>> i'm am a daetz. t it's said the sfp broke state and federal law. >> it shows police are trying to figure out how i got this police report on the death. in the court document an sfpd investigator lists i-team reports tweet by tweet story by story on the death of jeff adacih in february at this north beach apartment. they wanted to know how i got the police report that included photographs of the scene and concluded dan noise was offered the death investigation report by brian carmody that obtained the report from a san francisco police officer. carmody is a freelance reporter that sells information. based on that affidavit, the judge approved a warrant for carmody's phone records and another judge approved a raid on his home and office. david snider is executive director of the first amendment

collision. >> i think the police department violated the california constitution and california law. i think they violated federal law in executing these search warrants. this is a huge deal. >> the investigator did not tell the judge he's a journalist and had a press pass for 16 years. they listed him as freelance videographer, communications manager, uso bay area and wrote he is not currently employed by any of the news organizations that obtained the death investigation report. >> i would say it's absolutely clear that the department should have known that brian carmod kbrrks is a journalist and stretches credibility they had no idea. >> bill scott declined my request for an interview today but i questioned him at a news conference in may. how can you defend a raid on a journalist's home and office? >> i'm not -- i'm not here to try to defend it because there is a lot of information that we have to really look at and refle

reflect. >> his staff says the police department is reviewing protocols on members of the news media and san francisco department of police accountability is investigating what p happened. in san francisco today, scott said we must take steps to make sure this doesn't happen again. >> the suppress a corner stone of our democracy and the last thing we need is police raids on journalists so that they can't even protect our sources. >> the judge ordered six lines blacked out on the affidavit for a confidential informant. it appears to be someone that identified carmody has having that police report but under the court order, all of the information is not to be use in further action because a search warrant on a journalist is improper. >> out of curiosity, your name is all over this document. >> yeah. >> how did it make you feel seeing how -- i don't know if the word obsessed is correct but they clearly wanted to find out how you got your information. >> i kind of expected it.

i expected to be questioned by the police at some point but it looks like they realize i'm a real reporter and am protected under the california shield law so they couldn't really come after me. but they did go after brian carmody. >> what's next? >> four more hearings on four more search warrants, the one on his home and office so we should have more documentation like this coming out. >> interesting. >> continue to follow it all. thank you, dan. new at 6:00, berkeley police told us a woman was raped as she walked her dog near people's park this morning. it happened a dwight way. police say a man went up to a dog walker around 7:30 claimed he had a gun, forced her into a secluded area and took her cell phone and that's when the sexual assault happened. police have arrested a suspect, his name is demetrious johnson 36 years old. investigators say the victim did not know the suspect. he was a stranger. new at 6:00 a san jose man is charged with the murder of his mother. police say 35-year-old ryan

gar garner assaulted his 57-year-old mother at their home last thursday and dropped her off at regional medical center and left. the woman's enjuinjuries were n survivable and died after being on life support for four days. >> new at 6:00 a long-time member of the san francisco police department is moving across the bay and will be hayward's next police chief. tony toney chaplin will start in september. chaplain tells abc 7 news quote it's a great opportunity but leaving is bittersweet to me because i've worked with great people here. with an update out of oakland on the search for a potentially armed suspect near 580 in the intersection of keller avenue. police say they have arrested two people and have found guns, as well. both suspects are wanted in connection with the criminal investigation. one of the most clicked stories on our website abc7news.com is a tragic one. a couple celebrating their wedding anniversary in san

francisco over the weekend hit by a speeding car. the husband died, the wife still hospitalized. the driver has been arrested on misdemeanor charges. only abc 7 news has video of the crash that shows just how fast the driver was going. we've slowed it down so you can better see what happened and froze the video so you don't actually see the impact as the couple got hit. abc 7 news reporter lyanne melendez following up on the story joining us live. many say not enough is being done to protect pedestrians in these cases. >> reporter: that's right. they are saying that but take a look at this very busy intersection. you have the crosswalk very visible here. you have these markers surrounding me. to my right, let's be the bicycle lane all meant to protect me and the bike psyccyc and advocates say more of all of this is needed around the city.

>> lucy morales. nancy ing. >> reporter: today in front of san francisco city hall a moment of silence for those pedestrians and bicyclists who have died this year after being hit on city streets. the most recent one this past sunday. this video seen only on abc 7 shows the driver of a black tesla speeding and going through a red light before hitting a couple in the crosswalk. while this chart put out by sfgov shows the number of people killed dropped over the years, city officials say more is needed. >> we know, these are not numbers. we have to constantly be reminding people that these are people. >> reporter: the city spent millions on engineering projects meant to keep pedestrians safe. at this intersection in laguna street, cars are now not allowed to make a right hand turn on red after a pedestrian died at that intersection but san francisco is criticized for being being

reaction. a few month ace go police were stopping people on 19th avenue caught texting while driving. today, there is no enforcement in that location. and last may citations were given out to uber and lyft drivers that double parked at a busy intersection to pick up passengers. if you go today, they are no longer there. the driver of the car that hit the two pedestrians was charged with involuntary vehicle slaughter and running a red light. those charged usually face minimal penalties. state senator scott weaner says that, too, has to change. >> california state law honestly when you read it, it's as if people who aren't driving cars barely sat amento that would force caltrans to make pedestrian

weekend. they say you unlock a vehicle with your cell phone, the keys are then locked inside the vehicle, no need to meet the owner. in fact, you can pick up the cars along a street or in a parking lot anywhere, any time. traditional car rental companies only rent to drivers 25 and older. get around says they rent to drivers 19 and older unless it's a specialty car. according to get around, a tesla model 3 like the one in the pedestrian accident is not a specialty car. thus the 21-year-old driver had access to it. benson says he had plenty of problems. >> it seems about every three months something bad happens. i had one young woman who rented cannabis. d returned it without >> reporter: last week. >> i had a gentleman rent my car on a tuesday, and get arrested

let's get back to oakland and a abc 7 news luz pena there live for us. what's the town doing about this? >> reporter: they say they are doing as much as they can and the mayor of oakland said she's not shocked by the numbers and tell me their goal is to have a total of 700 beds by the end of this year. let's keep in mind more than 4,000 homeless in this city. >> oakland is answerng this crisis with a sense of urgency and invasion. >> reporter: a crisis that one of more than 4,000 homeless living in oakland says it's taking too long to fix. >> our waiting list to be on a waiting list. i'm number 115. >> reporter: she says she checks every week to see if she's up for permanent using. >> srt of people like living in them tents. >> reporter: data collected by officials confirmed that oakland's homeless population

per capita surpasses anywhere in the bay area including san francisco. oakla oakland's homeless population rose 47% between 2017 and 2019. >> we have the triple whammy of income inequality, an inadequate supply of housing, insufficient protections against displacement and a mental health system that is not working. >> reporter: last month oakland opened the first rv parking site and announced two more under development. it also has four sites the city calls cabin communities offering beds in backyard sheds to 118 transitioning from homelessness. >> we need more. in the county, we need 6,000 more shelter beds. >> reporter: the mayor says the homelessness crisis is a county-wide issue. >> if other communities are not going to build housing and affordable housing, do not think it's appropriate to site homelessness facilities in their

then and now. new at 6:00 one of the two stolen border puppies has been found. they say someone saw a woman walking the puppy in richmond. the person asked the woman about it, the woman left the dog and ran. police didn't find that woman or the other puppy unfortunately. the two dogs were stolen earlier this month. a castro valley woman took out her phone and started recording after she was accused of shoplifting at a kohl's store. she believes she was racially profiled. liz is live with the story, liz? >> reporter: yeah, ama, imagine coming to kohl's, trying to get a shirt for your daughter's

birthday party to be aggressively approached by two large men in this parkin lot who did not identify themselves and accuse you of shoplifting. that's what happened this to woman who thanks to this was able to record it. >> so please explain to me what i did. >> reporter: owe lyolanda began recording this video when she was approached by two security guards and accused of shoplifting. >> i come here and shop all the time. i spend a lot of money here, but because i look like a broke mom with a backpack, you target me. >> reporter: the nurse and mother of four said she purchased one shirt and left the other six items she tried on in the dressing room. >> they kept refusing to check my bag. i didn't take anything and kept insisting to check my bag. >> reporter: she tried to show them herself. >> let me do it. okay? a wallet, diapers, clothes, sunscreen. you see that? there you go. >> reporter: yolanda believes she was racially profiled.

she recorded the incident for her own safety. >> i knew from that moment that i needed to protect myself because i knew that it was going to be his word against mine and i was afraid. >> reporter: in a statement, kohl's told abc 7 the store prides itself on the customer service and creating a welcoming experience for all customers and they take allegations of this nature very seriously. they go on to say they apologized to yolanda directly for her experience and working on a resolution. >> i was humiliated and embarrassed and sick to my stomach. >> i never ever thought this kind of stuff would happen. everybody should feel like they can walk into a fitting room and leave their belongings behind without being accused of stealing. i'm just a normal mom trying to go to the store and shop and now i'm feeling like i need to present myself a certain way, look a certain way, can't carry a certain item or bag because

i'm being judged. >> reporter: now eventually she was released and went straight to the dressing room where she found the six items she tried on sitting right there. she says she's received no apology from the security guards and only after she posted on facebook did she get a response from kohl's. live in san leandro, liz. >> what is she saying about that response from kohl's? is she satisfied? >> reporter: no, she is not at all satisfied by that. she says she plans to take legal action at this point and says after she posted this video on facebook, she's received several responses from other people saying they had similar experiences, some even at this kohl's. so she says it's part of a larger issue that needs to be addressed. >> liz, thank you so much: governor new sosom announce new leadership for the dmv. steven gordon will be the new director when newsom took office, he announced the

creation of a strike team and the report came out today making recommendations and outlining the progress already made including a decrease in wait times. >> last august you would have been spending 58 minutes more waiting for a transaction than you would today. >> the long wait times had a lot to do with the complications caused by those real i.d.s. they will be required by october 2020 for air travel unless you have a passport with you. all dmv offices will close until 1:00 p.m. tomorrow so employees can train to process real i.d. transactions and improve customer service. all right. we are keeping close watch on the temperatures around here. >> which continue to rise drew too . >> they are. we'll see a warmer day than today but inland gets down right hot. live doppler 7 showing you the fog footprint banked up along the coastline of san francisco and half moon bay but elsewhere, a lot of sunshine.

outside the tower showing you just soaked in sun not only in san francisco but east bay and oakland hills seeing plentiful sunshine and baby blue skies. the highlights what we are tracking over the next couple days, starting tomorrow hottest spots close to 100 degrees by tomorrow afternoon away from the coast. however, that fog is still going to be there along the coastline so we'll stay comfortable and cool close to the ocean water. tomorrow afternoon we do expect but a 40 degree temperature range from the costa our inland communities as those highs really range from the 60s to close to triple digit heat however the weekend is trending warmer for everybody. looks like we'll lose the fog and that means our warmup will be felt along the coastline by saturday and sunday. right now 79 and 68 in oakland and drop to 64 in the city. 91 brentwood, san jose right now not too bad. comfortable at 75. overnight tonight here are the numbers. mid 50s to low 60s with limited fog. plenty of stores fars for a lot.

caltrain unveiled the long range vision for improvement and service for the next 20 years. 65,000 people ride the train every day. the goal is to triple that and provide service to 180,000 people by increasing the trains from five to eight and running express baby bullet trains every 15 minutes. it would need an extra 90 million dollar a year in subsides per year for the

don't worry about that. michael finney is here to clarify any confusion. >> a lot of confusion. people are contacting us all day long. the letter is tied to pg&e's bankruptcy. more than 6 million customers getting this letter and many are asking does this apply tony received two letters at home and his office where he serves as a consumer group that advocates for consumer's energy needs. his office received numerous inquiries from pg&e customers mystified by what the letter is all about. >> we've had dozens of people call the office and people who happen to know me ask me directly what does this notice mean? >> reporter: tony points out the letter doesn't actually come from the utility but the company's bankruptcy attorneys and reads more like a legal

documented because that's what it really is. inn mcdonald is a bankruptcy attorney not affiliated with pg&e. >> it's a confusing letter when you first get it. >> reporter: the bottom line, if you have a claim against pg&e, you have to file before the deadline of october 21st. anything submitted after that likely won't get paid. so who needs to worry about this letter? well, let's start with who doesn't need to worry? >> people who do not have to file a claim right off the top customers. you don't have to file a claim if it's something arising out of your customer relationship like a refund, a billing dispute. >> diane wrote me saying i'm confused and hope you can explain. i don't know if shareholders need to file a claim. good question. mcdonald says the answer is no. >> a stock is not a claim for money. a stock is an ownership interest in the company and that will be

dealt with later. >> reporter: who does need to file? fire victims and anyone else with non-fire related damage that they are blaming on pg&e even if they have already filed a lawsuit. if you're not sure, protect yourself by filing a claim form. >> our advice to people is just to make sure, go ahead and fill out this form. it's a very short form. >> so far, 3700 claims have been filed. the utility tells us we remain focused on compensating fire victims as quickly as possible. further reducing wildfire risks. >> all right. >> thank you so much, michael. >> all right. developing news in a murder of a tourist couple in canada. two young men once thought to be missing are now the prime suspects in that case. police announced today the manhunt for the men ages 18 and 19. they are accused of killing three people including china and

lucas fouler, her boyfriend who is from australia. police believe the suspects are armed and dangerous. >> investigators have also been able to confirm that they have left british colombia. and have been spotted in northe northern. we believe they are likely continuing to travel. >> they were found shot to death in a highway ditch on july 15th. the third victim was discovered some 300 miles away. a coroner is still trying to determine his identity. the man at the center of massive protests in puerto rico told his opponents today that he's listening. though governor ricardo is still rejecting calls to step down. also today, the judge issued search warrants for the cell phones of the governor and officials tied to crude and offensive online chats. for more than a week, hundreds of thousands demanded resignation in protest at times turned violent.
