first wife. here is our friend, diana macedo. >> reporter: the north carolina man accused of killing his wife, shackled and asking for an attorney. he is charged with first degree murder after his arrest in arizona, miles from the mexican border. his wife, a 38-year-old emergency room nurse and mother of two was reported missing on march 9th. three days later her body was discovered in the woods about 30 miles from their home. police say she was stabbed. a friend of diana says her husband was controlling and made her cut off their friendship, when he found out diana was planning to leave him. >> i was crying. she told me not to cry, that everything was going to be okay. >> reporter: now investigators have new questions about the death of his first wife, that died in 2006 after an accidental fall at home. police say they are considering exhuming her body. >> there are questionabl thing

furious they dropped all charges against smollett who was accused of a racist, anti-gay attack on himself. abc's alex perez is in chicago. >> reporter: prosecutors in chicago making that surprise deal with jussie smollett to drop charges, blind siding and angering chicago's mayor and top cop. >> i have been truthful and con since tent on every level since day one. i would not be my mother's son if i did what i was accused of. >> reporter: officials quickly blasting prosecutor's decision to make a deal with smollett. >> you all know where i stand on this. do i think justice was served? no. >> this is a whitewash of justice. at the end of the day it's mr. smollett that committed this false claim. >> reporter: under the deal, smollett did community service and will forfeit his $10,000 bond in exchange for no charges. even prosecutors said, they, too, believe he lied to police. >> you believe he lied in the police report?

>> yes, and this is not an exoneration. to say he was exonerated by us or anyone else is not true. >> reporter: chicago police officials say they had no idea this was coming. >> it shows they hide behind secrecy to broker a deal. >> reporter: it comes after smollett was indicted on 16 counts about allegedly lying on a hate crime attack. smollett, describing a homophobic and racist incident where two men beat him and left a noose around his neck. >> who [ bleep ] could make something like this up? >> reporter: police have insisted they have plenty of evidence to prove smollett lied including the testimony of two brothers who said he paid them with this $3,500 check. those men later seen buying supplies for the attack. >> mr. smollett is still saying he is innocent, still running down the chicago police department. how dare him? how dare him?

it leaves you wondering if he did it why is he not being charged, and why were they dropped? president trump celebrating the end of the russia investigation with republican lawmakers. >> the justice department prepares to turn over more of robert mueller's repord, they are shifting focus on capitol hill with the shifting fight over obamacare. abc's mary bruce has the details. >> reporter: as president trump arrived on capitol hill it was announced a version of robert mueller's report will be released in weeks and not months. >> mueller report was great. it could not have been better. it said no obstruction, no collusion. >> reporter: that's half true. the special counsel did not find collusion between the trump campaign and russia. he made no determination on obstruction of justice. writing, quote, while this report does not conclude the president committed a crime, it also does not exonerate him. attorney general, bill barr, said the evidence was enough to convince him to clear the president himself. >> the american people deserve to see the mueller report, not

software issue that is seen on all 737 max jets that were taken out of service. meanwhile, there was a delay in faa certification of the new software that was expected today. boeing is still submitting additional documentation for the software fix by the end of the week. new england patriots owner, robert kraft is changing his defense strategy against the prostitution case. he wants his case to be tried by a jury, not a judge, as he previously sought. the 77-year-old billionaire also waived his arraignment, which means he will not make a court appearance in florida tomorrow. the nfl is moving to avoid another controversy like the one at the end of january's nfc championship game. you all remember that one. league owners overwhelmingly approved a rule change to allow past interference to be challenged by koshs and reviewed by officials. that includes noncalls. like the one that changed the outcome of the rams/saints game. turning to the weather, it's raining again in parts of california. a severe storm system is moving in off the pacific and will also impact oregon and as far west as

severa several days of heavy rain and strong winds were too much for a single lane bridge on new zealand's south island. it washed away. after 16 inches of rain fell in a short period. other roads are closed as well as some schools. major league baseball has suspended san francisco giant's president and ceo, larry baer because of a public altercation. the incident was captured on video. pam baer fell to the ground when her husband tried to grab her phone during an argument. larry baer has to stay away from the club through july 1st. turning to a scare at a hotel in daytona beach, florida.

>> a 3-year-old boy was under water in a hot tub two minutes. a clerk watching a surveillance video got help. here is abc's victor oquendo. >> reporter: you are watching video of what florida police are calling child neglect. twin 3-year-old boys running to a hot tub at a daytona beach shores resort sunday night, one of them going under. it's agonizing to watch. the adults on the other side of the hot tub later telling police, they didn't realize he was in the water. according to investigators their mother was nearby, supposed to be watching them, but she was drunk and high. she admitted to consuming marijuana, alcohol and oxycotin. it was not until an employee watching surveillance radioed a co-worker and pulls the boy out. the toddler had been under the water for more than two minutes and was not breathing. the staff member begins cpr. others raced to his side. >> we got him breathing, but barely. >> reporter: the boy begins breathing on his own. >> try to keep him warm, okay? don't move him around.

our next story is truly worthy of oscar the grouch himself. >> imagine sifting through piles of garbage from new york city inside a waste transfer station looking for a lost wallet. that's what one man was forced to do. will ganss is here to sift through all of it for us, because this -- >> i will bring over the hand sanitizer after we are done with this story. good morning you two and good morning to all of you. one new york city man getting ready to fly to europe and realizing he doesn't have his wallet. thanks to technology, he was able to find it in another state in piles and piles of trash. >> i couldn't imagine how it was going to happen. i kept imagining, am i going to be standing in a landfill? am i going to be, you know -- these trucks hold 18 tons of garbage. >> reporter: a ton of stinky possibilities for a new york city man, accidentally tossing his wallet out with the trash. luckily for him, a tracking

device linked to an app on his phone, helping make a clean recovery. >> when they dumped the second pile, all of a sudden, my app said wallet is nearby. >> it started with his wife asking him to take out trash, while visiting friends. like any good husband, he did. the only problem, he took out more than the trash, not realizing it until the next day. >> friday afternoon i basically was about to head out and, i'm, like, where is my wallet? >> luckily he keeps a tile tracker in his wallet, tracing it back to his friends address. with that info, the sanitation department helping track it to a truck at a transfer facility in new jersey. once there, he teamed up with officials to parse through the 18 tons of garbage in the truck, waiting for his tile app to notify him when his wallet was close, which it wasted no time doing. >> this is the easiest one we have ever, found it in five

headline that it was this southwest boeing 737 max, hit by an emergency at take off. >> 701, we just lost our right engine. need to declare emergency. >> reporter: the jet, with no passengers on board, quickly circling back to orlando airport, in the air for 19 minutes, landing safely. why was it flying? the pilots planned to fly here, the southern california high desert where southwest is storing its maxs. united storing in houston. the entire fleet around the world, still grounded. boeing hopes the software fix will get the jets back in the air and get the update for the anti-stall system. the system implicated in the first crash in the lion air jet and suspected in the crash in ethiopia. ethiopia saying its preliminary report confirming or pointing to another cause is coming later this week. while it's believed a bad sensor and pilot error caused the first crash, boeing says the software update will make the safety system harder to trigger and easier to recover from.

sources told abc news the software update would be documented. certification could be pushed until early next week. david kerley, abc news, denver international airport. actor jussie smollett says he wants nothing more than to go back to work now that the charges he was facing have been dismissed. smollett has been cleared of charges in connection to an attack police say he staged himself. all the records in the case have been sealed by a judge in chicago. abc's alex perez is there. >> reporter: stunning developments here out of the cook county courthouse, an unexpected announcement from the prosecutor's office, dropping the charges against "empire" actor, jussie smollett. the actor was charged with 16 felony counts for allegations he lied to police and staged an attack, a hate crime, against himself. smollett leaving the emergency hearing where the decision was

announced those charges were being dropped, he spoke to the media and told everyone he was telling the truth throughout this entire ordeal and thanked his supporters, but a short time after that the prosecutor's office explained a little more about what happened. they say they reached an agreement with smollett. he did community service and agreed to forfeit $10,000 cash that the county has in exchange for dropping those charges. the prosecutor's office says in a case like this when they are dealing with an individual like smollett who does not have a criminal past it's not unusual for them to drop the charges. the police superintendent, eddie johnson, who had strong words for smollett after the charges were announced, continued with those strong words saying that

smollett and prosecutors are hiding behind a deal after his detectives worked hard to get to the bottom of this case. as for smollett, his legal troubles may not be entirely over. the fbi is still investigating whether he mailed a threatening letter to himself. alex perez, abc news, chicago. >> and as alex mentioned, the strong words from chicago's top cop. the city's mayor, rahm emanuel called the deal, which cleared smollett a whitewash of justice. he criticized smollett for continuing to claim his innocence. >> here's my basic anger. there is no sense from this person who now, the state's attorney says, committed the actual crime or the hoax. there's no sense of contrite. no sense of remorse. >> late last night the attorney for the two brothers were paid by smollett to stage the attack spoke out. she said the brothers were fully prepared to testify in any

criminal proceeding in the jussie smollett case, which is apparently not going to happen now. the bump stock ban that took affect yesterday survived one challenge from gun rights groups while another is pending. chief justice roberts declined to hear an appeal to stop the trump administration from outlawing the devices from firing like machine guns. they were used by the las vegas shooter to kill 58 people. the devices are now being destroyed since anybody who owns or sells them could face up to ten years in prison. the maker of oxycontin and the family behind them will pay $270 million to settle claims they helped create the opioid crisis. the oklahoma case is among 2,000 faced by pharma and the family. the money will create a national addiction and treatment center as part of the settlement. purdue denied any wrong doing. former vice president biden has apologized, once again, for the treatment anita hill received while testifying against then supreme court
