after a man was shot. he is expected to survive. people described the scene when shots were fired around 5:00 this evening. >>. >> i heard two gunshots go off and saw a bunch of people running down the hill. we got our stuff and ran off, as well. >> sounded like fireworks. the only thing that was scary was everybody started running towards us. >> police have not made any arrests and have not shared a description of the suspect. >> a developing story right now. another new chapter surrounding san francisco's em battled police chief as the police commission weighs in. >> this story has taken several twists an turns when the chief apologized for a raid at a journalist's home as they searched for who leaked a report on jeff adachi. >> abc7 news reporter kate larsson joins with us more. >> reporter: after getting slammed by the police union yesterday which represents the

rank and file of sfpd, chief scott is getting support today from the people ho help hire and sometimes fire the police chief. the san francisco police commission president and vice president defended sfpd chief bill scott releasing a statement which says in part chief scott apologized to the citizens of san francisco. chief scott has shown himself to be a person of high integrity. we would like to see him continue account great reform work he has started. three hours later, the commission sent another e mail which says the statement issued 0 it the media this morning was on behalf of police big president hersh and vice president taylor. at this time, it would be inappropriate for the commission to opine further without seeing the results of a full and fair investigation. aniquiv indication by the police commission was preceded ed by unreserved criticism from the police you know who on saturday called for the chief to resign. the san francisco police officer's association said his apology to the media for raiding

brian carmody's home was meant for him to safe face as opposed to accepting responsibility for his own actions. >> there's a question of veracity of the truth eighth been praised. that's why i keep steering back to the police commission who an componented the chief. >> richard is director of usf's institute of justice leadership. he says the police commission has a tremendous amount of authority over the chief and the department. >> if the poa's narrative holds bathe, it seems to me the police commission is in a position to find out where does that accountability stop. >> reporter: while attending carnivale on sunday, the mayor declined to comment when asked about the latest on chief scott's fitness to lead. she released a statement i'm glad the chief apologized but i remain deeply disappointed by the actions taken in this case up to today. this is unacceptable and we have to do better.

so there seems to be a little bit of a game of political hot potato playing out here. today's statements from the police commission just the latest in the evolving controversy over sfpd's raid of the local journalist which has set off a national debate about freedom of press. i'm kate larsson. back to you in the studio. >> thanks. weekend talks between the new haven unified school district and striking teachers came to an end without a deal this evening. abc7 news was at the office of education in hayward as both sides met. the only issue keeping teachers and the district part are salaries. teachers are seeking a 10% raise over the next two years. district says they can't afford that. >> we are struggling to keep teachers in the area. we're struggling to have teachers who can live close by to where they work. >> thi they called it, they can call it off. we are exceptionally motivated to get our teachers back in the classroom with our kids. >> teachers walked off the job

monday and by friday, only 9 of the district's students showed up for class. >> in the south bay, a dui crash shut down all lanes of highway 17 in santa claire rare county. around 1:00 this morning, a ford pickup truck hit a power pole on 17 north of idyllwild road knocking down power lines. officers arrested claudio maldonado for driving under the influence. a total of two poles were damaged. pg&e has to permanently repair them. >> the chp has put out initial numbers about duis this holiday weekend and says there have been at least 18 fatal accidents so far and in those crashes half of the people who died were not wearing a seat belt. officers arrested close to 740 people for driving under the influence. the maximum enforcement period ends tomorrow at 11:59 p.m. >> jen rafgsz veterans saluted

tonight we're learning new information about the california man killed in a shark attack off the coast of maui. >> officials saw say the man is from granite bay northeast of sacramento not far from fullsome. here's darria all binger. >> reporter: first responders is racing into the waters off the coast of maui on sated. >> we have a shark bite. >> reporter: a man swimming about 60 yards offshore was attacked by a shark. >> unresponsive. >> reporter: the 65-year-old california man identified as thomas smiley rushed to shore, his wife on the beach panicked. >> we could hear her screaming that's my husband. life guards quickly transferring the victim from a jet ski to a gurney. a witness described the scene. >> they pulled the man up. he looked unconscious when they.

san francisco a high of only 57 degrees today. 62 in l.a. one of the coldest cities we have on this entire map. but we are going to warm up over the next couple of days. it gets better from here on out. numbers right now, still in the 50s for most cities. 53 currently in san francisco. we haven't dropped too far from our high earlier today. 54 in san jose. spomts like napa and san rafael in the 40s today. overnight mostly cloudy. the numbers fall from where we are now, settling in the mid 40s in our coldest spots in the north bay lower 50s around the bay shoreline. we'll break down your memorial day itself, the holiday tomorrow. you notice we don't have the storm impact scale. the showers are gone, but the cloud cover is going to linger for much of the day tomorrow. partly sunny skies throughout the afternoon. breezy, 10 to 15 miles per hour. it's a dry day. temperatures slightly warmer tomorrow than we were today.

but still for may standards, this is below average. 63 in oakland tomorrow. 59 the high in san francisco. 64 in san jose. 65 in livermore and santa rosa. about 69 degrees. the unofficial start of summer this weekend a lot of people want to go to the beach tomorrow. not the greatest beach day. you can see it's partly sunny. a chilly sea breeze that limits temperatures into the upper 50s to lower 60s. ocean water temperature is chilly. everything will change by tuesday. look at these numbers. we are turning warmer. most spots away from the coast going into the 70s and then we're going to call wednesday back to reality. this is where we should be this time of year. we shout be well into the 70s and 80s in our warmest spots that's where we will settle midweek before even warmer air set to arrive for the upcoming weekend next weekend.

clues after a man was shot inside dolores park. it happened at about 5:00 tonight. the victim is expected to survive. no arrests have been made. >> the president and vice president of san francisco's police commission expressed their support for chief bill scott today but two hours later, other commissioners said it's too soon to back the police chief. the conflicting messages come in the wake of a police raid on brian car modi. police hoped to find the source of leaked information about of jeff adachi. >> the school district failed to reach a deal in contract talks today. union leaders want teachers to receive a 10% raise. the strike is entering its second week. >> midwest is going through another night of dangerous weather. >> last night a tornado tore through the town of el reno, oklahoma. two people were killed and you can see there the homes and buildings that were destroyed. this is the same town hit by a similar tornado in 2013.

lost in a maui forest is out of the hospital. amanda eller was discovered friday after missing for 17 days. she was darched from the hospital last night. she spoke about the terrifying experience one she thought she would not survive. >> there were times of total fear and loss and wanting to give up andton did come down to life and death and i had to choose. and i chose life. i wasn't going to take the easy way out. >> the helicopter that found eller was paid for with some of the $85,000 raised in an online fund-raising campaignton pay for the search for her. >> another horse has died at southern california's santa anita park, the third in nine days and the 26th since late december. the latest horse to die suffered a leg injury during a race yesterday and la times" now reports the decision was made to euthanize the horse during surgery today. it closed at the end of march before changing many policies

>> highway crews need something more powerful than a bulldozer to clear a roadway following a rock slide in colorado. take a look. engineers plan to use explosives to remove two giant boulders that block a highway near telluride. that would go for about $2.5 million in san francisco. the department of transportation shared these images. one weighs more than 8 million pounds. both tumbled on to highway 145 on friday. the impact destroyed the roadway. nobody was hurt. >> those are not boulderers. they are mountains. they look like it. new video shows boaters rescuing a baby deer stuck in a lake in auburn, california, northeast of sacramento. you can see there the boaters get the fawn out of the water, then carry it to shore. there they let it go. they saw the baby walking back up to its mom who was also on shore while this was all nice. if you see a wild animal in
