> . a man is alive after being rescued from frigid bow did he bodega bay. they were notified when the kayaker didn't return sunday when he was supposed to. it took half an hour to find him. the kayaker was wearing a lifejacket and a dry suit. the suit did develop a leak. the man did show signs of shock. however, he is okay.

officers credit his survival to filing a float plan and being prepared in the water. sky 7 was over pacifica where yet another dead whale has washed ashore. this is the tenth whale now that has shown up dead on bay area beaches this year. the whale is in a rocky area near shelter cove just south of pacifica state beach. scientists can't determine the cause of death until the carcass drifts into a more accessible area. gray whales have been turning up dead from starvation during their migration to alaska. this is the tenth whale to wash up on a bay area shore and this is just in the last few months. we told you about a dead whale in ocean beach just last week. the previous nine whales that have washed ashore have all been gray whales. the lack of food is forcing them to take dangerous detours through bay where the animals are sometimes hit by ships. berkeley police arrested an uber driver where they say he attempted to rape and kidnap a

woman. >> they say he refused to one woman threw herself out of the vehicle when it was moving just to escape. >> abc7 news reporter liz is live in berkeley where there are renewed calls for stricter background checks. >> reporter: that's right. this intersection here at telegraph and ashby avenue is actually where that woman had to jump out of her uber in order to escape that driver. we're told by the manager of this gas station that she then ran into his convenience store, asking for help. she looked scare. that manager then brought her into his office and called 911. this is the uber driver now behind bars, charged with kidnapping and attempting to rape two female >> police say he picked up a woman in her 20s and refused to let them out of his car.

then he picked up a second victim. they say he released her only after she threatened to break out of the window. >> he want to solicit her for sexual services. >> amare arrested days later in berkeley. uber saying they are deeply troubled by what happened and have removed him from the app. it comes as companies face increased scrutiny over safety. >> it seems they could do a lot more to screen out the bad apples. >> jay who writes about rite ride shares says he believes uber needs to beef up the background checks. >> how long did it take to you become an uber driver? >> 24 hours. >> wow! >> and it took me three or four days to become a taxi driver. i had to go through all steps. it took longer and it was a much more rigorous process. >> in 2017, state regulators document new safety rules for uber and lyft but decided against requiring the companies to fingerprint their drivers.

her young daughter is now in custody. pablo is the man seen walking in this surveillance video from last week. watch as the victim and her daughter appear. you see on the right-hand side there. they walk up the stairs. that's when the suspect right there grabs the woman's purse, dragging her and her daughter to the sidewalk below. police say cabrera is linked to other robberies. investigators say all the victims were women and all were carrying expensive purses. a tanker filled with cooking oil forced crews to shut down westbound 580 and 80. >> reporter: a traffic nightmare followed people into their morning commute. a tanker caught fire from westbound 580 to 80 just ahead of the toll plaza. >> the driver along with the good samaritan attempted to put out the fire but were

unsuccessful. >> reporter: police say if the tanker were carrying fuel, this could have ended much differently. >> luckily it was just cooking oil and it was started by a tire blowout. so luckily nothing. nothing blew up. >> reporter: but you can say some people's minds were blown as they sat in a massive back-up captured by sky 7. and we were no exception. yes, that is our white news van in the thick of it. the chp had to shut down the highway. >> it was a lenty process to get all the lanes back open. a second tanker showed up to take the cooking oil. two tow trucks were needed to get the original tanker and its charred wheels off the roadside. commuters zipped by. attempting to make it to work on time. >> the chp suggests if you hear something like this happening on the highway, and you are near your home, to please try to tak b.a.r.t., possibly the ferry. another way so they can pre investment extra vehicles from being on the road.

>> joining me today, julie, a private investigator. you conduct quite a few background checks. i know this. let's talk about using an agency to hire someone to work in your home. do they do a good job? can you trust them to do a good job? >> some agencies do. what i've been hearing on the news is that they're not doing a great job at it and you need a professional to get it done. >> what does a good background check include? >> good question. it is not only going to check for the criminal convictions but also delve into have they had civil cases against them? are they calling and checking their references? do they have small claims cases against them? who is this person? >> do you have to go to all the counties where they live?

how does that work? >> i don't have to physically to go each county but as i was saying, 13 counties in california do not put the records online. >> unbelievable. >> unbelievable, i know. >> what that means for me to do a good job and be dill general, need to go send a court runner to check those counties for runners, civil and criminal, or i physically go myself and get into the data bases and check for records. >> here in the state of california, what can you legally unearth about someone? >> well, if you're a private citizen, i can do quite a bit for you. you're obviously not anmployer with five or more employees. california state law is very strict. it shouldn't stop anyone from doing background checks. you can work with your employees but you need to be respectful of the legal things. >> a lot of people hire someone

off craigslist. can i check them out? i guess i know the answer. >> i get worried. i get a lot of calls after the fact when someone didn't do their due diligence and they're having an issue from that person who he's stole from them or did something to their apparetly or child or something awful. there are things you can do. hire a private investigator. i match the face to the person. it's not that hard. >> that's the most recent case. she was parading around as if she was someone else. that's what she's accused of. does that happen a lot? do you see that? >> yes. if you don't physically match the person's face with who you're speaking to on the phone. we can use skype. google meet. there are ways we can look at a face during interview and make sure that's the person you're talking to.

under cloudy skies, 59 degrees. pretty cool. it is in the mid 60s with oakland, mountain view, san jose and santa cruz. this is how the western skies look from emeryville. quite cloudy but most locations are not reporting rainfall. 63 in santa rosa. mid 60s, napa and fairfield. 64 in livermore. and this is the view from the east bay hills camera. these are our forecasts. sweeping southward and eastward. wet and wendy tomorrow with the possibility of some isolated thursday. and another storm will arrive over the weekend. tonight, as the rain begins to push onshore, first in the north bay, but other locations could see showers overnight. low temperatures will be in the low to mid 50s. it will be relatively mild overnight. it will start to get wet. we bring out the storm impact scale. a storm of moderate intensity.

for tomorrow, look for light and then moderate, even sometimes heavy showers. most locations can expect about a quarter to three quarters of an inch of rainfall. the north bay locations will get an ink or more. and wind gusts will range from 20 to 40 miles an hour. we'll see rain developing in the north bay. by 7:00 tomorrow morning, it will be reaching a little bit to the east and south. still concentrating in the north bay. then we see the rain rapidly expanding. these areas of orange and yellow represent the heavier steadier down pours which will be quite widespread going into the afternoon and evening. the evening will be a messy one. lots of rain. strong, gusty winds. look how expansive this will be. by 7:30 tomorrow evening. into the late night hours, quite wet, quite stormy. finally wing down. we project that by 11:30

the future is looking brighter for a peninsula company behind a plant based meat substitute. today burger king announced it is expanding the sale of its impossible whopper. the patty was developed by impossible foods of redwood city. the company has been struggling with the expansion since burger king started offering these meatless whoppers in st. louis last month. it has help impossible foods raise $300 million from investors that include jaycee, katy perry and serena williams. we have to try one of these. walmart is competing with
