residents who may be in the path of hurricane dorian. good evening. i'm dan ashley. >> and i'm ama dates. >> abc 7 reporter megan t tevrizian. >> the entire state now under a state of emergency ahead of dorian's arrival. >> could be the most significant storm we've had in a couple of decades here in orlando. >> reporter: the biggest threat could be flooding. florida's 17 million residents awaiting possible evacuation orders. >> and they live in a zone so that if we do issue that order you can move immediately. >> reporter: already telling people living on the barrier island and low lying properties they will have to leave starting 8:00 a.m. sunday. but even areas further inland could see flooding. many cities handing out free

the president's resort mar-a-lago. >> this is one powerful storm being fueled by the warm ocean waters, and it is growing. as you look at a satellite picture of hurricane dorian. the computer models all have it skirting the east coast of florida, and all of them are eyeing this state. so unfortunately it doesn't look like they're going to escape it. 6 to 12 inches for most areas. it is a dangerous category 4. it is going to slow down. it will cross the bahamas as a category 4 sunday evening. and by the time we head into monday it's getting ready to hit with a category 4. the biggest threat with this is going to be rainfall, flooding. storm surge 10 to 15 feet above normal. potentially serious flooding that is, large swells and damaging winds. hoping they get through this safely.

he is serving a life sentence. we have new developments tonight in the kate steinle case. >> the gun conviction against the undocumented immigrant who shot and killed her has now been overturned. >> the appeals court released the decision this afternoon ruling that the trial judge made a mistake. >> the mistake was failing to instruct the jury on a specific defense theory which was that he only was in possession of the weapon for a moment. >> reporter: in a statement public defender mat gonzalez said this really wasn't a close call. we thought that he would have been acquitted had the jury been instructed this way so this is very gratifying for us. he was a repeat offende a undocumented immigrant who had been deported five times when the gun he fired shot and killed
