left off this list. >> this is a step, but survivors tell me it's not far enough. the list oakland put out today is much shorter than reports we've seen in recent months. many of the 45 priests credibly accused of child sexual abuse have already appeared on abc 7 or in other published reports, but five are new names that don't appear in any public database. they're part of what the oakland diocese says is a new era of transparency. >> our two most important priorities, keep our children safe, healing and justice for our survivors. >> but attorneys and advocates for survivors say the list is too short. in october attorney jeff anderson released a report that found 95 priests accused of sexual misconduct in the oakland diocese. >> and how many more files do they have of how many offenders are they now keeping secret? >> the oakland diocese now says anderson counted priests who lived here for a time but offended in other parts of the state, and that the publication of the list today is just a start.

>> we're having an independent reviewer come in and look at our files, look at our processes. that report, that independent report should be done in late spring. >> if you're not going to be fully transapparent, then you're not transparent. >> joey piscatelli heads the survivors network of those who survived abuse by priest. he says the short list is deceitful. it does include the priest who abused piscatelli when he was a boy. i confronted father steve whelan in 2005. >> it's a spurious argument, accusation. i am not in any -- i have not been suspended or anything. >> so there is no truth to the accusation? >> none at all from my point of view. >> but piscatelli sued the church and a jury awarded him $650,000. now he says the oakland diocese still hasn't come clean. >> they said they have nothing to hide and they're hiding a lot. they're hiding a lot of names of a lot of accused ensued and convicted abusers that just

aren't on the list. >> the pope's summit on preventing clergy sexual abuse begins thursday. over the weekend, the vatican announced the highest ranking american church official to be reprimanded for sexual abuse, former cardinal and archbishop of washington, d.c. theodore mccarrick is being defrocked for sexual abusing minors and adult seminarians. >> both abuse and this cover-up can no long better tolerated. >> the only diocese or archdiocese in the bay area not to publish names of priests who abused children is san francisco. a spokesman there told me a review was under way, and they have made no decision yet if names of priests will be published. so we'll see. >> all right, thank you, dan. well, new at 6:00, it's official tonight. california has filed a lawsuit challenging president trump's national emergency declaration. 15 other states joined in today's suit. it claims there is no emergency at the border, and that the president is circumventing congress. mr. trump's declaration made last week allows him to use

money from the pentagon and other budgets to build a border wall. just hours ago, san francisco firefighters raced to a home that had flames shooting out of the windows. the fire burned in the city's haight-ashbury neighborhood on page street. people inside had to scramble to get out. abc 7 news reporter luz pena spoke to one man who ran from the flames. luz? >> thank you, ama and dan. that's right. we're here in san francisco. as you can see, the building right behind us, it's kind of getting cleared up right now. according to san francisco emergency department, 19 people are now displaced because of this two-alarm fire. we just spoke to san francisco fire assistant chief baker. he confirmed the fire started on the third floor of the building. currently the fire is out. firefighters are still spraying seioe building. here is a video of our sky 7. we can see the smoke coming out of the building. also in the citizen app, we can see the flames shooting up. we just spoke to the fire assistant that confirmed when they got to the scene, the floor plan of the building was

altered. >> with zero visibility and high heat, it takes a little extra effort to find your way to the seat of the fire. in addition to that, there was a lot of furniture and stuff that was impeding progress. so initially, we had to breach a wall to get first waterton fire. >> we turned the tv off for a second. we heard a very faint fire alarm. and so we stayed quiet for a minute. and all of the sudden we hear sirens in the background. like fire sirens. i said yeah, i don't like that combo. we should probably go. so we run out the doors. and by that time, when we're running out, there was glass coming down from that top window. >> around ten minutes ago, firefighters were on the roof of the burned building and assessing the properties right next to it. we're currently one block south of the panhandle section of golden gate park. the red cross has arrived to help the displaced residents. as you can see to my right, there is several wait to see if they're able to go back in their property and somehow get some of

their things out of here. live in san francisco, luz pena, abc 7 news. >> luz, thank you so much. and we use the abc 7 news app to send out this push alert as that fire burned so you knew what you were seeing. you could also watch live video in the app. the app is free to download and you can customize it so you get alerts where you live. take a look at what remains of a tesla that crashed in fremont. it caught fire after the crash. the driver we're glad to tell you was able to walk away. abc 7 news reporter david louie says firefighters are keeping a close watch on the wreckage. >> sky 7 was over the scene where the white tesla suv crashed, apparently at high speed into a tree. that triggeredthe iver m e ri. the driver told fremont police that he had just put in a 12-hour shift at tesla. police are looking at fatigue as a possible cause for the crash. it's not known if the batteries caused the fire. >> it's hard to tell if the components were the origin, the upholstery. it was a total loss by time we

got there, and fully involved. >> fremont firefighters continue to check for a second fire to break out using a thermal imaging camera. tesla batteries have a history of re-igniting hours and even days later. first responders have worked out a tactic with tesla to pour thousands of gallons of water on them to address this issue. tesla addressed a statement to abc 7 news that the damage sustained by the vehicle is indicative of a very high speed collision, which can result in a fire in any type of car, not just electric vehicles. we understand the drivers sustained only minor injuries. we are glad that he is safe. the model x is registered to brian morton. there is a tesla equipment mintenance technicnat namen a liedin ve tldonrm saightncluding t materials unit responded to the automaker's plant when an outdoor fire broke out involving battery components being disassembled for recycling. >> once the supervisors arrived, they were able to brief us on

what was stored there, the quantity and contents, and were able to provide bins for us to fill with water so we could mitigate the battery hazard. >> firefighters say from experience, the best way to put out these battery fires is with 3,000 gallons of water. in fremont, david louie, abc 7 news. >> now here at abc 7 news, we talk about building a better bay area. we're focused on the big issues that include housing and education. >> which is why the looming strike by oakland teachers is such a big deal. in oakland school district, teacher salaries range from $46,000 to 84,000. >> experienced teachers earn around $64,000. according to state data, that's the lowest of all alameda county school districts, a and the third lowest in the bay area. >> the median rent in oakland the more than $3,000, according to zillow, adding up to close to $38,000 a year. that's 81% of a starting teac r teacher's salary. for even the most well paid

teachers, it's 45%. >> lyanne melendez is live now with a look at the life of oakland teachers. lyanne? >> union members just finished about five minutes ago, just finished a two-hour meeting going over the logistics of a strike. in the meantime, the oakland unified school district said they are hiring emergency temporary teachers. they will consolidate classrooms and bring administrators to teach. with a teacher strike looming, both the oakland school district and the teachers union have refused to make the first move to discuss the contract. for example, the union wants to see a new proposal in writing before sitting down with the school district. >> what we're saying is we want to see the proposal that the district has. we want to see it. >> the district, on the other hand, says let's sit down first to discuss the offer and then begin to negotiate. >> they want to avoid the strike too. why not come and sit at the

table with us. it's the same question. we all want to avoid a strike. the last thing we want in oakland is to have a strike. >> oakland's mayor libby schaaf told reporters she recently spoke to governor newsom who reassured her more money will be allocated for education in his upcoming proposal which will give the district more funding. >> but the governor's budget definitely represented an increase and possibly more resources than people were aware of initially. >> the independent fact-finding report recommends a 3% raise for 2017-2018, a 3% raise for this year, and an economic reopen for 2019-2020. meaning the amount would be negotiated based on economic growth. while everyone acknowledges a strike would be disruptive, this principal says they will try to stick with the current curriculum. >> we plan to make sure that we use the instrtional time wisely by making sure that children are actually reading, writing and learning.

>> courtney riley has a senior in high school. >> i'm pretty sure he is not crossing the picket line, but he will have to do something related to his growth. and his education. >> now all parents should know that the city will have 15 rec centers open for parents to bring their children. they will be open from 8:00 in the morning to 3:00 in the afternoon. after 3:00, 3:00, they will have their normal after care program. i'm live in oakland, lyanne melendez, abc 7 news. >> lyanne, thanks very much. keep in mind teacher strikes are rare, but we've seen some national examples lately. today all three west virginia education unions have called for a work stoppage to begin tomorrow. denver teachers went on strike for three days last week after reaching what's been called a historic deal on thursday, which includes a higher starting salary and pay raises, including raises for cost of living. it was denver's first teacher's strike in a quarter century.

the north bay, sausalito has declared a disaster following a mudslide that destroyed one home and left at least five others red tagged. abc 7 news was at this morning's special security council meeting. sausalito can now receive help from the state after declaring a local state of emergency. one woman was i home when tons of earth pushed it down a hillside on thursday. susan gordon lost everything, including her beloved pet, peaches. >> my life is gone. i have to build from here.

every day is a new day. >> her care and getting her into a place and all those things are very relevant, and i think there is people working on that, and i'm thankful there are. >> the red tagged homes sit below property that is owned by caltrans and the national park service, and it's unclear if either of those agencies might be responsible for the damage caused by the mudslide. well, the storms may have cleared out, but they certainly did leave their mark. >> oh, big-time. take a logistic at this. it was a snow day for some people atop mt. hamilton in santa clara county. even the dog got in on the fun down there. they prove that you don't have to go far to see the snow. but some people did. >> that was abc 7 news reporter laura anthony. she joins us now. all right. you dor 14 hours to get to tahoe friday. >> wow. >> do you consider yourself crazy at this point? >> pretty much. crazy but not that crazy, because i think actually it was worthwhile. let's show you why. believe me, there was definitely some secondguessing going on inside my vehicle. but we -- are die-hard skiers.

we're tahoe regulars. and we knew at the end of this long slow journey, there would be a big payoff. >> this is highway 50 right above pollock pines. >> what started as an adventure turned into an odyssey, and then a bit of an ordeal. emboldened by the fact that highway 50 was open when interstate 80 was not, we left the east bay fully aware we were in for a long ride, and well prepared for what we expected would take maybe seven or eight hours. we had a full tank of gas, plenty of food and warm clothing, and the hope that the payoff would be worth the struggle. and though it took nearly twice the time we thought, what we found on the other side made it all worth it. sights like these in the high sierra have been hard to come by in recent years from the air, it seems hardly a peak is left uncovered. a thick blanket of snow that extends for miles in every direction. even the locals know that all of this is something to be celebrated. >> my wife and i were just at

heavenly, and we haven't seen this much snow in the trees, cold temperatures and great skiing and riding. it felt like i was in utah but in california. >> that's not to say there can't be too much of a good thing. there are, of course, the dangers of driving in it. but also the reality of digging out and making sure that roofs don't collapse under the weight of nature's bounty. but there is also the reward, the joy of floating through all that fresh powder, being the first to carve your own path, cut new tracks, knowing that with each turn, there is a new memory. i've still got it, a little bit there. >> you do. >> that poud wizard great. the kind we don't often see in california. light, fluffy and abundant. much of the video was shot at crystal bay, which is basically at lake level. and i can tell you the walk down to our condominium, the banks are over my head. i'm not that tall. >> but still. >> we're talking five feet.

features. it will be clear and chilly overnight. let me get out of the way of the moon. sunny tomorrow. chance of showers wednesday, and we have another chance of showers this weekend. moving along, we are out of the drought. certainly the bay area is in most of the remain maineder of california, although it is rated as dry, not in drought. these little brown areas in the extreme northeast and way down from palm springs southward to san diego, those areas are in what we call moderate drought, but not severe. so that's good news. on we go to overnight lows. it's going to be very chilly in our inland valleys. low temperatures will drop into the upper 20s at lakeport, santa rosa, cloverdale, ukiah, 30 in the ohs bay at livermore and down at morgan hill a low of 29. 33 in redwood city. even all around the bay shoreline. we're going to see lows in the 30s. it's going to be chilly just about everywhere. tomorrow we'll see bright sunshine, breezy conditions near the coast. high temperatures by mid afternoon will be in the mid- to upper 50s. in the early morning hours, still going to be quite chilly. but afternoon will be pleasantly

mild. here is a look at our storm impact scale. the approaching system on wednesday is a light storm. it ranks only 1 on the impact scale. rainfalls less than a quarter inch for most locations. and it will be a low impact event. here is a forecast animation starting at midnight tomorrow night going into wednesday morning. we'll see some clouds increasing, a little bit of rain beginning to move down from the north after the morning commute has ended. and then by midday, we'll see rain moving down southward along the coastline. maybe even snow up in parts of mendocino county. snow will fall over the sierra as well. the rain will sweep through quickly and move out of the bay area late wednesday night into thursday morning. that's the end it. here is the accuweather seven-day forecast. after that spotty mixed precipitation with the cold air coming in to produce maybe a few snowflakes in the higher elevations on wednesday. we get isolated early morning showers on thursday, but then it dries out. bright sunshine on friday. a slight, slight chance of some showers in the late evening hours on saturday, and about a

live where you live, this is abc 7 news. >> good evening once again. we'll begin this half hour with a story of burglary, car theft, a jaw-dropping video on the cloud, and a mother's profound disappointment. >> abc 7 news anchor dion lim brings us the story you'll see only on abc 7 news. >> i'm afraid to go into my own house. so that's a lot to take away from me. >> to understand this crazy story, let's rewind to february 10th when tiana le and her husband toai tran came home from their hawaiian vacation to find this. >> i go to my bedroom and i notice everything is ransacked through. >> their bmw was also gone. several days later, when toai picked up his phone to look at their vacation photos -- >> i find out that on thursday

there was this random video that's on my phone. >> the video toai believes was shot on his stolen ipad and somehow uploaded to the cloud and sent to his phone. you can see three young women -- we're blurring their faces -- smoking, drinking, waving bills in the air, having a good time. >> we saw my wallet in the video. oh, this has to be your car. >> afraid police wouldn't find the suspects, tiana took matters into her own hands. that's when things got even crazier. >> i put the video on facebook because i wanted some identification of who they are, because what the cops told us the night before, i felt like they weren't going to do anything. >> this video went viral, getting nearly 60,000 views, even by one of the teenager's very own mom. >> a friend of mine's message, sent it to me through facebook and said liz, i think this is your daughter. i mean, i'm not sure, but i think it is. and when i watched the video, i said oh, that's definitely her. >> her is elizabeth's 16-year-old daughter, standing right next to her.

they're one of three organizations participating in mb rising. it's two days of workshops and senators focusing on answers to challenges faced by young men of color. they kicked off the day with a day of service. >> if they don't graduate, roughly about 90% of them will have some exposure to the criminal justice system. we've got to break that school to prison pipeline. >> mbk rising is the inaugural event of my brother's keeper alliance. it was start by president obama in 2014 in response to the shooting death of trayvon martin. >> if i had a son, he would look like trayvon. >> on hand dave stewart, saying it's important for young black men to know they have opportunities for greatness. >> to make sure the advancement of youth and minorities in the bay area, we're making sure we

pave the way for them. >> the highlight of the two-day event will be a town hall meeting with president obama on tuesday. senior miguel who attended workshops in san francisco came from texas. he says finally there is something to give him a voice. >> the school tells me oh, your people were conquered and they were a slave. that's how i'm going to perceive myself. >> he is hoping mbk rising teaches him to rewrite his own history. anser hassan, abc 7 news. thousands of southwest airlines passengers are dealing with changes in their plans after flights were delayed by what the carrier calls maintenance issues. abc 7 news was at oakland international airport today. southwest and its mechanics are involved in a labor dispute, and the airline says it's taken more planes out of service than usual to keep up with an increase in regular maintenance. some passengers received text messages informing them that they need to take a different flight, including this woman we

found headed to phoenix. >> all we do is fly southwest so, we're a little surprised. >> we don't have any plans right now. as long as we got here safely for my son's wedding, okay. if they were coming here and it was for the wedding, i would have been highly upset. >> southwest canceled 2% of its 4,000 flights. southwest also finds itself being investigated by the faa for improperly adding up the weight of all the bags carried aboard some flights. an american airlines passenger had trouble flying home from san jose meantime. the airline didn't believe he had flown out, even though he had video evidence. robb hays from our sister station in los angeles has the >> steve homen is my cousin. he is 6'3" so he is easy to spot, unless he is on an american airlines plane that is where he is apparently invisible, leaving no trace behind. >> no trace whatsoever. i can tell you i had one cream, one sugar with my coffee, but that's all i know. they don't have a trace of me whatsoever. >> he knows this because american told him. he had booked a round trip

flight from l.a.x. to san jose for the past weekend. he flew up on friday. quickly learned his flight back had been canceled. >> they told me it's canceled because you never flew on your original flight. i said i sure did. i have it on camera and a everything. sure enough, there is the takeoff and landing. he used the american airlines app to buzz in during boarding. >> when i scanned it, i watched it turn green and he let me on the plane. >> but american said he wasn't on the flight. >> they even counted me on the airplane too and they still don't have a record of that. >> no record of a peng on a commercial jet liner? he says that poses safety and security questions. >> anyone could have been on that flight. what if i had a medical emergency? they clearly said they had no record of me on the flight whatsoever. so just a little concerning. >> we reached out the american airlines, which admit there's is no record of homen on that flight. a spokesperson says a mix-up like this is extremely rare, but that there was never any security since every passenger had to pass through tsa screening. the airline is refunding the extra $200 homen had to pay for

all right. now to new details in the jussie smollett investigation. the actor on the show "empire" is firing back as the story faces serious questions. >> a law enforcement official told abc news that two brothers told police that smollett was upset threatening letters sent to "empire" studio last month didn't get enough attention and he then staged the attack. >> detectives are investigating the allegation but have not confirmed this to actually be true. >> maggie rulli has more.

>> reporter: new questions about exactly what happened the night actor jussie smollett says he was attacked. now a law enforcement official says these two men told police they were paid by the actor to orchestrate and stage the racist homophobic assault. >> in illinois, filing a false police report is a felony, and he could face up to three years behind bars. >> just last week an emotional smollett went into great detail about the alleged attack. >> he said this is maga country, punches me right in the face. >> police arresting the two men seen here in these surveillance images from that night. but on friday, the men were released after police said they agreed to cooperate with investigators. police revealing all three of the men know each other, one even appearing as an extra on smollett's show "empire." >> police now seeming to make it clear that they believe the brothers and have very serious questions about jussie smollett. >> for weeks police have said smollett was being treated like a victim and was cooperating fully, but now tells abc news as

an abc 7 news producer researcher tried to track down the informational sites using my name. he was unable to find the companies listed as owners. the sites link to two different antenna providers. one is skylink. >> the concerns that you expressed to us are not just legitimate but completely shared by my client. >> john dewars is an attorney representing skyrink. he says an online affiliate marketer went rogue. those are the guys who get paid to drive traffic to websites. it's a murky world where the affiliate names are hidden by the networks that hire them. he said skylink had its company shut down the affiliate or remove it from skylink's account. that appears to happen. >> we hate deceptive marketing practices like the false presentation of your endorsement as much as you or more. >> i reached out to the other antenna compan livewave, but haven't yet had a conversation with decision makers there.
