district's office a few blocks away. picketing resumes in the afternoon going until 4:00 p.m. >> now, basketball playoff games are going on as scheduled tonight. however, playoffs for winter sports will continue as normal but spring sports like baseball, swimming, track & field, all games will be postponed until after the strike. >> that's right. let's begin our team coverage with abc 7 news reporter lyanne melendez. she's live in oakland tonight. lyanne? >> reporter: there is a bit of good news, and that is that both sides have decided to meet on friday at 9:00 in the morning. this could mean that they may be close to some kind of an agreement because the union said today, promised parents that this strike would be short. >> when we strike -- >> we win! >> when we strike -- >> we win! >> when we strike -- >> reporter: at 1:30 this afternoon it was clear oakland teachers were ready to walk out. >> oakland educators united with

patien parents, students, and communities will stand at the picket line at 86 school sites. >> reporter: that decision came after both the union and oakland unified failed to reach an agreement this morning despite a proposed salary increase. the school district went from offering a 5% hike over three years to this. a bonus of 1.5% of their base annual salary the first year of the contract, a 3% increase for 2018-2 2018 2018-2019 followed by a 2% hike the following year and add ed another 1% for a total compensation package of 8.5%. but the teachers have been asking for a 12% increase over three years. >> the high cost of rent in oakland, the high cost of living has driven our teachers out of oakland. >> reporter: the district loses close to 19% of teachers every year.

the union says it will resume talks on friday at 9:00 a.m., hoping to agree on other issues like smaller class sizes and hring more nurses and counselors. school district spokesperson john sasaki hinted both sides could meet before that. >> i will say there's always a possibility something else could happen. >> reporter: in the meantime teachers like donna salonga began cleaning out their classrooms and removing their personal items. >> yeah, it's really been hard. i was in my car this morning kind of anticipating getting teary about it. and i've already said good-bye for now to my fifth and sixth period. here i am during seventh packing up. >> reporter: while teachers and other union members will be on the picket line, the school district is reminding parents all schools will remain open with a limited staff and an adjusted schedule. >> what do we do? >> fight back. >> there will be staff ready to go and we want our kids in school. >> and many working parents say they may have to do that, even though they don't want to cross

back home. >> my hope is people really do take this seriously, understand that we're drastically overfunding our prisons compared to our schools, that compared to other high-cost states we're drastically underfunding our schools and our students. >> reporter: the principals made three requests. an increase in california's per-pupil spending, forgiveness of $36 million in debt from a state loan, and the revision of the state's charter law. >> we feel that if we could increase the per-pupil spending to also have some loan forgiveness as well as increased resources that it's the systemic level that starts at the top. >> i want us to have $5 billion more for k-12 education. >> reporter: the principal's found a receptive ear in state superintendent of schools' tony thurmond who spent the day neck o'land on tuesday. >> they're asking for things that are more than just compensation. they're asking for small class sizes, nurses and psychologists, in our schools. >> reporter: the principals also met with lawmakers including

ominous-looking clouds this afternoon. look at that. let's bring in abc 7 news anchor spencer christian for more. spencer. >> the rain, hail and snow from this storm have not been very widespread but there have been some impressive downpours. here's a look at live doppler 7. you can see we have one right now. this area of green and pink and white moving down over mount hamilton. the yellow areas indicate rainfall. and some of it's locally heavy but moving into the higher terrain away from the most populated areas. but look at the snow that's been falling all afternoon and into the evening atop mount hamilton. it's an interesting pattern we're in right now. it's unsettled. the storm ranks 1 once again for the evening and into the late-night hours we can expect some spotty showers, isolated thunder and small hail. a closer look a little bit later. dan? >> spencer, thanks very much. new developments tonight in the form of new video showing exactly what happened when a napa county sheriff's deputy opened fire on a man after he pulled a gun and tried to shoot her. a warning, this video may be disturbing and we want you to be prepared for it but it really shows you exactly what happened.

let's go live now to abc 7 news reporter wayne friedman in napa tonight. wayne? >> reporter: good evening, dan. it is disturbing video. it's the kind of thing you might expect to see in a video game except it's real and i suspect you'll be seeing this in training videos in the future. it happened last sunday night. an officer-involved shooting that we reported. we're going to show you the last 48 seconds. it's the body camera of deputy riley jar ecki. she saw a car parked on henry lane. it wasn't in the right place. it was facing the wrong direction. she got out and asked a few questions. let's take it from there. >> can i look around to make sure? >> mm-hmm. >> wait there. don't move. okay? >> okay. [ speaking foreign language ] . . >> roll it down.

[ gunshots ] >> that was 15 shots being fired by the deputy as she emptied her magazine into the car after the sprkts javier hernandez morales, turned and fired on her with a witt 22-caliber pistol, clearly without warning. next you'll hear from the undersheriff john crawford. he discusses a clear-cut case of attempted murder by the suspect and self-defense by deputy riley jarecki. >> loss of life is something we always take very seriously. it's not tyke eligh taken light either by this agency or any law

enforcement agency. in this case hernandez morales made the choice to attempt to murder deputy jarecki and she responded accordingly. we are proud of deputy jarecki's incredible poise and composure through this event. and her fight to save her life. >> what do we know about the suspect, javier hernandez morales? he did have a criminal history, he had weapons violations, he had a dui, he had an assault on a police officer. he was a farm worker. he lived in napa. the sheriff's department is still look into his residency status. they referred that case to i.c.e. as for deputy riley jarecki, she is off duty right now on administrative leave. that's standard. turns out she has deep roots in the napa county sheriff's department. her grandfather retired from the department. her father still works for the department. we asked the undersheriff how did the suspect manage to miss and in the undersheriff's words, "divine intervention."

live in napa, wayne friedman, abc 7 news. >> the officer was remarkably poised. wayne, thank you very much. we're getting our first look tonight at the man who's accused of hitting a little girl with his car and then driving away from the scene. this was in santa rosa. you're looking at 29-year-old dominick weaver. santa rosa police say weaver was hiding inside a bedroom when they served a search warrant at his home yesterday. detectives received many tips after the girl was hit on saturday. you see it circled there in red. she was sent flying into the air. they say a surveillance camera captured video of weaver driving his car after the crash. this young woman, the 7-year-old victim, had only minor injuries, thank goodness, and is recovering. the woman police say shot at undercover sheriff's deputies after carjacking a ups truck last week, made her first court appearance today in san jose. abc 7 news reporter vic lee has the story. >> reporter: 23-year-old joanna macy rogers appeared in court, shielded from cameras by her public defender. she and her companion, mark

moraski, allegedly seized a ups delivery truck last thursday night in san jose. the violent ordeal started when undercover deputies approached their suv parked at a light rail station. police say they drove away with the deputies in pursuit. as they entered highway 87 police say macy rogers began firing a shotgun at the deputies' car. deputy district attorney. >> miss macy rogers leaned out the passenger side of the car and fired at sheriff deputies striking the car that the undercover sheriff's deputies were fired at least four times. >> reporter: the two finally abandoned their car. police say they then took a ups truck at gunpoint. the truck made it to north first street and trimble road where dozens of police cars surrounded it. the ups driver was later released. macy rogers also left the truck, surrendering to police. moraski began moving the vehicle

but police armored cars stopped it. morassky armed with a shotgun jumped out of the truck. police say an officer shot and killed him as he ran toward the public who had gathered at the scene. the prosecutor says macy rogers was not a reluctant participant. macy rogers' family left the courthouse, declining to speak to reporters. joanna macy rogers was arraigned today on eight felony counts. four of them for the attempted murders of police officers. the other counts include carjacking, kidnapping, and hostage taking. she's being held without bail. vic lee, abc 7 news. a college student has a lot more than grades and tuition to worry about. he's facing federal charges because of an app that he created. >> tonight see how what the feds call a drug-dealing app managed to get onto the apple app store as a game. abc 7 news is about building a bay area. so when you told us there was a problem at the san leandro bart station we head there'd tod

california home sales hit the lowest level in more than a decade. that's according to a new report from the california association of realtors. january's total sales were at the lowest level since april of 2008. the number of sales has dropped for nine months in a row. now, in the bay area sales are mixed compared to last year. six counties saw their numbers drop and three counties saw the number of sales go up. california democrats are putting forth an aggressive plan to reduce homelessness across the state. a proposed bill would pool all state resources currently being

used to support state-run homeless programs into a centralized budget under the state housing authority. the consolidated funds would hold as much as $450 million for homeless support services. legislators say centralizing the money will simplify the aid process for local governments, replacing a grant application spread out across agencies. >> for many cities, especially the cities that do not have a full-time maybe housing grant rider or a full-time planner that can do this, they miss those opportunities. >> current estimates show california's homeless population to be about 130,000 people. meantime, happening tonight, warming centers will be open in santa clara county because the temperatures are going to be so cold. there are three temporary shelters in san jose open for people who need a place to spend the night. take a look at this time lapse view from a camera at the lick observatory atop mount hamilton showing the last 24 hours. the snow and ice covering the camera lens melted around midday.

you can see a lot of snow, though, still on the ground. snow levels are dipping across california. and that could mean snow will fall on interstate 5 along the grapevine, and that could delay drivers heading between the bay area and los angeles. leo stallworth from our sister station in l.a. has more. >> reporter: the california highway patrol bracing for deja vu on the grapevine. storm clouds forming, expected to unleash a repeat of last weekend's heavy snow and ice smothering the highway. the california highway patrol shutting the major highway down. some drivers getting stuck on the road during the closure, bundling up in their cars until the highway reopened. >> we did hear that the snow level is going to be down to about 1800 feet or 1500 feet or so. so if it does get that low and it does get that cold, we may have a repeat. we are ready for it, us and caltrans are ready for it in case it does happen again. >> reporter: the chp warning if you plan to travel the grapevine be prepared for the worst. >> make sure your tank is full in your car. make sure you have good

windshield wipers. make sure your headlines are working. make sure the operation of the vehicle is working sound, and then first and foremost slow down if you're going to go through that inclement weather. >> reporter: a dusting of snow on mountains above the high desert. tonight and tomorrow a fresh blanket of white powder expecting to drop below the mountains covering parts of palmdale and lancaster. the series of big storms getting people's attention. >> it hasn't rained like this in the 58 years that i've been here. >> and now here comes the snow. >> yeah, now here comes the snow. >> reporter: a lot of the slushy powder could become black ice in the frigid weather. people we talked to had the right idea about how to drive in such dangerous conditions. >> slowly and carefully. yeah. >> or don't come out the house. make a fire. don't come out the house. >> how do you manage your vehicle in that or do you just stay at snoem. >> just stay at home. >> reporter: leo stallworth, abc 7 news. >> wow. prey amadefinitely. we didn't have anything too crazy today. >> no, we did not. but weather's always changing and spencer christian is tracking it for us.

>> we just had a little cra crazine craziness. a little crazy is a good thing. here's a look at live doppler 7. unsettled weather at the moment. we've had passing pockets of showers throughout the day. there have been some locally heavy downpours but they've been widely scattered. also there's been a little bit of hail and you right now we see there's snow still falling down in parts of mount hamilton. here's the view from emeryville at the afterglow of sunset. 51 degrees in san francisco and in mountainview. 52 at oakland, 50 san jose, 49 morgan hill and 50 in half moon bay. the view from sutro tower an unobstructed view, no clouds inside looking out over stris. santa rosa napa 41. 47 petaluma. 52 concord, 45 lear skies. these are our forecast features. unsettled weather theeng and into the late-night hours. clearing and colder tomorrow morning and dry pattern will stay with us through the weekend. let's take a look through the sierra where we have a winter weather advisory in effect until 10:00 tonight.

we're expecting additional accumulation of three to it seven inches of snow about 4,000 feet and of course reduced visibility. back to you are o'storm here in the bay area, it's a light storm ranking 1 on the storm impact scale. for this evening expect isolated spotty showers, maybe some thunder and hail mixed in and snow if the highest peaks. looks like most of the activity will be offshore. here's the forecast. we'll see this little cell continuing to move down into the higher elevation south of mount hamilton. look at the activity offshore during the overnight hours. some of this may brush the coastline and produce some wet spots but it's not likely to be a wet commute tomorrow morning. overnight lows will drop into the upper 20s and low 30s in the north bay valleys, inland valleys of the east and the south bays will drop into the mid 30s and upper 30s around the bay shoreline. highs tomorrow, general flit mid 50s. it will be breezy, especially at the coast and across the bay and into the inland areas as well. but fairly narrow range of temperatures tomorrow about 54 to 58 degrees in most locations. and here is the accuweather seven-day forecast.

>> announcer: live where you live. this is abc 7 news. it looks like a game, but the feds say this was a front to sell drugs. a uc santa cruz student created that app. >> and now the 18-year-old faces decades in prison and millions of dollars in fines. abc 7 news reporter chris nguyen is on the story. >> reporter: a young college student once with a seemingly bright future now turning heads in an unimaginable way.

>> i do know that people do think of just certain ways to i guess get around things and try to find loopholes into things. so i mean, i'm not surprised that someone's done this, but it is definitely extreme. >> reporter: colin howard of sunnyvale is now charged with three counts related to the distribution and possession with intent to distribute meth and one count related to cocaine after a joint sting operation involving uc santa cruz police and homeland security resulted in his initial arrest last fall. police tipped off after seeing posters advertising the app on campus. the 18-year-old taken back into custody last week on federal charges. prosecutors say howard created an app called banana plug to facilitate the sale of illegal drugs, then used snapchat to communicate with customers. the app, a play on the university's mascot the banana slug, the word plug often used as a slang term for someone dealing drugs. >> we would have rather seen

him, you know, do research on cancer or gaming or something else that would have been positive in the world. he is no longer a student on our campus. >> reporter: the app, which appeared to be a game, went through apple's app store review process last november. on the surface users tapped tiles that alternated between images of bananas and electrical plugs with the goal being to clear the screen of all bananas. apple hasn't commented, but the company's guidelines make it clear, apps that encourage consumption of tobacco products, illegal drugs or excessive amounts of alcohol are not permitted on the app store. >> what's it's in the app store a lot of things can go wrong. that's why this monitoring, the community monitoring and the reporting was very important to take it down. >> reporter: howard has pled not guilty and will return to court this friday. in san jose, chris nguyen, abc 7 news. in the east bay it was day two of the my brother's keeper rise event in oakland hosted by the obama foundation.

♪ a choir led off the program with uplifting music, then began a discussion addressing the criminal justice system. a panel led by the richmond police department talked about successful violence reduction programs. lecturer and author shaka singer, who is a convicted murderer, spoke about his experience in prison and his goal to make sure other young men don't follow in those footsteps. >> don't accept somebody else's narrative because even though they told me i'd be back in prison in six months, 8 1/2 years later i'm standing here serving my people. >> president obama created my brother's keeper as a way to get leaders involved in helping to close the opportunity gaps for young men of color. abc 7 news is committed to building a better bay area, and transit is one area that we are focused on improving big-time. it's why we spent all last week talking about bart, which hundreds of thousands of people ride every day, maybe you. we received a lot of e-mails and questions and some suggestions. one came from ronald.

he said, "come to san leandro station. we have a door that never locks and people just walk out the door without paying. i complain to the agents. she said they know and nothing gets done." so today we went to the san leandro bart station to check it out. it's an everyday sight on bart. people walking through the emergency exit to avoid paying the fare. abc 7 news monitored the san leandro station for an hour today. we saw people jump the gate while others squeezed next to a paying customer to get through the barriers. >> the fare evasion is frustrating for our customers. it's frustrating for us. >> reporter: bart estimates it loses out on 15 to 25 million dollars a year from fare evasion. there are legitimate uses for the swing gate. but this man pushed a rolling cart through, then went back to pay his fare. but the most brazen fare evaders simply walk through the emergency exit right in front of the staths. so why don't the agents stop them? >> station agents are primarily for customer service. they are trained in responding

to medical emergencies but they are not law enforcement personn personnel. >> station agents can call police but the agency is trying a new approach. in 2017 bart began adding metal wires to keep people from jumping the barriers. swing gates were also modified. >> they actually have a lock op them. and if you open that, your picture will be taken and an alarm goes off. >> reporter: 14 stations will have these additional barriers by july. so what about san leandro? >> san leandro is on the list for next fiscal year, which begins in july. >> reporter: in the meantime more fare inspection agents are patrolling the trains. they will ticket passengers who can't provide proof of payment >> now, we want to hear your thoughts about bart or about anything we can do to keep building a better bay area. just head to abc7news.com and search the words better bay area. you can write us with your comments, concerns, comments, and questions.

on facebook we'd love you to join our better bay area group as we work on finding solutions together. in the south bay a drive-thru coffee shop is surprising customers with something not on its drink menu. the baristas are dressed let's just say for a day at the beach. customers seem pleasantly surprised. however, some neighbors are upset. abc 7 news reporter david lui reports from campbell. >> reporter: the newest place to pick up a cup of coffee in campbell is creating quite a stir. a neighbor, elena gazer, walked right up to us to complain. >> this type of business should not be here in a suburban neighborhood. >> reporter: the fuss is not about the coffee but what the briftas are wearing. bikini tops and daisy dukes. >> with the movement "me too" and try to get this type of business in the area i feel absolutely devastated. >> reporter: you can't see much from the outside of the tyny kiosk which caught sue johnston off guard on her first visit. >> it's okay with me. i didn't know that's what they were wearing. i've not seen one of these places before. >> reporter: were you surprised? >> yes. i was.

ambulance company. shay halligan enjoys the bouquet of flowers she received on her 61st birthday. it's a birthday the concord woman thought she would not live to see after a heart attack that was followed by three more. >> and the cardiologist didn't think i was going to make it. >> reporter: her husband joe appreciates every moment he has with his wife. he recalls the first heart attack happened here in september at the counter restaurant in walnut creek. joe looked over, then screamed for help. another patron he now calls john the life saver, jumped into action, performing cpr. >> john jumped up and came over and saved her life. >> reporter: an ambulance would later rush her to john muir hospital in walnut creek. doctors transferred shay to john muir in concord where they have a cardiovascular institute. today shay is on the mend and back at home. >> well, i love her. i mean, it's a miracle.
