delightful evening on the way. sounds like you'll need it after the commute this morning. let's get back to frances. we've got the hot spot right now, westbound 80, a fatal accident. a traffic alert right at powell. full freeway closure. westbound 80 shut down again this morning. this time it's in a worse spot. it's right at powell for folks heading to the bay bridge. you can see all lanes shut down from this fatal accident that happened at 4:25 this morning. only that one lane of traffic getting by. that's the powell on-ramp to the bay bridge. i want to show you another live caltrans camera. you can see the traffic there is messed up. that's powell on the right-hand side of your screen and the frontage road. that's where traffic is getting by. this is already causing well over hour-long delays on westbound 80 through berkeley and emeryville. consider alternate routes this morning. this morning ghost ship master tenant derick almena is

in jail following a split decision in the involuntarily manslaughter trial. >> 29-year-old max harris was found not guilty yesterday. the jury was hung, unable to reach a verdict for almena. he faces a possible retrial. he already has a hearing set for october 4th. a civil suit is definitely moving forward. that trial was set for may, but that could change if there is another criminal trial. families of the victims filed that civil suit alleging pg&e, the warehouse landlord, the city of oakland and others are all responsible for the deadly 2016 fire. >> as almena remains locked up in jail, 29-year-old harris is free. as abc 7 news reporter >> reporter: no long walk from the front door to a waiting car for max harris. the man who once faced 39 years in prison left privately as a free man. >> what's next? healing. that's all i can predict.

some real food, the comfort and support of his friends at any hour. >> reporter: friend and long-time supporter danielle silva said she always knew harris was innocent. he acted as creative director of the ghost ship. arrested and charged with involuntary manslaughter the summer following the deadly fire. on thursday after a month' long trial, harris was acquitted on all 36 counts, one for each person killed. >> max is incredibly sad and sorry for them. he's always expressed his remorse, his wish that he could have done something different to save someone that died that night. >> i can't imagine the healing that he's going to have to go through. he lost seven friends in one night. >> reporter: as part of harris' release, alameda county deputies drove him away from the jail. amanda del castillo, abc 7 news.

we have developing news. we are tracking hurricane dorian. the weakening storm is now a category 1 and is expected to make landfall in north carolina. the threat of flooding and a storm surge remains imminent. we want to give you a live look right now where this is expected to make landfall. abc news reporter megan tevrizian is in charleston, south carolina, with a look at the damage. >> reporter: as dorian bears down on north carolina, here in charles stop we're seeing the aftermath of the storm, broken awnings and debris littering the ground. hurricane dorian racing through the carolinas, causing destruction, flooding and at least 20 reported tornadoes. >> which way is it going? >> reporter: near myrtle beach, families had to run from the twisters. the high winds whipping off the siding of these apartment buildings. >> all of a sudden the windows broke loose. everything was swirling in our bedroom. >> reporter: wind gusts of up to 70 miles per hour tearing down

power lines, knocking out electricity to hundreds of thousands. stores boarded up as homeowners deal with the flooding. the governor urging residents to hunker down. diane wilson is there. >> the heavy winds and rain are here. several tornadoes throughout our area this afternoon. it's only expected to get worse. >> reporter: in the bahamas new before and after satellite images showing the utter devastation. coast guard helicopters showing most of the homes completely gone. as charleston starts cleaning up the mess left behind by hurricane dorian, the storm continues november north. north carolina facing hurricane-force winds. flash flooding remains a major concern. megan tevrizian, abc news, charleston, south carolina. meanwhile a search and rescue task force from california is in north carolina to help out during hurricane dorian. it includes first responders from all across the bay area

including san francisco, oakland and menlo park. this morning the team is in charlotte. they're ready to rescue people who may become trapped in floodwaters. in the meantime mike nicco has a look at what people can expect in our area. we'll take a look at that and then get to dorian. let's first look at the temperatures in the north bay. low to upper 50s with 57 in american canyon. only warmer in vallejo at 61. 53 in petaluma. 5 in tiburon. a lot of 60s elsewhere, like in el sobrante, vallejo, san ramon. redwood city at 53. northwest at 12. golden gate socked in with fog, also. the north bay and the golden gate is where it's going to be today. strong sunshine if you're out and about. peaceful on the bay today. no small craft advisory. east bay in the 60s at 9:00. we break out in sunshine quickly today. mid 80s this afternoon. down to 77 at 7:00.

for the peninsula, we're in the 60s and pretty cloudy through 9:00. break out sunshine by 11:00 and break into the 70s. we'll hang out in the mid 70s this afternoon. 70 at 7:00. here is a look at hatteras. you can see the eyewall punching through the outer banks right now and into some of the sounds, pamco sound. it's got 90-mile-per-hour wind. thankfully it's calmed down a little bit. it's racing off to the east and picking up speed to the northeast at 14. you see the area in red is where we have 74-mile-per-hour or faster winds, hurricane force winds. that's the entire outer banks. that's what we're dealing with. as it moves on out, it will create a lot of rip currents and dangerous surf. after this evening it should have minimal effect on anybody along the east coast as far as rain and winds. we'll talk about how the wintsds will change our weekend forecast coming up next. here is frances.

following this fatal accident. westbound 80 shut down at powell. we have a live camera shot at the scene. you can see it's right where the berkeley curve is as folks head over to the bay bridge. traffic was piled up. it looks like they opened that left hov lane to get traffic through. it looks like it was only to get the backup out of the way because most traffic is still being detoured off at powell. you can use that powell on-ramp to get to the bay bridge. we have a live caltrans camera also at the scene. so that right-hand side is showing cars getting onto powell. traffic is jammed and backed up all the way through emeryville and into berkeley causing at least one-hour delays right now. >> what a mess. we'll continue to follow that all morning long. if you think it's time to take your singing talent from the shower to the studio, get to the south bay. >> "american idol" is rolling into town for additions this morning. jobina fortson is live in san jose auditions -- no --

becky worley, abc news new york. another death in the u.s. is raising concerns about vaping. health officials say a second person died from a severe lung illness that may be linked to e-cigarette use. officials say the person died in july after using a vaping device that contained cannabis. the exact cause of the death is still under investigation. officials say the person's symptoms mirrored that of hundreds of others who were hospitalized after vaping. e sig rate maker juul has teamed up with a pr firm to publicize vaping success stories and to fight regulations. a reporter for buzzfeed says she got an email from the firm asking if she shared how juul helped her make the switch from smoking cigarettes to vaping. juul has gotten a lot of criticism forgetting young people hooked on e-cigarettes. summer tourist season may be winding down, but don't be surprised if you still see a lot

of visitors in san francisco. >> the san francisco travel association expects a record 26.2 million tourists to visit the city this year. that is 1.5% more than last year. tourists are expected to spend more money on their vacations, an estimated $9.5 billion this year. let's see what the visitors will experience as far as weather goes. >> here is mike. quite a change from day to day, the next three days. today we're a little warmer. a touch of autumn tomorrow as the winds kick up and temperatures drop about ten degrees. we rebound back to seasonal levels sunday and remain dry through next week. let's take a look at numbers. in the south bay we're still trying to get those 90s around morgan hill and gilroy. maybe we'll stop a little short today with upper 80s. much more comfort found in the rest of the south bay with upper 70s. los gatos at 84. on the peninsula today, very nice day from 73 to 78 degrees.

>> no, mike. it's horrible out there. a traffic alert for a fatal accident. all westbound 80 lanes shut down this morning at powell. here is a live come rah shot. it's calculating 1.5 hour delays. it's actually going to be worse than that looking at this shot. you're seeing headlights on westbound 80. that's ashby. you can see even the side roads are backed up. also in this backup we just got a report of a new crash at university. a motorcycle accident in the backup in the left lanes. apparently the rider -- the motorcycle rider is crawling to the center divide. westbound 80 avoid at all costs this morning. it's a massive mess. there's a live caltrans camera showing the backup getting off the freeway on to powell. this stretch is a spot you want to avoid. you may want to consider san pablo avenue there which is a little slow as well. heads-anotr heads-up if you're

trelg in or out of sfo over the next 20 days, tomorrow is the test. one of the busiest runways there will close. crews will upgrade the old runway and repair the concrete base. that closure is expected to cause major delays and perhaps even cancellations. united will waive change fees during the closure. the runway reopens september 27th. caltrain has reached full capacity. according to "the examiner" the trains are packed. last year ridership hit a peak of more than 65,000 rider trips every day. it may be a few more years before caltrain can expand. they plan to launch an electric train fleet in 2022. this will allow the agency to transport up to 30% more riders. the giants' lack of success on the field will help some season ticket holders save

arson investigators are trying to determine the cause of a mobile home fire that left a person dead. the two-alarm fire started last night about 11:00. firefighters put out the flames. >> we wetted down the fence, trying to do what he could to warn people. >> neighbors believe the victim was a woman in a wheelchair who lived in that home. san mateo police are searching for three men who hit an apple store and made off with dozens of items. it was all caught on cell phone video. >> looks standing there watching this happen. they were grabbing things from the display table inside the apple store. they left in a getaway vehicle. the police spotted that vehicle a few minutes later. they chased it up highway 101. chp took over the pursuit when

it got to interstate 80, but they lost the car on the bay bridge. happening tonight, the chase center is hosting its first concert ever, and this has been a long time coming. if you're planning to check out metallica tonight, make sure you know how you're going to get there. there's not much public parking. abc 7 news reporter anser hassan joins us from the chase center with details on the concert and the routes. >> reporter: good morning, guys. tonight is show time. the chase center may be new to san francisco, but faces a very old san francisco problem which is parking. the golden state warriors held a ribbon cutting ceremony on tuesday. metallica has been tweeting about their concert all week calling it a must-see event. how are the 18,000 people expected to get here? city officials are encouraging people to use public transportation. one option, take b.a.r.t. to get to san francisco, and then take muni to get to chase center.

acquitted in the oakland ghost ship fire trial. the 29-year-old was released from the alameda county santa rita jail last night. his first order of business according to "the chronicle" is to get a vegan meal. derick almena remains in jail after the jury was unable to reach a verdict in his case. the foreman says they voted 10-2 in favor of conviction but couldn't break the deadlock with multiple votes. both are charged with 36 counts of involuntary manslaughter, one for each of the people who died. the youngest person was just 17 years old. they were artists and friends, fathers and daughters. some were couples who died in each other's arms. un th,efense attorneys meantime had a very different sentiment. >> it was ridiculous that they charged max in the first place. it was almost comical.

last night divers, friends and total strangers walked together in santa monica. all but one of the victims has been recovered from the wreckage. the body of the final victim is still missing. a proposal to charge san francisco tourists driving down the crooked part of lombard street has reached the governor's desk. governor newsom has until mid october to sign the bill. it would allow a pilot program to impose a fee and create a reservation system. the bill passed the state assembly yesterday. more than 2 million people visit the cooked part of lombard every year. starbucks ceo howard schultz will not be running for president after all. the announcement came out overnight. schultz toyed with the idea of running as an independent. he conceded on his web cited saying not enough people are willing to consider backing an independent. he says the money he planned on committing to a presidential campaign will be used to invest in people and organizations to

westbound 80 near the berkeley curve. that happened about 4:25 this morning. it's absolutely amazing they got all the lanes reopened so quickly. however, the backup is still pretty bad. here is a caltrans camera. as you can see, at least traffic is moving, there is a crash in the backup westbound 80 at university. a motorcycle accident in the left lanes. so right now delays have actually improved. instead of an hour and a half, they've already dropped down to about 45 minutes. so this may be improving quickly. if you want to avoid it, you may still want to consider 680 and 24. that's still looking pretty good, or even heading

>> mike, thank you. this is pretty outrageous. an american airlines mechanic accused of sabotaging a jet is due in federal court. the mechanic disabled a navigation system because he was upset over stalled contract negotiations. the pilots ended up aborting takeoff when they detected an automatic alert. 150 passengers were on that flight in july headed from miami to the bahamas. an american woman could face a life sentence in the philippine z after she was caught trying to smuggle a child out of the country. here is a closer look at the security footage from manila's international airport. police say talbot carried the six-day-old infant in her carry-on bag and tried to get past security. she was detained as she tried to get on the flight to the u.s. she didn't have travel documents for the baby. she met the baby's biological mother on the internet. it's unclear if they exchanged any money. abc 7 news is committed to

we've have several hours of sunshine before the return engagement begins at 7:00 this evening. widespread temperatures up near the bay, sunnyvale and milpitas the coolest, upper 70s. then 82 at san jose, 84 at los gatos. sunshine, 77 if you're heading to the boardwalk today. a very pleasant day on the peninsula, 73 to 78 degrees with sunshine and a lighter breeze than yesterday. we'll have a few areas of sunshine, temperatures around 64 to 65 on the peninsula coast. a little more sunshine downtown, south san francisco and sausalito. upper 60s to low 70s there. mid 60s along the north bay coast. about 20 degrees warmer in your valleys. low to mid 80s until you get to santa rosa northward. along the east bayshore, very delightful day. mid to upper 70s. as you move ircht the east bay valleys, tri-valley mid to upper 80s around antioch and brentwood, holding on to 90s there. tonight, extensive cloud cover. fog in the same areas, mid 50s to low 60s.

up to ten degrees cooler tomorrow with 60s and 70s and breezy conditions. look at sunday, monday, tuesday, wednesday, thursday, all pretty much the same. 60s, 70s and 80s. frances? we still have about half-hour delays on westbound 80 because of a motorcycle crash at gilman. earlier they were an hour and a half. all lanes have been reopened. looking at headlights moving westbound. you see the red flashing lights. that's the motorcycle crash at gilman blocking the left lanes. i say only half an hour delays. it's still pretty bad out there. you may want to avoid it. everyone has gotten to the bay bridge toll plaza. metering lights are on. the eastshore freeway has been a mess, still worth avoiding. a lot of folks headed to 680 and 24. that's extra slow this morning.
