the ghost ship warehouse fire, a fire that killed 36 people. good evening, thank you for joining us. >> i'm kristen sze. dan ashley. thank you so much. max harris and derrick almena face charges for converting the warehouse illegally into a shared living space. they say the rules were loose and everyone was pretty much on their n. moow from abc7 news reporter brinkley. >> reporter: the judge set up an overflow room so scores of families with an emotional connection to the case could hear the testimony. harris, facing 36 counts of involuntary manslaughter, wore a suit and calmly addressed the jury. prosecution witnesses had previously described harris as a leadership role, collecting rent and organizing events. harris said co-defendant derrick almena introduced him before the fire as a creative director. harris said it was a fun surprise to me. it sounded like a joke and we

were not close to be officious or bureaucratic. >> he was scrubbing toilets, stocking toilet paper. he's been in custody two years waiting to tell his story, waiting to connect with the jury, waiting to tell the truth. >> reporter: families of the victims were upset. >> if you're in court and you hear what people are saying inside court and they come out here, they lie about what people have said. they always twist what people have said. >> reporter: this afternoon harris described his escape from the warehouse the night of the fair, testifying he tried using a fire extinguisher that failed to do much. and called 911 as he ran out yelling, fire, fire. harris will be back on the stand in the morning. i also spoke with the attorney for the other ghost ship defendant derrick almena. he saysal men a will also take the stand and address the jury.

that's likely next week. in oakland, i'm leslie brinkley, abc7 news. >> leslie, thank you. in san francisco, a man is reported to be in critical condition after being pulled out of san francisco bay. abc7 news was along the embarcadero as crews coming back from a drill on the water tried to rescue the person near the bay bridge. a witness reported seeing a man in the bay at about 12:15 p.m. officials are not sure why the man was in the water. first responders were seen doing cpr and he was rushed to the hospital. >> three kids are spending their summer break in their van after their parents were duped out of $10,000. they thought they were renting a house in south san francisco, but three days after moving in, they were evicted by the actual landlord. abc7 news reporter luz pena is live with the story you'll see only on abc7 news. luz? >> reporter: dan, no savings means no back up plan. $10,000 is everything this family had saved. they tell me they are calling

friends and family members to use their bathroom, to shower. but when it comes to sleeping, their van is all they've got. this is the gonzalezes' new home, their van. this is where you sleep now. >> yeah. >> reporter: has it been hard? >> yeah. >> reporter: why? >> because it's uncomfortable. >> reporter: parked right outside the house where they lived for a total of three days, 11-year-old elizabeth remembers waking up to someone at the door telling her mom they had to move out. when that landlord came knocking on your door saying you guys needed to leave, what did you think? >> that we were going to be living in the streets. and scared. >> reporter: that landlord she describes is the legitimate landlord for the property. victor gonzalez had already paid someone else to move in and to change the locks. >> he asked for the first month, for the last month, and the deposit. at least like 10,000.

>> reporter: south san francisco police confirm the gonzalezes were duped. >> they found a cloned ad online that solicited that property that was for rent. it was legitimately for rent by a real estate company, however someone was falsely presenting themselves as the property owner. >> reporter: they say the gonzalezes are past the time they can get their money back. paying with cash or transferring money are major red flags along with cost. >> way below market rents. that's a red flag. another one is an absentee landlord that can't meet with you. >> reporter: we found the same property, a legitimate posting on zwlil oillow and showed it t victor gonzalez. are these the same pictures? >> yeah, it's the same. didn't change anything. >> reporter: the pictures are the same, but the price, over a thousand dollars more compared to the facebook market post where they initially saw the property. for how much? >> 3,500. >> reporter: this one is posted

for on zillow for 3,995. >> yeah. >> reporter: in the midst of uncertainty on a summer break she never thought would be spent in her van, elizabeth is staying positive. >> what doubt your brother? you're the oldest. >> it's going to be okay. we'll get through this. >> reporter: we did, in fact, contact that real estate company that is renting that property that they moved into and they still have not returned our calls. also the south san francisco police department is looking into this case. they are calling the person that contacted this family, but they still have had no luck arresting anyone at the moment. also this family, all they have right now is their van. they're driving around the neighborhood looking for the next place to park tonight and sleep there. live in san francisco, luz pena, abc7 news. >> luz, thank you. in the east bay, kaiser permanente has plans to reshape oakland's skyline. they plan to build the 28-story

building right in the heart of the city. kaiser already occupies 7 buildings in oakland. everything will be consolidated into the new space. while it may not be taller with 1.6 million square feet of space, it will be larger than san francisco's salesforce tower. >> at the end of the day we can think of no better place to stay than oakland, california. >> i could not be more delighted to announce that kaiser permanente is going to be the owner and landlord for oakland's biggest office building. >> the mayor adds, she did not offer any deals to entice kaiser to stay. construction is expected to start next year. >> and you'll remember uber once committed to revitalizing downtown oakland before changing its priorities. uber purchased the historic sears building in 2015, then sold the property at 20th street and broadway in 2017. uber has now agreed to lease two

downtown office buildings in sunnyvale along south matilda avenue. the spaces roughly total 2,091 square feet. enough for 19,000 workers. the buildings are within five blocks of the city's cal train station and an area poised to undergo major revitalization. well, palo alto got a lot of attention when city leaders voted last week as we reported to you, to phase out plastic bags by july of 2020. what might have a bigger impact is requiring the buildings to be dee constructed instead of demolished. dee construction is the selective dismantlement of building components specifically for reuse, repurposing, recycling and waste management. demolition obviously is where a site is cleared by the most expedient means, often an implosion. abc7 news reporter chris reyes explains how this is a big deal as part of our coverage of the environment and other issues

that help build a better bay area. >> reporter: we took a tour of the recycling in san jose to see why construction debris can be such a big environmental problem. >> behind us this is what demolition material looks like. >> probably a little bit of plastic, a lot more carpet, things that we can't necessarily recycle on the back end other than wood aggregated metals. we've seen everything from bathtub sinks, you name it, to porcelain. >> reporter: by july 2020, they will have to play by a different set of rules. along with a sweeping plastics ban as part of the zero waste initiative, palo alto city council will now require crews to dee construct rather than demolish sites. >> you can't just smash it and combine everything because then it's harder to either recycle it or salvage it. >> deconstruction is a manicured steps where you're going into a project and taking out pieces with much care and handle. >> reporter: they say it will affect dozens of projects in

got word the hump back believed to be ali was four miles due west of san francisco's waterfront and has not been seen since. >> the pride flag is flying the first time above california state capital in sacramento. governor newsome's office tweeted this flag high above the building's west side. the pride flag flies below three other flags, california flag, w.o.w. flag honoring missing veterans. it's the modern birth of the lbbt rights, stone wall in new york. >> the hayward, new haven and newark unified school districts partnered to provide free healthy lunches for kids this summer. one of five sites for what school district calls its seamless summer food program.

young people up to 18 years of age may participate. now, this particular program serves an average of 1,000 kids every day. >> it's important because a lot of children, some children don't have a meal in the summer, and this is a nutritious meal, free, no cost to the parents or to the camps. we absorb all the costs. >> many of the sites also offer free activities and services for participants. go to abc7news.com for a link to all bay area county libraries offering free summer lunch programs and the locations. washington square park in san francisco's north beach neighborhood is now closed for the next six months. it's for a big renovation project to replace the existing lawn, and subsoil to correct a drainage problem that wastes millions of gallons of water every year. park regulars say the closure will have a significant impact on the neighborhood. they enjoy it every day. they call the park the neighborhood's front yard. >> a golfer in san ramon scored some great video of a surprise

spectator just off the green. you hear those birds? well, they're calling at a young bobcat who apparently tried to escape them by climbing up that tree. it happened yesterday on the 18th hole at the bridges golf club. watch as the bobcat kitten climbs even higher, then decides to hop off into the brush. >> and off he goes. well, in consumer news, a major recall from amazon to tell you about. >> yeah, the first the retail giant is launching a new subscription service and 7 on your side's michael finney is here to tell you more. michael? >> it sounds a bit like amazon prime. it is a delivery subscription for a brick and mortar giant, walmart. it's quietly rolling out a subscription service for grocery deliveries. the service called delivery unlimited costs $98 a year. a normal walmart grocery delivery usually costs $10 each time they show up. if you have a discovery bank account, there will soon be more money in your pocket.

the banking giant has just dropped fees from its checking, savings, money market and cd accounts. it has also done away with fees for insufficient funds, excessive withdrawals, falling below minimum balances, and stop payment requests. this is unbelievable. financial technology companies have been doing away with fees to attract young consumers, but this is a first for a large bank. discover is an online bank and does not offer branch services. amazon is recalling nearly 400,000 amazon basics ceramic space heaters. i've got one right here. here's what it looks like. you may have seen these around your home or your neighborhood, a lot of them. amazon has received 30 reports of the devices overheating, burning and sparking. this is where i usually tell you, you would return the product for a full refund, but amazon is doing things differently. those who bought this from amazon will receive a letter telling them to cut the power

right now. a combination of higher clouds and a little bit of flog rolling over san francisco. our temperature, 64 in san francisco, 68 in oakland. 79 in san jose. and currently in morgan hill as well. look at this live picture from the mount tammal pius camera. you watch the fog rolling in, low 70s to santa rosa to napa, 86 in fairfield, 88 degrees currently in concord. and livermore 85 degrees. those temperatures up a few. we're going to continue with that trend as we head into tomorrow. but just in case tonight you're stepping out and you're walking the dog, it is really a pleasant day and a pleasant evening around the bay. look for temperatures in the low 70s later on this evening with a mix of fog and some sunshine. and the numbers will be dropping as we head into the wee hours of the morning, into the mid 60s before they bottom outs in the.50 and 60s tomorrow morning around 7:00 a.m. watching matt rinne layer 1600 feet deep as we look at sutro tower and a live look at doppler 7.

you can see the fog hugging the coast starting to advance. in the city era nefrm they have we are seeing strong thunderstorms developing. some may be accompanied by hail and gusty winds with heavy rain. it is very active right now in the mountains. not the case in san jose. bright sunshine over the shark tank right now. foggy areas during the overnight hours. mild to warm the next few days. it is going to be a little bit cooler on thursday. so minor ups and downs is what we're expecting. 12 hour planner for tomorrow. for most of you sunshine at noontime and there will be some fog lingering so mild to warm in the afternoon. mid 60s to the low 90s. here's a look at the hour by hour forecast. fog near the beaches and the bay as we head into your morning commute. watch out. it may be pretty thick along the bay and the coast line with a little bit of mist at times. by the afternoon, it pulls back to the coast line and just hangs around there as we expect around this time of year. temperatures in the morning 50s, 60s, outs the door tomorrow afternoon, it is going to be a

nice day. 64 at half moon bay. 67 in san francisco, that's where some of the fog will hang around. 81 in san rafael. 80s around santa rosa. 84 napa. mid 70s in oakland. as you head inland, this is where it will get warm. antioch, concord. 84 san jose, 88 degrees in san mateo. there is a heat advisory for lake and solano counties tomorrow from 9:00 a.m. to 10:00 p.m. so just a word of caution. take it easy out there and stay hydrated if you're going to be in those areas. accuweather seven-day forecast, mid 70s to low 90s so a wide range for your tuesday and wednesday. cooler thursday. notice you drop down to the 80s. 60s coast side and then those temperatures will bounce back just a few degrees on the first day of summer. friday morning is when the summer solstice occurs. we'll have the summer spread going into the weekend and we'll continue that pattern until monday when it turns cooler and breezier. i would call this just right. >> yes.

at least a million and a half people packed downtown toronto today to celebrate the raptors historic win. it is canada's first time as nba champions. kawhi leonard proudly held up the finals mvp trophy. drake was celebrating alongside the players. the raptors beat the golden state warriors 114-110 last thursday. to wrap it up, the warriors congratulated the raptors today by taking out this full-page ad in the toronto star today. it shows stefan curry hugging kyle lowry along with the message, the golden state warriors congratulate the toronto raptors on their historic achievement and bringing the 2019 nba championship to the city of toronto. jessica a moose, a resident with ties to the bay area, took the

photo and shared it with abc7 news. >> that is a really nice gesture. well, the san jose sharks just signed a deal to keep one of hockey's top players at his position in teal for the next 8 years. nhl.com reports defense man erik karlsson agreed to a contract worth 11 1/2 million dollars per year. that would make him the nhl's highest-paid defense man. carlson joined san jose in a trade before last season began. but injuries limited his time to 54 games out of 82. the sharks praised carlson's commitment to coming back from leg surgery, so he's here for the next eight seasons. >> this girl makes rock climbing history. >> how her dad and an elephant kept her going. >> we want to thank brian for this picture of capitola. share your
