interruptions, she was finally appointed surrounded by her daughters. >> i've got to tell you on my way over here, i got to have a beautiful walk through chinatown, right? for anyone who trust i have yet to earn, i will work every day to earn your trust. i will work every day to build safety that is not predicated on a zip code. >> while many agree she's qualified for the job, some supervisor rs critical of the appointment. the election is november 5th, a month away. >> i think it's an unfortunate decision that's really meant to sway election behavior in the last days of an election. >> ironically, mayor breed encountered a similar situation following the death of ed lee. a then board president, breed stepped into the position fl acting mayor while statement running for office. but a month later, january 2018, she was removed from her job by her colleagues on the board because they saw that as a political advantage.

supervisor mark fehr ril was voted in. breed had no apologies. >> we don't leave an office open because an election is coming up, especially one of the most important offices in our city. >> even though the election is on november 5th, in reality the person who wins wouldn't actually take office until january. so the mayor told reporters she didn't want that seat vacant for that long. mayor breed also said that when she heard that gus gascon was retiring, she couldn't help but get excited about the future of san francisco. abc 7 news. >> new at 6:00, richmond police are hoping new doorbell video will help them drak down the suspects in a deadly shooting. two people were killed in a triple shooting in richmond. another person hurt.

police responded to a shot spotter caller near 32nd street and edmond avenue. police believe the people in the blue ford explorer may have information related to that shooting. a fifth parent in the cheating scandal learned his fate today. napa winemaker augustine -- is the first local parent in the case to be sentenced. he received the longest sentence so far. abc 7 news i-team reporter melanie woodrow has been covering the scandal since it broke. >> of all the parents charged, he faced the longest recommended sentence at 15 months in prison. he'll serve a third of that. sentencing to five months in prison for his role in the college admissions scandal. it's the longest sentence a parent involved has received so far. he pleaded guilty to conspiracy to commit mail fraud and honest services mail fraud. federal prosecutors say he

agreed to pay rick singer, the mastermind behind the scandal $300,000. the money disguised as donations to singer's foundation was to participate in the college recruitment scheme. part of the bribe was for his daughter to be recruited as a usc water poef low player, a sport she didn't actually play competitively. ult maley, he was arrested before he could make a final $200,000 payment. they had asked for leniency because his daughter wasn't admitted to usc. in a recorded conversation, he worried the scheme could blow up in his face, something i asked him about in march. >> is this what you want by blowing up in your face. >> a judge sentenced him to two years supervised release, 500 hours community service and a $100,000 fine. >> four other parents have already been sentenced. felicity huffman received 14 days in prison, devin sloane

>> deandre summerville learned a lesson the hard way. the 21-year-old received a summons for jury duty. his first time in a courtroom. he was chosen to serve as a juror on a civil case and told to come back the next day, 9:00 in the morning. >> i woke up and looked at the time. i was like, oh, shoot, it's past the time. >> instead of calling in to court to let them know he overslept, he went to work. days later, he received a subpoena to go before the judge. >> i stay at the beginning of every trial, i talk about the importance of jury service. >> i just said, sir, i honestly, i overslept. and i didn't understand the seriousness of it. he asked if i had a criminal record. i said i've never been arrested. >> what happened next stunned him. despite apologizing, he sentenced him to ten days in jail. his failure to appear delayed the trial by 45 minutes. he lives with his grandparents. he says he could only think of

taking a live look at san francisco airport. new nonstop flight next year. you can fly direct from sfo to rome starting this june. about 12 hours of travel time. it hasn't operated out of sfo since 2001. lax is banning uber, lyft and taxis from picking up travelers at the curb. instead, they have to take a shuttle to a designated dropoff area starting at the end of the month. lax is the latest major airport to do this. other airporting ban can you remember -- a lyft meantime is offering new rewards to drivers including a new pay structure, cash bonus is one perk. up to 5% cash back on gas. a bill just became law to reclassify rideshare drivers as

clara, including murder. >> the attack was random but deliberate. abc 7 news reporter chris nguyen has the story. inside the santa clara county hall of justice, she was in tears as she learned her bail was denied by the judge. the long time resident is accused of a deadly rampage tuesday afternoon at the rancho san antonio open space preserve near cupertino which claimed the life of the man in sunnyvale. >> i don't get why someone would want to repeatedly hit somebody over and over for no reason. he was just walking. he didn't do anything wrong. >> michelle andrews was his neighbor for 15 years and shared her disbelief. >> respectful. nice. kept to himself a lot. >> she drove on to the trail where she hit him with her vehicle intentionally reversed and drove back and forth over his body multiple times as seen by a witness and a park ranger.

court documents reveal she fled the scene and tried to hit another man on a different part of the trail. he dove to the ground to avoid getting hit and hid behind an oak tree. >> she faces 33 years to life. >> she faces three counts including murder with enhancement for using car as a deadly weapon and resisting an officer. legal analyst and former prosecutor steven clark says determining her mental state at the time of the attack will be key for the defense. >> they will reverse engineer her mental health history to look into whether she has any serious mental health disorders or whether there was something going on that caused her to act in this way. >> authorities say the victims appear to be attacked at random. >> the d.a.'s office will ensure that she's held accountable to the full extent of the law. we will ensure that the victim's family will see justice in this case. >> she's due back in court on the 7th for a plea hearing.

at the hall of justice, chris nguyen, abc 7 news. dramatic moments in the hillsborough heiress murder trial when the mother of the victim took the witness stand. this is tiffany lee in the light pant suit leaving the court. she and her boyfriend are on trial for the murder of her ex in 2016. green's mother took the witness stand today. we've highlighted her showing her exiting the courthouse and hugging friends and family after her testimony. she told jurors that she talked to her son on the night he disappeared. he told her he was going to meet lee that night. she cautioned him to meet lee in a public place. prosecutors say after meeting outside millbrae pancake house, she lured him to -- green was killed by olivier adella in a kidnapping gone wrong. he worked as a bodyguard and

personal trainer. ghost ship founder, derick almena will be tried again in march for the deadly warehouse fire. it's one month after the co-defendant, max harris was found not guilty. amen a's team wanted his bail reduced but it was rejected by a judge. laura anthony has the story from oakland now. >> there is nothing that i can do that can take away what happened. nothing. >> derick almena's wife, had hoped his bail would be reduced from $750,000 to something his family could afford. but an oakland judge disagreed. >> i'm really sad about this denial of the bail. alder rick wants to do is be with his kids. that's all he ever wanted. >> he's been in jail for more than two years and he will stay there until the next trial on 36 counts of involuntary

abc 7 news. members of an oakland school community are demanding action following a hit and run that killed a pedestrian this week. >> when safety is under attack, what do we do? >> parents, students and administrators from garfield elementary school staged a protest at 22nd avenue and foothill boulevard in this morning. they're hoping to get drivers to slow down on the busy street. the effort is after a woman was killed on tuesday. her niece, the garfield student was injured. police evacuated hundreds of students from a fremont middle school after someone e-mailed a bomb threat toe the campus. police tweeted around 9:00 a.m. that they were investigating a bomb threat at thornton junior high school. investigators say they had nothing to prove the threat was credible but took measures and evacuated the building. a thorough search found nothing suspicious and police gave the all clear around 10:00 a.m. detectives are now investigating this anonymous email to see if
