropped away after the slide began above on land owned by the national park service, beneath highway 101 operated by caltrans. we asked the mayor who might be responsible. >> we have been working with the park service and caltrans. >> when you say working with, what do you mean? >> in trying to figure out what other areas are we vulnerable. >> this morning the mayor

presided over a city council hearing that ratified sausalito's declaring of a state of emergency and heard from slide victims like susan gordon. >> i lost $2 million, but my life was saved. >> susan lived in the house that that collapsed. in less than a week her life has gone topsy-turvy and gone down a mountain. at this point how is your sense of security? >> i don't have any. >> for instance, how she doesn't have any. susan was trying to get a new cell phone. she wanted her old phone number. she went to the company. the company said we won't give you that old phone number unless you give us a photo idea. she didn't have a photo id. that was on her license. her license is down the hill inside the house. so she went to the dmv to get a new license to get a new photo idea, and she'll visit in 30 days. by the way, we contacted the dmv and the national park service. no callback from either of them. in sausalito live, wayne

freedman, abc 7. >> that is frustrating. thank you, wayne. and there is still no word on when the flooded westbound lanes of highway 3 n reopen. sky 7 flew above the area near a levee breach that caused this flooding. engineers spent the weekend analyzing embankments. they say floodwater needs to recede out to san pablo bay before the full extent of the damage and any potential fix can be determined. a heads-up for drivers who use the richmond-san rafael bridge. repair work on the upper deck will begin tomorrow night at 9:00. tomorrow at 9:00 p.m. crews need to do a permanent fix after concrete fell on to the lower deck a couple of weeks ago. it forced officials to shut down the bridge for several hours. caltrans installed a metal plate that was a temporary fix, though. drivers should be prepared for lane closures during the overnight hours. the diocese of oakland has released a list of 45 priests credibly accused of sexual abusing children. only six of the accused are still alive. victim advocates say there are priests who aren't listed,

including father alex castillo. he was put on administrative leave last month after being accused of inappropriate conduct with a minor. the diocese tells abc 7 news the list of names will be updated as needed. >> it's another piece of our efforts to keep our children safe and to promote the healing and justice of survivors. >> the release of the list comes as pope francis prepares to host a summit on preventing clergy sexual abuse. organizers say they want to make bishops aware of their responsibilities to protect their flocks. the consequences of shirking those responsibilities and the need for transparency. the abc 7 news i-team reporter dan noyes will look deeper into the oakland diocese list coming up at 6:00. a napa county sheriff's deputy shot and killed a man in his car. >> investigator says the man had a gun. it happened on henry road west of the city of napa about 11:00 last night. >> over the scene this morning,

there were evidence markers surrounding the car, and there was a gun on the roof. a sheriff deputy says an officer saw the car parked and got out to speak with the driver. a deputy then radioed shots had been fired. they're not releasing details on what led the officer to fire her help. here at abc 7 news, we talk about building a better bay area. we're focused on calling out problems and searching for solutions across the bay area. >> in oakland teachers struggling to make ends meet say they will strike starting on thursday. the union representing the 3,000 teachers announced the walk-out on saturday, making it the latest in a wave of educator activism across the united states. >> last week teachers in denver walked off the job for three days before reaching a deal on thursday. and teachers in the nation's second largest school district, los angeles, staged a six-day strike last month. settle odd about a 6% raise. >> abc 7 reporter lyanne melendez is life in oakland today with the latest on the action taking place here. lyanne? >> well, the teachers walking in

right now to attend a meeting to discuss, of course, the possible strike, which would commence on thursday. the teachers, by the way, have been without a contract since july 2017. now this fact-finding report which we obtained today says that the district, the school district and the union are not that far apart. the issue now is bringing them back to the table. even this close to a potential strike, the oakland district and the teachers union are stuck on the logistics of a future meeting. for example, the union wants to see a new approximately in writing before sitting down with the school district. >> if it's not brought to us in writing that addresses major changes and major investment in our students, then oakland educators are going to strike. >> the district, on the other hand, says let's sit down first to discuss our latest offer, and

then begin to negotiate. >> they want to avoid the strike too. why not come and sit at the table with us? it's the same question. we all want to avoid a strike. the last thing we want in oakland is to have a strike. >> oakland's mayor libby schaaf told reporters she recently spoke to governor gavin newsom who assured her more money will be allocated for education in his upcoming budget proposal which will give the district more funding. >> the parties are not so far apart, and again, i'm hopeful from the resources that have been identified in the governor's proposed budget. >> the independent fact finding report found that the proposed 5% over three years that the district is offering will not keep pace with inflation. but at the same time acknowledges that the district would have a hard time affording te 12% raise that the union wants. the report therefore recommends a 3% raise for 2017/2018, a 3% raise for this year, and an economic reopen for 2019-2020.

while everyone acknowldges a strike would be disruptive, this principal says they will try to stick with the current curricul curriculum. >> we plan to make sure that we use the instructional time wisely by making sure that children are actually reading, writing, and learning. >> now many parents we spoke to said they will not cross the picket line in support of the teachers. so the city of oakland has said that it will open 15 rec centers and also, by the way, libraries will be accessible to students. i'm live in oakland, lyanne melendez, abc 7 news. >> thank you, lyanne. here is a little background on the district. last year oakland reported more than 36,000 students in its 87 district-run school. it has just over 387 teachers. starting teacher salary is $46,570. pay tops out at $83,000. now according to state data, that is the lowest of all

thankfully suffered only minor injuries. now look at this. a lot of people on abc7news.com are looking at this these photos of the vehicle. they were taken by abc 7 news reporter david loeouielouie. just mangled there. you can see how damaging the crash and the fire were. investigators say driver fatigue could be a factor. david will have a live report on the investigation as well as tesla's response. that's coming up on abc 7 news at 5:00. now to that new twist in the jussie smollett case. >> yes. a law enforcement official tells abc news that smollett was upset that a letter sent to "empire"'s chicago studio last month didn't get enough attention, and now police say they're working to corroborate allegations that smollett paid two men to stage that assault. >> abc news reporter maggie rulli has the latest. >> reporter: new questions about exactly what happened the night actor jussie smollett says he was attacked. now a law enforcement official says these two men told police

they were paid by the actor to orchestrate and stage the racist homophobic assault. >> in illinois, filing a false police report is a felony, and he could face up to three years behind bars. >> just last week an emotional smollett went into great detail about the alleged attack. >> he said this is maga country, punches me right in the face. >> police arresting the two men seen here in these surveillance images from that night. but on friday, the men were released after police said they agreed to cooperate with investigators. police revealing all three of the men know each other, one even appearing as an extra on smollett's show "empire." >> police now seeming to make it clear that they believe the brothers and have very serious questions about jussie smollett. >> now smollett's attorney tells abc news is the victim of a hate crime who has cooperated with the police investigation, jussie smollett is angered and

devastated by recent reports the perpetrators are individuals he is familiar with. he has now been further victimized by claims attributed to these alleged perpetrators that jussie played a role in his own attack. nothing is further from the truth, and anyone claiming otherwise is lying. in their most recent statements, smollett's attorney says there are no plans for him to meet with chicago police today. they have no further statement. maggie rulli, abc news, new york. a florida mother is demanding charges be dropped against her 11-year-old son who was arrested after refusing to recite the pledge of allegiance at school. it began when a substitute teacher at lawton chiles middle school asked the sixth grader to stand for the pledge. the student reportedly told the sub the flag was racist. the comment sparked an exchange that ended with the teacher telling the student he could always leave the country. the sub called the administrators who eventually called police. the boy's mother says school officials and police just

overreacted. >> i'm upset and angry, i'm hurt, more so for my son. my son has never been through anything like this. and i feel like they should have handled this differently. >> the arrest affidavit says the student refused to follow multiple commands, repeatedly called school leaders racist, and threatened to get the school resource officer and principal fired. school said the sub did not know that students are not required to participate this the pledge, and that she won't be teaching at the school again. it will be quite a show in the night sky tonight. that's because we will be treated to the largest super moon of the year. super moons happen when the moon is at its closest point to earth along its slightly elliptical orbit. this is the second of three super moons this year there will be another one next month. february's super moon is also known as the snow moon. that's cool. >> appropriate. very cool. >> will we see it, though? >> that's the big question. let's go from the super moon to the super meteorologist. >> we are going see the it.

looking statewide you see it's dry in some locations, but only one area has even moderate drought, and that's down the extreme southwestern part of the state from palm springs down to san diego. the rest of us are out of the drought situation for now and looking pretty good. overnight conditions will be clear, clear skies, and really, really chilly in our inland areas with low temperatures dropping into the upper 20s at lakeport, cloverdale and santa rosa. in the inland east bay 30 at livermore and down south a low of 29 degrees at morgan hill, right around the bay shoreline lows in the mid- to upper 30s. here is a 12-hour planner for tomorrow. start the day with cold conditions in the early morning hours. we'll be warming up to mid-50s inland and around the bay by about 4:00 p.m. or so. low 50s on the coast and the temperatures drop sharply after sunset tomorrow night. highs tomorrow more specifically 53 in half moon bay. 57 in oakland. 56 in fremont. 57 at napa and at santa rosa. down in the south bay, 56 in san jose and over at livermore, a high of 55.

yep, this guy knows what i'm talking about. try my $4.99 sourdough patty melt combo. live where you live, this is abc 7 news. >> and here are the stories making headlines at 4:30. firefighters are putting out flames in san francisco's haight-ashbury neighborhood. this video from the citizen app shows flames coming out of a home on page street near baker. fortunately there are no reports of injuries. five homes are still red tagged in sausalito following last week's mud slides. residents of the homes haven't been able to get back into the area. the city has declared a local emergency to get state as well as federal aid. a tesla driver survived a fiery head-on crash today in fremont. fremont fire is keeping a close watch on the wreckage just in case that fire re-ignites. abc 7 reporter david louie will

have the latest coming up on abc 7 news at 5:00. this president's day, there have been protests across the country by people opposed to president trump's decision to declare a national emergency. abc 7 reporter serena marshalls that the story. >> from newark -- we'll wild bridges. >> to d.c., austin, chicago and pittsburgh -- >> no racist wall! >> protesters out in opposition to the president's decision to declare national emergency at the border. >> it's ironic that we are here on president's day not to honor past presidents, but to unite in a fight against the current president. >> the emergency declaration allowing trump to tap into funding from other government agencies, up to $8 billion according to the white house. members of both parties have come out against the move. >> i think there is enough people in the senate who are concerned that what he's doing is robbing from the military and the dod to go build this wall. >> although senator duckworth thinks congress will vote to

organizers demand congress take action to block the move. let's turn now to the sierra and all of that snow. records are being set in the sierra for the amount of snow that has fallmen the last couple of weeks. >> travel to and from tahoe has been miserable. abcnews reporter laura anthony, oh, she found that out firsthand over the weekend. it took your 14 hours to get there. that's at least quality family time in the car? >> a little bit of bonding going on. i should start with a disclaimer, first of all. we have a family place up there, and have been driving up in the winter for many years. so we knew what we were getting into. that said, it did take much longer than expected. but the rewards were amazing. >> this is highway 50 right above pollock pines. >> what started as an adventure turned into an odyssey, and then a bit of an ordeal. emboldened by the fact that highway 50 was open when interstate 80 was not, we left the east bay fully aware we were

in for a long ride, and well prepared for what we expected would take maybe seven or eight hours. we had a full tank of gas, plenty of food and warm clothing, and the hope that the payoff would be worth the struggle. and though it took nearly twice the time we thought, what we found on the other side made it all worth it. sights like these in the high sierra have been hard to come by in recent years from the air, it seems hardly a peak is left uncovered. a thick blanket of snow that extends for miles in every direction. even the locals know that all of this is something to be celebrated. >> it's so good s mnare ce back. i believe i just saw that it was 26 trillion gallons of water has now fallen on the state. we're here at lake level right now, and you can even see behind me, that's about three and a half to four feet here in the heavenly village, which usually doesn't see this much snow in that short of time. >> that's not to say there can't be too much of a good thing there are, of course, the dangers of driving in it.

but also the reality of digging out and making sure that roofs don't collapse under the weight of nature's bounty. but there is also the reward, the joy of floating through all that fresh powder, being the first to carve your own path, cut new tracks, knowing that with each turn, there is a new memory. okay. i'm not going to tell you what happened after the video, but not sure if you can tell from our video, but as many of the ski areas are finding their crews are actually having to dig out the lifts so that the chairs can get around at the bottom stations. we're used to seeing the powers way up above. >> that's amazing. the pictures are stung. how are the roads now? >> they're doing an amazing job. they are running outoom to throw th>>he machines that cut walls and throw it. it looks to me like there is nowhere to throw it. it's that high. donner summit we came down yesterday, the walls on the summit i would say are 10, 12

immense size of our snowpack in the sierra. you will also notice that lush green vegetation across much of california. we have seen 18 trillion with a t gallons of water so far this month fall over california. that's enough to fill 27 million olympic-size swimming pools. so we've seen a lot of rain. our snowpack is doing really well as well. take a look at this. this time last year our snowpack was at a measly 20% of average. this year, look at that number. the snowpack today at 141% of average. so healthy snowpack will bode well for our water supply later on this summer. >> wow. >> he said trillion. >> i know. >> woo! >> impressive. just ahead, a trip of a lifetime. >> after 17 years searching for her biological family, a woman finally meets her aunt she never knew, and it happened at a bay area airport.

>> live doppler 7 sunny skies all across the bay area right now. and we are out of the drought. how about that? drought monitor showing only a couple of areas that are even considered dry. way up around lakeport and way down south, south of morgan hill, south of gilroy in fact. we're in good shape right now. bewe still would like to see a little bit more rain before the rainy season is behind us. it's going to be cold tonight with low temperatures dropping into the upper 20s in some parts of the inland north bay over in the inland east bay and down to the south bay even upper 20s to low 30s. around the bay shoreline look for mid- to upper 30s. by mid afternoon we'll be seeing sunny skies, high temperatures in the mid 50s in most locations. it will be a nice pleasant late winter day. here is the accuweather seven-day forecast. light showers will come in on wednesday. that's just about it, though. it's not going to be a very rainy day. we'll be dry on thursday with lingering clouds and maybe a couple of offshore sprinkles.

british lawmakers issued a scathing report today that calls for tougher rules on facebook to keep it from acting like, quote, digital gangsters. >> i think their persistent failure to deal effectively with harmful content. they've got the technical know how to still sele us and products, help advertisers sell products based on a deep understanding of everything we do on facebook. so why can't they do more to use the same technology to address harmful and illegal content that >> the report says facebook, quote, intentionally and knowingly violated both data privacy and anti-competition laws. according to the bbc, the report

contractors can often create terrible experiences for their customers. and the biggest complaint is time, that you hire someone. they say oh, we should be able to knock this out in six, seven, eight weeks and four months go by and they're still working, working, working. and part of that is because contractors get busy. they try to juggle multiple jobs and keep everyone happy. another problem is that just everyone whose watched the home improvement television shows knows that, you know, things come up. problems occur that there is hidden damage or things, and it kind of delays things, and weather can often delay things. so lots can go wrong. the best way to protect yourself is by hiring a really good contractor, and making sure that you have a really good contract with that contractor that protects you. >> so how do you find a good contractor? here you can go on the state website and check it out. at least get one not in trouble. >> you should for sure find one

that is licensed. one problem is a lot of people have is they hire unlicensed contractors. it makes it a little difficult to get help from authorities if you've hired an unlicensed contractor. they're going to be more likely to want to help you if you've have a problem that you hired someone who is licensed. then you're making sure that their work is properly permitted and inspected if that's needed for the type of job you have. >> so what should you know before you sign a contract? >> well, you want to make sure. the most important thing is to make sure that you're paying as you go, that you're not pay together much money up front for the work that is to be done. i think it makes sense to pay a small amount to secure your place in the contractor's schedule, but a lot of people get into trouble where they've paid someone a lot of money. the contractor says oh, i need to buy appliances and cabinets, so i need all the money for that, and you pay them, and then they kind of disappear, or the work just stops for a while. that's really a huge problem a lot of people have. you can prevent that by making

>> cheers has changed his life in more ways than i can even describe. ♪ they are together all the time. they go to school together, basically everywhere together. they have a very unique bond that i really can't even describe. it's amazing. this dog is everything to us. >> we're reed's parents. reed is 9 years old. he was born with spinal cerebellum ataxia. if you look at an image of his brain, his cerebellum is about half the size it should be, which affects his fine motor skills, his speech, and his ability to walk. >> reed needed a walker to walk for a very long time. the walker became unsafe because he was walking too quickly in it. i had the idea that if we could find another option for him, i

would pursue that. we found the organization that we got cheers from, four paws for ability. >> cheers is a standard poodle. >> cheers is trained in three main services. number one is mobility. he helps reed walk farther safer longer than he otherwise would be able to. the second service that he is trained in is called behavior distraction. reed's nonverbal. even though he has an alternative talking device -- >> i want a pizza with cheese. >> he will occasionally get very frustrated when he can't get his points across. the dog will help him calm down when he starts to get frustrated. the third service that he provides is alert. let's say reed falls. the dog will bark. and that will tell me that i need to go look for reed and make sure that he's okay.

>> the fourth thing cheers does for reed is brings him into more social situation with other kids in the school. >> he is a social bridge. >> i like to say that reed is not the child with special needs. i want other kids to think about reed as the kid with the dog. it's when children want to pet the dog, they have to ask reed. that socialization brings reed closer to his classmates. he was named cheers because he was born around new years. we certainly couldn't have come up with a better name because like in the show, cheers, everybody knows your name. so now everybody in our neighborhood knows reed because of cheers. >> he is just made life just that much easier. he is still a happy little boy, and he is happier because of the dog. just being there with him, just knowing that his companion, his best friend is right there. thank god for cheers. >> that is so special. it makes you tear up.

luz? >> thank you, that's right. here's what we know. at least 15 residents have been displaced because of a two-alarm fire behind us. currently the fire is out. firefighters are still spraying sections of the building. it broke out around 3:12 behind. firefighters are currently on the roof of the burned building and assessing the properties right next to it. we spoke to one of the residents who was inside the building when the fire broke out and tells us he never thought this would happen to him. >> we turned the tv off for a second. we heard a very faint fire alarm. and so we stayed quiet for a minute. and then all of the sudden we hear sirens in the background like fire sirens. i said yeah, i don't like that combo. we should probably go. so we run out the doors. and by that time when we're running out, there was glass coming down from the top window.
