continue to commute in this morning. i want to move back over to livermore quickly because i am learning that that big rig that was turned over on its side involved in that three-car crash, this is westbound 580 past greenville road should all be cleared up in the slow lane in about half an hour or so. hopefully that will be done. guys? governor newsom calling for an investigation into why gas prices are so high. >> a new analysis shows drivers pay as much as $1 per gallon than the rest of the country. the national average you can see is $2.64, but not here in california. the average is $4.13. abc 7 news reporter lauren martinez is live with a look at what is going on. good morning, lauren. >> reporter: good morning, kumasi and reggie. a new report from the california energy commission is suggesting that big oil companies are misleading and overcharging drivers by as much as $1 per

gallon. now the report says brand retailers like 76, chevron and shell often charge more because they say their gasoline is of higher quality. but analysis from the report could not explain the price difference and the quality of gasoline. so the governor wrote a letter to attorney general javier beccera asking his office to investigate whether oil companies are price fixing or engaging in false advertising. we spoke with a man from berkeley who travels to sausalito for work and the high gas prices are cutting into his paycheck. >> i mean, look at it right now. it's $4.34. it's going to cost me $97 to fill it up. that's a lot. so limits what can i do and where i can go. >> reporter: the california energy commission said they don't have any evidence that gasoline retailers fixed prices or engaged in false advertising but the industry could not provide any proof that its

gasoline was better than what the state requires all retailers to sell. now they said in an email they did receive newsom's request and will handle accordingly. reporting live in emeryville, i'm lauren martinez, abc 7 news. >> thank you, lauren. now to the south bay. santa clara police are investigating some high school athletes for allegedly using homophobic slurs to bully a male cheerleader. members of the wilcox high football team yelled the slurs back on friday. school district reached out to police yesterday. lgbtq allies say what happens next within the wilcox high school community is pivotal. now the mother of a male cheerleader says he was back at school on monday under security watch. police say as they talked to witnesses and victims, if they find there was no actual crime committed they would turn it over to santa clara unified school district. new developments this

morning in the college admissions scandal. lori loughlin's daughters are no longer enrolled at usc according to the registrar's office. the actress and her husband are accused of paying half a million to a fake charity to get their two daughters accepted. both have pleaded not guilty. and this atherton husband and wife who pleaded guilty are scheduled to be sentenced in february and march. they are accused of paying $400,000 to have their daughters' college entrance exams corrected. they paid to help one daughter get admitted into georgetown as a fake tennis recruit. gary phillips is back to his political duties after having a heart attack. 75-year-old started having chess pain while playing in a golf tournament about a week ago. he was rushed to the hospital where doctors put a stent into a blocked artery. the mayor told the marin independent journal he had no prior signs of heart issues and now he's feeling fine. >> two months after getting treated for her fourth bout of

we have breaking news in to the live desk right now. former president jimmy carter has been hospitalized with a pelvic fracture after falling at his georgia home. i want to bring up here this is a tweet from the carter center. it says former u.s. president jimmy carter had a fall yesterday evening at his home. he has been admitted to the medical center for observation and treatment of a minor pelvic fracture. he is in good spirits and that he is also looking forward to recovering at home. so earlier this month we know

that carter fell and had required stitches, but he went and helped build homesor f habitat for humanity the very next day. mr. carter turned 94 years old, the oldest surviving president in u.s. history. we will monitor his condition as soon as we learn more information we will let you know. more trouble for a san francisco-based juul lab. a man says vaping juul products for a year put him in the hospital. he says 80% of his lungs filled with fluid. he spent two weeks in the hospital and was put into a medically induced coma. >> you're sitting on a bed and your parents are looking at you and your family and you don't realize how much you're cared about until that happens. >> so evans has filed a lawsuit claiming juul failed to, quote, properly assess and warn about the harm its products cause to the human lungs and body. you can hear from his attorney coming up on "gma" at 7:00 right

after abc 7 mornings. here is a video we've been watching, a crafty suspect in new york city. look at that. takes a jump out of the squad car even though he still has handcuffs on and he didn't get very far. an officer took him down in the middle of the intersection. he lost a shoe in the process and then the other officers swarmed in to help out. they say that suspect was arrested for being part of a crowd that was gathering around a shooting crime scene there. >> i want to see this again. >> here he goes. and stopped. >> where did he think he was going? >> i don't know. and, i mean, being a part of a crowd, that wasn't a huge thing -- it seems like it didn't have to go that far. >> yeah. speaking of going too far, speaking of someone who needs to come and get this woman, this kansas woman knows how to pump up the motivation to go to the gym. ♪

livermore but it is going to impact the commute from tracy. they tweeted out you can expect this cleanup to be clear in about an hour. there were four cars, four vehicles ived in this crash, two big rigs, two cars, an axle broken, a big rig turned on its side. they have to get the fuel out of the big rig so there's a lot of work that needs to be done here and it's going to be a while. >> jobina, thanks for the warning. the bay area getting ready to go dark. >> abc 7 news reporter live for us in half moon bay. amy? >> reporter: the san mateo county ad is a new one and we are finding people in half moon bay didn't know this was a possibility so we need to help spread the word. talk about it throughout your day if you live in san mateo county this could be happening. we did talk to some people who are frustrated to hear this is coming. pg&e says it has not decided yet whether it will be turning off the power. they are watching the weather. they took marin county off the list but added parts of san mateo county. the ceo says he understands this creates hardships but this is the new reality as they try to prevent fires. if the power is turned off here in san mateo county pg&e says it would happen around 2:00 a.m. on thursday.

>> i have a generator, i'm all set. i have power. people who don't have power but the last time a day and a half we're out of juice so, yeah, they're just covering their rear ends. >> reporter: this possible power outage could impact up to 201,000 customers. the bay area customers that could lose power are napa, sonoma and san mateo. they could start as early as wednesday evening. forecasters checking the weather models every hour and that they will make the call when they are ready. amy holly feel, abc 7 news. we are keeping a close eye on pg&e's actions and will let you know the latest plans through our abc 7 news app. get push alerts as we fiend out more. firefighters are watching for flare-ups from the wildfire

near brentwood. firefight hers a tough time reaching the flames. the fire blacked out 105 acres before crews finally got it under control but didn't threaten any structures. evacuation orders are now lifted for this fire because crews have it under control. they stopped the flames before they could come over a ridge. the fire started yesterday morning, crews remained on the scene to make sure the 40 acre fire doesn't reignite. the deadly overnight shooting in the tender loin. we have been following this for you all night since getting word just after 11:00. police say at larkin street and golden gate avenue about a block away from the civic center. they eventually died at the hospital. no word yet on his name or any

possible suspects. we'll let you know as soon as we get more information. >> okay, jobina, thank yo happening today, observing begins a two-week cleaning operation at a homeless camp. >> sky 7 was over the site near high street. the city says it's become a fire danger and people are being asked to move to the other side of the lot while the city workers remove amounts of hazardous materials including wooden structures, propane tanks and trash. the city will let residents come back once it's clean. it will create and maintain a new fire lane pathway so emergency vehicles can get in and out. >> key testimony in the impeachment into president trump. the top u.s. diplomat of ukraine will testify privately before house lawmakers. william taylor is one of the people at the center of the impeachment inquiry. he raised the alarm over the possibility the president may have withheld foreign aid in exchange for political dirt on joe biden.

>> have to get tougher in the fight because the democrats are trying to hurt the republican party for the election. >> the president's key supporters including south carolina senator lindsey graham say they will stick by mr. trump. happening today san francisco is tackling traffic safety. sfmta will get an update on the effort to stop drivers from running red lights. the city plans to install cam a cameras like this one. cameras at eight other intersections will be upgraded. other changes can also help. red light violations accounted for about 300 crashes last year. >> it's a vacant lot right now but about to be part of the solution to one of the major challenges we face in building a better bay area. you are looking live at the big board at the new york stock exchange starting down just a tad this morning. another update on the markets next. our commutes are getting worse but there's an app that could save you time and money.

>> first, though, it is 6:37. drew is here with a look at our forecast. >> a wam one this afternoon. we are tracking that fire weather watch that will begin at noon in the north bay and then expand into the east bay hills starting at 8:00 p.m. tomorrow evening. areas shaded in orange, what you'll find are winds developing out of the north and northeast. that's an offshore wind, a dry wind this time of the year gusting 30 to 40 miles an hour. there could be isolated spots in our highest elevations that gust well over 50 miles an hour. any fires that start could spread rapidly. hour by hour we go, the winds become active first. and then as we go overnight into early thursday morning, 4:00 a.m., you can see those winds are very akive across the northern half of the viewing area gusting close to 40 miles

pass by? for people using drugs openly people don't feel disgusted? >> in response mayor breed told us the billboard is hurtful, disrespectful and no place in san francisco politics. the billboard is paid for up until the november election. it's not going anywhere. b.a.r.t. says banning panhandlers and performers from trains is legal and it has the research to back it up. b.a.r.t. staff will complete their findings to the board of directors thursday. they looked into panhandling bans across the country after floating the idea severa months ago. in august the aclu clapped back at that proposal. the organization sent an email at that b.a.r.t. saying a ban on solicitors also bans free speech. it's one of the toughest challenges when we look at building a better bay area, finding affordable places to live to fix our housing crisis. there is hope in places like the south bay. this week santa clara county leaders are expected to approve a new wave of affordable housing projects thanks to a fearly $1
