but he is defending his actions. >> abc's ines de la cuetara has the new details from washington. ines, good morning. >> reporter: good morning, janai and kenneth. well, the president has until thursday to hand that over whistle-blower's complaint, and some are calling for a transcript to be released. overnight president trump still playing defense tweeting "the wall street journal" report saying he pressured the ukrainian president eight times to investigate biden is, quote, a democrat/crooked media con. trump also taking aim at the whistle-blower who made a formal complaint about that call writing here, she doesn't even have a firsthand account of what was said. trump's pushback coming as he seemed to acknowledge he did discuss biden during a july phone call with the ukrainian president. >> the conversation i had was largely congratulatory, was largely the fact that we don't want our people like vice president biden and his son creating the corruption already

in the ukraine and ukraine. >> reporter: ukraine's foreign minister is now backing up trump's assertion. so far the administration has refused to allow the whistle-blower's complaint to be released to congress even after the inspector general determined the complaint was credible and of urgent concern. now the administration faces a thursday deadline to hand over the complaint for congressional review, otherwise, house speaker nancy pelosi threatening a whole new stage of investigation. republican senator mitt romney weighing in saying, it's critical for the facts to come out and some democrats now suggesting -- >> why doesn't the president simply release the transcript of that call? >> reporter: something the president has not ruled out. >> we'll make a determination about how to release it. >> reporter: and the acting director of national intelligence joseph maguire will face the house intelligence committee on thursday. he is expected to be asked why that whistle-blower's complaint wasn't handed over to congress

as required by law. janai and kenneth. >> and we will be watching this one closely. ines, thanks for joining us this morning. the u.n. general assembly kicks off today and the president is not expected to meet with iran's president who just this weekend called on western powers to leave the persian gulf. but secretary of state mike pompeo is defending the decision to send more u.s. troops to saudi arabia after that massive attack on a saudi oil facility. >> apparently they're bloodthirsty and looking for war. president trump and i are looking for a diplomatic resolution to this. we had a nation state attack another nation state, the largest on the global energy supply in all of recorded history. we're prepared to do the things we need to do to try to deter iran from this kind of behavior. >> overnight british prime minister boris johnson said the uk has concluded that iran was responsible for the saudi attack and he says the uk would consider joining a u.s.-led

military effort in the gulf. we turn to the murder trial of an ex-cop who shot and killed her neighbor. the former dallas police officer says she mistakenly entered the man's apartment thinking it was her own apartment and that he was a burglar. a jury will now decide whether amber guyger committed murder, a lesser offense or no crime at all. this morning the city of dallas is bracing for a former cop's murder trial. >> hi, this is an off-duty officer. can i get -- i need ems. >> reporter: amber guyger admits she shot and killed botham jeann and in the 911 call obtained by wfaa she tells the officer 19 times that she thought jean was in her apartment. >> i thought it was my apartment. hey, man. >> what's his name? [ crowd chanting ] >> reporter: amid protests, a grand jury indicted guyger three days after the shooting. critics and jean's mother questioned why it took so long

for the officer to be arrested. >> give me justice for my son. >> reporter: according to the arrest warrant, guyger had just finished a 13-hour shift and says she mistakenly parked on the wrong floor, walked down the wrong hall and went into the wrong apartment. while still in uniform court documents show the door was slightly open when guyger arrived, and she opened fire when jean disobeyed her commands. legal experts say a murder conviction will be difficult because a decision will likely hang on whether the jury believes the shooting was a reasonable mistake. in this video taken four days before his death, jean is seen leading worship in church where he was a bible study leader. jean's mom was one of the last people to talk to him, and she's now prepared to take the stand. >> it's a struggle, but i'm happy that it's finally -- the time is finally here so that we could get some closure. >> in addition to murder, the jury could find guyger guilty of manslaughter or negligent

homicide, which also carry long prison sentences. that trial is expected to last about two weeks. the mosquito-borne virus eee is now blamed for at least seven deaths in the u.s. the newest deaths from eastern equine encephalitis were in massachusetts and connecticut. meanwhile, a teenager in michigan was recently diagnosed. savannah's mother says her daughter's symptoms started with a headache and now she is fighting for her life. >> our whole lives have been flipped upside down. the tears flow whenever they flow. they come out whenever they want at this point. >> eee will be a threat until colder weather arrives. people in risk areas are being urged to use insect repellent with deet and remove standing water from their yards. in the race for the white house a new poll shows elizabeth warren surging in ohio and it finds warren taking the lead over joe biden for the first time with bernie sanders in a distant third place but that poll also shows only one in five voters in iowa have made up their minds. turning to the weather,
