including one where guyger jokes about the death of martin luther king jr. >> reporter: at harding university overnight a remembrance for botham jean who was remembered at his alma mater for years after his graduation. >> he came through this school and left an impression on the hearts of everybody here. >> reporter: former dallas police officer amber guyger shot and killed jean in his apartment in september of 2018. on tuesday, a jury found her guilty of murder. throughout her trial, she insisted she walked into the apartment by mistake thinking it was her home and believing he was an intruder. then opening fire. it took the jury less than five hours to reach a verdict. >> this ruling will now say that you are safe to be in your homes and people can no longer just say, i made a mistake and took your life. >> reporter: the jury made up of men and women of different ethnicities had the choice of murder, manslaughter or acquittal. >> i wish he was the one with the gun and killed me.

>> reporter: prosecutors trying to point out contradictions in guyger's behavior, beginning with why she went into the apartment despite hearing noise inside. >> you could have called for help on your radio, and you could haad a calvary there in two minutes. >> i could have. >> you could have had s.w.a.t. there. >> i could have. >> had you done any one of those things, mr. jean would probably be alive today. right? >> yes, sir. >> reporter: defense attorney brian buckmire says that was a telling moment. >> when we look at the verdict that was given, murder, not manslaughter, it's obvious that the jury here believed that in opening the door, pushing forward and knowing that there were sounds of somebody inside that her actions inside that home were intentional and not reckless. therefore, that was murder. >> reporter: on police body camera, several officers immediately started cpr to try to save jean, something prosecutors say guyger failed to

do. >> did you properly perform cpr on mr. jean? >> no, i did not. >> reporter: as the tria begins, prosecutors have been given permission to show jurors racially charged text messages linked to guyger. one exchange came during the city's martin luther king jr. parade. someone texts guyger, when does this end, lol. she replied, when mlk is dead. oh, wait. in another exchange two days before the shooting, someone texted her asking if she wanted a dog. do you know what you need? a german shepard? i happen to have one for you, although she may be racist. guyger replied, it's okay. i'm the same. prosecutors showing jurors three posts from pinterest. one image saved by guyger showed a military sniper with overlay text that said, stay low, go fast. kill first, die last. one shot, one kill, no luck, all skill. guyger's defense team is pected to call witnesses as the sentencing hearing resumes today. she could face anywhere from 5 to 99 years in prison. and we turn to the new twist in the explosive impeachment battle in washington.

the state department's independent watchdog is heading to capitol hill today for what's being called an urgent briefing on the ukraine scandal. meanwhile, house democrats are trying to bypass secretary of state mike pompeo as they face off over impeachment witnesses. they're suggesting pompeo has a conflict of interest. abc's serena marshall has the new details from washington. serena, good morning. >> reporter: janai, good morning to you, and all of that happening as the president is ramping up his attacks on democrats and their impeachment inquiry llincait an attempted coup on his presidency. one week into the impeachment fight, the battle between the executive and legislative branches on full display. in italy -- >> mr. secretary, do you have any comment on reports you're on the july 25th call with the president? >> reporter: mike pompeo not answering questions, but back home, trading threats with democrats responding to their requests for

confidential interviews with state department employees as an act of intimidation attempting to bully and treat improperly, those employees. democrats firing back not to pompeo, but his number two writing, secretary pompeo now appears to have an obvious conflict of interest. after new revelations that pompeo was on that call between president trump and the president of ukraine, threatening to withhold his salary and saying he was the one trying to intimidate witnesses or prevent them from talking with congress. >> he basically wants to put the state department in lockdown. >> reporter: but the state department's independent watchdog set to give an urgent briefing to lawmakers today. sources telling abc news the highly unusual meeting is related to the department and ukraine. president trump meanwhile continuing his defense via twitter writing, he has come to the conclusion that what is taking place is not an impeachment. it is a coup, and still trying to unmask the whistle-blower. but the senate's most senior republican not having it. senator chuck grassley rebuking the president writing the statement, the whistle-blower ought to be heard out and

protected. despite the objections of pompeo at least one of the five state department employees confirming they will make an appearance on capitol hill. kurt volker is one of the envoys to ukraine, and he will participate in his deposition on thursday. janai? >> we'll see serena. thank you. a ballistic missile was tested just hours after talks with the u.s. this time, officials say the missile may have been launched from a submarine suggesting kim jong-un is expanding his military capabilities with weapons that are harder to detect. japan believes at least one missile landed in japanese waters. police in hong kong are defending an officer who shot an anti-government protester in the street. they say the officer felt threatened by the student protester who was carrying a pole. it was the first known police use of live ammunition against the demonstrators. the shooting overshadowed the celebration of the 70th anniversary of the communist rule in china. the student is in stable condition.

a judge's decision in a lawsuit against harvard university is being seen as a major victory for supporters of affirmative action in college admissions. the judge ruled that harvard's admissions process does not discriminate against asian-americans by holding them to a higher standard than students of other races. the group that filed that lawsuit is planning to appeal, and the case could end up at the supreme court. we're getting our first look at a daring rescue by police near houston. they formed a human chain in swift-moving floodwaters to pull this family out of their sinking car. officers passed two children to safety before rescuing two adults. imelda has been blamed for four deaths and dumped more than 40 inches of rain. the big weather story this morning is the record heat in the east. so let's take a look at this wednesday forecast. you can call it hot-tober. the south and midwest have already seen this heat wave. schools are closed today in

oh, deer. a georgia woman took a hoof to the head at this gas station. yep. that's right. this deer came out of nowhere. it tried to jump over her and kicked her, but she is okay this morning. she says she was more concerned about being late to work. new details about president trump's effort to block central american migrants from entering the country. when the president threatened to close the southern border back in march, he had reportedly told his advisers that he wanted a border wall fortified with a moat, stocked with snakes or alligators which prompted his aides to investigate what that could cost. officials tell "the new york times," after publicly suggesting that soldiers shoot migrants if they threw rocks, the president backed off, but later suggested that they shoot migrants in the legs to slow them down. his staff told him that would be illegal. the mosquito-borne virus eee has claimed another life in

connecticut. cases have been reported from michigan to massachusetts. many schools have rescheduled sports events to make sure kids are inside before dusk. new york city is beefing up security around movie theaters debuting the new joker film this week amid concerns about violence. the nypd says there will be heavy police presence inside and outside theaters along with undercover officers. authorities are taking precautions after the movie theater shooting in colorado back in 2012 which came during a screening of "the dark knight rises." so drone deliveries by ups are taking off. the shipping service is the first to win government approval to call itself a drone airline. it had been delivering medical supplies in north carolina as a test, and now it can do so throughout the entire country, but don't expect to see a ups drone delivering goods to your door any time soon. restrictions are in place when it comes to commercial drone flights. a woman who bought a couch at a thrift store never imagined what she would find between the cushions. while looking for her cell phone

now to california. an apparent kidnapping caught on camera. home surveillance shows a woman banging on a neighbor's door begging for help. >> police say the woman's boyfriend then dragged her away. kayna whitworth reports police have now used that video to find her. >> reporter: the man in this video is behind bars. the terrifying attack captured on the neighbor's doorbell camera. police say the woman was running from her estranged boyfriend. she's kicking and screaming as the man grabs her hair, violently drags her away and threatens to kill her. >> get up or i'll kill you. >> reporter: it happened in this neighborhood in arcadia, california just before sunday. police got the video monday and moved in, rescuing the woman and arresting 27-year-old robert michael mendez who police say was holding the woman against her will in his home. the video was turned over to police by the homeowner in this case, but the company ring has video sharing relationships with more than 400 police departments across the country.
