weeks at number one. we'll talk about that, more on that ahead. first, george, we have a lot of news to get to. >> we do have a lot of news to get to. the latest on the deadly shooting at that northern california food festival. it left three people dead, more than a dozen injured. family and friends gathered for a vigil overnight as investigators focus on a white supremacist social media account that may be linked to the gunman. will carr is on the scene in gilroy. good morning, will. >> reporter: and, george, investigators say it will take days to comb through this massive crime scene. this has been a heart breaking couple days for this community. one local leader said the shooter waged war on this small town, but it comes as we're hearing truly amazing stories of survival. ♪ after those terrifying moments at a california food festival, this morning we now know the names of the dead. 25-year-old trevor irby, 13-year-old keyla salazar and stephen romero who was just 6 years old, his father getting that gut-wrenching call from the boy's mother and rushing to

saying was a lie, maybe i was dreaming. >> reporter: 15 others injured and authorities say this is the man responsible, 19-year-old santino william legan. investigators pouring over his past, searching a home the gunman was once linked to and scouring an instagram page bearing his name that investigators say is filled with white supremacist messages, not ruling out a potential second suspect. >> it seems that this was a random act but, again, we've got a long way to go before we come to a determination. >> reporter: investigators believe the suspect legally purchased an ak-47-style rifle at a nevada gun store on july 9th, then illegally transported that gun to california. the store owner telling abc news he ordered the rifle off my internet page. when i did see him, he was acting happy and showed no reasons for concern. at a vigil overnight, the community coming together to mourn as survivors share their harrowing stories.

reports of a shooting at a walmart in mississippi. watn reporting two people were killed and and officer injured when a gunman opened fire. the suspected gunman was shot and is in custody. michael? now to that growing tropical threat in the pacific. hurricane erick is picking up strength and tropical storm flossie is right behind it. rob marciano has the latest. good morning, rob. >> good morning. one more fresh off the coast of mexico, 20% chance of development with this. flossie, erick, these are the ones we're most concerned about. let's start with erick, about a thousand miles off the coast of hawaii but you can see in the satellite picture the last couple frames, a little bit of an eye developing here. 85-mile-an-hour storm forecast to become a cat 2 likely to stay south of hawaii but certainly very close to the path and big waves and rain with this. that's as we head towards thursday and friday. flossie a thousand miles off the coast of baja california. this is forecast to be a cat 3. this is forecast to get a little bit closer to hawaii if you

extend the computer models out. so we'll watch this closely this weekend and the beginning part of this week and we also have the potential threat for some action in the southeast in the atlantic. we'll talk more about that in a few minutes. >> thanks. we turn to washington. president trump tweeting late into the night upping his attacks against congressman elijah cummings and his baltimore area district. let's bring in abc's kyra phillips there at the white house. kyra, the president really seems to be digging in here and denying these attacks are racist. >> reporter: absolutely right, cecilia. even as his critics call his language inflammatory and divisive, the president seems unwilling to let his feud with congressman cummings fizzle and now president trump has another target in his crosshairs, the reverend al sharpton. this morning, as president trump speaks in historic jamestown, virginia, a group of black state lawmakers plan to boycott, this following trump's repeated attacks on minority members of the congress. overnight, the president ramped

up his tweets targeting oversight chairman elijah cummings and his majority black baltimore district, calling the city, the worst and making the unsubstantiated claim that billions of dollars had been stolen or wasted. neither the president nor his staff offered any proof to back up the charge. >> the comments are just outrageous and inappropriate. >> reporter: and his latest target, reverend al sharpton who spoke in baltimore monday. the president lashed out calling the civil rights activist a con man and a troublemaker who hates whites and cops. sharpton fired back. >> i'm going to keep making trouble for bigots. as far as me being a con man, if he really thought i was a con man he'd be nominating me for his cabinet. >> reporter: as democrats present a united front, republicans not condemning the president's remarks. congressman mark meadows, considered an ally of the president and a good friend of cummings. >> you're one of my best

friends. i know that shocks a lot of people. >> and likewise, mr. chairman. >> reporter: now meadows breaking his silence stating i know both men well. neither man is a racist, period. senator tim scott, the only african-american republican senator, told the state newspaper that he didn't think trump's tweets were racist. instead, calling the president an equal opportunity offender. and, george, congressman cummings' committee is spearheading a number of investigations into trump's administration, escalating a probe now into private email and cell phone usage, authorizing a subpoena for communication records from white house officials that include ivanka and jared kushner. we'll stay on it, george. >> kyra, thanks. >> that's not the only one. chairman cummings released a new report detailing how one of the president's closest personal friends and political allies was trying to use his influence to cozy up to dictators in the middle east and profit from his relationship with the president. let's bring in mary bruce for more on that.

good morning, mary. >> reporter: good morning, george. well, his name is tom barrick and he's one of the president's long-time friends and ran his inaugural committee and according to this report barrack once pushed the white house to sign off on a deal with saudi arabia to build dozens of power plants that could have benefited him financially and also once gave one of his associates with close ties to gulf leaders a sneak peek at one of the president's energy speeches so he could have a chance to make edits. this report says that there are serious questions about whether the white house is willing to place the potential profits of the president's friends above the national security of the american people and it is exactly the kind of oversight of the trump administration that is likely putting the chairman of this committee, elijah cummings, in the president's crosshairs. >> certainly seems so, mary. let's switch gears and talk about the debate, second round of democratic debates begins tonight. it will be over two nights, ten candidates on each stage each night and tonight the front-runners in the center of the stage will be bernie sanders and elizabeth warren and one of the big questions is they're political allies. will they go after each other or the front-runner not on the

stage? >> reporter: exactly. tonight is going to be all about the showdown between these progressive powerhouses, elizabeth warren and bernie sanders. i wouldn't expect many fireworks because these two are friends. they are long-time political allies. so far they have been hesitant to attack each other out on the campaign trail. their truce will be tested. it's unlikely at this stage they see much benefit to going after each other and are likely to direct their fire at the front-runner, joe biden. >> for so many others on the stage tonight it really is going to be a do or die moment. if they don't get something going, they're unlikely to make the third debate which abc is hosting in september. >> reporter: exactly, george. so much of the action is going to be on the wings of this stage. for a lot of these candidates this is their last best chance to try to make a splash on the national stage and qualify then for the next debate, for our next debate. we're going to be keeping a close eye on candidates from the red and purple states like governor hickenlooper and bullock, representative tim ryan. they'll have to have a breakthrough moment tonight.

>> mary bruce, thanks very much. michael? now to that massive data breach affecting 100 million people. a woman is facing charges accused of hacking capital one credit card applications and accounts. rebecca jarvis joins us now with the details. 100 million people. >> it's so many people, michael, and this just keeps happening. every single day we hear about a new data breach. this time impacting millions of capital one customers. now one of the largest data breaches in history. this morning, paige thompson, a seattle software engineer, under arrest after authorities say she hacked credit card issuer capital one gaining access to more than 100 million applications, exposing credit scores, balances, payment history and contact information. 140,000 social security numbers and nearly 80,000 bank account numbers compromised too. investigators say they tracked thompson who went by the name erratic on twitter after she allegedly posted the stolen

information to a site using her name and email address. allegedly tweeting the bank, quote, i've basically strapped myself with a bomb vest, dropping capital one's documents and admitting it. ♪ promise that you'll never find another like me ♪ >> reporter: capital one which is endorsed by a-list celebrities like taylor swift, samuel l. jackson and jennifer garner, says customers whose information has been breached will be notified and will offer free credit monitoring and identity theft protection. and if convicted, the suspect faces up to five years in prison and a fine, michael. >> but is it possible that consumers could possibly get a settlement out of this? >> it's possible. we just saw that with equifax that consumers are getting a settlement and have seen it in previous data breaches. the biggest thing right now is to take advantage of that free credit monitoring and stay on top of those bank accounts. everyone should be doing that regularly regardless of whether you deal with capital one or not. >> stay on top of your credit.

>> yes. >> all right, thank you, rebe a rebecca. cecelia? we turn to jailed rapper a$ap rocky appearing in court in sweden for their time this morning. he's on trial for assault after that street fight caught on camera. james longman has the latest. good morning, james. >> reporter: good morning, cecilia. celebrities, activists, fans, even the president have taken up a$ap rocky's cause. n il his trial in sweden is finally under way. >> anything to say about the swedish legal system? a$ap's's and lawyer. they arrive to court for day one of his trial. the 30-year-old whose real name is rakim mayers was arrested with two of his backup singers days on suspicion of days after this june 30th street fight, video obtained by tmz. the musician saying he acted in self-defense, posting this video on instagram allegedly showing the moments leading up to that altercation.

>> we don't want to fight you. we're not trying to go to jail. ♪ >> reporter: the grammy nominated american rapper and fashion trendsetter with multiple platinum hits has been awaiting trial in sweden for nearly four weeks while celebrities have rallied to his defense, including justin bieber, kim kardashian west and husband kanye who personally lobbied the president to rv avalby so rocky. >> reporter: president trump even speaking to the swedish prime minister on phone thursday chastising the country for its treatment of americans. tweeting, i watched the tapes of a$ap rocky and he was being followed and harassed by trouble makers. treat americans fairly. but the swedish government saying in a statement that government is not allowed and will not attempt to influence the legal proceedings. a verdict is expected on friday. now, these kinds of charges carry a maximum two-year prison sentence in sweden. it's also understood the man who was allegedly assaulted is asking for $15,000 in compensation. michael? >> all right, thank you so much, james. now we turn to katy perry

showed. he does have to testify. we move on to those new developments in the case of two americans arrest the for killing a police officer in rome. one of those suspects now claiming self-defense, the judge is skeptical. ian pannell is in rome in front of the jail where both are being held. good morning, ian. >> reporter: yeah, good morning, george. that's right. one of the teenagers, finnegan elder claimed he thought he was going to be strangled but the investigating judge dismissed that saying there was no evidence or marks of strangulation on his neck. this comes as moments ago police and prosecutors defending their handling of this case. this morning, new details about the attack that left this italian police officer dead and two san francisco teens behind bars in rome. police say 18-year-old gabriel natale and finnegan elder murdered police officer mario cerciello rega. seen here allegedly stealing a backpack in a drug deal gone wrong. police say when the teenagers

demanded drugs and money for its return, the owner called them. according to a court document obtained by abc news officer mario cerciello rega and his partner andrea varriale seen here at rega's wedding last month went to recover the backpack. varriale said when they approached the teens with their badges friday night identifying themselves as police elder and natale seemed suspicious launching into a violent attack that left his partner bleeding abundantly falling to the ground saying they stabbed me. the entire encount story lasting about four minutes. police say elder stabbed rega 11 times with a 7-inch blade and they then fled to their hotel where he hid the knife in the ceiling. natale claimed he had no idea his friend had attacked the officer with a knife until the next morning but an italian judge disagreeing saying he acted as an accomplice. authorities say the teenagers confessed to their involvement in his murder. meanwhile, this photo of natale blindfolded while in police

custody causing controversy. his attorney claiming it significantly undermines the credibility of rule of law. this as the dead officer was laid to rest, buried in the same church where he married just a month ago. both americans met with the u.s. consul in rome on monday and elder's family saying they plan to travel to rome soon adding, our hearts go out to the family and friends of officer cerciello rega who have suffered an unimaginable loss. so it could take up to a year for the pair to be formally charged. the judge saying she thought that the americans had shown an absence of self-control and were highly dangerous saying because she thought they were a flight risk she wouldn't release them. george? >> okay, ian, thanks. let's bring in dan abrams for more. you have two different suspects, two separate sets of facts that could lead to game theory. >> you'll have two different defenses. with regard to the guy who actually did the stabbing it's clear it's going to be self-defense which is i didn't know he was a police officer.

he came at me. i was just defending myself. tough argument when you have 11 stab wounds. the second guy, though, is going to say, i didn't even know there was a stabbing. i just thought there was some sort of altercation and i tried to get out of there. i had nothing to do with it. so the question will be do they try to cut a deal with him, the one that didn't do the stabbing to say, work with us here? we'll cut you a deal. >> what could cause problems for both it all appeared to begin with a drug deal gone bad. >> that's right. that doesn't help them. there's another crime they're charged with here, extortion. they're charged with murder but also extortion for basically saying to them, hey, you better come back here if you want your phone and give us drugs, et cetera. so that's not a helpful fact on the extortion charge but it also isn't helpful on the murder charge. when you're talking about the situation that they were involved in, it makes a self-defense claim just a little bit harder as well. >> we also saw the picture of one of the suspects being blind

folded during the questioning. how much trouble is that for the prosecutor's case? >> it's trouble for the police. the police are dealing with the international fallout. but as long as it's true that, when they were questioned, they were questioned with a lawyer present, which is what the police are saying, this isn't going to have that much of an impact on the case itself. it'll look bad and they'll certainly mention it but it won't be a make or break issue in terms of guilt or innocence on the facts. you know, the police there say we've already transferred the guy that did it. they never should have done it but different question from how does it impact the case? >> dan abrams, thanks very much. george, now to new developments in that college admissions cheating scandal. actress lori laughlin's daughters are breaking their silence on social media sharing a message about their mom as we learn new details about her legal strategy. abc's eva pilgrim joins us with more. good morning, eva. >> reporter: good morning, michael. these girls have been laying low on social media since news of this scandal broke but they returned to instagram to

your guide here was a book called "atomic habits"? >> best-seller. i got something for you, michael. stand by. as we all know making or breaking bad habits is one of the most difficult tasks for us human. the truth is, we're wired for failure here. so i went to an expert for advice. >> happy new year. >> reporter: eight months ago we rang in the new year right here in times square. do you even remember what your resolutions were? probably not since some research shows 80% of new year's resolutions fail by the second week of february. our effort to right our wrong habits over. so why is making or breaking habits so hard? you can blame it on evolution. in order to survive our brains evolved to focus on immediate issues like avoiding sabre tooth tigers. evolution only cared about us creating habits that helped us live long enough to reproduce. it didn't care about whether we were good about forming long-term healthy habits like flossing our teeth.

which is why so many of us find it so fiendishly hard to stick with a diet or boot up and exercise or meditation habit. enter james clear. author of the best-selling book "atomic habits: an easy & proven way to build good habits and break bad ones." he starts small with the two-minute rule. >> take whatever habit you're trying to build and scale it down to two minutes to do. meditate every day for a month becomes meditate for 60 seconds. so easy you can't say no to it. if you don't become the type of person that meditates for 60 seconds five times a week you have no chance to meditate for 40 minutes. >> reporter: we tested out his advice. jude wanted help with forming an exercise habit. we challenged her to do three sit ups for two weeks. >> focusing on one thing made it a lot less stressful. >> reporter: while jude wanted to make an exercise habit i wanted to break a bad habit. the habit i would like to break

is late night snacking. if forming a new good habit is about making it easy breaking a bad habit requires making it more difficult. for me that meant putting snacks on high shelves out of sight out of mind. james recommended something pretty extreme. a lockbox with a timer which would make it impossible for me to get a rice cake after 8:00. another hack, brushing and flossing early. the minty taste could reduce late night cravings. as jude and i got to work we turned for inspiration to mitch pressnick. the so-called micro habit approach helped him lose more than 100 pounds. he went to the gym for five minutes every day. >> after about a month i was dying to do ten minutes and i finally let myself do ten minutes then after another two weeks i was dying to do 15 minutes. >> reporter: how did jude do after a couple weeks? >> usually starting is the hardest part so now that i've

started something, it will encourage me to stick with it and to build upon it. >> there's this quote by ed lattimore that says the heaviest way to the gym is the front door and it's that idea. how can i make it easy to open the front door? >> while i didn't find the lockbox super helpful. >> not big enough. the early brushing definitely helped my craving. is there a set amount of time it takes to form a habit? >> the honest answer is forever. habits are not really the finish line to be crossed. it's a lifestyle to be lived. >> lara just told me she doesn't mind brushing twice. so it won't work for her. i'm not going to lie. in terms of my late night slacking, i have done some back sliding. there are two big things that me because it allows me to see the urge to eat arise and i let it pass. >> let yourself have a rice cake every once in a while.
