>> when we strike we win. >> reporter: it was an announcement that everyone anticipated but many hoped not to hear. >> this is an indefinite strike. this is not a one-day strike. but we want a short strike. >> reporter: that decision came after both the union and oakland unified failed to reach an agreement this morning despite a proposed salary increase. the school district went from offering a 5% hike over three years to this, a bonus of 1.5% of the base annual salary the first year of the contract, a 3% increase for 2018-2019 followed by a 2% hike the following year and added a fourth year increase of 1% the first six months, then another 1% for a total compensation package of 8.5%. the teachers have been asking for a 12% increase over three years. >> our teachers need a living

wage. >> reporter: the union says it will resume talks on friday at 9:00 a.m. hoping to agree on other issues like smaller class sizes and hiring more nurses and counselors. the school district hinted both sides could meet before that. >> i will say that there's always a possibility something else could happen. >> reporter: in the meantime teachers like donna began cleaning out their classrooms and removing personal items. >> yeah, this is actually really hard to do. i already see the lack of life in my classroom. >> reporter: teachers and other union members will be on the picket line, the school district is reminding parents all schools will remain open with a limited staff and an adjusted schedule. >> we will have staff there. we have our administration there. we have central office staff there. we have emergency temporary teachers there. >> reporter: the city of oakland will also have 15 recreation centers like this one which will open as early as 8:00 a.m. for those parents who refuse to cross the picket line.

and those rec centers will be open from 8:00 in the morning until 3:00 in the afternoon. now on our website abc 7 news, we will have a list of options parents will have. i'm live in oakland, lyanne melendez, abc 7 news. >> is there any idea what percentage of kids are expected to show up in school tomorrow given the limited staffing available in the schools? >> reporter: larry, i wish i knew. i don't think the union knows or oakland unified district knows. i will tell you this, though, i have spoken to parents and they say, many of them, we will not cross that picket line. now on the other hand you have another reality which is, of course, working parents. i think a lot of them will be sending their kids to school because they have no other options. >> lyanne melendez reporting, thanks. >> we do want to stress oakland schools will stay open during the strike.

students can still go to school. the city of oakland will open 15 recreation centers from 8:00 to 3:00 monday through friday as an option for parents who don't want to send their children to school. the teachers union will provide volunteers at these centers. another option for parents, public libraries. they will be open during regular business hours. however, the city is asking that children 7 and younger be with a parent or caregiver. ac transit says it may reduce service to schools, detour routes and close some bus stops during the strike. you can keep up to date on the strike through the abc 7 news app. we will have the latest news, the status of the strike, and how it's impacting the community. >> investigators released the video cam video of a man firing a gun at a deputy while she spoke with him. >> roll down the window. roll down window.

shots fired. shots fired. >> oh, my gosh. >> that deputy returned fire and the suspect identified as javier hernandez died at the scene. this occurred late sunday night. the deputy was not hurt. well, a uc santa cruz student will be back in court after he was arrested for allegedly selling illegal drugs through an app he created. federal authorities took 18-year-old colin howard of sunnyvale into custody after an undercover sting operation. abc 7 news reporter matt keller has the story. >> reporter: college campuses are often the launching point for some of the most popular apps and websites in the world. the justice department says here at uc santa cruz an app was facilitating the sale of illegal drugs. there was a joint sting operation with uc santa cruz police and homeland security.

they were tipped off by posters put up around campus advertising banana plug. the university's mascot is the banana slug. plug is often used as a slang term for someone you can get drugs from. the justice department alleges howard developed the app disguised as a game, but the real purpose was facilitating the sale of illegal drugs including cocaine, molly and shrooms. an affidavit says customers were invited to make special requests. the justice department says an undercover sting with multiple drug buys ended with howard being arrested. he's charged with distribution and intent. >> i do know that people do think of just certain ways to, i guess, get around things and try to find loopholes into things. i'm not surprised that someone has done this. >> that's the first time i've heard of someone making an app to promote their drug business. i don't know.

that just sounds silly to me. >> reporter: howard was in court yesterday and released after his hearing. his next hearing is scheduled for monday. if he's convicted on all the charges, he could face more than 60 years in prison. in santa cruz, matt keller, abc 7 news. >> turning to our weather, a time lapse view atop mt. hamilton showing the last 24 hours. it was hard to see anything a few hours ago. the snow and ice covering the camera lens melted around midday. you can see lots of snow, though, still on the ground. look at the nice overnight lights. gorgeous. well, the snow is coming down in the sierra. it looks nice except for the roadways there. this is a look at the cameras cal trans has on 50 and 80. the roads are clear now but there are chain controls on both unless you have four wheel drive with four snow tires. it is the first snow since last week's storms dropped more than 7 feet. >> a ton of snow. right to spencer christian for a

first look at our forecast. spencer? what's left of our current storm is not very widespread but where it's raining, it's raining. a look at live doppler 7. a cell sweeping down through parts of the east bay. in the areas indicated by the yellow and orange we have scattered downpours and lafayette and tracy and out along interstate 580 and let me track this for you. this system, this cell is moving to the south/southeast by 4:21 moving through livermore around 4:27. about 6:04 p.m. over mt. hamilton where it is already snowing lightly in the higher elevations and there's more on the way. the storm ranks one on the storm impact scale. it's producing isolated showers, locally heavy downpours, small hail possible and snow over the highest peaks. right around 6:30 or so, you'll see that cell moving down over mt. hamilton and pushing further to the south. during the late night and

overnight hours spotty showers mainly offshore but some will move along the coastline and produce wet spots in coastal areas. a closer look at this storm and the seven-day forecast in a few minutes. larry? >> thank you, spencer. highway 37 back open now in both directions. sky 7 was over novato after caltrans reopened the westbound lanes. they were closed last friday after the storm led a levee to burst. they were pumping out the water to get the road reopened. a drive-by coffee shop is surprising customers with something not on its drink me menus. >> the baristas are dressed, let's say, for a day at the beach. customers seem pleasantly surprised. neighbors, some not ha>> d loui campbell. >> reporter: it's the newest place to grab a cup of coffee. come for the coffee and you get something unexpected. the baristas wear bikini tops

like that. if the girls are comfortable with it, it's a free market. >> reporter: are you comfortable with it? >> i am very comfortable with it, yes. >> reporter: as a few people have pointed out if customers are not pleased with what they are wearing at the kiosk there are several other coffee shops within a few hundred feet of the location. in campbell, david louie, abc 7 news. >> the baristas say there are heaters inside the kiosk so they ar warm. >> it is winter. bicycle advocates are calling on san francisco to increase the number of bike racks across the city. the bicycle coalition and district 8 supervisor mendelman wants new sidewalk and street bike racks installed this year. they claim the cost of the project wouldn't be as expensive as officials might think. >> the city already has thousands of these racks sitting in a warehouse. we're not asking the city to buy anything new. we're asking them to install what they already have on hand. >> the coalition is requesting

this is day two of the obama foundation's mbk rising event in oakland meant to inspire young men of color. mbk stands for my brother's keeper. right now leaders and community organizing efforts are talking about their work. >> black lives matter, their co-founder, and next up black panther director and oakland native and actor michael b. jordan will talk about the impact of that groundbreaking film. >> the events have been going on all day today. eric thomas joins us live with a look behind the scenes. eric? >> reporter: and, larry, ama, there was a morning session as well. the star of that right up your alley, larry, victor cruz, the former wide receiver for the new york giants, who is retired now. and talking about what he's doing to give back to his community. the bottom line a lot of speakers and topics including mentor/mentee and the criminal

this is the view looking westward at mainly clear skies. right now 55 degrees in santa rosa. 57 in petaluma. fairfield, concord and livermore and there's this view from our rooftop camera. once again you can see the clouds off to the east and southeast there. these are our forecast features that will be clear and chilly overnight. sunny and dry the next few days, through the weekend, with showers likely to return early next week. let's take a look at the sierra where we have a winter weather advisory in effect through 10:00 tonight. we expect another 3 to 7 inches of snow above 4,000 feet and there will be reduced visibility. now back to our storm here in the bay area ranks one on the storm impact scale. for the remainder of today and into the evening hours, small hail is possible and, of course, snow over the highest peaks. notice we'll still see the cell moving through parts of the east bay and into the south bay. during the overnight it will

and here are the stories making headlines at 4:30. oakland teachers are going on strike tomorrow. the union said it hopes the strike will be a short one, but they did not give more details. the district is telling parents to still send their kids to school tomorrow though staffing will be limited. negotiations between the union and district will resume friday. oakland school principles were at the state capitol today. this photo tweeted in a meeting. the principals are lobbying for more funding for public education. video shows the attempted murder of a sheriff's deputy.

the deputy shot and killed a man. new details coming up at 5:00. ice, snow, and freezing temperatures creating very tough conditions in many parts of the country. more on the storm. zachary? >> reporter: we woke up in the d.c. area to heavy snowfall. it's turned to rain and has created lots of issues. flights were canceled across-the-board and kids were home from school this storm stretched out across the country, over 32 states impacted. two storms are about to collide and in many ways are already crippling a large stretch of the country creating a winter emergency. from kansas to new york and up to maine, lightning hit this pickup truck. the driver got out safe. the vehicle just a ball of fire. in some areas cars spun out as

plows have been unable to keep up with the heavy snowfall. more than 2,000 flights canceled as this winter storm dumped ow and airport snow operations at reagan national and dulles airports are in overdrive. de-icing planes, removing snow, and clearing runways. things were so bad in minneapolis that the faa had to call for a temporary ground stop for all planes. the roads weren't much better. the snow too much for this fedex truck in minnesota. in kansas cars spun out creating dangerous roads. richard steele says he's had enough. >> honestly i want summer to be here. ready for that 115-degree weather. >> reporter: in the south the issue is rain where forecasters say thunderstorms could create serious flooding. across tennessee and atlanta, forecasters are saying the rainfall could climb to 2 inches per hour. in nashville, firefighters had to come to the rescue.

>> we pulled three people out of the water. >> reporter: it was the collision of these two storm systems, obviously the rain in the south and snow in parts of the midwest and the north that really created tough conditions out there. >> reporter: and, zachary, we understand that things weren't as bad as originally expected. is that true? >> reporter: yeah, it is. the national weather service predicted 2-6 inches of snow from the dmv area up to new york city. as you can see just a little bit of snow around here but this thing certainly isn't done yet. the northern states are getting hit. >> thank you. here is another look at the weather in washington, d.c. almost covering up the nest -- >> look. >> of two bald eagles. that eagle is named liberty. the poor thing, up to her neck in snow.

all right. we have some breaking news to tell you about now taking place in san jose. above mt. hamilton road where a car has been found down a hillside about 100 feet from the roadway. you see it there. oh, it's upside-down. sky map 7 was showing us exactly where it happened. how far the car was from mt. hamilton road. firefighters are trying to see if anyone is still inside the car or needs help in the nearby woods. we're staying on top of this. southwest airlines says it took a big hit from the partial government shutdown. the airline says it cost $60 million, far more than the original estimate of $10 million to $15 million. the report is the late nest a series of troubles for southwest. the faa is also investigating whether the airline

miscalculated the weight of checked bags on its flights. now to developments in a decades old case. authorities have arrested a man on suspicion of killing a southern california girl more than 45 years ago. like several other high-profile cases we've seen recently dna was used to make the arrest. alex stone has the details. >> reporter: it's an arrest 45 years in the making, 11-year-old linda o'keefe disappeared in newport beach in 1973. she was walking home from school. her strangled body found in a ditch. so many decades later a dna match on a genealogy website has led police to 72-year-old james neal in colorado. >> he's being charged with murder and two special circumstances. he's also being charged with murder, kidnapping. >> reporter: it's a case that has haunted police for years. last july newport beach police

told lyinda o'keefe's story explaining how she died. >> when school got out -- >> reporter: using dna from the crime scene police utilized age progression to create this composite of a suspect. on the left, what he might have looked like in 1973 and one 45 years later. here is what james neal looks like today. >> 45 years ago is when the watergate hearings began and yet for 45 years the newport beach police department never gave up. >> reporter: generations of detectives worked on the case. in 1973 they say neal lived in the county and used a different name. if convicted he could get life in prison or the death penalty under 1973 law. >> cases like this you never forget. >> reporter: alex stone, abc news. >> 45 years is unbelievable. dna evidence has helped police identify and capture suspects in

several other decades old cold cases. a suspect was arrested in the golden state killer and east bay rapist killers. the suspect in the 1974 murder of a woman at stanford university, that man shot himself to death. in august the man believed to be the norcal rapist, ten attacks across six counties. a warning today to anyone who visited an exhibit at the grand canyon national park over the last two decades. officials say visitors to the park's museum between the year 2000 and june 18 of last year were possibly exposed to unsafe levels of uranium. it was found in three buckets stored next to a taxidermy exhibit. experts believe the amount of exposure was unlikely to be hazardous to visitors.

smollett. in a tweet today police officials said "the empire" actor is considered a suspect for filing a false police report. >> the actor's team is now in talks with well-known criminal defense attorney mark geragos about representing him. abc news reporter elizabeth herr with the latest. >> reporter: they now suspect jussie smollett of filing a false police report when he claimed he was attacked last month by two men who beat him and tied a noose around his neck while shouting racist and homophobic slurs. officials telling abc news they have spoken to his attorneys but are still wait to go reinterview the actor. police had been looking into allegations smollett may have orchestrated and paid for the attack with the help of these two brothers who have not been charged. smollett denied the allegations. this as we learn federal authorities are also investigating smollett to see if the actor played any role in

sending this threatening letter, mailed to the chicago studios of "empire" a week before the alleged attack. smollett talked about the letter in this exclusive interview with abc news. >> the letter had a stick figure hanging from a tree with the words that said smollett, you will die. in big red caps, maga. did i make that up, too? >> reporter: we are also learning he was once accused of giving false statements to the lapd. according to court documents from 2007, the actor was charged with false impersonation, driving under the influence, and driving without a valid license. while allegedly giving his brother's name when he was pulled over. he pled no contest to reduced charges and completed an alcohol treatment program. >ack to the weather now. sky seven flew over the sea

today we'll make chicken pot pie. some pasta. we have a two-cheese. we have diced carrots, broccoli and peas and a little bit of fresh thyme. this is the secret ingredient. we add the cheese in to start melting. after we mixed it up, we'll start adding our ingredients. fresh thyme, grilled chicken, broccoli. this has been lightly branched, some carrots. last but not least, peas. what is chicken pot pie without peas? i love the different textures in the dish. now it's ready to go in the oven.
