legion of honor. >> vic lee has the latest on this investigation. vic? >> reporter: ama, dan, the tourist whom police have yet to identify is here at zuckerberg's san francisco general hospital with serious injuries. meantime, police are still looking for the burglars who did this to him. >> it's a risk parking here. definitely. >> reporter: visitors to the legion of honor were shocked at the news. >> that makes me sick. that's really hard to hear. >> reporter: a tourist run down by burglars in their vehicle yesterday in the late afternoon. it happened when he began snapping pictures of them as they broke into his parked rental car. >> in doing so, he was interrupted by the suspect vehicle which struck and ran into the victim. >> reporter: here's what we know about the victim. he's reportedly from oregon. a father in his 40s visiting with his teenage son. he was rushed to zuckerberg san francisco general with life-threatening injuries. >> there's so much history here and it's just beautiful.

>> reporter: today was another normal day at the leenl of honor. the parking lot littered with shattered cou in more than a dozen spaces. lola wood thought she was lucky finding a parking place until she looked down. >> this is probably why this parking spot is open. they saw the glass on the ground. >> reporter: then she realized something. >> and there's not even any police around. >> reporter: william hamilton came to see the rubens in the museum. he had a suggestion. >> i'd like to see this organization put cameras in those trees over there. >> reporter: the museum does have cameras on the rooftops. we don't know if they captured what happened. there are signs on lamp posts around the parking lot but they're small and easy to miss. as for police presence, we saw officers parka empty police van here is a possible deterrent. >> the city as a whole has seen a dip in the auto burglaries. we have been conductingoperatns

to your vehicle. joining me is officer art mon teal with the chp to talk about ways suc keep yourself safe from a break-in like this. look inside the car right now. what are some things you would recommend people do to prevent a break in. >> when a crook is walking by, they look for something of value. lock your vehicle. the other thing would be make sure that nothing of value is left visible. >> even though we broke the side windows you say drivers should be aware of the back seat, as well. >> basically, even though you put stuff in the trunk thinking it's safe, then once they break the window, they have access to being able to open the trunk. so you could always lock your glove compartment. a lot of cars will have the l over there. or just don't leave anything in the vehicle. >> some drivers also feel compelled to write a sign that says there's nothing in their . oakland police tell me thieves will sometimes take a device,

broken glass is scattered over the parking lot at the legion of honor in san francisco where car break-in suspects are accused of running down a man taking pictures of them yesterday. the tourist reportedly from oregon suffered life-threatening injuries. >> derek al mane was back on the stand today. his attorney accused a prosecutor of character assassination after they brought up an incident with al mane's son when police respond to a party at the warehouse. news reporter laura anthony will have the latest at 5:00. flooding in concerny, nebraska. some areas saw nine inches of rain. this system is heading east and could produce severe storms in the great lakes region sneenl there are calls for alex acosta to resign over a lenient plea deal he brokered for jeffrey epstein years ago. he spoke about it today. abc news reporter mona cosart abdi is live with the new

developments. >> reporter: today alex acosta noted on several occasions times have changed since he negotiated that epstein deal and at the time, he was just trying to do the best thing for those victims. >> in a press conference wednesday, labor secretary alex an kostas defended a controversial plea deal he negotiated with wealthy financier jeffrey epstein. >> facts are important and facts are being overlooked. >> reporter: stating that the florida case started at the state level and blamed the state's prosecutor's office for initially negotiating an agreement that would have let epstein walk. >> without the work of our prosecutors he would have gotten away. >> reporter: the deal he helped broker las come under new scrutiny after epstein was indicted this week by federal prosecutors in new york. according to the indictment did, epstein lured teenage girls to his mansions in manhattan and palm beach, florida, allegedly sexually assaulting them in massage rooms. some of the allegations in the new are part of the investigation acosta oversaw. >> a good prosecutor will tell
