injection. >> today the court issued the final ruling creating permanent protections for the sanctuary counties. new at 6:00, new video of a tesla driver asleep at the wheel. people in a passing car got this video on i-5 last saturday. can you believe it? they didn't call police because they saw the driver wake up and regain control of the car. the tesla wasn't moving erratically and traveling about 70, 75 miles an hour. it's not clear if the vehicle was in auto pilot mode. we seen this happen in june. this video was taken between 405 and 5 in los angeles. the person who shot the video says he called 911 when he saw the sleepy driver and then watch this, back in march. >> i think this guy is like passed out in his tesla. >> that witness says the tesla driver appeared to sleep for about ten minutes, woke up once, looked around and went back to sleep. this also happened around los angeles. tesla's website advices drivers

quote auto pilot is intended for use with a fully attentive driver with their hands on the wheel prepared to take over at any time. also new at 6:00, no action will be taken against sacramento kings' head coach luke walton following allegations he sexual assaulted a woman. kelly says walton attacked her at a california hotel while he was an assistant coach. she said he continued to harass her when he became the coach of the lakers and she was a broadcaster for a cable television station. an investigation says more than 20 people were interviewed by declined to take part. abc 7 news is working to build a better bay area and public transit plays a key role. sport is testing the trains that will soon transport passengers to and from the station at the end of the smart line. the green dots show the ten

intelligent, resourceful, they represent all walks of life. they just needed the opportunity to be able to recover and come back. >> reporter: many cities treat homelessness with temporary fixes like short term shelters or encampments but this is a permanent home for 150 of the areas most vulnerable residents. housing is combined with support services including a full-time on sight nurse, harm reduction specialist and counselors. >> this is the first project we've been able to get built. we have 13 others in the pipeline and will be able to start to tackle this challenge. >> reporter: destination home played a key role in the project by bridging public and private resources. >> thousands of people still out on the streets, we need to make sure we're coming together as a community to support more of the housing because it not just good for the people that get into their homes, it's good for all of us has a whole. >> reporter: good for residents like michael ekhes art.

bookings, no flight itineraries and always an excuse. >> it was almost like we were still almost a year and a half out. >> reporter: rachel says far from the aloha life. >> it's the exact opposite. >> reporter: on august 6th an email from wen. >> everything is under water. >> reporter: those issues including a lawsuit out of new york filed july 23rd by cash flow funding which bought house of aloha's and her future receivables for $50,000. less than 24 hours after she received that money, cash flow fundings attorney say wen defaulted on the first payment of $600. >> my client was just bewilder d bewildered. >> reporter: cash flow funding is suing her for more than $100,000 and attorneys fees. the police department says they have interviewed 13 victims that paid her and discovered their

vacations were never booked. they referred the case to the santa clara d.a.'s office. this week dozens more victims contacted me many mentioning jamie rodriguez. rachel says jamie continues to down play the situation. >> it sounded like she was trying to cover for wendy, as well. >> reporter: i learned jamie works in the civil division records department clara county superior court. court policy requires to disclose outside work but not clear if jamie did. the same spokesperson says it does not comment on personal issues. with two months before the big day, the couple and their family are out $27,000. rachel and mike ky still need a place to stay the night before their wedding. even though, the couple says their love is stronger than ever. >> reporter: jamie rodriguez has not responded to my request for comment, wen who had been

the breeze there blowing. 73 santa rosa and low 80s, fairfield 81 in livermore. this is what we're used to here in the bay area. golden gate bridge sure rounded by fog. coastal fog pushes over the bay tonight. mild to warm saturday. it heats up sunday and if you're missing the humidity that we had yesterday, it's back. the middle of next week. i'm not missing it. here is a look at the hour by hour forecast. 7:00 tomorrow morning foggy along the bay as we head into the afternoon, the fog pulls back but sits there near the beaches while into the afternoon and evening hours. first thing tomorrow morning, watch out for a little drizzle near the coast. otherwise foggy start for most of you. mid 50s to the low 60s as we head into the afternoon, it will be a beautiful day in the south bay. santa clara 85, 92 gilroy and 75 in santa cruz and on the peninsula, 81 mountain view and 80 in redwood city and mid 60s

say i'm on my own. >> by myself. >> in san francisco. >> far from what douglas and maria wanted to hear from their 13-year-old daughter especially after paying alaska airlines a $75 unaccompanied minor fee. >> my hear is in my throat like shaking. >> the 13-year-old flying across the country to spokane, washington with her first layover in san francisco. a kind stranger letting the child use his phone. >> i saw your daughter crying, and i have four kids and i know how you feel right now. >> helpless and thousands of miles away, the stranger escorted his daughter to the alaska airlines customer service counter. and then the phone rings, it's the airline. >> she was lost not even stating that she was alone. it was just acting as if there was an issue with the flight and we have to get your permission to put her on another flight. >> alaska airlines told us caring for a child flying alone

is their top priority. they apologized saying they had tabs on the 13-year-old the entire time but understand she may have felt unsupervised in the crowded area. they also said they are working to strengthen processes to make sure young guests feel safe. not a good enough answer for these parents who say they will think twice next time before allowing their kid to fly alone with alaska airlines. >> i do still want my full refund. you were able to refund my $75, admitting to the fact that she was indeed alone, you know, so why can't i have my money back? >> obviously made the parents very nervous. >> the family spoke to an alaska airlines rep who said they received the $75 refund within seven days, for the 13-year-old, she did make it safely to washington. >> she's okay, at least. coming up, hope you didn't check your 401 k balance today. yikes. stocks are down again and trade

ginsburg's spokesperson said the justice will continueic blood td david cokekoch has died. his brother charles confirmed the passing saying he was battling prostate cancer for the past 27 years. the koch brothers have been huge forces in american politics since the '80s. david koch's network was $50 billion, making him the 11th richest person in the world according to forbes. illinois health officials are reporting what could be the nation's first death tied to vaping. the unidentified person who had recently vaped died after being hospitalized with severe respiratory illness. the number of people in illinois that experienced respiratory illness after vaping doubled to 22. the report comes two days after the cdc announced 149 cases of

severe lung illness nationwide. video of the amazon rain forest fires is adding fuel to the world climate debate. a local environmentalists and fire officials say the fires are likely to have a direct impact on california. here is abc 7 news reporter leslie brinkley to explain why. >> reporter: french president macron tweeted our house is burning, literally. the lungs that produce 20% of the planet's oxygen is on fire. so far this year there is an 84% surge in amazon rain forest fires, 70,000 so far sparked by human activity. some blame brazil's far-right president. >> amazon may be reaching a tipping point, which means that it has been degraded or deforested so much that it -- the echo system can no longer sustain itself. it might be a savannah, a much

one of these is not like the others. look at this. a fuzzy pink pig was spotted next to several dogs at an animal shelter. turns out this little piggy is a regular at the shelter because he has a habit of escaping. the pig did get reunited and return to his family. >> cute. rescuers are still hoping for the public's help tonight. three days ago a cat was plucked from a ledge of the bay bridge hundreds of feet up in the air. >> san francisco animal care and control is working to find the cat's owner but so far, no luck. >> reporter: he's living on what amounts to the top bunk at the animal care and control. a few feet off the ground is cat's play to this black and white mystery man after being plucked off a ledge this week. 300 feet up.

>> dangling over the ledge. we had caltrans and highway patrol stop so we didn't get squashed. one office managed to grab the leash and another could lean over the edge with a net and scoop the cats up. >> reporter: handlers have been calling the cat tennings after the sherpa and for the past week, the bay yar area is captivated. they have been blasting his image over social media trying to locate the owner. one man made contact after hearing his cat escaped from home here in the bay area but no match. >> so all of us approached trying to get the owner to come in and be reunited. >> reporter: vets treating him over the past three days say he's no good health and investigators don't consider him abandoned or abused. >> we don't believe it was any

the raiders are 3-0 this preseason and showed a lot of resolve in last night's 22-21 win over green bay in canada. last night's game played on 80 yard field due to a count for damage after the goalposts were moved to accommodate for rules. with the field issue, the packers pulled starters including aaron rogers did not play but jon gruden didn't have as big of a problem with the conditions. >> we like the field. we thought the field was perfectly ready to roll. didn't impact our play calling or evaluations. we just adapted as they did to the new dimensions of the field. >> we certainly have all played on much worse surfaces in our life, but it was one of the deals where they weren't playing their starters and so we just decided to sit them.

howard reached a contract buy outwi out with memphis. he's entering the 16th season and returned for a second time after playing one year 2012, 2013 in l.a. native ghost will be in l.a. on september 28th. he stopped by to tape an upcoming episode and talked about the personal connection to the tragedy at the gilroy garlic festival. >> i have two nieces and a nephew, one of my older brothers and they are pretty shooken up and freaked out about it. thank god none of them got injured. if you have family friends and stuff like that got hit and stuff like that with bullets and it's tough, it's tough but it's my turn to give back and to be able to be in that position to donate a portion of my portion to what is going on and help people, i mean, it's what we do.

mostly as kids will always do, they are finding work arounds. some are bringing a second phone to surrenderer keeping theirs and others are bringing a magnate to unlock the pouch. without phones, there is a noticeable change in class. students with their eyes on the teacher, not their phones and in the hallways and cafeteria, too, more talking to one another with their voices, not with their fingers tapping out texts and posts. what really matters is helping our children succeed in school and in life and it will be very interesting to see if other schools around the country and the bay area follow san mateo high's lead. i always love to hear from you. follow me @danashley. >> look for breaking news any time on the abc 7 news >> we'll see you at 11:00.
