>> it looks pretty bad to me. >> reporter: it's like time stood still. at least that's how it looks. one of three years seriously damage bid a land slide. all but the property immediately adjacent to the homes is owned by east bay mud. >> how has this been for your family? >> it's been difficult on my wife, my kids, very difficult financially. >> the creek down here established the slide in january of 2016. >> the attorney for the homeowners says a key piece of evidence in the case will be an outside engineer's report. and internal east bay emails that indicate it was aware. the hillside was susceptible to a catastrophic failure two months prior to the massive slide in march of 2016. abc7 news obtained a copy from 2016. in it an engineer writes, the land slide is being actively

undercut by the creek. and the bigger movements could occur if the land slide is not stabilized. it also indicates concern within the utility. one engineer saying we suggest the land slide be repaired. there are residents. >> east bay mud, it suggested that they recommended stabilizing this hillside. did nothing until it was too late. >> what's really frightening is my neighbor's floors, they had three children sleeping on that floor and they weren't issued a safety alert. to me, it is unconscionable. >> they provided only a written statement to abc7 news, the land slide is in litigation with an upcoming trial date. we trust in the legal process and hope for a fair resolution. now those who live in this area know there was a popular paved bike and walking trail down at the bottom there.

it was completely wiped out by both the first and second slides. besides this recreational use, i'm told it was also intended to be an avenue of escape and a road that could be used by emergency vehicles in the case of a disaster. as you can see, it, like everything here, is still covered in plastic. the trial now set to begin on june 10th. >> all right. we heard in your piece, one of the homeowners talking about what a financial hardship this has been. what has it really been like for the amount of day on day basis? >> there are two families here who haven't been able to live in these homes. especially this one here. both have been compromised to the point where they've been red tagged. i talked with both of those homeowners and they say it's been takerbly difficult. they've had to keep making payments on these homes that they own. the mortgages, the taxes, all of that. while renting other properties.

one homeowner said they've moved four times in the three years since the shied has happened and there's really no end in sight. >> that's tough. >> you really see the scope of the problem. >> in the east bay, a woman is suspected of stealing the identity of a nanny. then wanting to steal from families who wanted to hire her. this is their suspect. 60-year-old darlene monticalvo. investigators say she tried to get hired by two families in san francisco but those families ended up uncovering a con. one of the families had a surveillance camera that captured video of monticalvo in their home as she interviewed for the nanny position. police say she was posing as an emeryville woman who israel a nanny. they connected with the real nanny and she called police to report someone had stolen her identity. >> the suspect created a profile

to be a mother seeking childcare services. and our victim got in touch with the suspect. and they communicated. and during the course of the communication, the victim provided the suspect with her personal information. >> monticalvo is also wanted by the oakland plarlt for several felonies, including injury to a child. she's been arrested before in so-called nanny scams. police tell us dating back 15 years. anyone with information in this latest case is asked to call police immediately. now to a bay area man who loves the outdoors and the trial for a man accused of savagely beating him while he worked as a security guard. >> the trial is very close to ending and the verdict. live in san francisco with the update. >> did jessie vieira

a woman or did he viciously attack wh hkateos auestions tha now and they need to make here's a look at the incident in question. last november, 57-year-old dan jansen can be seen on surveillance camera setting up barricades around the old bank of manager building. it says skate boarding isn't allowed. you can see skaters moving the barricades. things escalate. right here you see jansen hit the ground. investigators say he was swarmed by the skaters and assaulted by jesse vieira. they rushed him to the hospital. brain swelling forced doctors to remove part of his skull. >> nothing will change what they did.body >> that was his sister's response after the first
