the latest. good morning, elizabeth. >> reporter: mona, good morning. another health scare for former president jimmy carter has him waking up in the hospital for surgery scheduled for later this monk with his family asking for prayers. former president jimmy carter back in the hospital this time for brain surgery. the carter center confirming the 95-year-old is at emory university hospital in atlanta for the procedure to relieve pressure on his brain. abc news learning the swelling in his brain is due to multiple falls. he fell back in may breaking a hip then he fell twice last month. >> i fell down and hit my forehead on a sharp edge and had to go to the hospital. >> reporter: carter seen here following his fall in early october, the atlanta braves hat covering his 14 stitches and a black eye. another fall just weeks later left carter with a minor pelvic fracture, but despite his health issues in recent yearsner down.

showing his support here for one of his favorite causes, a habitat for humanity event in nashville and teaching sunday school as recently as last week, then earlier this month the longest living u.s. president made headlines revealing he was at ease with death after his bout with cancer in 2015. >> so i assumed naturally that i was going to die very quickly and i was in prayer about it. i didn't ask god to let me live and i found that i was absolutely and completely at ease with death. >> well, carter went on to say his only concern about dying was missing his family. right now he's said to be resting comfortably with his wife rosalynn by his side. mona and kenneth. >> elizabeth, thank you. and breaking news overseas. more violent protests in hong

million immigrants. the case being heard today will challenge president trump's decision to end the daca program. started by former president obama that allows undocumented immigrants to stay in the u.s. if they came here as children. those people have become known as dreamers. they include leezia dhalla who came from canada when she was 6 just and said the only reason she didn't become a citizen is because of a paperwork mix-up. >> i think there's a lot at stake. our entire lives are built on this program. we don't kvernment should not e immigrant laws based on age. the court will decide whether president obama had the authority to create the program without approval from congress. a developing story from san diego where a 19-year-old has died after an incident at a fraternity house. san diego state university has now suspended all fraternities on campus. the victim reportedly suffered a

a college gymnastics star who has died at the age of 20. melanie coleman was her team's captain at southern connecticut state university. she passed away after a training accident in which she suffered a spinal cord injury. her coach says coleman's team is heartbroken. >> melanie was one of those gymnasts that just no matter what the adversity just kept pushing herself to be better and to do more and in turn made others around her better being a total role model for the entire -- our entire team here. >> coleman was studying nursing while practicing in gymnastics. in the past she had been honored by usa jennifer aniston as an all-american scholar athlete. there could soon be another democrat running for president. former massachusetts governor deval patrick is considering jumping into the race. patrick ruled out a presidential run earlier this year but sources say he doesn't think the other candidates have gained enough momentum. meanwhile, the latest poll shows

former vice president joe biden holding on to a narrow lead in the first primary state of new hampshire. and new questions this morng aboutafet 38 planes that the airline bought from foreign companies are waiting comprehensive inspections according to "the dl wally remain in operation. southwest has agreed to complete those inspections by the end of january, or it could be penalized by the faa. an arby's restaurant has been causing controversy in minnesota after posting a policy when it comes to children. a sign on the door said, only well behaved children who can keep their food on their trains and their bottoms on their seats are welcome. if you can't do this, you will be asked to leave. the sign has since been taken down, and arby's reportedly disciplined the manager for not reflecting company values. well, coming up, the backlash after a man is handcuffed by police for eating a sandwich at a train station. also, a family fights for the right to keep their baby on

to give her all the chances there are. >> reporter: 9-month-old tinslee lewis has spent her entire life in the hospital with a rare heart condition and lung disease. now tinslee's medical condition says her team will never improve and the treatment keeping her alive is causing her pain. the hospital gave the ten days' notice required by law and planned to stop the ventilator yesterday. but a judge has now stepped in issuing a temporary restraining order. >> i thought they was going to pull the plug on my baby. i didn't think that she was going to still be here today and that's what i'm grateful for. >> reporter: in a statement the hospital called the decision gut wrenching but said, quote, we feel it is in her best interest to free her from artificial medical intervention and suffering. this morning, her family says tinslee deserves a chance to fi for. >> if that machine is giving her that smidgen, don't take it away. >> now the hospital says nearly 20 other hospitals have refused

to take tinslee in as a patient and agreed with the doctor's assessment. the judge has now given the family until november 22nd to find a hospital willing to admit her. the head of uber is under fire after calling the murder of a "washington post" columnist a mistake similar to a car crash. during an interview with the news site axios, the ceo was pressed about the company's ties to saudi arabia which is uber's fifth largest shareholder. he was also asked about the cia's conclusion that the saudi crown prince ordered the assassination of columnist jamal khashoggi. >> i think that government said that they made a mistake. >> well, they made a mistake and somebody is dead. >> listen, it's -- it's a -- it's a serious mistake. we've made mistakes too with self-driving and we stopped driving and we're recovering from that mistake. >> uber's ceo apologized for the comment after boycott uber became a trending topic online. and in sports the number of
