encampment. i'm dan ashley. >> i'm kristen sze. thanks for joining us. today symbolized how complicated the homeless situation can be as we try to build a better bay area. dozens of residents of a makeshift rv park were evicted. >> the city says the encampment at union point park got too big and a hazard for the community around it. luz pena is on the story. >> when you're a kid, playing with trucks is one thing. having a truck back up to your house to take i another. >>e how. >> 6-year-old benjamin woke up to city workers evicting him and his family from this parking lot. today he was supposed to go to first grade instead he stayed back because he was stressed. >> do you wish you had a different type of home? >> yeah. >> like what. >> a home that's a house. water for fish.

>> you want a room? >> yeah. >> reporter: while he dreams of a forever home, his dad is trying to figure out where they can sleep tonight. >>. >> reporter: what are you thinking? >> i don't know where to go right now. m okiny rht ior >> wa. r t, wifeidstheir home. a week ago the city of oakland handed out eviction notices. >> we have had outreach workers out there. some children we identified. we made a family shelter available for them. >> reporter: according to the city of oakland, before deciding to clear the encampment, they checked for health, safety location and size. according to them the location met all four in a negative way. vvs that can't be driven out with be towed and placed in impound for ten days. everything outside of this area

will be thrown out. they're just migrating. they're not having a set place. is that the solution? >> it's not the long-term solution. it's not. but if you have one or two rvs ty mo and tlocation, city-wide, that's a lot better. >> in oakland, luz pena, abc7 news. >> a judge today set a man accuses much attacking a woman outside her apartment building in san francisco will now of remain in jail. the case is against austin james vincent had become focal points for proponents of a proposed homeless city near the assault. >> lyanne melendez is outside the jail to explain why. >> reporter: this is the judge that previously released him. now today, she said given the new information and after reading the police report, she said "i believe that the defendant represents a public

safety risk." these are still photos of today's arraignment in court where austin james vincent was charged with assaulting a woman and some of her friends with a knife. and issuing criminal threats against them. police say that was back in february. the case was never resolved until the victim saw this mugshot of vincent following an alleged attack on another woman outside her apartment on august 11th which was caught on surveillance video. today the district attorney's office said other calls have come in. >> some of those calls have not been substantiated but we have to review every singlenent is that comes in. some we're still reviewing. > today the judge ordered vincent to remain in jail after he turned himself in yesterday following the february allegations. last week, judge christine van aken was criticized for ordering his release pending the outcome of the alleged attack caught on camera. vincent was ordered to wear an

ankle monitor only after the judge saw is the surveillance video. >> i was frankly alarmed. >> van aken says she now believes vincent is a public safety risk. his attorney says while in jail, vincent will no longer get account medical and psychiatric help he was received. >> austin's you know,bvlybout t. my focus is helping austin and i'm just going to keep help him nvigate through the complex system. >> reporter: there is now a new proposal on the table. the d.a. wants to the consolidate both cases. the august 11th and the february cases and they usually do that to save time and resources. that will be decided during a hearing on september 3rd. i'm live in san francisco, lyanne melendez, abc7 news. >> thank you. the oakland fire department is trying to contain a fuel spill in the oakland estuary after a boat that someone may have been living on started to

sink. the department defeated these photos. the rescue team placed 300 feet of boom around that sunken vessel. this is near the jackland aquatic center. fish and wildlife was contacted by the fire department today because of the leaking fuel. >> they are putting down absorbent pads that is soaking up all of the gasoline that is on top of the water, the gasoline is going to float to the surface. >> the game warden says it appears no wildlife has been affected. >> now to the latest in the ghost ship fire trial. a mistrial is now a real possibility. abc7 news reporter lesley brinkley is live in oakland to explain why suddenly. lesley? >> it's quite a mess here. i can tell that you. court is out for the day. 9:30. basically they're starting to run out of time and they're starting to skate on thin ice. as you know, they started out with four alternates down to one. lots of scheduling conflicts we heard about today. and that could leave ultimately

no alternates. i consulted with a couple of attorney who are not affiliated with this case. they said that the case cos proceed. the trial could proceed with only 11 jurors. that col happen but both the prosecution and defense would he have to agree toe that. if they did not, very likely they would agree, this could go to a mistrial. >> three jurors were dismissed yesterday for misconduct. the judge replacing them with three alternates and ordering deliberations to begin all over again. today in court, the judge alluded to the misconduct incident happening late last thursday. involving a possible text mess and with a media link of some kind. the jurors add mon flished to not interact with each other or use the internet to look up anything pertaining to the case. the judge today said she could criminally sanction two of them for contempt of court. the third was dismissed because she knew of the illicit communication and didn't report it. >> seems unlikely that the

county is going to start prosecuting jurors for who knows what. but this certainly puts a serious crimp in the trial. it's now in jeopardy. >> the only remaining alternate juror could soon be seated on the panel because of a fourth juror who has a scheduling conflict upcoming. there are many work and vacation conflicts to sort through even though the judge told the jury the trial could extend into october. she's asking for proof of nonrefundable expenses. one juror delayed a medical procedure. the judge also said she had a calendar. she highlighted all the scheduling conflicts, some of the jurors had and it basically blocks out most of the days in the month of september. also, thursday this week till after labor day, the court is planning to be dark. that is they have another acation period scheduled.

a debate is going on right now at san francisco city hall over whether a muni station should be named after rose pac. pac was an influential political activist who played a big role in the central subway project that is currently under construction. now, pac died in 2016. muni's board is considering a special order that would name a station in chinatown after her. while she was powerful, she was divisive and that's being reflected in the public's comments going on right now. >> i urge you follow your naming

policy and name the subway as chinatown station. no rose pak. thank you very much. >> we believe rose pak was our warrior, chinatown's guardian and than rose pak is chinatown. >> if approved the central subway chinatown station would be named chinatown rose pak station. >> walmart suing tesla claiming its solar fires started fires at several walmart stores. they say the fires destroyed large measurements of merchandise and cost hundreds of houses in repairs. walmart began using solar panels made by solar city in 2010 on the roofs of hundreds of its stores. tesla acquired solar city in 2016. solar city was founded by two cousins of elon musk. people who live in areas prone to wildfires are having an increasingly difficult time finding insurance. data from zip codes hit by devastating wildfires in california between 2015 and 2017

shows a 10% spike in nonrenewals by insurance companies and reveals the availability of insurance in high risk areas has dropped. the state's insurance commissioner says he has noticed this trend and it should be as a wake-up call. >> wildfire risk is one of the top concerns raised during a summit today about lake tahoe. it the 23rd annual summit brought together leaders from california and in. they said protecting the national treasure takes a bipartisan collaborative effort. >> most of it always relates to money, can you fund this project, that project. well, you need a yes on both sides of the aisle. and we've been able to be do that with tahoe. that's very special. >> a forprotest action plan was released a day ahead of the summit. including prescribed burns and use of satellite imagery and artificial intelligence to map
