from washington. >> reporter: yeah, so the source goes back 11 years when jeffrey epstein struck a deal to serve less than two years in prison and avoid a possible life sentence in an investigation involving 40 teenage girls and this deal was orchestrated by a now prominent member of the trump administration. against labor secretary alexander acosta, president trump standing by his secretary for now. >> you're talking about a long time ago and again it was a decision made i think not by him but by a lot of people. >> reporter: top democrats and multiple presidential candidates calling for acosta to resign in the wake of indictment of disgraced financier jeffrey epstein charged with sex trafficking girls as young as 14. some of the new allegations also part of an old investigation into epstein for more than a decade ago where acosta served as the prosecutor in south florida. epstein struck a deal with acosta registering as a sex offender and serving just 13 months in county jail. one of epstein's alleged victims saying she was kept in the dark as the deal was reached.

>> they were already signing the secret plea agreement with him, you know, and keeping -- keeping me out of the loop. >> reporter: secretary acosta responding to critics tweeting, the crimes committed by epstein are horrific and i am pleased that new york prosecutors are moving forward with a case based on new evidence, but a federal judge has determined acosta and his prosecutors broke the law by not informing the victims about the terms of the prior deal. >> i am calling on secretary acosta to resign. >> reporter: president trump acknowledges he knew epstein but the trump organization saying epstein was banned from mar-a-lago years ago. >> i had a falling out with him a long time ago. i don't think i've spoken to him for 15 years. i wasn't a fan. >> reporter: well, president trump says the white house is looking into secretary acosta's role in prosecuting epstein but president trump also noted that under secretary acosta the economy has done very well. janai, kenneth. >> trevor, thank you for joining us this morning.

the battle over obamacare is playing out in a federal appeals court with health benefits for millions of americans on the line including those with pre-existing conditions. a three-judge panel heard arguments tuesday on whether a texas judge was right to strike down the affordable care act. two of the judges seem skeptical that the law's individual insurance mandate is constitutional. a ruling is expected later this summer. now to the growing calls for a hate crime investigation in arizona. police say a white man killed a black teenager because he felt threatened by his rap music. the murder has sparked outrage, even getting the attention of a presidential candidate. >> he was really god's gift. >> reporter: this morning a family is grieving the loss of a 17-year-old in arizona. >> he was out there living his life going to work, going to school, making sure he was getting everything taken care of. he didn't have just one job. he had two jobs. and was trying to get a third job. >> reporter: police say elijah al-amin was at a soda machine when michael adams walked up behind him and stabbed him to death.

according to court records adams told investigators he heard elijah listening to rap music in the parking lot saying the music made him feel unsafe and he needed to protect himself and the community from the victim. >> supposedly what he said is that his music had reminded him of others who attacked him. >> reporter: this morning civil rights group are calling for hate crime charges against adams with more than 100,000 tweets containing justice for elijah including one from presidential candidate writing rip, elijah. >> my name is michael paul adams. >> reporter: records show adams was released from prison just two days before the murder after serving a 13-month sentence for aggravated assault. his lawyer says the arizona department of corrections should have given adams access to mental health services after his release. >> this is a disabled person and he's been released into the world and left to fend for himself. and two days later this is where we are. >> reporter: in response, the department of corrections says

adams was given information about where to find help for mental illnesses but the department says it had no legal authority over him after he was released. as for elijah's family, they say mental illness is no excuse. they say hate motivated the murder. >> so the fact that someone is trying to claim that that's the reason why my brother's life was taken, it's just an excuse and it doesn't help. it doesn't -- it doesn't lend any type of consolement like it doesn't help at all. >> there is no hate crime statute in arizona but a judge can impose a tougher sentence if it's determined that a hate crime was committed. delta air lines is trying to figure out why an engine failed during a flight from atlanta to baltimore. this is what passengers saw out the window. a piece of the engine still bouncing around inside. the captain told everyone they had lost an engine. flight attendants starting preparing passengers for an emergency landing even telling them to loosen their collars and take off their glasses.

>> after we heard the boom, we just saw all this smoke come up into the cabin, and that's when we really started freaking out. >> i texted my mom, i love you. i texted my dad, i love you. >> the plane was diverted to raleigh durham and landed safely. the engine will now be taken to atlanta for the investigation. the death of an american scientist in greece remains a mystery this morning. suzanne eaton's body was found inside a world war ii bunker on the island of crete. her family thinks she may have become overheated while running or perhaps she fell. an autopsy will be performed. homicide detectives will lead the investigation. back here in the u.s., new flooding concerns in the heartland. this is the scene around kearney, nebraska, after nine inches of rain in some areas. floodwater was four feet deep forcing some evacuations by boat. meanwhile parts of the south are now bracing for a possible tropical storm that could dump more than ten inches of rain. let's take a look now at your wednesday forecast. good morning.

general claims the hotel chain's advertised rates were often misleading because they didn't include the fees that guests had to pay when booking rooms online. those charges are sometimes called destination fees and can be as high as $95. the suit claims nearly 200 hotels charged the fees. the company is not commenting. a new plan to offer free college tuition this morning. the university of texas says it will offer full scholarships to some students from low income households. the school has set up an endowment that will fund scripps for instate students for families who earn $65,000 or less a year. about 20% of students are expected to automatically get them beginning next fall. another popular show leaving netflix and could signal a huge shift in the streaming video industry. at&t which owns warner media including hbo has pulled "friends" off netflix so it can run the show on its own streaming service which will be called hbo max and follows the recent announcement that nbc

is pulling "the office" off netflix for the same reason it launches a new streaming service. wiegand fiercely fighting back against reports the indiana toddler slipped through her grandfather's arms while playing near a window on this royal caribbean cruise ship. >> this was preventible. >> reporter: the 1 1/2-year-old died sunday afternoon after plummeting 150 feet from deck 11 of the "freedom of the seas" docked in san juan, puerto rico. chloe's grandfather claiming he walked her to the glass window bank near the children's water park area seen in this video from a cruise earlier this year. >> there's a wood railing right there. he puts her up on there thinking she will bang on the glass and it's going to be great and she goes to bang on the glass. the next thing he knows she's gone. >> reporter: chloe's grandfather had no idea this window was open. according to her family, chloe loved to look through glass, face against the boards at her big brother's hockey game. the puerto rican police commissioner saying investigators are interviewing

happens sometime after 10:00 police say when they arrived on scene they found a 22-year-old male victim in the middle of the road suffering from a gunshot wound and the man died on the scene. they say there are no other victims at this time and believe this was a targeted shooting. police are not releasing the victim's identity pending notification of the family and they are asking anybody with information to contact san pablo police. abc7 news. we have developing news in san francisco bay view neighborhood. police are investigating a shooting that left one man dead an another man wounded. this happened just after 11:00 last night on jennings street between van dyke and wallace avenue. officers have a crime scene near at yosemite and keith street. it is unclear if the two crime scenes are related and we're
