the accident happened just before 7:00 p.m. in the dangerous area known azraq coop strait between tiburon and angel island. the boat,rer appears to have hit a ware unclear, but both suffered severe cuts from the propellers. >> there is a fair possibility that they were immediately swept under the boat when they went off the bow, or they were hit when he turned the boat to rescue them. >> after the accident, javier burillo pulled his sonsconthi ye forhelp. the 11-year-old had already died. when police tested burillo for the presence of alcohol, they say he exceeded the legal limit. they arrested him in his home and took him to county jail. this afternoon, detectives served a search warrant on the property, reasons unknown. tiburon police say d dve fatality.>> o him to do

>> around three months ago, the trump administration announced that it would allow for officials to hold families in detention centers indefinitely while their cases are being reviewed by a judge, the chairman of the san francisco republican party agrees. >> well we have two choices. well can either leave them in the camps while they're adjudicated or we can send them back into mexico. so if we want to give them the due process that people want them to have, we need to keep the camps open. >> in addition trump recently said he was considering to end the right of citizenship for children born to noncitizen parents here in the u.s. live in san francisco, luz pena, abc7 news. >> all right, luz, thank you. in the north day, this morning's light showers may have played a role in a fatal crash. it happened just after 6:00 in the morning. the road was wet at the time. the highway patrol says a woman was killed after being thrown from an suv when it went off the

road at dry creek and wall roads. at least two other people who were in the car are okay. witnesses say it was the only car involved in the accident. now to the east bay, where wet roads may also be to blame for an accident that closed two left-hand ladies of northbound 680 for seven hours. two big rigs collided near vargas road and fremont after one hit the center divider and jackknifed. a second truck carrying gas hit the first. it spilled nearly 4,000 gallons of fuel on to the highway. two cars were also involved in the crash. fortunately, there were no serious injuries. and official says a combination of high speed and wet roads likely caused this rollover in a remote area of eastern contra costa county. the chp had some advice for drivers. >> just slow down. even if you're doing the speed limit, kit be too fast if it's a wet roadway. so don't worry about traveling under the speed limit. >> this one happened at marsh creek road at sycamore springs road. a tow truck came out to upright the truck, as you can see there. the driver says he was going about 35 miles an hour when he

went around the curve and just flipped over. fortunately, the driver was not hurt. well, the rain has moved out of the bay area, as you can see. but take a look at what's going on in sierra right now. we have snow in september. >> you can see it falling on highway 50 this afternoon. and there could be more on the way. i want to touch base with abc7 news meteorologist sandhya patel. sandhya? >> dan and kristen, winter in the middle of late summer in the sierra. right now live doppler 7 is tracking a mix of rain and snow. the snow is at the highest elevations. as we get you in closer here, you will notice most of this is south of lake tahoe. it's a mix of rain and snow south of there. now they do have another chance come wednesday for seeing some more mixed precipitation. here in the bay area, as you take a look at our local radar from this morning, we did see some rain here locally, and most areas were about a quarter of an inch or less. we have another possibility of seeing showers, but it's not for

everyone. i'll be back with the details coming up. kristen? >> thank you. the ftc wants to know what major cell phone carriers are going to do when pg&e decides to shut off the power to prevent wildfires. a letter went out thursday to at&t, sprint, t-mobile, u.s. cellular and verizon. they have ten days to respond with their plans. cell phone companies typically rely on generators and battery backup systems to keep their equipment running during extended outages. in the quake of last week's announcement of pg&e reaching a settlement with insurance companies for recent wildfires, we're getting a better idea of the price tag. >> the agreement which still needs the approval of a federal court is for $11 billion. but "the wall street journal" reports the state's wildfires in 2017 and 2018 cost insurance companies more than $24 billion. one company became insolvent following the camp fire. >> meanwhile, all evacuation orders have been lifted for a wildfire in riverside county. the horseshoe fire started over

the weekend and was threatening dozens of homes near san jacinto. firefighters have made considerable progress and containment is at 40%. nearly 500 acres have burned. there are no reports of injuries or damage to any buildings, and again, the evacuation orders have been lifted. developing news from the state capital when it comes to vaping, just days after new york moved to ban flavored e-cigarettes, california governor gavin newsom is issuing an executive order to try to cut down on their use by teenagers. abc7 news reporter laura anthony has the story from sacramento. >> it's interesting that in many cases, these pods hold substantially higher concentrations of nicotine than even traditional tobacco. >> saying he's seen quite enough, california governor gavin newsom announced his own evacuation order to snuff out teen vaping.

and the ready accessibility of flavored e-cigarettes. >> governor alone is not afforded the right legally to ban those products outright that we would need legislative support. again, we're pushing the envelope. we'll see how far we can go. >> newsom's order includes three initiative, warning labels on e-cigarette ads and at stores. $20 million into a vaping awareness campaign and the removal of illegal vaping products. >> in the next few weeks, the public should see a swell of ads and campaigns that really target schools and families, parents and children directly. >> newsom also wants to explore taxing e-cigarette products based on their nicotine content. the governor's order comes after two other states, new york and strict flavod cigarettes. to in california, newsom cited at least one death and 63 cases of respiratory illness related to vaping thc or cannabis-based oils. san francisco-based juul labs has 75% of the market.

the company did not immediately respond to newsom's order, but has indicated support for measures designed to reduce the use of juul products among teens. the governor's actions today stopped short of banning flavored cigarettes, but he told reporters if such a bill lands on his desk, he will, quote, absolutely sign it. in sacramento, laura anthony, abc7 news. >> and as of last thursday, the centers for disease control reported at least six deaths linked to the use of ecigarettes. one of those was in california. another 380 illnesses were attributed to vaping in a total of 36 states. the cdc activated its emergency operation center today in response to the spike in deths and illnesses. it will work around the clock collecting data and helping local officials. the cdc has not said at which level the center will be operation. level 1 is the most urgent, and a level 3 is the lowest.

abc7 news is committed to building a better bay area, and recently we've looked at fremont and how it's tackling the homeless crisis. just last week, the city moved forward with a plan to build a navigation center behind city hall. the issue was contentious, andrew a huge crowd to city hall as the debate went on for hours. fremont's goal is to have it up and running by the middle of next year. >> fremont has more than 600 people who are homeless. about 80% of them are considered unsheltered, meaning they are living on the streets. the city has the third highest homeless population in alameda county behind oakland and berkeley. >> the city of fremd has seen a 27% increase in the number of homeless people since 2017. >> yeah, and as the bay area struggles to find ways to address the homeless, the city

launches a new service tomorrow. >> ansar hassan joins us live with how this would work. ansar? >> yeah, kristen and dan, good evening. one of the major obstacles homeless people face is trying to keep their bed and their clothes clean. this new mobile unit gives them a place to shower and do laundry, two very simple tasks that can be very difficult for people who have no police to go. craig johnson has lived in fremont since 1968 and has been homeless for the past few years. he says being homeless is tough, but what most people don't realize is just how hard it is to keep clean. >> it's pretty hard. i've got a lot of friends because i've lived here so long. but for a lot of these, especially the younger people, they don't have nowhere to go. they're hoping this new cleanll assistance. >> i think the goals are really to provide dignity and a more

healthy environment for our homeless residents. >> inside the unit, there are two full bathrooms. people will be given 15 minutes for a shower. city officials say it's a way to help people stay clean, which they say can be a major obstacle fo those out on the street. >> a lot of our homeless work and having access to a shower to be able to be clean and have clean clothes because we do laundry as well as showers, is really important. >> the trailer won't just serve fremont, but newark as well. the unit cost $125,000 and is a project fund bade grant from alameda county, earmarked specifically for programs to assist the county's homeless population. this man who didn't want to talk on camera says these services aren't enough. the city says it's a start. >> we think it's going to take multiple approaches to address the homeless issue. >> the unit had its inaugural

run this morning. it officially launches tomorrow. they're hoping once it's fully up and running to provide services twice a day, monday through friday. report life-threatening in fremont. aneser hassan, abc7 news. >> thank you. we want to hear your ideas about building a better bay area. share them on facebook. san francisco mayor london breed reacted to reports today that housing and urban development director ben carson is apparently planning to visit the bay area tomorrow. breed was touring the circle navigation center in the city's mission district. the expanding center has just added 60 new beds to bring its total to 186. the mayor said current federal policy leaves significant room for improvement, and that carson should be aware of the effect that it's having on the city. >> and i think that has had a direct impact on homelessness. no new section 8 w d wit wlie b. kennedy. in fact, a lot of the investments that we've gotten we

haven't seen since the obama administration. >> breed promised staff and residents at the center that the city will continue expanding services and adding new shelter beds. well, governor newsom is also asking president trump tooo help the homeless. this comes as the white house is talking about getting more involved in doing something to address california's growing homeless crisis. federal officials were in los angeles as we reported to you last week to see the numerous homeless camps that have popped up there. the governor's request seeks 50,000 more vouchers and to increase their value to account for soaring rent costs in the state. a new warning tonight for those with student loan debt. >> that's right. and a once popular movie ticking service is no more. >> too good to be true. michael finney is here with all that and more. >> you're right about that. here is a story that's important to you if you have student loans. the federal trade commission has taken action against a couple of student loan debt relief

services. the ftc alleges defendants charged illegal up-front fees, leading consumers to believe the money went towards consumer student loans. the ftc says consumers should take this as a warning, saying there are other firms out there making similar claims. it sure sounded like a good idea, but not all good things last. movie ticketing service moviepass was launched back in 2011 has closed down, the less for now. the service offered several different plans. one of its most generous offered a movie a day for $9.95 a month. customers who wanted the best deals had to pay in advance. those customers will be reimbursed. there is nothing to worry about, the website says. there are other similar services still operating, including those offered by amc and regal movie theaters. there is another reason consumers should consider signing up for the new apple credit card.
