she hired security to watch her house at night. she was that afraid of anything happening. i spoke with that security officer. what he said he saw watching overnight coming up at 5:00. >> thank you so much. >> in the east bay, livermore police searching for man accused of killing a teenager after a verbal altercation. the suspect is 21-year-old jorge tellez. they served a warrant on his home this morning but he wasn't there accused of shooting an killing a 16-year-old boy on stanley boulevard last night. a memorial to the victim was set up there. officials have not released the victim's identity. he was a student at livermore high school. the san francisco man shot by a snow pla county sheriff's deputy on the fourth of july is set to be assigned tomorrow from the hospital. friends say batai coffee took lsd and ppl who tried to keep him from leaving a bow diego bay home and accused of stabbing a security

don't care about or respect them. >> reporter: still, white doesn't think it's clear how he will break out from the pack of other presidential hopefuls. >> tom steyer has a couple things going for him. he has plenty of money to spend as he's willing to put his own money into politics and his push to impeach donald trump he has gotten a lot of folks to sign on that. he has a ready made donor database. >> reporter: steyer has grown frustrated. we expect to hear more about that throughout his campaign. jobina fortson, abc7 news. >> meantime, former two-time presidential candidate ross pero lost his bat with leukemia. the 89-year-old died early this morning at his home in dallas. the texas billionaire is best known for running one of the most successful third party campaigns in the past century. this is video from 1992. he won 1% of the vote that year.

he was less successful during his second bid getting only% of the vote. >> aebate over the minimum wage is unfolding tonight in emeryville. >> the city has their highest minimum wage in the country as of july 1st, it became $16.30 an hour. that's more than san francisco at $15 an hour. and significantly more than the state minimum wage. >> state business owners are asking the city for relief. tonight the city council may decide if they should be exempt. >> news reporter liz kreutz joins us with more on this tonight. liz? >> reporter: hi. as you said, ex-ry vi's minimum wage went up to $16.30, the highest in the country on july 1st. because of an anticipate that passed earlier this year, businesses with up to 55 employees have been exempt from paying those wages. minimum wage advocates are coming here tonight to this meeting asking the city saying

it's necessary for their survival. at black diamond cafe, co-owner dave pays his employee the minimum wage of $15 an hour and hoping it stays that way. >> we like to have certain number of minimum wage but going beyond $16 an hour is going to hurt a lot of small businesses. >> he and owners of other businesses like rudy's can't fail cafe are currently expimt from paying the minimum wage, the highest in the country. they say if the city decided to get rid of that exemption at the meeting tuesday, their businesses may fail. >> i think we're going to lose business for sure. >> reporter: at the beginning of the year, black diamond cafe had eight employees, six full-time and two part-time. each worker earned $15 per hour for a total weekly payroll of about $3,825. with a $16.30 minimum wage, that weekly cost would increase to $4,000156 per week.

an additional $331.50. black diamond's owners could not afford nap so the two part-time workers lost their jobs. >> it's going to we had cut also, we might have price. >> while small business owners are worried about the bottom line, employees argue they need a living wage. >> even with a minimum wage of $15, in the bay area that's not liveable be? the president of the restaurant opportunity centers unitied which helps restaurants across the country find alternative ways to cut costs. >> let's talk with the city council about tax incentives for employers. not about cutting workers' wages. >> tonight at this city council meeting it, the city will decide the fate of the exemption for small businesses and decide to repeal it so everyone pays $16.30 regardless of business size or decide it's its up to voters to decide and put it up for a vote in the next election.

>> we are through through a study following the north bay fires. about 150 members of the san francisco fire department took part. they wanted to see what kind of toxins might have gotten into their blood when they responded to the tubbs fire in santa rosa. preliminary results show two things. elevated levels of mercury and a chemical found in their gear and the foam they use to fight flames. the fire chef says this brings into focus a much bigger trend that they're see. firefighters die with their boots off. she says 54% of recent firefighter deaths have been attributed to cancer and this is a call to do more. >> but we have a responsibility

in the east bay, a movie theater opened for more than 20 years has shut down. abc7 was at the amc class in deer valley 16 in antioch. it showed its last movie sunday. amc gave no explanation for the closure other than a simple sign saying there are no shows playing. the property owner just signed a letter of intent for a multimillion dollar veneration. amc's notes the closure suggesting moviegoers head to their newest location in brentwooded. >> new details about the kids' song that can be annoying or charming. ♪ baby shark that's right. the baby shark song is coming to

now news to build a better bay area from abc7. >> here are the stories making headlines at 4:30. police are searching for this man jorge tellez accused of shooting and killing a 16-year-old boy outside of the taco bell on stanley boulevard last night. police say the two were arguing when tellez shot the victim. he was a student at livermore high school. >> ghost ship founder derick almena was on the stands together at his trial. he said 2 police officers and 13 firings visited and inspected the warehouse in the months leading up to the deadly fire. the minimum wage in emeryville is now the highest in the country. $16.30 an hour. but some small business owners say it's just too high. some businesses are currently exempt but the city council is meeting tonight and may decide to get rid of the exemption. >> today the senate transportation committee looked at a bill to increase the rebate

future of obamacare back to federal court. >> over half of of 65 is holdin their breath waiting for a decision in the fifth circuit. >> health care law is in front of three u.s. fifth circuit court of appeals judges in new orleans. a coalition of democratic led states backed by the house of representativeses are challenging a lower court's ruling to strike the entire law down. at the center of the debate is the affordable care act's individual mandate that requires all-americans to purchase health insurance or pay a penalty. a texas judge deemed the mandate up constitutional. if uphead, tens of millions of americans would lose their health care, protections for people with pre-existing conditions would be eliminated as for coverage for young adults who stayed on their parents plans. president trump vowed to replace obamacare with a less expensive plan. mitch mcconnell says he's not in support of repealing the law but

livermore is joining san franciscos in banning e cigarettes. >> livermore is about to become the first city in the tri-valley to do that, but at least one shop owner says the ban may drive him right out of business. >> here's news reporter amy hollyfield. >> reporter: you are looking at all of the flavored tobacco devices confiscated last year at a livermore high school. outraged and frustrated parents took the issue to the city council. and last night, got the outcome they wanted. a city-wide ban on the sale of flavored tobacco products and e cigarettes. >> we're thrilled to see livermore take a stand against

big tobacco. this is something that's an epidem mick. >> reporter: christie wong cofounded flavors hook kids after their teenaged kids told stories of walking through clouds osmeto prevent vaping. she believes the ban will have a major impact. >> income 36 jurisdictions in california where they have used local policy to fight this it has been extremely effective in bringing down youth rates of purchase. >> this is not fair. >> reporter: but this man is worried. this is going to put him out of business. he just bought this smoke shop in october. and says this will wipe out most of his business. >> in my store it's about 80% or 90% of the flavor and the electronic. but they're blaming the kids buying from the store but i don't think so. because we always check their i.d.s. >> reporter: he's not alone. the city of livermore says this impact 71 tobacco retailers.
