the sleepwalking murder trial. should a man be held responsible for murdering his wife if he was sleeping while the shots were fired. plus, how early is too early? the debate raging over radio stations already playing nonstop christmas music. and "the little mermaid live!" behind the scenes, what you didn't see during the tv performance. good wednesday morning. thank you for joining us. we begin with an election night upset breaking overnight. >> results coming in from key races in several states. and democrats are claiming a big night. the biggest story is from the governor's race in the red state of kentucky where democrat andy beshear declared victory over the incumbent republican matt bevin even though analysts say the race is too close to call. >> president trump who won kentucky by 30 points in 2016 threw his support behind bevin at a rally monday. democrats say this race proves their momentum nationwide.

>> i haven't had an opportunity yet to speak to governor bevin but my expectation is that he will honor -- he will honor the election that was held tonight, that he will help us make this transition, and i tell you what, we will be ready for that first day in office and i look forward to it. nod a >> we are not conceding this race by any stretch. here's the thing, understand this, though. understand this. we want the process to be followed and there is a process. >> bevin would need to win court approval for a full recount. meanwhile responding to the results president trump's campaign said the president's rally monday helped bevin finish stronger than expected and helped five other kentucky republicans win their races. it was a good night for democrats in virginia. they won control of both houses in the state legislature. that means virginia will be under complete democratic control for the first time in 25 years. but good news for republicans in mississippi. lieutenant governor tate reeves will take over the governor's

mansion there and easily defeated his democratic challenger. we turn to the other big story this morning, the massacre in mexico. an american family slaughtered on the way to a wedding. this morning new stories of survival are emerging. >> nine members of the same family were ambushed and killed just across the border from arizona. a quick thinking teenager is now being credited for saving several of his siblings hiding them in bushes along the road. >> we've learned a baby was found alive after she was hidden under the seat of an suv that came under attack. this morning, stories of heroism and survival after the deadly ambush on an american family in mexico. the group was traveling by caravan picking up family members for a wedding when they were attacked by a drug cartel in an apparent case of mistaken identity. nine members of the mormon family were killed including three mothers and six of their children. two of them were twin infants. this morning relatives say a 7-month-old baby named faith is alive thanks to a final selfless act by her mother.

>> i don't know if christina in her last moments of life saved her daughter by laying her on the floorboard. >> baby faith was found alive hours after the attack. >> they think that maybe the mother tried to put the child like on the floor under the seat in some way to save her life. >> reporter: meanwhile a 13-year-old boy is credited with saving several members of the family. relatives say the teen hid six of his siblings after their mother was shot and killed and then walked 14 mile foss get help. >> he basically saw that cartel shooting. there were like 60 people shooting at them from all over the mountains around and the little kid decided to keep the kids away in the bushes. >> reporter: mexican officials say the women's three suvs may have been mistaken by rival drug gangs. the family is part of a religious settlement in sonora

state known for its drug violence and violent crime. abc's tom llamas is in mexico. >> i asked a former mexican intelligence officer why these vicious criminals would shoot and kill innocent women and children. his chilling response, because they can. he says they are the law in that section of mexico. >> reporter: president trump addressed the ambush saying mexico with the help of the united states must wage war on the drug cartels. mexico's president responded saying he's grateful for trump and his offer but says his country will move forward alone. family members who survived the attack are now being treated at a hospital. now to the impeachment battle in washington and one of the new admissions from gordon sondland met by protesters overnight arriving at the airport in portland, oregon. he says he did not change his testimony to acknowledge a quid pro quo in the ukraine scandal but that seems at odds with a newly updated transcript of his testimony. abc's karina mitchell has the new details. karina. >> reporter: good morning, kaylee. it was a stunning reversal by

one of president trump's loyal supporters, and it came in a four-page statement telling lawmakers his memory was, quote, refreshed and that he personally delivered the message president trump allegedly sought to send to ukraine. for the first time gordon sondland revising his testimony confirming a quid pro quo linked to ukraine announcing a public investigation into president trump's political rivals in exchange for $400 million in military aid. sondland adding the public statement would need to come directly from ukrainian president zelensky himself. in his original testimony sondland denied any preconditions to aid when asked. the president has used the testimony in his defense. >> the ambassador who i heard was tremendous and a tremendous person, he was 100% for what we're saying, 100%. and if you look, he also said there was no quid pro quo. that's the whole ball game. >> reporter: but sondland says he was just repeating what the president told him on a phone

call and now he says his memory was refreshed from other key witnesses who contradicted his initial statements. >> it's never too late to do the right thing. people want to keep coming forward telling us the truth, we'll welcome it. [ crowd chanting ] >> reporter: arriving back in portland overnight, the ambassador was met by protesters chanting tell the truth. >> i didn't change my testimony. >> reporter: the white house dismissing sondland's reversal. >> the transcripts that were released today show exactly what the president has been saying all along. that is he did nothing wrong. >> reporter: in a statement the white house argues the transcripts show even less evidence for impeachment than previously thought. house democrats have requested acting white house chief of staff mick mulvaney appear for a deposition friday but his testimony like others this week will likely be blocked by the white house. kaylee. >> karina, thank you. a developing story where two murder suspects are on the run after escaping from a jail in

monterey sunday. last night authorities evacuated a motel six in the nearby city of morena after getting a report that one of the suspects had been seen there, but after a nearly eight-hour standoff, police stormed into the room only to find it empty. the inmates escaped the jail sunday by climbing through a hole in the ceiling. turning now to the weather, snow is making the morning commute slick across parts of the upper midwest. let's take a look at your wednesday forecast. good morning. we're tracking more snow and cold across the great lakes from northern michigan back into southeast minnesota. one to three inches expected. some spots locally more as we head into tonight. farther to the south it's heavy rains from north texas into oklahoma and northern arkansas. up to five inches possibly which could lead to flooding as we head into tonight. wintry weather widespread across the northeast as we wrap up the workweek. northern new england, 6 to 12

off. the car's owner is recovering from minor injuries. the family who say they were the victims of racism at a buffalo wild wings are speaking out. justin vahl and his family requested a table for 18. he says the host asked for the race of the group. allegedly because another customer didn't want to be seated near black people. some of the children cried as their parents spoke at a news conference tuesday. >> i was appalled. i was astonished. i was in a restaurant trying to take my family and friends and kids to a restaurant and i was being asked what race i was. >> to see them try to understand is hurtful, right, because that's something they shouldn't have to do. you look at them. and they're all different. and they need to know that's okay. >> buffalo wild wings apologized and fired the employees involved and that customer has been banned for life. at&t is settling a government complaint over its unlimited data plans.

lazarine said he sauled his wife and said he had just dreamed he shot and killed his wife of 35 years. but it wasn't a dream. he admits he shot her half a dozen times and claims it was involuntary on account that he was asleep. >> there are other witnesses over there that have seen the manifestation of his sleep disorder and we thought that would be important for the jury to know. >> reporter: taking the stand for the defense four men who each at one point had been incarcerated with lazarine since the murder and talked about his odd sleeping behavior. how he would often walk in his sleep both day and night. also on the stand, a sleep expert who gave him two sleep tests in 2015. >> he did have a lot of movement in rem. in rem you're not supposed to move. you're supposed to be paralyzed. >> reporter: as for the prosecution they called debrah's oldest daughter to the stand and she described lazarine as a heavy drinker and in damaging testimony for the defense, she said lazarine had threatened to kill her mother in the past.

more testimony is scheduled today and, if convicted, lazarine could face life in prison. a sheriff's deputy is charged with child abuse after this video showed him grabbing a 15-year-old girl by the neck and slamming her to the ground. willard miller has been suspended without pay. the incident came after the girl appeared to kick him. it happened at a school for children with emotional and behavioral issues. a pennsylvania woman has been arrested accused of falsely claiming she had cancer and collecting more than $10,000 in donations from good samaritans. police say the woman calling herself jessica cornell used facebook and a fund-raising site and went on podcasts to tell her story, but that's when something didn't add up. >> the whole interview seemed off from the very beginning. i have a lot of experience reading body language so i could tell she was lying. she was kind of going through like a cancer check list. >> reporter: the suspect's own husband eventually reported her to the police. facebook and the fund-raising

>> that's after ranked choice voting kicked in. lauren martinez is live in san francisco with so much more on this race. >> that's right. you know, we reported that this race is one to watch for and the results are proving that to be true. ches boudin was in the lead last night, but this morning it is shows suzy loftus, mayor breed's pick, is in the lead. it's a close call. suzy loftus has 47,234 votes. ches boudin has 46,494 votes. there's only a difference of 240 votes between them at this time. this week boudin received high indoe endorsement from bernie sanders. boudin grew up with both of his parents in prison. they were caught up in a height in the 1970s. he has a different perspective on crime. he wants to stop prosecuting

low-level crimes like petty drug possession, while at the same time getting tougher about prosecuting police officers in questionable use of force cases. now last night we spoke with boudin at his party in soma. >> i've been out all day talking to voters. everywhere i go people voted for us. i know how hard my team worked. i know we had the best ground game. we had the most social media. we had the best platform. ultimately san francisco voters are smart, they're paying attention, they'll vote for the candidate who is actually committed to reform, not a candidate who says reform but has a track record of status quo. >> he is optimistic that he will ultimately prevail in the race. suzy loftus is cautiously optimistic she'll win this race. loftus has a background in law enforcement and promises to crack down on crime. mail-in ballots still
