>> announcer: now from abc 7, live breaking news. >> and that breaking news is at san francisco state university, several buildings on campus have been evacuated because of a bomb threat there. this includes the student union, the library, as well as a residential building. police are searching the campus as we speak. final exams are happening this week and the school of nursing was holding a graduation ceremony in one of the buildings. >> as we were finishing, we got word there was some sort of a bomb threat and we were asked to leave directly out to the street. >> now, there was also an evacuation on campus last month after a man walked into the library and said he was going to shoot up and blow up the building. he was arrested on two felony counts of criminal threats. good afternoon, thanks for joining us. >> thank you for joining us. we want to turn our attention to the weatherment you can see outside lot of clouds today. but it's dry right now. but get ready for rain.

rainy time leading up to christmas. spencer is here with the forecast. >> we'll start with this, no green showing up on the screen. radar is not picking up any precipitation. this is a few from the tower, looking out over san francisco. if you're looking north ward the skies are bright but the clouds are the dominant feature in the sky. there's a storm coming this weekend that will begin a pattern of unsettled weather that will continue through christmas. we'll see the next wave of stormy weather pushing into the north bay late in the day, reaching all parts of the bay area by sunday morning. strong gusty winds, snow in the sierra. this is going to be a significant storm. it will continue through monday. that's just for starters. what does santa have planned for us later in the week? i'll give you a closer look a little bit later in the news cast. larry and kristen. >> i'll see you then. i have a feeling we know what he

has planned. more rain. >> rain! yeah. >> look at the scene here. a massive oak tree crashed in on a home. the homeowners said no one was hurt. >> power was out or cut and he's not allowed back in until the tree is removed and the roof is covered. >> reporter: good evening, guys. this is the tree that came down. crews stopped work just a short while ago. this tree is massive and it could take a few more days to clean up. the roots that rped up from the ground showed just how massive this huge oak tree is that landed on this house. >> the homeowner reported that a large oak tree had fallen over the roof of his house and it punctured the roof into the ceiling of his living room. >> reporter: no one was injured and the damage was limited to this one house. but the house has been red tagged and the homeowner can't come back until the tree is removed and the hole in the roof

is covered. one tree expert says big trees falling is an ongoing problem throughout the bay area. roots are weak because of the drought. the tree fills with water whichh saturates the soil. >> it was very muddy because of the rain we had for the last month or so. the tree fell over because of its own weight. >> reporter: jill and her family have lived on this street years. today's crash has them taking a look around their yard to see what needs to be done. >> we were so concerned about fires for obvious reasons. hadn't really thought about this. i thought there's no fire risk at the moment but now i see other risks. >> cal fire wants to remind people this is not just an issue with big trees like this one. they suggest if you think your trees have a problem or need to be trimmed, call a professional

to get some advice. reporting live, abc 7 news. ansar, thank you. new details in the hills borrow heiress murder case. the man is a freeman. a hung jury in a trial earlier this year. the same jury acquitted the co-defendant, tiffany lee. she gives the case the nickname. she made history early in the case by posting more than $60 billion in bail. they are murdering of keith green. his body was found almost two weeks later. he was last seen outside a restaurant talking to lee. abc 7 has been covering the case since 2016 and she is live outside the jail in redwood city. melanie. >> reporter: yeah, the san mateo district attorney's office that decided not to retry said that

decision was based on conversations they had with about half the jurors following the trial who said the evidence simply wasn't there. free from custody for the first time in approximately 3 1/2 years. can you tell us what you're feeling right now? the san ma today district attorney says justice was not served. >> as of today, there will be nobody held accountable for keith green's murder. the evidence ultimately was not enough. >> reporter: prosecutors charged tiffany lee and viot with the murder. the jury acquitted lee who was already released and was hung on viot. >> the question was today was will we retry him? did i feel something could occur differently in another trial. i concluded the answer was no. >> he was never guilty of the crime, so it's the right decision. >> i felt the evidence was

sufficient to prove that the two of them were responsible for green's death. a jury told us otherwise and that's how our system works. >> reporter: but at least one juror is questioning her decision. she asked we not show her face. >> we worked so hard and i now have to rely on exactly what colleen relies on which is karma and the fact that these people have to live with what they did. >> sometimes cases just simply don't measure up. >> reporter: all of that said, viot could still be charged again later. >> there's no statute of limb talgss for murder. >> she cannot be charged again by the state of california. meanwhile, the body guard and trainer who faced accessory to murder charges for dumping green's body remains in custody. prosecutors cut a deal with him but ultimately did not call him as a witness. san mateo county district attorney says if he could roll back the clock, he would have

never cut that deal. still he says he does not believe the jury would have convicted adella on murder charges. adella will be sentenced on accessory to murder charges, the charges he pleaded guilty to on january 10th. it is possible with the number of years it has taken with this case that he's already served all the time he'll be sentenced to. and in at that case, he could be released that day. live in redwood city, abc 7 news. >> melanie, thank you. another pedestrian has been killed on the streets of san jose. as the city inches closer to reaching an all-time annual high for traffic related fatalities. >> this happened at the intersection of center road and needles drive not far from a large park. it comes after a separate deadly collision in the neighboring town of los gatos involving a san jose city council candidate. >> reporter: this afternoon, may

makeshift memorial honors an 85-year-old killed in this intersection. she was in a marked cross walk, but police say she wasn't able to fully cross before the light turned green and ended up getting hit. in this case, the driver stayed on scene and is cooperating with the investigation. we spoke to the chairman of the bicycle safety advisory committee. >> this affects everybody. we all get in a car at some point. we're not safe from this problem. >> in recent years the city narrowed some streets to reducee speeds. however the tragedy now marks the 59th traffic-related fatality of the year, just one short of the all-time high recorded in 2015. the incident comes just days after a devastating collision in nearby los gatos. late monday morning, san jose city council candidate jenny

higgins struck and killed 66-year-old star ki. higgins who serves as president and cofounder of women's march bay area released a statement saying in part, my heart goes out to the man's family and loved one as they are suffering this tragic loss. words cannot adequately express my sorrow, and i ask for your support in accepteding your thoughts and condolences to the devastated family. police say the collision and its cause remain under investigation. in the south bay, chris wynn, abc 7 news. a san jose family's christmas tree may have started the fire that destroyed their house this morning. no one inside was hurt thanks to the quick actions of an 11-year-old. abc 7 news reporter talked to the young hero. >> reporter: this is one of those hugs you wish would never end, a grandmother loving on her hero granddaughter who saved

their lives when their home caught fire early thursday morning. >> i woke up and went to check my elf on the shelf andent back inside my room. and then all i saw was black smoke and i saw fire. >> that's when berlin did exactly what she was supposed to do, waking up her sister, mom, dad, and grandmother to get out fast. this is all that's left behind now, the home completely destroyed. cause is under investigation. there's a possibility the christmas tree was involved. all the presents under the tree are also gone, a sad reality for the family less than a week from christmas day. >> i had just bought her gift. it was -- i got it on groupon. it was a visco girl >> reporter: the family sad about the presents not being under the tree anymore but they're just most grateful that all of them made it out safely. we're hearing the family's cat is not as lucky.

the cat was not able to make it out. we're hearing the home is a total loss. they're going to be taken in by the red cross. everyone so thankful for the quick thinking actions of that 11 year old girl. abc 7 news. marines who were nearby at the marine corps reserve center brought clothes and jackets to the family. just a short while ago, san jose firefighters went back to the house to donate gifts. they posted these pictures on facebook. the gifts had been donated by the community as part of the toy drive that the fire department supports. there's also a gofundme page that raised over $6,000. a good samaritan helped a stabbing victim on a b.a.r.t. train last month. this morning the b.a.r.t. board recognized sophia humphrey for her act of heroism. she came to the assistance of tyrone williams who had been stabbed after trying to stop a

now through january 2nd. a day after the president was impeached, top senate republicans still denouncing the move. mitch mcconnell even accusing speaker pelosi of being afraid to send the shotty work product to the senate. that's a quote. >> reporter: a new battle over impeachment. when will the articles be sent to the senate. >> when tla wrote the constitution, they expected there could bay rogue president. i don't think they suspected we could have a rogue president and a rogue leader in the senate at the same time. >> the move came after senate majority leader mitch mcconnell said last week he was working if had total coordination with the white house. and this week on the senate floor said he was not an impartial juror.

>> they said it was so urgent it could not wait for due process, but now they're content to sit on their hands. >> reporter: it all followed wednesday's historic vote, impeaching a president for the third time in history. >> article one is adopted. >> reporter: the charge is abuse of power and obstruction of congress. democrats say president trump's actions left him no choice. they accuse him of inviting foreign interference into the election by pressuring ukraine to investigate joe biden. then blocking witnesses with direct knowledge of what happened with ukraine from testifying in the impeachment hearings. the votes mostly along party lines with not a single republican voting to impeach the president. >> i don't feel like i'm being impeached because it's a hoax. it's a set up. it's a horrible thing they did. they happen to have a small majority and they took that small majority and they forced people. >> reporter: january 6th was the expected start date of the senate trial, but that date is

now in jeopardy as senate republicans and democrats continue to negotiate the terms of the trial. really though, the ball is in speaker pelosi's court. abc news, washington. well, president trump is the third president to be impeached. the first was andrew johnson in 1868. bill clinton was impeached in 1999. both were acquitted by the senate and not removed from office. now, president richard nixon was almost impeached. the house judiciary committee passed three articles of impeachment, but nixon resign before an actual vote. tonight seven candidates will debate for the final time this year. >> joe biden, pete klobuchar, sanders, warren, and yang. the next debate is january 14th in iowa just a few weeks ahead of the caucuses.

honor local fans think is overdue, raiders receiver cliff branch and 49ers roger craig among the finalists for the sent y'all class of 2020. it's a group of player, coaches, and con ttributors. branch was a deep threat with the raiders, blazing speed, won three super bowls, played in three afc championship games. he died back in august. roger craig also won three super bowls. he was the first in history to have a thousand yards rushing and receiving in the same season. among coaches nominated tom flores along with mike hol m gwen and dick verymeal. many of those names long overdue. >> i love watching those guys. >> ah, that was the days. we could have those days again

someday. >> perhaps this season. >> we've got interesting weather coming our way, pretty active pattern developing in the week leading up to christmas. dry conditions prevail right now. in fact, skies are actually not terribly cloudy. looks pretty -- did i say crowdy? looks pretty cloudy from this perspective. it's currently 59 degrees city, 60 at oakland. mid 50s at gilroy and half moon bay. we have bright spots out there. temperature readings in the mid to upper 50s at santa rosa, petaluma, napa, fairfield, concord, and liver more. this is a view of the golden gate. these are forecast features, increasing clouds but dry tonight and tomorrow. wet windy storm arrives late saturday, continues through the weekend and into monday.

that unsettled pattern will continue through next week. overnight lows will be mainly in the id many to upper 40s. little chillier in some of the inland valley locations where those drop into the low 40s but it'll be dry. then tomorrow under partly cloudy skies look for high temperatures in the upper 50s to low 60s narrow range of temperatures about 59 to 61 or 62 degrees in most locations. let's look ahead to saturday when the next storm comes in. 8:00 saturday morning at which point it'll be cloudy. then by midday to late afternoon we'll see rain arriving. it'll be fairly steady and widespread and even heavy at times in the north bay at first and then spreading saturday and sunday morning with some snow falling over the higher elevations, way up north and in the sierra. snow is expected as well. it'll still be raining here in the bay area on sunday. the storm won't wind down until monday. so, we have quite some active

weather coming our way to that three-day period saturday through monday. wind gusts starting saturday morning will start to kick up a little bit. we'll see gusts up to 35 to 40-miles-per-hour especially near the coast late saturday and early sunday morning. it will taper off a bit late sunday afternoon. it will bring substantial rain fall and strong wind and prompted winter weather advisory for the sierra. we may see over a foot of snow in some locations in the sierra. on saturday as the storm arrives so does winter. winter solstice occurs at 8:19 p.m. that's pacific standard time. we'll have showers under breezy conditions on sunday. another wet day on monday. maybe a little bit of a break on tuesday. christmas eve, by christmas day looks rainy, lingering into

then it picks up next thursday and friday as people go back home. the tsa says they're bringing in more officers to handle the long lines at security. now, as people head to the airports for the holidays, you might want to think twice about plugging into that public usb charging station at the airport or the mall because there's a mobility you might get juice jacked. now you're wondering what is juice jacked? lauren martinez has the details. >> reporter: it's called juice jacking. >> there is a way for people to be able to hack into your phone or tablet if they have somehow messed with the plug that you're plugging into. >> reporter: it's hard not to plug your device when you're low on battery. >> sometimes there's seats where you can plug the phone or devices in. >> reporter: the fcc is warning holiday travellers if you plug into a public usb port at airports, hotels, or other places, your information could be compromised. >> part of the reason for this is that the cord you use is the same for transmitting data.

based on 50 billion pings, location pings, across the country. each one represents a single dot. the conclusion, our every move can be pinpointed and identified. i interviewed "new york times" writer and editor stuart thompson about why this is so dangerous. stuart, most of us think the location we provide to apps is anonymous. you found it's not so anonymous, right? >> it's really not. it's pretty trivial to identify the data. you can look where they go to work and where they live. that's usually enough. if you imagine your own commute, you probably take a route. there's not many people that live in your house and work in your workplace. that's pretty identifiable. >> what other public info can you use to figure out who is behind a dot? >> linkedin is useful, twitter, facebook, news articles written about a person all give signals as to who is behind the data. you only need two or three to get a sense of who it is. we approach aid number of people

and by and large were never wrong about who we thought it was. >> you had data from silicon valley. give us an example of someone you tracked. >> one guy ben showed up. we didn't know it was ben. it was just dots. we saw him go to microsoft on monday, amazon on tuesday, and microsoft on wednesday. and by january of next year, he was only going to amazon every day. so, we called him up and talked to him and he said, yeah, i spent a day at amazon doing interviews. i think that's an example of the practical use case of this data in the wrong hands you could imagine companies wanting to know that kind of information. >> you also point out apps don't make it easy for us to understand what they're doing with their location data. >> like a weather app or something. it might ask you to share location for an alert. and the choice really isn't very clear as to what you're signing up for. it might even say we'll give you targeted advertising. they mine your location data like a kind of material, like a raw material like gold or something.

>> do companies sell location data to just anyone. >> companies that sell data say they work with trusted partners, large partners, people with established business interests. to a large extent we don't know where the data has or can go. that's because there's no laws about disclosure. it's a black box and the way the industry works. >> let's be honest. no one cares where you or i go, it's pretty mundane. but at the highest level, how could this present a national security threat? >> there's actors that go to their desk every day. they're using it to leverage against elected officials, against our government, against the institution of democracy, against judges, against the legal system. >> speaking of elected officials, what did you find at president trump's mar-a-lago report? >> what we have is a bunch of phones you can tie back to people. so, i think for people that visited mar-a-lago at the time, there's potentially a record of that, that they were not

expecting to have created. >> we've heard a lot about the president's use of his personal cell phone. have you found data that can pinpoint where he's been? >> i think i have to defer to the piece tomorrow. >> what can we do as individuals to reduce our exposure. >> i would start by limiting the apps that are look at your location. a lot of people couldn't name the app that led us to your front door. go through your settings and evaluate it. if you look at our piece and see a bunch of data and trails connecting the data back to people, that's what people have on users most likely. >> right. think about it. you've heard stuart, by the way, tease to his report tomorrow. the series will run through sunda. and larry i asked what's the end game. why did you put this out there? what is it for? is it for advocacy, more government regulation, more government disclosure. so, the answer is yes, yes, and

really spend money? >> awkwardly usually. 7 on your side's michael finney has advice. >> it's always fun to spend money and even more fun this time of year. should you surrender to that and go for it or come up with a plan? you know what we're going to say about that. joining me is carlene from charles schwab. do we think of money differently this time of year? >> we're spending it differently. we're spending more. the average consumer spends about a thousand dollars in gift giving and holiday decorations this time of year. that's a big difference than our normal spending. >> recently there was a study where people said they were willing to go deeply in debt then not have their children have a bunch of gifts. >> it's true. i think when they're little, you're spending a little bit less on the gifts but as they get older you have to have the conversation on do they really want these gifts? would it be better to have a bunch of small gifts at that time of year or save up and take

a family vacation and not be spending as much at one time of year? >> so, what you're suggesting is even though it's a time of giving, you need to sit down and say there are limited resources. >> well, and i think you should also have the conversation on, you know, it used to be it's the thought that matters with the gift. but is that really true for all the different generations that are participating in the holida season? why don't you have a conversation with your entire family and find out what's important for each one of them? how do they feel about money? >> i know with my own family a couple of different times we've said do we want to do a trip or do we want to do a bunch of gifts? trips come in high on the list. people would rather do that. >> i think most people would rather do that because it's this experience, right? and generationally, people want to have an experience with the people around them and the people they love. it's not about opening ten gifts versus having an experience with the people that you enjoy being around which is your family.

>> here's the deal. young people need stuff but they need clothe thars appropriate for work. they may need a work computer. a lot of us look at the holidays as a way to help them along in life's journey. >> we could do that but we could shift and grow with them which is how are they planning for those things in their lives. sometimes financial planning doesn't have to be big and comprehensive. it can be simply figuring out a budget. so, how do they incorporate exactly what you just said into their daily budget, monthly budget, annual budget? >> how do you start this conversation? >> well, you start it by listening a lot. all of us have a different opinion around money, we grew up differently around money. ask them what they would prefer? open up the conversation by being easy about it and having great listening skills. then you can come up together with a plan as a fmly and then individually we can all come up with our own plans. >> isn't part of this it's a little late by the time you're having the conversation if you
