mayor london breed is celebrating with her supporters. i'm kate larson in san francisco where the race for district attorney is getting heated. a packed meeting tonight. on the agenda, possible crack down on short-term rentals. in san jose, a father knocked unconscious. tonight we hear from the victim. abc 7 news starts right it's election day for several bay area communities and the results are coming in right now. two major races in san francisco. >> the race for san francisco's district attorney has become a nail-biter and mayor london breed is cruising to re-election. >> mayor london breed is winning with 60% of the vote ellen

>> tonight as you said she is handily in the lead and really no surprise. it's hard to beat an incumbent and the five challengers running against her are really relatively unknown to voters. she greeted her supporters, thanked them for their support and vowed to work hard particularly to combat homelessness. >> it feels good. i'm excited, but i'm also, like, anxious to continue to get the work done because i want them to be proud of the decision that they made. i want them to see a difference and be happy about the conditions of san francisco, and that's going to take a lot of work. >> now, enthusiasm for mayor breed, though, does vary. a recent poll showed just one third of san franciscans approve of the job she's doing, another

third ambivalent. one man said he left the mayoral race spots blank on his ballot. >> i'm not super thrilled with the way that the da appointment happened. i think that should have been left -- i also haven't been happy with the way she's been like tough on crime the same way other people in the past have been. the raids have continued for the homelessness, stuff like that. >> reporter: a lot of work ahead. still breed is celebrating tonight. this would be her first full year term as mayor. up until now she's been finishing up the term for the late mayor ed lee. let's move onto the san francisco district attorney's race which is too close to >> boudin is making a strong showing tonight with 33% of the

vote. and loftus has 31% of the vote. >> reporter: this is what the camp has been predicting, that they would start to catch up later in the night because more conservative voters tend to vote later and loftus is more conservative candidate. take a look. it is packed shoulder to shoulder inside right now with a background in law enforcement loftus has promised to crack down on crime that affects quality of lifelike car break-ins for example. but mayor breed's appointment of loftus to interim da so close to an election has proved very controversial. some see the mayor's clear endorsement of loftus as a positive while others feel it amounts to but she says she's optimistic about the prospect of keeping

her job in the da's office. >> let me tell you, i was on the street up until the polls closed talking to people and making their decisions and they want what we want. let's keep hitting refresh, right? cautiously optimistic, thank you all. >> all right, so not too far from here boudin is having his party. he's a san francisco public defender. he's usually on the opposite team of the prosecution, and he's a favorite among reform minded progressives. this week boudin receives a very high profile endorsement. he grew up with both of his parents in prison, they were get away drivers that resulted in three people being killed. he wants to stop prosecuting many low level crimes like drug possession at the same time

tougher on questioning police officers. he's optimistic he'll ultimately prevail in this race. >> i've been out all day talking to voters and i know how hard my team worked. i know we had the best ground game, i know we had the most social media. i know we had the best platform and ultimately san francisco voters are smart, they're paying attention and they're going to vote for the candidate who's committed to reform, not a candidate who says reform but has a track record of status quo. >> the night is still young, but a very interesting race for san francisco's da's office. there hadn't been a non-incumbent race for more than a century in san francisco for this position. and they're hoping it will cleanup the district attorney's office which has lost a third of their lawyers since january. >> now to san francisco's prop c. if approved it would overturn san francisco's ban on the sale

and distribution of some e-cigarettes and vaping products. you can see proposition c looks like it's going down in defeat hard. 81% of the people saying no. with 99% of the precincts reporting. your uber or lyft rides could get more expensive. san francisco prop d would a tax on ride shares. the tax money would go towards transportation and pedestrian and bicycle infrastructure improvements. after negotiations with city leaders uber and lyft agreed not to oppose the tax. >> voters in san francisco also deciding prop e, and as you can see 74% say yes to opposition e. it would allow for 100% affordable housing projects and educator housing projects in public zoning districts. it would also allow of the approval of the projects to be

expedited, moved along much faster in terms of permitting and everything else. >> long time san francisco columnist and now abc contributor phil mateer is here. >> conventional wisdom would say they are on the spectrum along with suzy loftus. more on the traditional law and order side of the equation. he's on the reformer side that says fewer incarcerations. it's conventional wisdom that says, okay, rank choice voting you get four picks or five picks and the ones that have the lowest numbers drop out, it adds up. i would say loftus' people feel quietly confident they're going to win this one, although it could be very, very narrow and we might not know tonight. >> the da's office has been

really a launching pad of talk about the importance of this position. >> first of all, it is the top cop in san francisco, and that is position that naturally puts you in the national spotlight because so many things happen in san francisco, whether it be on the streets or in the crimes, we tend to lead a nation. also this is on the agenda right now, which directions should cities go in terms of criminal justice? we've heard about in chicago, in los angeles, even in alameda county last year. what we have here is a split. the new groups are saying what we need to do is less incarcerations, more deterrent and not prosecute let's say homelessness, not make it crime, let's not get the police involved in it. you have another group saying we're not talking about necessarily putting people away for a long time but sometimes they need a time out. and that is the split you're

going to be seeing here and other cities. so the whole country is going to be watching. it's also good for mayor london breed. because if she is going to go ahead with her agenda, she won two big ones tonight, the housing bond and the permission of the voters to build more housing. plus that 68% of her own vote, she's going to come out of this strong. >> you hear san franciscans complain a lot in terms of ride share cars taking over the city. voters also weighing in on that ride share tax -- >> that's close. how many people do you know complain about too many lyfts and ubers on the streets? >> all the time. >> how many people do you know take uber and lyft all the time? in this case what they do is came to a compromise agree you might hate us but we can provide

tonight the city council meeting began with a moment of silence. >> everybody was screaming, crying, running, you know, going from here, there and down there. everybody tried to escape. >> reporter: and now there's talk of cracking down on short-term rentals like the home where the party took place thursday night. it was rented through airbnb. >> banning airbnb is not a solution. >> reporter: many in this packed audience were in favor of letting hosts continue to operate short-term rentals if done responsibly and by the letter of the law. >> this is done everywhere lafayette, berkeley, everywhere. >> reporter: but others feel strongly. one incident is too many and more needs to be done to limit the rentals. >> banning them entirely at

least on a temporary basis until we can figure out how to make sure this sort of thing doesn't happen again. >> okay, we can't have clapping, thank you. >> the council had the option of considering an all out ban on short-term rentals requiring hosts to stay on the premises or mandating a two night minimum stay in the city. and the council will make a decision and then direct staff to investigate. they should come back with more information november 19th. >> lisa, thank you. and we've learned there are 24 investigators on the case. their police chief gave an update tonight. >> the investigation is continuing with the police department and a variety of other local bay area agencies and the federal bureau of investigation. >> now, the brother of farly who died in the shooting stopped by,

he said he was expecting a son in march. >> we're down right now, but this is going to make us stronger as a family. >> his half brother was charged with murder in a deadly shooting in 2015 in san francisco. our media partner the mercury news reports investigators are exploring whether the shooting is possible retribution for that attack. in san jose, coming up a frightening attack outside of a family home. what the family says their concerned about now. also here tonight a surprise scything on b.a.r.t. today. we get to the

only on 7 a father in the south bay is knocked unconscious by crooks on halloween night. it happened outside his home in san jose's willow glen neighborhood. amanda del castillo sat down with the victim. we do want to warn you some of the images are graphic.

>> reporter: halloween night the hsband approached two people insisting they leave the premises. soon after everything went black. >> i don't remember too much after that because out of nowhere something hit me in the face. >> reporter: though graphic photos reveal the violence, a concussion, broken nose, 16 stitches, injured ribs and at this point missing keys. >> my children saw their father this way and, you know, they were traumatized. >> they put me on a gurney, shoved me into the ambulance. that's a ride i never want to take again. >> reporter: after hours in the hospital the family finally returned home. >> we were only home about 10 minutes before the car was stolen. >> reporter: so she posted to facebook to alert neighbors. among the hundreds who reached out was a san jose police officer. >> this gentleman took a special interest in us, and he is the reason that they were found. >> reporter: the call came monday, the car located miles away. two people arrested.

>> i've got a phone, i hit 911, people that aren't supposed to be here. >> reporter: for now the family will focus on security and recovery. new developments with the dramatic rescue at the colosseum b.a.r.t. station over the weekend. john o'connor, the b.a.r.t. supervisor seen pulling a man to safety just seconds before a train came barrelling into the station is going to be honored this thursday. a he's going to be a hometown hero. we've seen all sorts of things on b.a.r.t. over the years, but a horse went for a ride this afternoon on a train. it's all perfectly legal. b.a.r.t. says the passenger and horse showed up at the rockridge station with the proper paperwork to say it's a service animal. the law permits service animals to accompany people who have disabilities. >> time to check on our weather.
