people know, first of all, that the deputy is okay. >> reporter: we just heard from the napa county sheriff's department explaining that graphic video which if you want to see, we will show you it. it happened in 48 seconds. it's not a video game. all captured by the body camera. she stopped to check on the driver of a car in rural napa late sunday night. the video picks up with her questioning the suspect. >> can i look around to make sure? all right. wait right there. don't move, okay? >> okay. >> roll it down. roll down the window.

roll down the window. >> shots fired, shots fired. >> reporter: distressing. there were 15 different shots fired into the car after the suspect javier hernandez morales turned and fired at the officer with what we're told was a .22 caliber pistol and without warning obviously. you will hear from undersheriff crawford who says it's a clear cut case of attempted murder by the suspect and self-defense by the deputy. >> loss of life is not taken lightly either by this agency or any other. in this case, whoever, hernandez morales made the choice to

attempt to murder deputy direcki and she responded accordingly. we are proud of her incredible poise and composure. in her fight to save her life. >> reporter: as for the suspect javier hernandez morales, the sheriff's department says he did have a criminal history that included weapons violations, a dui, another assault on a police officer. we're still waiting for more details. the department says the deputy is off duty on administrative leave. her grandfather works for the department and retired. her father still works for the department. we asked how did the suspect miss. the undersheriff said divine intervention. live in napa, wayne freedman. >> indeed, wayne. thank you. developing news from oakland where teachers will go on strike in just 13 hours from now.

the teachers union met to continue negotiations and did increase its salary over with a total compensation package of 8.5%. teachers have been asking for a 12% increase. negotiations are expected to resume friday. in the meantime teachers have been cleaning out their classrooms removing personal items. >> this is actually really hard to do. i already see like the lack of life in my classroom. >> the school district is reminding parns all schools will be open with a limited staff. they have 15 recreation centers open for parents who refuse to cross the picket line. >> and the looming strike prompted school principals, nearly half of them, to make an early morning trek to sacramento. >> they want to persuade lawmakers to spend more money on education. >> reporter: in an unprecedented move three dozen oakland school principals took a rare day away

from their campuses. a plea for more state funding for public school districts on the eve of a teachers' strike back home. >> we want to show the teachers and our community how much we support them. now is the time to really let the legislatures know what's going on. >> reporter: an increase in california's per pupil spending, forgiveness of $36 million in debt from a state loan, and the revision of the state's charter law. the principals found a receptive ear in state superintendent of schools tony thurman who spent the day in oakland on tuesday. >> i understand that they don't want to go on strike but they feel they need to or may need to to send the message that we need to do more to fund public education and to support our students. >> reporter: the principals also met with lawmakers including rob bonta. >> that said a lot to me, their act of being here, so many of

them taking the day off from their responsibilities and they came because they care. >> reporter: the oakland principals appreciated the sympathetic reception they received from the capitol but know it's going to take much more than that to solve their district's current crisis. >> with the pressure building on our district and on our teachers to negotiate the time is right now for principals to step up. >> reporte oakland schools will stay open and students can still go to class. if parents don't want to send their kids to school there will be 15 recreation centers. the teachers union will provide volunteers. another option, public libraries. the city is asking that children 7 and younger be with a parent or a caregiver. and keep this in mind. ac transit may reduce service

and close some bus stops during the strike. >> keep up to date through the abc 7 news app. the woman police say shot at undercover sheriff's deputies after carjacking a u.p.s. truck last week made her first courtroom appearance in san jose. vic lee is live with the story. vic? >> reporter: the court appearance was brief. she was arraigned on eight felony counts. the others include carjacking, kidnapping, and hostage taking. 23-year-old joanna rogers appeared in court shielded from cameras by her public defender. the or deal started when undercover deputies approached

their suv park at a light rail station. they entered highway 87. police say macy rogers began firing a shotgun at the deputy's car. the deputy district attorney. >> during the course of the pursuit miss macy rodgers leaned out of the passenger side and fired at sheriff's deputies striking the car at least four times. >> reporter: the two finally abandoned their car. police say they took a u.p.s. truck at gunpoint. dozens of police cars surrounded it. macy rodgers also left the truck surrendering to police. police armored cars stopped it. armed with a shotgun jumped out of the truck. police say an officer shot and killed him as he ran to the public who had gathered at the

scene. the prosecutor says macy rodgers was not a reluctant participant. >> the evidence clearly shows she was a very willing participant. >> reporter: her family left the courthouse declining to speak to reporters. macy rodgers is being held without bail. her next court appearance is in march where she is expected to enter a plea. >> vic, thank you. let's move on to the weather forecast, some rain heading this way. >> we had some sprinkles. it's getting active. not everywhere. we had a thunderstorm develop. there is snow falling. we'll chicago it for you going towards mt. hamilton. 5:27, mt. hamilton. 6:02 into morgan hill. pockets of moderate to heavier

showers around the area. in fair field, cordelia. isolated thunder and hail is possible with the spotty showers. i'll be back with the hour by hour time line coming up. a uc santa cruz student created an app that looked like a game but the feds say it was a front to sell drugs. >> the name of the app was a play on the school's mascot. >> reporter: a young college student with a seemingly bright future turning heads in an unimaginable way. >> i do know people think of certain ways to, i guess, get around things and try to find loopholes into things so, i mean, i'm not surprise that had someone has done this. it is extreme. >> reporter: colin howard is charged with three counts related to the distribution and possession with intent to distribute meth and one count related to cocaine after a joint

sting operation involving uc santa cruz police and homeland security resulted in his arrest last fall. police tipped off after seeing posters advertising the app on campus. the 18-year-old taken into custody on federal charges. prosecutors say howard created an app called banana plug to facilitate the sale and used snapchat to communicate with customers. the word plug often used as a slang term for someone dealing drugs. >> we would have rather seen him do research on cancer or gaming or something else positive in the world. he is no longer a student on our campus. >> reporter: the app went through apple's app store review process. on the surface users tapped tiles that alternated between images of bananas and electrical plug to clear the screen of all bananas. apple hasn't commented.

apps that encourage consumption of tobacco products, illegal drugs or excessive amounts of alcohol are not permitted on the app store. >> a lot of things can go wrong. that's why the monitoring and reporting is very important. >> reporter: howard has pled not guilty and will return to court. breaking news out of chicago, our sister station there is reporting that actor jussie smollett has been charged with felony disorderly conduct for filing a false police report. >> it comes weeks after the star of the show "empire" claimed he was attacked by two men who beat him and tied a noose around his neck. >> police began looking into allegations that smollett orchestrated the attack and paid two brothers to help him. president obama's my

granted credit card holders protection from financial institutions. >> a survey found almost half of americans have not ever heard of the act. so 7 on your side's michael finney is here to talk more about that. >> and half of them don't remember when we didn't have it. financial institutions had pretty much a free run on many pocketbook issues close to consumers' hearts and wallets. the card act set rules that interest rates can't be changed in the first year of opening an account. there must be 45-day advanced notice and full disclosure of fees and charges of credit cards. consumer advocates fought hard for this law and here at the ten-year anniversary it's important to point out this didn't just happen by accident.

rain we're expecting. >> not done with it yet. >> it is just getting interesting thmt is a cold system. we have been tracking showers, a thunderstorm developed. we are seeing those snow showers mixing in with some rain showers. they are heading towards morgan hill, not the snow but the rain as we take a look at street level radar. you will notice some moderate pockets of rain falling. if you get a brief downpour, we are tracking some moderate to heavy showers in milpitas so at 5:39 it will be over milpitas, east san jose as those showers continue to progress southward. radar showing you some very light returns right now. we will continue to see that moisture limited but that cold system continuing to push southward.

the soda taxes passing in communities around the bay area could soon be california state law. state democrats are introducing a package of measures they claim will cut consumption. lawmakers cite studies that show the average american consumes about 50 gallons per year. which equates to 39 pounds of excess processed sugar annually. they include labels with warnings of diabetes.
