and moving smoothly here. now i want to hop over to the richmond/san rafael bridge where things are looking pretty good this morning. reggie and kumasi? thanks, jobina. five victims of the gilroy garlic festival shooting are filing a lawsuit later today. >> reporter lauren martinez live from the financial district with more on that. >> reporter: reggie and kumasi, a news conference will be held here at the hilton hotel to announce that lawsuit. it alleges negligent security measures led to the deaths and injuries on july 28th. though officers responded in less than minutes, three people died in the attack, 17 people were injured. investigators say the shooter got on to festival grounds by cutting through a fence. the shooter engaged with officers and was fatally shot. it targets the gilroy garlic festival. at 11:00 this morning, a law group will announce the filing

on behalf of five victims. lauren martinez, abc 7 news. thank you, lauren. community organizations plan to rally today in response to an attack against three men in their 60s. it happened saturday in san francisco's chinatown. police are looking for at least two suspects. this follows another attack on two men back in july. the suspect in that attack was arrested last month. the community organizations plan to condemn it at 4:00 this afternoon. police are investigating a suspicious death on a san francisco golf course. the body has been identified as an infant. police released new information in the case. there are concerns about the health of the child's mother and police are asking anyone with information to give them a call. at the live desk i'm following a landmark case in the supreme court today, the

nation's highest court will hear opening arguments over the daca program. the trump administration is trying to end daca, created during the obama administration. daca protects more than 700,000 young undocumented immigrants who came to the united states as children. the trump administration has tried to repeal it but lost the case in the lower courts. the supreme court has agreed to consider the government's appeal on the third try. people in the bay area will show their support for daca today. an immigrant rights group has organized walkouts with ten schools in san jose. they plan to rally at afternoon in hill view park. ka mass kumasi? >> thank you, jobina. strategies ahead of the public impeachment hearings. house investigators released another transcript. this is from laura cooper. she's a deputy assistant secretary of defense who testified the white house ordered aid withheld from ukraine. the hearings are scheduled to start tomorrow morning. abc 7's special coverage will

they want to chop down trees. neighbors are pushing back against the plan today at the board of supervisors meeting. they've even created a website and a facebook group called save the trees of 3333 california street. >>ast year we lost over 2,500 trees in the city. we can't just keep doing business as usual and allowing developers to plow down the trees because it's inconvenient for them with the promise of planting them later. mother earth has a time schedule and we need to get on it. we also want to hear your ideas. you can join our better bay area group on facebook. steph curry is giving hints when he thinks he might be back for the warriors after suffering a broken hand a few weeks ago. >> just playing basketball, i love playing and having fun. i know klay does, too. we're like caged animals.

along the coast. temperatures respond. how about mid to upper 60s from 64 at half moon bay to san francisco. a very nice 69. average highs about 65 right now. richmond, 70. fremont, palo alto, 74. low to mid-70s around the bay. inland, 73 at san rafael to ukiah, santa rosa, concord at 79 and morgan hill 80. tonight look at that with the high clouds hanging around, mid-40s to mid-50s. my accuweather seven-day forecast, tapering of the temperatures as the offshore breeze goes away. we're close to average. we should all be in the 50s and 60s. look at the warming trend for the weekend v. a good one. here's jobina. a new sig alert in san rafael right now. a car has crashed and is on fire blocking all the lanes there northbound 101 before 580. there are no serious injuries reported here but there's lots of debris in the roadway and it looks like the backup could be a while as fire crews work to get

everything handled there. now hopping over to concord, westbound 4 before port chicago highway we have four to five cars involved in a crash here. blocking the right two lanes, speeds are down to 22 miles per hour in this spot. and then down in san jose another crash that is involving five cars this is san jose. there are two lanes blocked here and two rollovers. in today's "gma first look" the ceo of uber is now under fire. >> he used the word mistake when comparing the murder of journalist jamal khashoggi to a death caused by a self-driving car. kenneth mouton has the details. >> reporter: the ceo of uber under fire after calling the murder of "washington post" journalist jamal khashoggi a mistake during an interview with axios on hbo. >> i think that government said that they made a mistake.

platform. >> the agency's gm is saying, sorry, but one board member is calling that apology humiliating. amy hollyfield is live where that incident happened. amy? >> reporter: good morning. right here it says no eating, no drinking here at b.a.r.t. and this b.a.r.t. board director now saying she's defending the police officer saying he was just enforcing the law. the general manager should not have apologized. the video of what we're talking about, the incident that has everyone talking and divided. a b.a.r.t. police officer confronting a passenger for eating a sandwich on the platform. the rider would not give his name so the officer handcuffed him. the rider, steve foster, admits he cursed and used homophobic slurs towards the officer. he was eventually released. he has accused the officer of overreacting. now a b.a.r.t. director says the gm should not have apologized.

carter at the live desk now. the 39th president is at emory university hospital in atlanta. he's scheduled to have brain surgery. a spokesperson says the procedure will relieve pressure on his brain caused by bleeding from his recent falls. he broke his hip during a fall in may. then he fell twice last month suffering a black eye and minor pelvic fracture. the 95-year-old is currently the longest living u.s. president. he beat cancer in 2015. earlier this month he said he is, quote, at ease with death. after his bout with cancer. reggie? >> he's a tough, tough person. we wish him well. more information from san jose police today on a deadly weekend shooting involving one of its officers. >> it should the shooting happened just after 3:00 p.m. on the stretch of road north of winchester boulevard. san jose police say an officer shot and killed a male passenger wanted on a warrant after the man pulled out a gun.

the driver wasn't hurt and the victim hasn't been identified. in the north bay there are multiple investigations into the shooting of a father of six. an off-duty police officer shot the man why vallejo. family and friends gathered in the parking lot of a gas station to hold a brief prayer vigil. witnesses say the 38-year-old and an off-duty richmond officer got into a fight over a parking spot. the east bay times has identified the officer as virgil thomas. >> i want justice and to find out what happened. >> i really believe if he would have said he was a police officer that my son would have not been arguing back or something. >> according to court documents thomas was subject of a federal civil rights complaint, accused of excessive force and depriving a man of medical care back in 2005. that case was later settled. sonoma county will start cleanup in the kincade fire.

the county will do a sweep to search for hazardous waste items like pesticides, batteries and paint left over from the burning. the first step is free but after that homeowners will have to hire a private contractor. building and the bay bridge this morning. i want to talk about temperatures, and they are not bad. we're in the upper 40s to even some mid-50s throughout the south bay. we do have some middle 40s around santa teresa, alum rock and los altos 60. we've got mid-40s in the north bay valleys, mid to upper 40s in the east bay valleys and upper 40s to mid-50s throughout the bay. a look at the golden gate bridge, my biggest concern, there's a west/northwest wind so some of this could leak into the bay the next couple of hours. we'll keep an eye on that -- us being me and jobina. not as chilly. mainly hazy on the bay. we're 48 at 7:00. 68 at 11:00. 58 at 7:00 and then for the east bay we're 52 at 7:00 and then we'll jump 20 degrees by 1:00 and 72 and hang out in the low 70s. dropping down to 61 at 7:00.

hopping over to this issue in concord, this has just now cleared up, westbound 4 before port chicago highway a three car crash. you see the speeds are still slow so we will continue to update that for you throughout the morning and very quickly locking at a five car crash right lane still blocks this morning. pat sajak says he will be released from the hospital after an emergency surgery for a blocked intestine. he posted on twitter saying he's happy the worst has passed and expects to leave the hospital in a day or two. he says he expects to return to work if co-host vanna white hasn't taken over the show. she's had to fill in as the main host over the past few shows because he underwent that surgery. speaking of popular game shows, "jeopardy," so many of you love it. host alex trebek had to hold back tears when a contestant
