calling that apology humiliating. amy hollyfield is live at the pleasant hill b.a.r.t. station in walnut creek where this happened. amy? >> reporter: a board director now saying she is going to stand up for the police, coming to their defense. first a look at the video. there was a man eating a sandwich on a platform. you can see a b.a.r.t. police officer confronting him. this was at the pleasant hill b.a.r.t. station. the officer says he refused to give his name so he grabbed his bag and handcuffed him. he was later released. foster admits he then cursed at the officer and used homophobic slurs. b.a.r.t.'s general manager has issued an apology to foster, but one board member is now saying he should not have apologized. >> i think that our police officer in this case acted

exactly the way he's expected to. to uphold the law. the whole thing has been humiliating to our police force that our general manager acted this way. >> reporter: in this situation our officer was calm and professional when he advised the rider of the prohibition against eating in the paid area of the station. unfortunately, foster immediately became hostile and belligerent. foster has said he believes the officer overreacted. he does not accept the apology from the general manager. and he is considering legal action. reporting live, amy hollyfield, abc 7 news. i'm tracking the latest on former president jimmy carter at the live desk. the 39th president is at emeryville hospital this morning scheduled to have brain surgery.

a spokesperson says it will relieve pressure on his brain caused by recent falls. he broke his hip during a fall in may. then he fell twice last month suffering a black eye and minor pelvic fracture. the 95-year-old is currently the longest living u.s. president. he beat cancer in 2015. earlier this month carter said he, quote, is at ease with death after his bout with cancer. reggie? we wish him well. a lawsuit is being filed today that alleges negligent security measures led to the deaths and injuries on july 28th. four people were killed. 17 others injured. investigators say the shooter got into festival grounds by cutting through a metal fence to avoid metal detectors. it targets the gilroy garlic festival association. lauren martinez has more on that in the next half hour. more information from san jose

police today on a deadly weekend shooting involving one of its officers. >> the shooting happened just after 3:00 p.m. on saturday. north of winchester boulevard. police say an officer shot and killed a male passenger who was wanted on a warrant after the man pulled out a gun. the victim hasn't been identified yet. there are multiple investigations into the deadly shooting of a father of six. an off-duty police officers shot the man in vallejo. family and friends gathered in the parking lot to hold a brief prayer vigil. an off-duty richmond police officer got into some kind of fight. they have identified the officer as sergeant thomas. >> i want to know what happened. >> i believe if he said he was a

police officer that my son would have not been arguing back. >> he was accused of excessive force and depriving a man of medical care in 2005. that case was settled. sonoma county will remove the charred remnants of the disastrous kincade fire. they will do a sweep to look for and clear out hazardous or potential toxic waste items like pesticides, batteries, paints left over from the burning. the first step is free for property owners. the press democrat reports that could cost between $40,000 and $90. insurance should cover the cost. >> improving street safety. changing this dangerous intersection after a hit-and-run crash. also, more than picky eating. why it may not be your fault if

a little bit of haze out there for the bay commute. isolated dense fog near the coast for the morning commute. we go from 49 in the north bay to near 70 at noon to 58 at 7:00. quite a drop. 70 at noon to 73 at 3:00 to 61 and for san francisco we'll warm from the mid-50s. grab that coat. we'll take a look at the cooling trend. how is it going out there? not too bad. a sig alert. nothing too serious. just want to let people know they can expect some delays. we are looking at a disabled big rig. this is southbound 101 before east washington at this point the big rig is blocking the second to the left lane there. we do not have an eta when this will reopen.

44 on a tuesday morning. the niners lost and the sun will come up. we'll deal with a little bit of fog from cambry and along our coast, also the golden gate. you'll see a lot of high clouds with temperatures in the mid to upper 70s, chico, sacramento. month ray, yosemite. afternoon sunshine, 77 in l.a. 65 today in tahoe. milder. upper 50s to low 60s. improving street safety is part of building a better bay area just weeks after an oakland woman was killed and her young niece injured in a hit-and-run crash new efforts to make a dangerous intersection safer.

it's happening at foothill boulevard and 22nd avenue just outside garfield elementary school. cornell barnard has a look at the improvements. >> reporter: neighbors say this intersection is too dangerous where a hit-and-run driver killed june as she crossed with her niece who was injured. the crosswalk is next to garfield elementary. >> at that time i was a school but my mom told me that an accident happened here. it's so sad. >> reporter: he and his mother were killed as they crossed foothills at 26th avenue. >> it's grief and love to the families who were impacted. >> reporter: nikki bass says new safety improvements have been made at 22nd and foothill where barriers and vertical plastic poles in an effort to slow cars down.
