after domestic abuse allegations involving his family resurfaced. now many are wondering why the white house didn't know about the allegations. one senator is even calling for an investigation. this morning, the trump administration under fire following the sudden resignation of the acting secretary of defense. >> they don't like to vet. all these assistant secretaries, assistant this, assistant that don't get vetted, and look what happens when you don't vet. >> reporter: patrick shanahan withdrew his name from consideration to be defense secretary just hours after a report revealed allegations of domestic violence within his family. "the washington post" reporting in 2010, police were called to the shanahan house to find him with a bloody nose. both he and his wife kimberly accused each other of physical violence. police arrested only shanahan's wife. he later dropped the charges. and in 2011 police were called after shanahan's then 17-year-old son will got into a violent altercation with his mother. the arrest report says will grabbed a baseball bat and struck his mother on the back of

her head. shanahan says, i believe my continuing in the confirmation process would force my three children to relive a traumatic chapter in our family's life and re-open wounds we have worked years to heal. the white house is now facing new questions about why the allegations didn't surface when shanahan was nominated as the pentagon's second in command and again before he was named acting defense secretary on january 1st. >> i feel that there was possibly a deliberate concealment here. i think there ought to be an investigation by the i.g. and the department of defense. >> reporter: president trump defended his administration's vetting process while praising shanahan. >> i had heard about it yesterday for the first time. we have a very good vetting process, and you take a look at our cabinet and our secretaries, very good, but we have a great vetting person. he is a terrific person, and it's a difficult time for pat, but he's going to take a little time off for family service and for working things out. >> reporter: meanwhile, just days after shanahan approved

sending 1,000 more troops to the middle east in response to rising tensions with iran, the pentagon now has four top positions vacant including secretary of defense, deputy defense secretary, air force secretary and chief management officer. >> this is a very difficult time with everything going on in iran and all the provocations and counteractions, and to have no secretary of defense at this time is appalling, and it shows the chaos in this administration. >> the white house has named a new nominee, the widely respected army secretary mark esper who will face senate confirmation. now to phoenix where a community meeting about the police response to an alleged shoplifting incident turned into a wider discussion about police brutality. the father involved in the incident in which police pointed their guns at his pregnant wife and young daughter said his family is lucky to be alive. the mayor says she's sick over the case, and many in the crowd

of more than 2,000 residents last night used the meeting to address other frustrations with the city's police department. >> something has to be done so that this never happens again. >> i am listening to what you say. at the end of the day, though, the proof is in the pudding. the proof is in what happens after this meeting. >> the police chief there was booed when she said real change starts with the whole community, not just police. the mayor announced that nearly all officers will wear body cameras by the end of the summer. california's largest utility has agreed to pay $1 billion to local governments for its role in the recent historic wildfires. equipment belonging to pacific gas and electric is blamed for starting many of the fires. the money will help rebuild the town of paradise destroyed by the so-called camp fire, which killed 85 people. this morning 48 million americans from the plains to the mid-atlantic are bracing for possible flooding.

a reputed mobster was killed while waiting in line at a mcdonald's drive-through last fall. now his son is under arrest and facing murder conspiracy charges. anthony zottola is accused of providing information about his father's location before the hit. no motive has been given. more americans are saying that they fell seriously ill while visiting the dominican republic. the latest a bride from virginia who says she fell unconscious during her honeymoon at a resort in punta cana and was told she had a blood infection. she's waiting for test results to determine the cause. meanwhile, another woman claims her flight home from the resort was filled with people who had become sick. at least eight americans have died in the dominican republic this year, but the state department denies that there's been any increase in the number of american deaths. a fifth grader from cleveland will soon see her anti-bullying design on cars all over ohio. 11-year-old brooke balser is the winner of a statewide license plate design contest aimed at stopping bullies. officials say her colorful bully-free car design is a

we're back with this airline passenger under arrest. people say he was so drunk and out of control on a flight to dallas, other passengers zip tied and duct taped his hands. >> the flight from pittsburgh was diverted to oklahoma city where that passenger allegedly threatened police as he was arrested. we turn now to the navy s.e.a.l. on trial for murder and war crimes. >> edward gallagher is accused of killing a teenager who was

under his care in iraq, but the defense claims the case is built on lies. this morning, a decorated s.e.a.l. under trial for war crimes. chief edward gallagher is accused of stabbing and killing a wounded isis fighter. investigators say he celebrated after sending a picture of the body to his platoon member with a caption that read, i got him with my hunting knife. during his opening statements gallagher's lawyer called the text an attempt at dark human telling the jury, was the photo in poor taste? probably. was the photo evidence of murder? no. gallagher's wife says her husband is innocent. >> he should be retiring next month, and yet he's been entrapped in this nightmare. >> reporter: gallagher who served eight tours of duty and earned two bronze stars also faces two attempted murder charges in the shooting of two civilians including an elderly man and a young girl in mosul. prosecutors say he threatened to kill navy s.e.a.l. members who reported him. the politically charged case caught the attention of

president trump, who voiced his support for gallagher on twitter, and even before the opening statements, the case was shrouded in controversy. a judge removed the lead prosecutor for tracking emails between gallagher and his defense team. >> the defense plan for the next days and weeks is to annihilate the government's case to show that these witnesses are lying, to show that these charges have never been brought -- should never have been brought. >> eight navy s.e.a.l.s are expected to testify. the defense claims gallagher's subordinates made up the allegations because they were angry he was too tough on them. the trial is expected to take about three weeks. a mother of three who had her fallopian tubes removed just became a mother of four. elizabeth kough was shocked when she found out she was having another baby four years after undergoing the procedure that was supposed to prevent her from getting pregnant again. she had a smooth pregnancy and gave birth to a healthy baby boy named benjamin despite those odds. >> my doctor said that it was very low, it was as close to 0% as you could get. it was one of the most effective birth controls, if not the most

due to police activity. we have calls in to find out more information. we also have an abc 7 news crew headed to the scene and will have a live report in our 5:00 hour. this is the same area where a cab driver was discovered dead on monday night. his body was found dumped by a sheriff's deputy. he's identified as abdul melk. he leaves behind a wife and a daughter. new this morning, laundry may be to blame for a fire that forced a san jose family out of their home. firefighters arrived to see smoke pouring from the garage after 11:00 last night. two adults and two children evacuated the house when they spotted smoke. firefighters say the family was doing laundry at the time. investigators think an electrical issue may have sparked that fire. chp investigating another freeway shooting on interstate 60 in san jose. >> this latest incident happened

after 8:30 on southbound 680 near king road. police are saying the shots came in a vehicle traveling alongside it. they say there are conflicting reports about what kind of vehicle it was. investigators say a bullet went through the left rear window and out the right front window. nobody was hit, but a 12-year-old girl suffered cuts from shattered glass. that incident followed monday's deadly shooting on the same stretch of freeway. this is video taken after chp officers found a wounded man inside his car on northbound 680 near landis avenue. the victim has been identified as 30-year-old matthew rios of milpitas. a brush far forced to evacuate a movie theater last night. the flames scorched five acres bere
