collision. 45 minutes for you. 13 minutes across bay bridge when you make it through the toll practices. san francisco to sfo should take you about 10 minutes. thank you. new developments in the college admissions scandal. we learned overnight it's expanding. the department of education looking into eight universities including stanford. according to "politico" education secretary betsy devos called into an investigation looking into whether universities broke any laws with financial aid. this will run parallel to the original investigation. twelve people implicated in the case appeared in court yesterday including coaches. they all pleaded not guilty to racketeering conspiracy. next week is when we expect actresses lori loughlin and felicity huffman to be in court. michael avenatti, lawyer for adult film actress stormy daniels says he is confident he

will be exonerated on charges of bank and wire fraud. avenatti accused of trying to extort nike for $25 million. according to prosecutors, avenatti threatened to release damaging information about nike if the sportswear giant refused to make multi million dollar charges to him. he's facing bank and tax fraud. he's accused of stealing funds from a client to pay off his own expenses. >> it is much harder to defend against things like wire fraud and bank fraud, tax issues. why? because they have documents, they have paperwork. as a result it's not a sort of ambiguity to what did i say, what didn't i say. i'm michael jackson avenatti, i'm much more concerned about that california case. >> avenatti is out of jail on a $300,000 bond. developing news from washington, democrats are demanding the justice department turn over special counsel robert

mueller's full report to congress by next tuesday. members of the committee strongly hinted they will subpoena attorney general william barr if they don't get that report by april 2nd. republicans and white house declared victory after barr's four-page summary said there's no evidence of collusion and no determination on whether the president obstructed justice. president trump's personal lawyer rudy giuliani calls out mueller saying not exonerating his client on obstruction was, quote, a cheap shot. >> we should just take a little breath and stop and everybody should apologize for accusing the president falsely of collusion. that turns out to be totally false, totally and completely unsupported, he's completely exonerated. there's no evidence of it. >> president trump says he has no objection to the report being made public. yesterday he even offered praise for the special counsel saying mueller acted honorably. also from the white house the trump administration making

moves to strike down the entire affordable care act. the justice department is now siding with a federal judge's ruling in texas that found the act to be unconstitutional. the administration is now asking the federal appeals court to throw out the entire law. top democrats lashed out at the republican-led effort. house speaker nancy pelosi said the move was an all-out war on affordable, dependable health care. meanwhile california senator kamala harris called on people to, quote, fight back again with everything we've got. california attorney general xavier becerra says his office will defend the act every step of the way. governor gavin newsom will host a roundtable. they will share concerns with the governor. he plans to talk about the first in the nation housing affordability proposals in his budget. the event starts at 12:30 this

afternoon in sacramento. >> at abc 7 news we're committed to building a better bay area. that includes cleaning up our streets. that is not so easy in berkeley where trash is piling up, especially along frontage roads off interstate 880. the city wants it gone but it can't get rid of it because that is caltrans property. the city says caltrans is supposed to clean up the area about every two weeks but it hasn't done it because of limited resources. people who live in that encampment say they see people dump their garbage in the area. some neighbors have ideas to prevent that. >> maybe they should organize some kind of community cleanup to let people know that's a problem. >> like commercials or showing that behavior is going to make you think about it when you're driving by and about to throw your package out. >> caltrans says, quote, working with all of our local partners to find solutions to homelessness in the bay area.

it is dark. that is one tough factor that rescuers are having to deal w the police sergeant on the scene tells me a group of men were hanging out. two of them decided to go swimming. only one made it back. they told police they got in the water around 3:45 this morning so he's been missing about 3 1/2 hours. we did see a group of friends on the sidewalk watching the beach, hoping rescuers can bring their friend in safely. we will stay here on the scene and bring you details. stay with us throughout this newscast as we follow this breaking story. live in pacifica, amy hollyfield, abc 7 news. >> amy, thank you. obviously dark out there making it very difficult. >> we'll continue to check in. thank you. new developments in nasa's plan for all female spacewalk. the walk isn't happening as planned because of space suit sizes. nasa says two of the astronauts

that breaking news is from the peninsula. sky7 is over pacifica where a search is on looking for a swimmer in the ocean. they were called at 4:45 to help out their surea surgea surgea ee swimmer. they follow the chopper as it continues to go along the coastline this morning. >> we heard there were two people in the water and one didn't make it out. that's where the swimmer is happening. pacifica and rockaway is where the search is going on right now. can you see the helicopter above the ocean. it is obviously dark out there.

still have a vehicle fire. that vehicle made it off to the shoulder and some onlooker delay. that is heavy into concord. >> alexis, thank you. right now a sunnyvale boy being treated in a hospital after falling from a fourth story balcony. >> this happened at the sunnyvale fairways complex off camino real. that's where we find abc news reporter jobina fortson. of course we're pulling for this little boy. what do we know about his condition? >> yes, 4 years old. as of last night was listed in serious condition after he was taken from the apartment complex here at sunnyvale fairways. i did reach out to the sup vail department of public safety this morning and the officer on duty told me he did not have any further updates on the child's condition beyond last night. around 5:00 p.m. yesterday the boy fell from the fourth story of the apartment building. investigators were taking measurements of the balcony and building late into the night. the man who called 911 says he

lives on the first floor and was with his family when he heard has loud thud from outside when he found the 4-year-old boy unconscious but breathing on their balcony. >> i heard a sound and looked down and there was a kid on the balcony. we weren't sure which apartment or whom it belonged to. so i saw he was bleeding. i called 911 when i saw that. >> the neighbor says he didn't even realize there was a fourth floor here, but they found the family the child belonged to once the paramedics arrived last night, investigators say at least one adult family member was home at the time of the incident. cps and district attorney were contacted about this incident per protocol. it appears at this point the incident was an acciden. reporting in sunnyvale, jobina fortson, abc 7 news. >> jobina, thank you. as reggie said earlier, we are pulling for that young boy this

morning. b.a.r.t. police arrest add man who attacked a woman on a train. according to a b.a.r.t. spokesperson he hit the woman on the train traveling from daly city to colma. it caused her to bleed. she walked through several train cars to get away from her attacker. they met the man in colma where he was arrested for assault with a deadly weapon. the woman was taken to sf general where she was treated for nonlife threatening injuries. new this morning senator kamala harris releasing details for her bold proposal. she wants to give teachers across the country a $13,000 raise. >> harris is running for president. she's calling the pay hike the largest federal investment in teacher pay in u.s. history. so how would we pay for this. senator harris wants to crack down on estate tax loopholes. her plan would cost about $315 billion over 10 years. we have new details in the

investigation of boeing 737 max. "the new york times" reports during flight simulations pilots had less than 40 seconds to override a system intended to prevent stalls. the pilots were in a situation similar to what they think went wrong on the lion air crash last fall. they believe a malfunction sent the plane into an uncontrollable nosedive before the crew could disengage the system. boeing says it plans to issue a software update tomorrow. >> a bill that would ban long paper receipts has cleared its first hurdle in the state legislature. the bill would require businesses that earn more than $1 million a year to give electronic receipts you unless they ask for a printed one. the measure passed its first committee vote yesterday. ting says it would remove tons of paper from landfills. paper receipts can't be recycled because they are coated with chemicals. a quick thinking hero saved a group of maverick surfers in

the past of the great white shark. drake stanley is a professional surf rescuers. >> this shows the outline of the shark. he was on water safety patrol when he noticed the shark about 9 feet away. nine surfers in the distance. one was paddling away catching the attention of the great white. stanley turned on the jet ski, got right on top of the shark and revved the motor. the shark had turned e shark to the attention to the surf eeeeer was going after him very deliberately and aggressively. >> stanley went into rescue mode. turned on the jet ski, got on top of the shark and revved the motor. he alerted surfers. >> everyone climbed onto my ski that could fit and the ones that couldn't held onto the side and i slowly motored the whole crew back to the beach. >> reporter: he said it adds to all that mavericks is. a restaurant closing after two decades in business.

yes, i know it's march 26. we've got up to 4 feet of snow possible in the sierra to 5:00. breaking news in pacifica where crews are searching for a swimmer. this happened near pacifica and rockaway. >> amy hollyfield is live for us on the scene. amy. >> jessica, i just asked the sergeant if there's any talk of when they would call off the search. he says they aren't there yet. this man has been missing for three hours and the water is probably about 53 degrees. it is getting lighter, though. that should help them. they were looking in the dark, that was very difficult for them. we do have a view from sky7 to show you the coast guard boat that is out there searching right now. we are near the lighthouse hotel near rockaway beach. police say there's a group of people hanging out. two of them decided to go for a swim. that was around 3:30 this morning. one man did not make it back.

a 28-year-old man. the group told officials, or the swimmer that did make it back, they felt like the water was pulling them couple of people sitting here on the beach watching, looking out toward the ocean. they look like they are physically okay but distraught and watching and hoping that their friend will be pulled in to safety. police say rescuers will likely want to keep at it until daybreak where they can see better. that is happening right now. as of now, no news on spotting this man. reporting live in pacifica, amy hollyfield, abc 7 news. okay. thank you, amy. now to the east bay and threat of election tampering. a hacker apparently tried to gain access to contra costa county elections office. an employee opened an e-mail from a known sender on thursday. that triggered a cyber security alert that the underlying ip address wasn't from a known address as they claimed to be.

so the system was immediately locked down. they attempt to appear to have patterns that match prior attempts at other government offices across the country. >> clearly their ongoing attempts to get into sensitive government systems, whether just to cause havoc, whether it's to undermine confidence, whether it's an attempt to gather information, it's too early to really say what the motivation was. >> no other election offices in california have reported a similar hacking attempt. now to a startling new study about marijuana. edibles are apparently leading to a spike in emergency room visits in colorado. recreational marijuana has been legal in colorado since 2014. edibles make up only .3% of pot sales. researchers found they are linked to more than 10% of all er visits. here is the reporter covering the story for "good morning america." >> reporter: one of the reasons this happened, when you smoke marijuana you feel the effects

westbound 880 at mcbryde avenue in richmond. to me it does look like they are getting pretty close to clearing it. i believe all the vehicles are loaded onto the tow trucks. hopefully they are watching closely. they will pull away soon and the lane will be open. drive times westbound 80 highway 4 to the maze along that stretch 59 minutes. so you are in the red just under an hour. westbound 80 across the bay bridge 12 minutes. that's honestly pretty good considering we have a disabled bus reported. westbound 880 around treasure island and that is blocking one lane. for now that is just in the yellow. southbound 101 san francisco to sfo that remains in the green at 11 minutes. still heavy here at well on walnut creek southbound 680, earlier vehicle fire on treat boulevard, off on the shoulder. sounds like they are still waiting for the tow truck. folks slowing down to take a look at that. now that it's out, having a tough time recovering. executive delays into concord. thanks, alexis. new at 6:00, a prize winning show dog has vanished at one of

the busiest airports in the country, hartsfield atlanta. she escaped her crate as loaded onto a flight in amsterdam. a number of people are looking for the dog including two wildlife biologists. atlanta airport staffers and customs and border protection. her owner, as you might imagine, is in a panic. >> horrific. it's missing a family member for us. we don't have any children. the dogs are our children. >> the airline says it expresses its sincerest regrets and is actively working with atlanta airport to search for the dog. how strange. i can't imagine how that happened. >> no. i hope they find her
