out by a riptide and his friend charged his harldedest to save . >> a.j. just yelled at him to float on his back, watch the waves. and a.j. got sucked into the undertow as well, and he felt like he was drowning. >> luckily someone reached a.j. in time and pulled him back to shore. he and his friends were seen boogie boarding when a riptid sneaked up on them. >> sometimes when you have two current that are battlin each other it causes the rip current out to sea. >> reporter: friends and family refused to leave poplar beach where they had come on spring break. >> he was a gifted athlete. we'd known him since he was a baby, and he had a -- my

daughter said he had a full ride scholarship to university of wyoming. i feel so sorrowful for the family. all their hopes were in him. >> reporter: and the coast guard will remain in the water until midnight. the rest of the crews, however, have left for the night. >> such a shame. lisa, thank you. also developing tonight, a pilot is dead after a plane crash in fullerton, california, just north of anaheim. the faa says no one else was oboard. the twin-engine plane caught fire just after 8:00 tonight. the pilot had filed a flight plan with a destination in utah. the cause of the crash, of course, just beginning to get under way. new at 11:00, a political mailer many people received this week and saw on tv and online is being called racist propaganda.

kate larson live in san francisco with the story tonight. >> reporter: this flier showed up in my mailbox and it surprised me along with many other san franciscans including mayor london breed. >> it's offensive, it's hurtful, it's disrespectful. >> reporter: mayor london breed says she's disgusted by this political mailer which equates this statehousing bill to negro removal. >> i lived through it and we are still sadly living with the impacts. >> reporter: the mailer and tv ads seen throughout san francisco this week with a 1963 quote from actor and activist james baldwin. state senator scot wiener is the author of sb 50. the mailer accuses wiener of making the housing affordability crisis worse for working class communities of color.

>> we went through a terrible time period where we were pushing african-american people out of san francisco and bulldozing neighborhoods. this bill is designed to stop that from happening in the future. >> reporter: the mailer was paid for by healthy housing foundation, a division of the health care foundation based in los angeles and run by michael weinstein who spoke to be my phone tonight. >> we standby it. the truth may hurt, but the reality is san francisco has become a place that all the rich people and mostly white people can live in. >> to think someone would be that unprincipled to prey upon the pain of black people. >> reporter: reverend amos brown is president of the sanfranbran. he also received the flier in the mail. >> it's racist. >> reporter: mayor breed buzz support sb50, but it is controversial. even those opposed to the bill

like supervisor gordon mark are against this flier. live in san francisco, i'm kate larson, abc 7 news. >> thank you. let's go to the south bay now and a really tragic story. a 3-year-old boy is dead, his own grandmother in jail accused of murder. abc 7 news reporter amanda decostillo live with the story tonight. the little boy later died. his grandmother was then arrested wednesday night in san jose. a family is mourning the loss of a 3-year-old boy. police say he was under the care of his grandmother at the time. >> unfortunately, this little boy died, and we had to take the grandmother into custody. >> reporter: police say the incident happened monday afternoon on the 700 block, officers responded to a 911 call.

they found the boy unresponsive. >> our officers tried every possible method to try to preserve his life. >> reporter: the county coroner says the boy was strangled. on wednesday the grandmother the 70-year-old was booked into jail for homicide and child abuse. back in the gated communty say it's tough to imagine such tragedy could happen so close to home. >> generally it's pretty pleasant, family oriented, kids all around. >> reporter: police say the boy's parents were out-of-state, and he lived with his aunt who acted as his guardian and his grandmother at the time. the santa clara county sheriff's office says she's being housed in a dorm for the severely mentally ill to make sure she doesn't harm herself or others. >> it's not only shocked our

community but shocked our personnel. and i as a father, i can't believe what the family is going through. >> reporter: she's expected to make her first court appearance friday afternoon. abc 7 news. >> all right, thank you so much, amanda. we have new details tonight about a large group of students who became mysteriously sick at a berkeley school. berkeley police say a hazmat team was called out to malcolm x elementary just after 9:00 this morning. 50 students and a teacher reported feeling disney and felt some nausea. the air was tested but nothing toxic was found. more tests will be conducted tomorrow. hundreds of people marched through east oakland late this afternoon to demand safer intersection. it's all in response to the deaths of a 6-year-old and his mother. they were killed by a hit-and-run driver saturday night. many of the marchers were from oakland international community

the redacted version of the special counsel's report on the russia investigation was made public today. now tonight abc 7 news reporter marcy gonzalez explains this is far from over. >> reporter: the mueller report finally released today nearly 450 pages detailing the results of a wide ranging 22-month long investigation. the special counsel finding no evidence of a criminal conspiracy between the president or his associates and russian meddling in the 2016 presidential election. but declined to clear the president on 11 possible instances of obstruction of justice. the report describing the moment the president learned a special counsel had been appointed. the president slumped back in his chair and said, oh, my god, this is terrible. this is the end of my presidency, i'm blanked. the investigation finding the president repeatedly tried to intervene and pressured white house counsel don mcgahn to get mueller fired. he refused.

that is largely because the persons who surrounded the president declined to carry out his orders. robert mueller noting, if we had confidence after a thorough investigation of the facts that the president clearly did not commit obstruction of justice, we would so state. >> the special counsel made clear he did not exonerate the president. >> the facts that are now established by this report are damning. >> reporter: but still the president is claiming vindication. >> i'm having a good day, too. it was called no collusion, no obstruction. >> reporter: defiantly tweeting tonight i have the right to end the whole witch hunt if i wanted. i could have fired everyone including mueller if i wanted. i chose not to. i had a right to use executve privilege, i didn't. but this is still far from over. there are more than a dozen related investigations under way. some members of congress will soon get to see a largely unredacted portion of the report, and mueller has been called onto testify here on capitol hill by the end of next
