this has to be a mass mailing because i don't have a frozen embryo. >> reporter: the news devastating former marisa bristol, turning her fertility journey upside down in 2017. >> we had never dreamed of just having one child. we always wanted more. i mean, i could have had ten easily. >> reporter: in 2003 marisa and her husband at the time, john, were hoping to give a sibling to their young son brett. the couple going through three unsuccessful rounds of ivf. according to the lawsuit against women and infants hospital, the couple was told the remaining embryo harvested was not viable. and just three years later, another blow for the young family. john passing away suddenly in his sleep. >> my world was totally turned upside down. >> reporter: marisa moved on with her life, even remarrying, until receiving that 2017 letter stating that she had a frozen

embryo at providence's women and infants hospital. >> i felt like i was now grieving a child that i didn't even know existed, a child that i could have had. it was a piece of john. it was a sibling for my son brett. >> reporter: marisa now paying $500 to keep the embryo stored, but since john has passed away, according to court documents, marisa is unable to make any other decisions about it. now filing a lawsuit against the hospital seeking unspecified damages. >> she wants accountability for what happened for the fact that this embryo was in their possession for 13 years and she was never notified about it. she would like an apology. and the third thing she's looking for is an assurance that this will not happen to someone else. >> reporter: the hospital telling abc news in a statement, that due to privacy laws they will not comment on this or any patient's care but adding, we stand behind the expertise and professionalism of our entire fertility center team, whose
