biggest hits and -- ♪ yeah i'm gonna take my horse to the old town road ♪ >> "old town road" smashes a record that stood for generations. plus, a new way to keep your cool in the summer heat. a wearable air conditioner. before your next take-out order, something you need to know about that food delivery driver. what nearly 30% of them admit to doing. good tuesday morning, everyone. thank you for joining us. we begin with what could be the largest security breach to ever hit a financial firm. >> capital one announced a hacker gained access to personal information of millions of people applying for credit. >> this morning, a woman is charged with the huge data breach as we learn more about the customer as affected. this morning the big bank warning. capital one says a hacker gained exposure to credit cards, credit limit, balances, payment

history and contact information. no credit card numbers or log-ins were released but about 140,000 social security numbers were compromised as well as about 80,000 bank account numbers. the fbi has arrested a seattle software engineer in connection with the breach. authorities say went by the name of erratic on twitter. they tracked down page thompson because she allegedly posted the information to a site using her name and email site allegedly tweeting the bank saying, quote, i've basically strapped myself to a bomb vest dropping capital one's documents and admits it. if convicted she faces up to two years in prison. >> she never said anything to any of us. >> thompson's roommate said she doesn't think thompson meant to hurt anyone. >> page just wanted to see if she could. she had no nefarious intentions with the data. >> reporter: the breach comes just one week after the credit rating agency equifax agreed to a $700 million settlement back in 2017.

>> it's not just a breach of security. it's a breach of public trust. we should have confidence that the confidentiality of our information will be maintained. >> as for capital one, it says it will notify customers whose information may have been breached and will offer identity protection and free credit monitoring. thompson is due back in court thursday. now to the deadly shooting rampage at a food festival in california. three victims died in the attack and dozens have been wounded. this morning we're hearing from some of those survivors as authorities look into the troubling social media rhetoric posted by the gunman. this morning, stories of survival after the mass shooting in california. >> the worst possible situation that you could be in. >> reporter: nick mcfarland says he was at the gilroy garlic festival when he spotted the gunman loading his weapon. >> i run into the booth where our family was and say run like three or four times and after the third time you just just hear -- >> reporter: mcfarland and

his friend justin bates were both shotted. doctors say he was grazed by five or seven bullets. >> the doctor told me if these ones would have inched to the right they would have gone to my lungs. i don't know how i'm alive. >> reporter: kayla salazar as one of the three victims who did not survive. salazar was preparing to celebrate her 14th birthday this weekend. the other two victims, 6-year-old steven romero and 25-year-old trevor irby. >> when he called he said, i love you grandma and i'd y, you. >> reporter: the shooting began as the annual garlic festival was winding down sunday. authorities say the suspect evaded security by cutting through a fence and sneaking onto the festival grounds then unloading with an assault-style rifle. he was shot and killed in less than one minute by police officers. >> despite the fact that they were outgunned with their handguns against a rifle, those three officers were able to fatally wound that suspect.

>> reporter: the shooter has been identified as a 19-year-old who lives just miles from gilroy. investigators say he bought the gun legally three weeks ago in nevada. the owner of the gun shop says the suspect was happy during the purchase saying, we sell to people who we think are upstanding citizens. i pray to god for all the families. elsewhere security is now being increased in chicago where hundreds of thousands of people will attend the lollapalooza music festival this weekend. >> we have over 330 cameras that are focused on the footprint of lollapalooza and the perimeter itself. >> authorities are looking into white supremist messages the gunman posted online and criticizing the festival just before the attack. overseas the assault trial for a$ap rocky is underway. he was arrested on suspicion of assault along with two of his backup performers. tmz obtained video of the altercation. acted in self-defee

and released video taken moments before the fight. a verdict is expected friday. president trump is among those who supported a$ap rocky and criticized sweden for detaining the rapper for weeks before trial. and president trump is refusing to let up on maryland congressman elijah cummings despite growing criticism of racism. he unleashed a new attack claiming billions of dollars pumped into his district were stolen or wasted. meanwhile, as the president slams baltimore as rat infested, his son-in-law jared kushner's family owned company is facing allegations that the apartment buildings they own in baltimore are rat infested. and cited for code violations. maryland senators say they sent letters to the kushner owned companies about the alleged violations but never heard back. >> you've got the kushner companies profiting over housing that is run down, that's not properly taken care of. the president may pretend today that he wants to help baltimore, but he's been obviously trying

tt.drag it down andpo t >> the kushner owned companies said it's proud to own thousands of apartments in the baltimore area and says it maintains a high quality residential experience. police near miami are investigating the death of a 2-year-old boy found in a day care van. they say the boy was transported in the same van yesterday morning. hours later with temperatures in the 90s authorities were called. an autopsy will determine the cause of death. it comes just days after a pair of 1-year-old twins died in a hot car in new york. their father says he forgot they were in the car when he went to work. time now for a look at your weather for this tuesday morning. tropical storm erick is churning towards hawaii. it's expected to become a the hawaiian islands friday and saturday. meanwhile, in oregon, 500 homes are now threatened by the so-called mile post 97 wildfire. the fire is only 15% contained.

angeles in a los angeles courtroom for a christian rapper who sued katy perry. a jury agreed part of the pop star's 2013 hit "dark horse" was lifted from marcus gray's song "joyful noise" which came out in 2009. the trial continues this morning where damages will now be discussed. it could take up to a year for two american teenagers to be formally charged with the murder of a police officer in rome. the teens are unlikely to be granted bail after a judge said they're considered a flight risk. one of them is now claiming he acted in self-defense when he allegedly stabbed the officer repeatedly. the officer was responding to an alleged drug deal. thousands turned out for his funeral monday. the american rid cross is reporting an emergency blood shortage. it says it has less than a three-day supply of most blood types. it's now offering gift card to anyone who donates blood or platelets. a man is speaking out after

being trapped in a wrecked car for five days in the woods. jose velasquez doesn't remember the crash but remembers waking up being unable to move realizing he was seriously injured. rescuers found him by tracking his phone. the pings stayed in one place until the phone died. velasquez survived on rainwater. >> i was next to a tree, and there was vines growing around it. i realized that the inside, it looked moist, so i tried peeling the bark off of it and just chewing on the line just to get some kind of moisture in my mouth. >> velasquez is now recuperating at home. the 32-year-old says he can't believe he survived. he hopes to be walking by january when he gets married. so the tsa has made some shocking discoveries in checked bags in recent days. first a missile launcher was found in a bag at baltimore washington international airport. an active military member said he wanted a souvenir from his time in kuwait.

the launcher was confiscated and not to be outdone, officers at newark airport in new jersey found a grenade. the discoveries prompted a reminder to travelers do not bring military grade weapons on flights. there could be soon a new way to keep your cool during the summer heat. sony is developing this wearable air conditioner that slips on the back of your shirt. it's controlled by an app on your phone allowing you to lower the temperature on your back from 97 degrees to 73. the expected price tag around $115. might help your back sweat. >> pretty cool. coming up, the effort to rescue several whales in trouble along the florida coast. but first the new poll this morning with surprising news for joe biden ahead of tonight's democratic debate. >> it has happened again. another young tourist attacked by a bison. we'll hear from the latest victim just ahead. >> tech vo: this teacher always puts her students first.

beached on florida's gulf coast. they joined crews in setting up tents to protect the whales from the sun in reddington beach. three of the whales were sent back into the gulf. two were taken to a rehab facility. we turn now to the race for 2020. tonight could be make or break for some of the struggling presidential hopefuls facing off in the second debate of the democratic primary. >> bernie sanders and elizabeth warren will share center stage. they'll be among ten candidates trying to stand out. abc's trevor ault is in detroit, the scene of tonight's debate. and, trevor, you join us with the surprising results of a new poll. >> reporter: that's right, janai. good morning. good morning to you, kenneth. we're starting to see the front-runner former vice president joe biden bounce back a little bit ahead of this second wave the debates. you know, with ten candidates each night it can feel a little more like a series of elevator pitches rather than a political debate but does make things more unpredictable with so many

trying to break through, what, with this poll we see it appears to be a top-heavy field. it's time for round two beginning tonight of the second wave of debates in the quest for the democratic presidential nomination. the candidates once again split up over two nights, all trying to knife through an extremely crowded field. heading into night one a new poll shows former vice president joe biden expanding on his lead. now with 34% support up from 22% at the beginning of the month. senator elizabeth warren is in second at 15% with senator kamala harris appearing to lose her first debate bump dropping to 12% from 20%. senator bernie sanders in fourth at 11%. the front-runner biden seems to have shaken off what was regarded as a lackluster performance in the first debate. senator warren says these debates won't be about taking swipes at other democrats. >> we all have a chance to talk about our vision for america, to talk about our plans for america, to talk about how we see building a future in this country. >> reporter: one area where those proposed policies will likely get a lot of focus is health care.

senator harris releasing her plan. >> under our medicare for all plan there will be no more co-pays. there will be no more deductibles. >> reporter: but she's already been met with criticism for the plan's details. the biden campaign saying she's committing to unraveling the affordable care act while senator sanders' campaign manager says call it whatever you want, but you can't call this plan medicare for all. now, after seeing the bump that senator kamala harris got for taking on former vice president joe biden in the first debate, we might see some more sparring. some more fireworks tonight and tomorrow especially among the struggling candidates who if they don't have their moment now, it may never happen. janai, kenneth. >> and we will have those big moments right here on "america this morning" tomorrow. trevor ault, thank you. for the second time in one week a young tourist has been attacked by a bison in a national park. this time it was a 17-year-old attacked in north dakota. park rangers say he somehow got in the middle of a fight between two bison, and one charged at him. just days earlier a 9-year-old

was tossed in the air by a bison in yellowstone national park. the latest victim spoke to us over the phone. >> at first i kind of didn't believe it, oh, my god, i'm getting charged by a bison right now. there was nothing that i did to aggravate him, and then all of a sudden i kind of got this feeling that something was chasing me, and then all of a sudden he just throws me into the air. >> the 17-year-old says he is an an experienced hiker and didn't think something like this would happen. he's recovering after being air-lifted to the hospital. we're hearing from former red sox star david ortiz for the first time since he was released from the hospital. big papi was shot at a bar in the dominican republic in june. since then he's been hospitalized in boston. ortiz released a statement thanking his doctors, fans and the red sox for their help and also posted a picture of a steak saying being at home is p food just yet. >> glad he's recovering well. up next in "the pulse," the soup that's been cooking for 45 years.

southbound direction. and now the community came together last night to remember the victims from the shooting. >> we don't know what lead the 19-year-old to open fire. investigators are investigating social media post made by him and his car, and he purchased a ak-47 from nevada and brought it to california. three people were killed, 12 others wounded. >> the three victims that died were all young, 6-year-old steven romero of san jose, always full of joy, and 13-year-old kayla salazar was also from san jose, and 25-year-old trevor was visiting gilroy from new york and friends say he was the type of person that could bring joy to everybody he met.

>> the community is vowing to remain strong and not giving into fear. jobina fortson is live with how the victims are being remembered. >> reporter: there was a huge showing of support for the grieving community last night. the man that organized the vigil outside of the city hall said he thought maybe 20 or 30 people would show up, but close to 1,000 people showed up because everybody wants to help this community move forward, and it was not just people in gilroy but other places as well. three young lives lost, ages 6, 13 and a man in his 20s, and on top of that the person responsible for this was one of their own. last night's vigil put a focus on those killed and everybody else working to heal. heal. >> this is my hometown, and
