much joy and love and hope where can't express my thanks to everybody enough for what's happened. >> reporter: on sunday morning while waiting for his food he stood up for a dennys employee who was being harassed by a customer. that customer then punched him leaving him with a broken nose, pallete and teeth. his mother paula wants justice for her son and the community. >> please everybody look at this picture because this guy's dangerous. >> reporter: so initially it was believed that the suspect was a door dash driver, but this morning investigators here at the fremont police department said there was no evidence of that. however, tonight police said that they got new information from door dash about a second employee who better matches that suspect description. no arrests have been made, but as soon as we learn any new information we'll update the story. live in fremont, i'm kate larson, abc 7 news.

we are not done with the rain this week. live doppler 7 along with satellite tonight. it's a mainly cloudy night, and we're tracking some areas of drizzle. that's the green you see. and as we get you into tomorrow morning future weather showing you you're going to greet the day with gray skies and some pockets of drizzle. you'll find that drizzle from 6:00 in the morning and approaching parts of morin county. but that is just the start what will be a wet finish to the week. we're tracking two more storms. that friday is the wettest all week as it taps into a weak atmospheric river. we'll show you when dryer weather returns in a few minutes. b.a.r.t.'s police chief announced his sudden retirement today. the decision comes after leading the department for two tumultuo tumultuous years. >> reporter: all everyone is saying within the system is that they are happy for the chief and

he has done a lot in a short amount of time for this department, but others have a very different opinion. >> he was a great guy to work with. i think everybody at b.a.r.t.'s is really going to miss. >> reporter: the vice president of the b.a.r.t. board had only good things to say about his tenure here. >> he's really been pushing on recruitment, having some incentive, changing on the hiring process. >> reporter: b.a.r.t. police officer vacancies are down from 40 to 20, and some regular riders say officers are more visible, too. >> at b.a.r.t. station they've been trying to improve it, and that's something we've been noticing. >> reporter: but not everyone has seen positive changes. some have only experienced painful repercussions after riding b.a.r.t. nia wilson and her sister were both stabbed last summer. nia died and her family is emotional and angry at

sharing the risk. >> i know a lot of people are praying for us. >> reporter: he's missing his best friend, the 40-year-old father of seven children immigrated to california four years ago from afghanistan where he worked as a translator i u.s. troops. during that time he was shot and wounded by the taliban. he settled in concord and started driving for uber. but on february 3rd he was killed on the job in a horrific head on crash on highway 101 in san francisco caused by a wrong way driver. >> my mom, she remembers my dad like every single day and she cried for him. >> reporter: 14-year-old yaya is stepping up to help his younger siblings. a gofundme account has now raised $327,000 for the family. >> our main focus, our main goal is to get them a house.

>> reporter: but the family still waiting to hear from uber about what kind of financial help they may be entitled to. uber offers additional driver injury protection at a cost of about 4 cents per mile, offering survivor benefits to family members if you are killed. it's unclear if he was enrolled. >> i did contact uber. they've been in contact with us. >> reporter: uber sent us a statement saying this was a horribly tragic incident and our hearts continue to be with the grieving driver's family. >> workers need to be protected. >> reporter: philip mcafae founded ride share.org, many who can't pay their medical bills. >> i think that's the weakest part of the economy. i think that's the most hurtful aspect is to put people out in this very risky business and not make sure that they have the basic protections that everybody else has at the workplace.

>> reporter: he's advocating for better protections like workmans comp for ride share drivers. >> and all this week on abc 7 news we look at the ride share realities and the impact these companies are having on efforts to build a better bay area. we certainly invite you to share your ideas and see what your neighbors think by joining our better bay area facebook group. >> new developments tonight in the killing of rapper nipse hustle. the suspect was arrested this afternoon. it came just hours after los angeles police called for holder to turn himself in. investigators say the shooting was a personal matter between the two men but didn't go into details. surveillance video shows the suspect talking to hustle outside his door where that shooting happened. new at 11:00 hundreds of people gathered tonight to remember two teenagers who are electrocuted while rescuing a dog from a canal.

the two 17-year-old boys sifly pulled the dog from the canal yesterday, but when they tried to get out of the water sadly they were electrocuted. jacob's mom says it happened when they grabbed onto a bridge that had live >> and that's too soon for any young person to be taken off this earth out of negligence. >> investigators are trying to figure out how the bridge became energized. the search is on for the vandals who trashed an east bay school. students and teachers arrived in oakland thrk to a mess that's going to cost thousands of dollars to cleanup. whoever is responsible broke windows, covered the walls in paint and smashed computers and a toilet with a huge rock. a librarian was one of the first to discover the destruction. >> the hallway was 2 feet of

for us at jsu this week. a welcome site considering college stress for students here begins with looking for a place to park. described as the airbnb of parking, the app allows students to rent parking spots from hosts. >> i wanted a solution to my own problem. >> reporter: they launched the app in january and have since partnered with the university as jcu was promoting the app on campus. according to sjsu 20,000 students drive to school but there are about about 1,500 parking spots at the campus. the app is causing some apprehension in the neighborhood. >> it took me three times but finally on the third time i said let's try it. >> reporter: off camera others

pointed to liability issues. the possibility of litter left behind by app users. and at the top of the list, security. >> you get the license information, the type, the color and the year. plus you also have the number of the driver. >> reporter: 2,100 students currently use the app, paying $2 an hour, $25 a week or $60 a month for a private spot. >> i'd like to have a toning down community built, and if this is one of the way to extend the bridges i'm happy for that to happen. >> reporter: creators want to expand and possibly bring the app to the city of san jose, also to california state university andhe entire system. >> amanda, thank you. >> a bill that would allow homeless students to sleep-in their cars overnight at community colleges is moving forward. it is being pitched by a palo alto assemblyman burke berman and made out of committee today.

a recent survey showed that nearly one in five community college students in california have been homeless within the past year. well, great news from today's snow survey. the state no pack is at 162% of normal. >> snow pack supplies about a third of the state's water needs as it melts over the spring and summer, obviously. the huge numbers are the result of more than 30 smearic rivers that have drenched the state. and another one is on the way. >> let's get right on over news meteorologist drew tuma. >> allowing for a gorgeous rainbow over the embarcadero with those stormy clouds as the bark drop. but tonight those clouds have filled in once again, and live areas of drizzle right now. the shark tank you can see that right in the foreground.

over head you see a lot of gray skies, and those clouds will be with us tomorrow morning and through much of your day on wednesday. accuweather highlights morning drizzle for your compute, clouds throughout the day. two more storms we're tracking. one on thursday, but a wetter one coming in here on friday to finish out the week. and then we're going to do a 180. warmer, dryer weather looks to move in here over the weekend. so it looks like the weekend actually shaping up to be pretty nice. right now temperatures under that cloud cover and light wind, uniform. 57 in oakland, 54 in san francisco, and napa, 50 degrees. overnight tonight numbers pretty much going to stay where they are right now. a lot of cloud cover, some isolated drizzle, mid to low 50s your starting temperatures out the door. your future weather, plus plan out your wednesday. some isolated drizzle, but it won't be as nearly as wet as you were this morning, just very isolated pockets of drizzle. the clouds, though, they're

going to stick with us the entire day. so again it's a mostly cloudy day with limited sunshine. highs tomorrow 60 in san francisco, 62 the high in santa rosa and concord. up to 65 degrees. another cold front will swing through here on thursday. the storm impact scale, level oe light system. again newsance light showers. it won't be a wash out of a day, but you will find yourself under a drop or two on thursday. but all eyes on friday because it looks like a wetter system moves in here friday afternoon. you could see some light to moderate rain over northern california. the good news, this is quick moving system, so the flooding risk remains very low. but it will have an impact on the giants home opener on friday. i know. oracle park on friday may include showers and temperatures in the 50s. here's the accuweather seven day forecast. we'll see tomorrow some pockets of drizzle, but more showers light in nature on thursday, some rain to start out saturday morning but we dry out in the afternoon. and look at sunday.
