that's where he was caught. it all started at the b.a.r.t. station. that's where the killing happened at the south hayward b.a.r.t. station. b.a.r.t. police say a good samaritan tried to stop a man from stealing from a passenger. the two got into a lloo arnd 1:00bofighs and approached a salesman. >> as soon as i opened it up, somebody grabbed my arm. i thought it was a customer. i looked to the side it was a weird guy with no shirt on. i was like what the hell? >> they got into a fight. the salesman let him go and says the man sat and waited for police. b.a.r.t. police arrested him and charged him with murder and carjacking. they have not released his identity or information about the victim.

we'll talk more about the fire danger coming up next. breaking news out of san jose, at the live desk, police are investigating a major three-car crash. look at this video coming in to our newsroom. this crash happened at alum rock and jackson avenues late last night. a fire captain says nine people were involved a tenth person may have left the scene. some people were taken to the hospital with critical injuries. a witness said he saw a car going fast down the street before he saw the crash. >> thank you. in a couple of hours, the latest pg&e power shutoffs are set to start. >> more than 51,000 customers in sonoma, napa and solano counties are on notice. the shutoffs will start around 7:00 this morning. the utility is planning on shutting off power to prevent

wildfires, but pg&e says weather conditions have improved and power will not be shut off in other counties. some schools in sonoma county will be closed because of those power shutoffs. >> they include the alexander valley unified school district and forrest school a bay area state senator is proposing legislation to help people cope with the power outages. steve blazer of contra costa county wants to require pg&e to have battery backup on cell phone towers and to provid battery packs to customers whose lives depend on access to electricity. this morning executives from at&t, time warner, comcast, t-mobile and verizon wireless will appear at a state puc hearing on how they handled operations at recent state shutoffs and fires. we will send out push alerts when pg&e decides when and where

they will be shutting off power. the city of orinda voted to change its short-term rental laws. the ordinance comes after five people were shot and killed at a halloween party hosted a the an airbnb. last night a 45 day emergency ordinance was passed. that bans non-hosted short-term rentals in orinda. it requires a two-day minimum stay with the owner of the property. people against this are calling the changes arbitrary and unfair. >> i have an objection that a host would stay in the same structure as their guests. i think that objectionable to most people. >> having the host on the property is beneficial because it's helping control what's going on with the rental. >> the ordinance takes effect immediately. it expires in 45 days but city leaders can extend it for two years. this morning all eyes are on a critical witness in the

impeachment inquiry. american bams did or ambassador gordon sondland will testify. he changed his testimony saying he remembers president trump offering a quid pro quo to the ukrainians. >> reporter: this morning, the stakes are rising in the impeachment inquiry against president trump. not only was sondland on that july 25th call between president trump and ukraine, he also has a close relationship with the president. on tuesday, national security official tim morrisson testified former national security adviser fiona hill might have coined it a gordon problem. >> i decided to keep track of what ambassador sondland was doing. i didn't necessarily always act on things gordon suggested. >> reporter: tuesday's testimony began with lieutenant colonel alexander vindman, a decorated veteran and top ukraine official on the national security council, and jennifer williams,
