the left lane is the only lane open right now. i will pull up the map so you can see where it is. here is the spot. you can see speeds are down to 19 miles an hour here. in san jose another sig alert. you can see the information. the backup extended 3 1/2 miles. this is northbound 85 before union avenue. five cars involved, right two lanes blocked at this point. happening today survivors of the gilroy garlic festival shooting are filing a lawsuit, claiming there were major lapses in secured that led to the deaths of three people. >> reporter lauren martinez joins us live from san francisco with details on this. lauren? >> reporter: reggie and kumasi, the lawsuit charges the gilroy garlic festival association, it alleges that security measures,

negligent security measures led to the deaths and injuries of that shooting on july 28th. now according to police the shooting took place on the north side of the festival and the cloetest team responded immediately when calls came in around 5:40 p.m. they were there and engaged with the gunman who was armed with an assault type rifle in less than a minute. a 6-year-old, 13-year-old and 25-year-old were killed. why the suspect opened fire still remains a mystery. a news conference will be held at 11:00 this morning. lauren martinez, abc 7 news. community organizations plan a rally in response to an attack against three men in their 60s. police are looking for at least two suspects. this follows another attack on

two men back in july. a suspect was arrested last month. they plan to condemn it at a rally. police are investigating a suspicious death on a san francisco golf course and the body has been identified as an infant. they say there are concerns about the health of the child's mother and police are asking anyone with information to give them a call. new details this morning in pg&e's payouts to wildfire victims. citing a bloomberg report the bankrupt utility will offer $23 billion. they sought bankruptcy protection after the massive northern california wildfires in 2019 and last year which were blamed on its equipment. democrats and republicans are rolling out their strategy, another transcript, this time from laura cooper.

welcome back, everyone. new at 6:00, research from cedars-sinai said vaping may be more dangerous for your heart than traditional cigarettes. what they found is people smoking combustible cigarettes had lower blood flow to their heart during periods of physical stress, people smoking e-cigs lower blood flow to the heart muscle not just during physical stress but during rest. that implies much more vascular or blood vessel effect. >> you can watch the full interview on the new study with

that's what i'm calling it right now. 6:16. hi, everybody. if you were up late watching the game like some of us were, good thing is we don't have much fog to contend with this morning, so during the commute unless you're right near the coast or the golden gate bridge, that's where the fog is. in fact, you can see here so far the camera hasn't pushed through the gap and made it yet. not only this morning but this afternoon. now the offshore breeze will keep fog limited to the same areas with high clouds keeping us as mild as this morning and right now no sign of rain the next 10, 12 days. i'm sorry to say that. i really am. a look at how quickly the clouds even at the coast will start to dissipate that will help us reach the mid-60s. san francisco, 69. 70 at richmond. you head southbound we'll warm into the mid-70s along both sides of the bay shore. hit the south bay, we're in the mid to upper 70s, even an 80 in

good morning, everyone. it is tuesday, november 12. thanks for waking up with us. >> you're never more than seven minutes away from the accuweather forecast. what do we have in store, mike? >> there is the marine layer right there. less than 1,000 foot marine layer that created fog around half moon bay and also to the golden gate bridge which i think jobina will show you. let me show you the winds and they're slightly undercutting the offshore breezes. even sfo no fog coming through the san bruno gap. we're pretty good to go. milder. 48 to 50 at 7:00. there you can see a low to some upper 60s along the coast at 4:00. 67 to 70 from noon to 4:00 around the bay and 74 to 78, one of our warmest days this week. over to jobina. >> i have two sig alerts and a fog advisory. we're going to start with the sig alert, a live look from a caltrans camera.

>> the gm fwm is saying sorry but one is calling the apology humiliating. reporter amy hollyfield is live in walnut creek. amy? >> reporter: hi there. yeah, b.a.r.t. officials divided on the issue. b.a.r.t. riders tell us this morning there's no reason to be split on this issue. first, take a look at the video so we can catch you up on what we're talking about. it shows a b.a.r.t. police officer at the pleasant hill station confronting a man who is eating a sandwich on the platform. the officer ends up handcuffing him when he won't give his name. the rider admits to yelling obscenities and homophobic slurs. the general manager has apologized to the rider. well, now the b.a.r.t. director says he should not have apologized. a b.a.r.t. rider this morning tells us they can both be right. >> i think you can do both. i think you can apologize for somebody being arrested for probably something that is very minor and say, look, maybe we should focus on other things.

i do think you have to stick up for the police. >> a confusing message to our police officers on what they should enforce and what they shouldn't enforce. you can't tell a police officer to only enforce certain laws and not others. >> reporter: here is the statement from the police officers association defending the officer saying he was just enforcing the b.a.r.t. rules and that the officer was calm and professional. the rider eating the sandwich, steve foster, he has said he does not accept b.a.r.t.'s apology and is considering legal action. reporting live from the pleasant hill b.a.r.t. station, amy hollyfield, abc 7 news. now on abc 7 news a live desk update. >> tracking the latest on former president jimmy carter. the 39th president is at emory university hospital in atlanta this morning. he is scheduled to have brain surgery. a spokesperson says the procedure will relieve pressure on his brain caused by bleeding

from his recent falls. carter broke his hip during a fall in may. he then fell twice last month suffering a black eye and minor public fracture. the 95-year-old is currently the longest living u.s. president. he beat cancer in 2015. earlier this month he said, quote, he's at ease with death. after his bout with cancer. kumasi? >> in the north bay multiple investigations this morning into the deadly shooting of a father of six. an off-duty richmond police officer shot the man in vallejo. family and friends are gathering in the parking lot of a gas station to hold a brief prayer vigil. they say he and an off-duty officer got into a fight over a parking spot. the east bay times identified the officer as sergeant virgil thomas. >> i just want to find out what happened. i really believe if he would have said that he was a police officer that my son would have

not been arguing back or something. >> according to court documents sergeant thomas was the subject of a federal civil rights complaint accused of excessive force and depriving a man of medicare care in 2005. that case was later settled. sonoma county will remove debris from the kincade fire like pesticides, batteries and paint. this step is free for property owners. after that hired contract will come in and it will take about three weeks. the 49ers are no longer undefeated. >> their "monday night football" matchup against the seahawks came down to the final play in overtime. jobina has been with us through the highs and the lows. >> kumasi, the very highest of highs and the lows. we keep watching the video but it stings. i love your attitude. going to turn those frowns

kearney street to announce the lawsu lawsuit. it alleges negligent security measures led to the shooting on july 28th. though officers responded in less than a minute, three people died in the attack. 17 people were injured. investigators say the shooter got into festival grounds by cutting to a fence to avoid metal detectors. the shooter was fatally shot. it targets the gilroy garlic festival association. reporting live in san francisco lauren martinez, nbc 7 news. at the live desk following a landmark case in the supreme court, the highest court will hear opening arguments over the daca program. i want to show you a live picture right now and then we'll get to the video here.

the trump administration is trying to end daca created during the obama administration. daca protects more than 700,000 young, undocumented immigrants who came to the united states as children. the trump administration has tried to repeal it, but lost the case in the lower courts. the supreme court has agreed to consider the government's appeal on the third try. people in the bay area will show their support for daca today. an immigrants right group has authorized walkouts in san jose and they plan to rally at 12:30 this afternoon. kumasi? thank you, jobina. to your morning money report, google is tackling an annoyance on the internet. >> the labeling websites that load too slow. no word what the badge of shame will look like. amazon is expanding grocery options with a new grocery store that's not a whole foods or an amazon ghost store. it reportedly, though, will not use those amazon go stores

take a look at what's going on weatherwise. the golden gate bridge, a rare treat. the fog is going under the bridge. isn't that absolutely gorgeous running the time lapse on that. and this is the way it looks from sutro tower. that is a fantastic photo this morning. high clouds will dominate with milder temperatures. our warmest days this week. limited fog tonight because we still have an offshore breeze. the high clouds will stay around keeping us mild overnight. mainly mild with no sign of rain through the extended. at least there's a chance of rain. for today anything along the coast will evaporate rather quickly so expect mid to upper 60s in san francisco. maybe it doesn't completely go away.
