department podium, special counsel robert mueller uttered his first public words in nearly >> reporter: for much of his n ten-minute statement, mueller stuck to the bottom line findings of his russia probe and made it abundantly clear that the investigation did not exonerate president trump. >> if we had had confidence that the president clearly did not commit a crime, we would have said so. >> reporter: mueller's statement contradicting attorney general william barr's conclusion that there wasn't enough evidence to determine trump obstructed justice. instead, the special counsel says he did not make a determination because charging the president with a crime was not an option. >> under long-standing department policy a president cannot be charged with a federal crime while he is in office. that is unconstitutional. >> reporter: as he exited mueller noted only congress can hold a president accountable.

>> the constitution requires a process other than the criminal justice system to formally accuse a sitting president of wrongdoing. >> reporter: democrats on the hill taking that as a cue. >> it falls to congress to respond to the crimes, lies and other wrongdoing of president trump. we will do so. >> reporter: but as mueller's words stir fresh calls from house democrats to move toward impeachment, house speaker nancy pelosi is holding firm. >> you don't bring an impeachment unless you have all of the facts. >> reporter: on the other side of the aisle, the president and move on. >> reporter: and mueller also offered a stern warning. he said that there were multiple attempts by the russians to interfere in the 2016 election. he says that deserves the attention of every american, maggie, kenneth, something not to overlook. >> mona, definitely, thank you so much. now, although the white house

says case closed to all of this, democrats and even some republicans insist mueller's statement was essentially an impeachment referral. >> but abc's devin dwyer says what congress does next remains unclear. >> reporter: he said it for posterity on camera on the record. he said if he had confidence that the president did not try to obstruct justice he would have said that. he didn't say that so that throws a log on the fire of talk, most of it political talk now about what democrats will do in response to the president's behavior. >> mueller said there's no need for him to testify in front of congress saying, quote, my report is my testimony. louisiana's democratic governor says he will sign a strict new abortion ban into law. it bans abortions once a fetal heartbeat is detected with no exceptions for rape or incest, but the new law would not take effect unless a similar law in mississippi is upheld by a federal appeals

court. we turn to that scary scene at a major league baseball game. a young girl was rushed to the hospital after she was hit by a foul ball. the cubs/astros game stopped for several minutes as stunned players and fans hope for the best. this morning a professional athlete in tears following a scary sight. >> you've got some guys that everybody is high on down there. >> that one went sizzling off into the stands. >> reporter: a foul ball hit by cubs player albert almora jr. striking a child. he was immediately overcome with emotion. >> just the way life is. as soon as i hit it, the first eyes i looked eyes on were her so that's what -- yeah. >> reporter: fans and players visibly shaken. almora then fell to his knees near the plate and was consoled by teammate jason heyward and manager joe maddon. >> i want him to understand, listen, this is not under your control. there is nothing you could have done about that differently so please don't blame yourself. >> reporter: a photo taken by the associated press shows the girl conscious and crying as she was taken away. almora completed the at bat after taking several minutes to

compose himself. >> the rest was kind of a blur. the rest of that at bat. i finally came to my senses r a. >> reporter: later almora went over to the section wherever the girl was sitting to find out her condition. he was seen speaking to a security guard when he became emotional crying on the guard's shoulder. >> when the half inning was over, i just couldn't hold it anymore. >> reporter: following a string of fan injuries in 2017, all major league baseball clubs were required to extend protective netting up the base lines. minute maid park in houston meets those requirements but witnesses say the little girl was sitting about ten feet past where the netting ends. such an emotional scene there. there's been no official word overnight on the girl's condition but was described as awake and alert. that's good news. new flood warnings are in effect this morning along the arkansas river nearly twice as high as it was just ten days ago. the national weather service warns that most river

communities will see significant or major flooding in the next seven to ten days. and right now every emergency with more rain threatening already swamped areas. a series of tornadoes and funnel clouds swept through parts of northeastern texas last night. most of the extensive property damage is northeast and south of dallas. and in central illinois, straight-line winds tore apart a small airport in vandalia overturning planes and damaging hangars. now, let's take a look at your thursday forecast. good morning. unfortunately another round of severe storms throughout columbus, pittsburgh, all the way over towards the d.c. and new york area. concern about flash flooding and hail. look for persistent showers that the ohio valley region and we're going to be concerned with flooding downpours thursday night with swollen streams and the possibility of six inches of rain falling throughout this region and that's not the only

leisurely swimming off a panama city beach in florida. apparently she's unaware that a shark was circling her. clearly the man shooting this had no way of warning her. finally people screaming on the beach got her attention. she hustled back safely to shore. president trump's criticism of the late senator john mccain is back in the spotlight. a new report claims the white house told the navy to keep the "uss john mccain" out of sight during trump's visit to japan. military officials are denying the ship's name was covered with a tarp and insist the name was not obscured. the president responded on twitter tweeting, i was not informed about anything having to do with the navy ship "uss john s. mccain" during my recent visit to japan. mccain's daughter megan responded to the report attacking the president saying he will, quote, always be threatened by the greatness of my dad's life. amazon has unveiled a new feature for echo devices aimed at boosting privacy protections. the echo software has been

suspect. ashton kutcher has taken the stand at the trial of an alleged serial killer in los angeles. kutcher testified about a night 18 years ago when he was supposed to take a young woman out. he went to her home but she didn't answer. the actor says the next morning he found out the woman had been found dead. the suspect is accused of being a sexual thrill killer responsible for a string of murders. well now to a tiny bundle of joy who entered the world weighing as much as an apple. a preemie believed to be the world's smallest surviving baby has been discharged from a san diego hospital now weighing 8.6 ounces when she was born in december. that's about half a pound. but now five months later, she's tipping the scale at a healthy 5 pounds. her parents who are keeping her name anonymous thought they would never get to take her home. >> they told my husband that he had about an hour with her and that she was going to pass away. but that hour turned into two

blocking. a backup in the cash lanes on the right. no other issues and no metering lights yet. that should happen closer to 5:20. thank you, alexis. the man accused of intentionally plowing his car into a crowd of pedestrians will be in court. >> isaiah peoples faces multiple counts of attempted murder, but today the judge could tack on more charges. abc 7 news reporter jobina fortson is live at the courthouse for us. good morning, jobina. >> reporter: good morning. the santa clara county district attorney's office is expected to decide by today whether r not to file hate crime charges against isaiah peoples. that would be on top of the eight attempted murder charges he is already facing. a question still remains as far as the motive of the crash that happened last month. prosecutors say peoples, who is an army veteran, was on his way to bible study when inteioll plod his corolla into a crowd of people and a cross walk at el camino real and sunnyvale avenue.
