exchange that played out on the pleasant hill bart statio ten days ago as steve foster and his girlfriend were on the way to work. >> she is the one who is actually recording it all on her phone. amy hollyfield this morning showed there is a cafe located at that station just a short distance away from a sign that displays bart's rules, which include no eating, drinking or smoking in the paid areas, which includes trains and platforms. >> here is abc7 news reporter melanie woodrow. >> steve foster says he still can't believe what this video shows. >> i didn't expect that to happen at all. >> reporter: a bart police officer detained foster last week for eating a sandwich on the platform of the pleasant hill bart station. foster's girlfriend was with him. >> i told her pull her phone out, because i felt like something wasn't right. >> reporter: one of the officer >> before i can say anything, as you can see, he alrady had it in his mind that he wanted to put me in cuffs. >> reporter: another officer arrive and assisted with cuffing foster.

he says the officers called him name. >> i wasn't resistant at all. i had no kind of arm force to keep them from putting me in cuffs. >> reporter: foster's attorney has now filed a claim against bart and the officers. he says the officers were engaged in a form of racial profiling and selective law enforcement. >> this is a case where a slight admonishment could have easily have occurred, but yet it did not. >> foster was cited and detained about an hour, causing him to miss work. bart's general manager apologized to foster and bart riders in a public statement. he also said eating in the paid area is banned and that foster had refused to provide identification, cursed at officers and made homophobic slurs. a bart spokesperson tells abc7 news bart will not comment about a future lawsuit. bart's independent police auditor is conducting an investigation, which will be pausedis is served with a lawsuit. inkland, melanie woodrow, abc7 news. major new developments.

police investigating that halloween house party shooting in orinda arrested five people in a series of coordinated sweeps. one in vallejo, one in antioch, one in san mateo, two in marin city all through a shooting in a house rented through airbnb. this video was shared with abc7 news showing a s.w.a.t. team from contra costa county ordering people inside one apartment to come out with their hands up. one neighbor told what's she saw. >> it looked like something you see in a movie. it was police everywhere. and then they -- they let off some -- i don't know what you call them, tear gas up the street. >> orinda police have not said if any of the people arrested today are suspected of firing the deadly shots on halloween. the first four suspecs on this list, jacquez sweeney, jason iles, lebraun wallace and

shamron mitched are all charged. the last person, devon williamson is accused of being an accessory. ittialian police officers announced they have just finished their investigation and are asking for an immediate trial. finn elder and gabe nathalie have been in a rome prison since the july 26 stabbing death of the officer. the teens say they didn't know the police officer and his part their were police. the judge now has five days to decide whether to grant the speedy trial. developing news. two students are dead after being shot this morning at a southern california high school. police say a classmate pulled a gun from his backpack and opened fire before shooting himself. this was at saugus high school in santa clarita, just north of l.a. along with the two students killed, three others are injured tonight. the 16-year-old suspect is in the hospital. police say his condition is

grave. reporter vanessa vasconellos with our sister station has more from santa clarita. >> reporter: moments of panic as hundreds of saugus high school students ran to safety. >> six to eight shots. >> multiple shots fired, possibly people down. >> according to the l.a. county sheriff, it was just after 7:30 when a student opened fire on campus, shooting at least five people before shooting himself in the head. terrified students barricaded themselves in classrooms, including sophomore arianna kasar. >> broke desks to make sharp edges because the lock on the door was broken. >> they prepared for the worse by arming themselves with anything they could. >> we handed out scissors. one of the girls had her softball bag and people had bags just in case. >> it's disturbing to me. i don't understand why this keeps happening. >> retired teacher says even though many students were just getting to campus, it was their active shooter and lockdown

training that came into play. >> i hope the kids can recover from this, because it's pretty traumatic. it doesn't go away just because it happened and you're safe. there is lasting effects. >> l.a. county sheriffs investigators are going through the suspect's social media accounts, saying he did make a threat previously, but it's since been removed. they're saying use this as an example wherever you may be. if you see something like that, say something. it could prevent something like this in the future. reporting in santa clarita, abc7 news. the white house reacted to the shooting today. vice president mike pence spoke during a visit to nasa's ames research center in mountain view. >> and we will not rest or relent until we end this evil in our time and make our schools and our communities safe again. >> president trump tweeted his first comments at 3:34 this afternoon, eight hours after the shooting. he wrote "we send our deepest condolences to the families and friends of those tragically lost, and we pray for the speedy recovery of the wounded."

lawmakers. >> abc7 news is committed to building a better bay area which includes finding possible solutions for homelessness. today a san francisco judge did not rule on a motion to stop construction of a homeless navigation center on the waterfront. the neighborhood group safe embarcadero for all has opposed the building. last month it filed a new motion saying the city failed to get necessary approval from the state lands commission. >> we don't think that the state lands commission is going to agree with the city on this. the city is leasing waterfront, san francisco bay front property for 79 cents a-square-foot. it's supposed to be spending that money for the benefit of the general public. >> the group says the city should have to go back to square one. there are currently five navigation centers. the location on the embarcadero would be the sixth one to open. a big hurdle in the way of the oakland a's buying their old coliseum home has now officially been cleared. today the city of oakland dropped its lawsuit that could have blocked the acquisition.

insiders say that lawsuit clouded the a's' plans to develop the coliseum site, and that the team needs that redevelopment project to make a new ballpark at howard terminal more economically viable. more on all of this now from abc7 news anchor eric thomas. >> this is a great sign for a's fans and for oaklanders. >> reporter: oakland mayor libby schaaf saying the future looks bright after the city withdrw the lawsuit that stood in the way of the a's buying the column. >> so we're really excited that we're putting that behind us so we can transact with the county and move forward with our deal on the coliseum. >> the coliseum is on the other hand jointly by oakland and alameda county. the a's want to buy the 155-acre site and redevelop it into an entertainment and sports complex while building a new stadium for the team at the howard street terminal on the city's waterfront. the a's already had a deal with the county to buy their half for $85 million. that's when oakland sued the county to block it, forcing the team to sweeten its deal. >> i think we reemphasize that

we're going have community benefits, affordable housing, local hire. all the key things that we're also bringing to the howard street terminal project. >> we're really encouraged that the a's have suffered the city the same deal that they offered the county. however, our interests could be a little different. and so that will be the process of negotiations. >> now attention turns to what the a's want to do with the coliseum property. the team has a plan, but not everybody is crazy about it. vice mayor larry reed's district includes the coliseum. he says he and his constituents support a new stadium to keep the team in town, but -- >> they would prefer for the a's to build their baseball only stadium at the existing coliseum. >> the team expects to conclude a sale with the county before year's end, and a deal with the city next year. in oakland, eric thomas, abc7 news. elected leaders join neighbors and long-time customers in demanding that a long-time cafe stay open despite getting an eviction notice from san francisco.

exploratorium camera. pier 15 on the embarcadero in san francisco looking back at the skyline. you can see the cloud layer there. it's 5 in san francisco. 59 at oakland and redwood city. 61 at san jose and 54 at gilroy and half moon bay. and the view at the golden gate looks pretty good as well. not long oohed we did have some lingering clouds there. they'll probably return overnight. it's 54 degrees right now at santa rosa. we've got 57 at petaluma, napa, fairfield and livermore and 59 at concord. here is a few from our rooftop camera looking down on to the embarcadero. and these are forecast features. it will be cloudy with spotty drizzle through the night and the early morning hours. mostly sunny skies will prevail in the afternoon. and a warming trend system cog our way this weekend. november warmth will make a return visit. forecast animation starting at 7:00 this evening. notice a little line of moisture is likely to be moving on to the peninsula, at least down to the santa cruz mountains. but it will be disappear or dissipate quickly. then as we get into the early

morning hours, notice a little trail of light showers offshore moving toward the coastline. so 5:00 tomorrow morning, as the commute gets under way, we may see some spotty drizzle here and there. but it's not expected to last very long or be very widespread at all. by midday, we'll see clearing across the entire region. overnight look for low temperatures under cloudy skies and possibly with some spotty drizzle. low temperatures mainly in the upper 40s to low 50s. and then tomorrow's high temperatures will range from about 61 at half moon bay to mid-60s generally right around the bay shoreline. and upper 60s to near 70 in our inland areas. now looking ahead through saturday, we can expect a bit of a warm-up, especially inland, where we'll see some mid- to upper 70s. not much change on the coast and around the bay shoreline on saturday. but all areas will be a bit warmer on sunday with high temperatures inland approaching 80 degrees, and we'll see some 70s around the bay shoreline. mid-60s on the coast. pretty much the same range of temperatures expected on monday. so here is the accuweather

melanie woodrow is digging into why people are getting sick now. >> vaping has been around future a number of years, but investigators say something changed this summer, making people sick. despite the cdc's recommendation that people stop vaping, a lot of people are still doing it. tonight what you need to know if you're one of them. ♪ steven calls himself a deadhead. here he is in the '70s with the quintessential long hair, which he grew out after military school. it was there in the late '60s he discovered pot. >> i was a regular consumer of whatever it was that we used to smoke back then. >> reporter: he later switched to vaping. >> vaping is a 21st century phenomenon. >> san francisco journalist has been on the cannabis beat nine years. >> vaping took over because people wanted to make healthier choices about consuming cannabis and not smoking. >> but that choice now appears to be producing dire consequences for some vapors. according to the centers for disease control and prevention, as of november 13th, there have

been more than 2,000 e-cigarette or product use associated with lung injury cases. 42 people have died, including four right here in california, one of the four in marin county. >> so we saw a perfect storm this summer. >> downs believes that perfect storm was a combination of a decrease in the price point for cannabis due to legalization and a decrease in the cannabis supply in the elicit market, encouraging non-licensed manufacturers of cannabis oil to dilute their product more and more, therefore stretching their profits. downs says consumers caught on and started performing what he calls the bubble test, associating the thickness or the viscosity of thc oil with purity. if the bubble didn't move, consumers would think their product hadn't been diluted. >> black market cutters and chemists responded by coming up with an additive that can cut thc oil while still making it thick. >> vitamin e acetate is one of

those additives. they found vitamin e acetate in all 29 samples, and thc in 23 samples. the cdc says the findings do not rule out other possible compounds that may be causing lung injuries, but help investigators better understand the potential ingredients that may be contributing to the cause. according to the cdc, no one compound or ingredient has emerged as the cause of illnesses to date, a point echoed by the california department of public health. >> the challenge with the multiple patterns of lung jere merging is that it suggests that there are likely multiple mechanisms of injury and/or multiple different chemicals that could be the culprit. >> laboratories in san francisco are one of the state's licensed cannabis testing laboratories. employees here homogenize samples, making sure they're even, random and representative, then test the samples according to state regulations. here is what they're looking for. >> potency, pesticides,

microbial contaminants, heavy metals, really just everything to make sure there no contaminants and the potency on the label is in the product. >> if a cannabis product doesn't pass the test, the state requires that it's reprocessed or destroyed. inresco labs california doesn't require vitamin e testing. of more than 200 cartridges from licensed manufacturers tested, none had significant concentrations of vitamin e acetate. of 11 illicit market cartridges tested, five had vitamin e acetate concentrations of 34 to 48%, and all 11 failed california's pesticide residue tests. >> we were baffled. how could this be happening? >> reporter: ucsf medical toxicologist dr. neil bennett has been studying at what happens when vitamin e acetate is heated at different levels to see if it's broken down into something toxic.

his feelings about vitamin e acetate and other oil. >> they're healthy if you eat them or put them on your skin, but they're not healthy if you heat them up and inhale them. when it's inhaled basically it forms a thick cloud of oily assistance, it guess into your lungs and gets absorbed slowly. basically, it can coat your lungs with an oil. >> two findings stand out linked to the e-cigarette or vaping product use associated lung injury cases. first, htc is present in most of the samples tested by the fda to date. and second, products specifically containing thc off the state were from other ninfo sources are linked to most of the cases. the labs' director of cannabis services says there are ways to know if you purchased an elicit product online. beware of any sort of marketing to children, or suspicious use of trademarked property like this flintstones logo. also watch out for claims on the

packaging the product is organic. there is no organic designation in cannabis at this time. some packaging looks especially convincing because it's a fake of a real licensed brand, complete with the california sticker, potency label, even batch number. >> we can pretty much buy any packaging, any labels in branding from any of the vape manufacturers online right now. have them shipped to your house and fill it with whatever oil you like, which is pretty scary. >> that's why some licensed manufacturers like rove are now putting qr codes on their products. users can scan the code with their cell phone to verify they have an authentic product from a licensed retailer. despite e-cigarette and vaping product use associated lung injuries and deaths, along with the unknown of what specifically is causing both, steven schaub says he'll continue vaping daily. >> take a hit or two and turn on the music. >> but says he will only buy regulated products from licensed retailers. the cdc recommends that you do not use e-cigarette or vaping

million. he is now a free agent. bumgarner has been the backbone of the giants franchise over the past ten years. his resume, three world series titles, he was epic back in twoy2014 as the world series mvp. the giants had the opportunity to trade bum good afternooner at the trade deadline. they were hoping to make play-off charge. that didn't quite work out. as he signs elsewhere as expected, the giants would receive a draft pick in return. keep your eye on the braves. will smith also declined his qualifying offer today. the he did sign a three-year, $39 million contract with the atlanta braves. smith saved 48 games over the past two seasons, emerging as the giants' closer. what's odd here, despite the size of smith's contract, the braves apparently plan to continue with mark melancon as their closer. we'll see what happens once the season begins and maybe they make changes. the mvp awards announced today. semien came in third. 33 homers. but the award once again goes to

mike trout. it's trout's third mvp award. he trails only barry bonds for most career mvps, and barry won seven of them. trout with a career high 45 homers led the majors in on-base percentage. far and away the best in the game. missed the final 19 games with an injury, but voters did not hold that against him. dodgers center fielder cody bellinger won the national league mvp award. hit .305, 47 bombs. beat out christian yelich for the top honor. he joins jackie robinson and don newcombe as the only dodger in history to be rookie of the year and mvp. that is pretty good company. to the nfl and the 49ers host arizona on sunday. the question is whether george kittle and emanuel sanders will be able to play in that game, both dealing with injuries. they did not practice today. now, before we look ahead, got to look back at the monday night game. 1:50 to play. they threw incomplete passes.
