suspect. the third suspect is the only one behind bars. he may not be for much longer. >> the victim died in 2016. his last known whereabouts were meeting with his ex-girlfriend and the mother of his daughters. >> we have been covering the case since 2016. we have today's new details. >> reporter: this man free from custody for the first time in approximately 3 1/2 years. can you tell us what you are feeling? >> happy. >> reporter: the district attorney says justice was not served. >> as of today, there will be nobody held accountable. the evidence ultimately was not enough. >> reporter: prosecutors charged them with the murder. he is the father of her children. after 12 days of deliberations, the jury acquitted lee who has been released and was hung on

the other man. >> the question was, will we retry him? something could occur differently in another trial. i have concluded the answer to that was no. >> he was never guilty of the crime. it's the right decision. >> i felt the evidence was sufficient to prove the two of them were responsible for green's death. a jury told us otherwise. that is how our system works. >> reporter: at least one juror is questioning the decision. she asked we not show her face. >> we worked so hard. i now have to rely on exactly what colleen relies on, which is karma and the fact these people have to live with what they did. >> sometimes cases don't measure up. >> reporter: he could still be charged again later. >> as you know, there's no statute of limitations as to murder. >> reporter: the jury acquitted lee, she cannot be charged again by the state of california. the bodyguard and trainer who faced accessory to murder charges for dumbing green's body

remains in custody. prosecutors cut a deal with him but ultimately did not call him as a witness. the district attorney says if he could turn back the clock, he would have never cut that deal. still, he says he does not believe the jury would have convicted him on murder charges. he will be sentenced on january 10 on the accessory to murder charges that he pleaded guilty to. it's possible at this point, he served all the time he will be sentenced to and could be released that day. a journalist was in the courtroom for almost every day of the trial. his name is ed walsh. he is usually behind the scenes here. melanie spoke to him today. his perspective is at 6:00. >> that moment in court, the moment this morning, it lasted about a minute when they said he was not going to be tried, he

was going to be set free today, that was such a dramatic moment in court. for me it was dramatic as well, even though i knew it was coming. i would have been shocked if it went the other way. still, it was shocking. i lived this case for three years, three and a half years. i was having nightmares about this case last night. i was having trouble sleeping. i was like, that kind of stress that i'm feeling as a reporter covering this case is multiplied by the victim's family, relatives of the defendants, by the attorneys involved. i get a sense what have they must be going through. >> ed is a good journalist. watch the unedited interview with him on abc7.com. find all of our reporting that we have done since the case began in 2016. moving on. there's not much to show today on live depp looppler 7 but tha going to change soon. spencer is here with us tracking the next storm. >> that's right.

and caused extensive damage. crews worked carefully to remove parts of the oak piece by piece from the roof along ferndale way. the home is red tagged. no one can go inside until all of the tree is removed. a hole in the roof is covered. firefighters believe rain may have caused this tree to topple. >> the root was very muddy because of the rain we have had for the last month or so. that tree obviously fell over because of its own weight. >> after the rains came, well, there's no fire risk at the moment. now i see other risks. >> tree experts say years of drought can damage a tree's root system so it's more likely to fall when the weather gets wet again. final exams are being rescheduled at san francisco state after several buildings were evacuated because of a bomb threat. the campus is still closed. the buildings are being searched. the threat came in after 2:00

this afternoon. the school sent alerts telling people to evacuate, including dozens attending the school of nursing graduation ceremony. there are concerns about racial harassment at a high school. the principal has sent a letter to parents informing them of race-related incidents involving students. eric thomas has more. >> i don't think it's about this area. i think we have seen it everywhere. >> reporter: this spokesman telling me that this area is far from the only place dealing with racial harassment. here it's gotten bad enough that the principal sent home a troubling letter december 6. >> the first one said we were frustrating we were getting reports of racial harassment. >> reporter: yesterday, another letter went out. >> we had more incidents reported to us throughout this week. >> reporter: in one, in an online chat room, a student called the african-american male she was talking with the n word. >> it doesn't surprise me based

on what the climate of the country right now. >> reporter: this woman says her son was the target of racist graffiti written inside a boy's bathroom in 2016. >> it stays with you. they are hurtful. >> reporter: her son graduated last year. she credits school officials with trying to improve things. >> there's always going to be hate. there's always going to be fateful words. i think it's really a matter of how we address it as adults. >> reporter: they are not identifying the student. they say there are programs from inside and outside the district to reduce racial animosity and increase understanding. officials vow to keep trying and say there will be repercussions. >> we will follow the code and there will be consequences. >> reporter: the principal says, they will not shrink away from racism. instead, they will confront it and talk about it openly. in hopes of making more progress this time.

in danville, eric thomas, abc 7 news. sadly, another pedestrian has been killed on san jose streets as the city inches closer to an all-time annual high for traffic-related fatalities. this comes after a separate deadly collision in the neighboring town involving a city council candidate. we have more now from the south bay. >> reporter: tonight, a makeshift memorial honors an 85-year-old woman killed in this intersection. she was in a marked crosswalk but police say she wasn't able to fully cross before the light turned green and ended up getting hit. in this case, the driver stayed on scene and is cooperating with the investigation. we spoke to this man, chairman of the san jose bicycle and pedestrian safety advisory committee. >> there affects everybody. we're all a pedestrian at some point. we get in a car. we're not safe from this problem. >> reporter: the city has narrowed some streets to help

reduce speed. installed bike lanes. upgraded select crosswalks as part of its vision zero safety initiative. the tragedy now marks the 59th traffic-related fatality of the year, just one short of the all-time high recorded in 2015. the incident comes just days after a devastating collision nearby. monday morning, a city counsel candidate struck and killed a 66-year-old man. she serves as president and co-founder of women's march bay area released a statement saying in part, my heart goes out to the man's family and loved ones as they are suffering this tragic loss. words cannot adequately express my sorrow and i ask for your support in sending your thoughts and condolences to the devastated family. it's unclear if she will continue her pain. the collision and its cause remain under investigation. >> there's no more important job

than keeping your eyes on the road and looking out for people that are pedestrians, bicyclists. they are often tough to see in rain and inclement weather and the dark. it's important to be vigilant when driving. five miles per hour can make a difference between life and death when a car hits a person. >> people don't understand the difference between 25 and 30 miles an hour is big in that you are twice as likely to kill somebody. >> twice as likely for it to be fatal. with help from the sfmta and the cow palace parking lot, we tested braking distances in a simulated crosswalk. see the results on our website. city council will vote on a temporary ban on short-term rentals. it comes after a shooting on halloween that left five people dead. if approved, non-hosted rentals would be banned for 45 days.

property owners would be required to be on the property during the rental term. tonight's meeting starts at 7:00. a surprising development in a class action lawsuit against fastrak and the golden gate bridge district. >> you are looking at the bridge live. the traffic is light right now. the suit does claim the toll authorities wrongly charge penalties to thousands of california drivers. >> just as a trial was about to begin, fastrak filed a motion saying the lawyers who brought the lawsuit should be thrown off the case. >> we have been watching this case. it stopped the whole trial. >> this is amazing. this could also mean throwing out the entire lawsuit filed on behalf of millions of bay area motorists, maybe, probably you. why? the public agency says the attorneys who brought the lawsuit illegally spoke with one of the witnesses. that would disqualify them from trying the case. the statute of limitations runs

out january 2. in the last hour, a judge agreed to start the trial. will decide later whether or not to disqualify the plaintiffs' attorneys. without a legal team, of course, the suit could be in jeopardy. here is what's at stake. the lawsuit claims that tolling agencies illegally charged toll evasion penalties to thousands of motorists after the golden gate bridge switched to all electronic tolling in 2013. the agencies say they have improved the system but want to keep the new policies a secret or they say we might use the information to avoid paying tolls. the toll authority tried to ban the public from the courtroom during testimony about those policies. 7 on your side objected to that. a judge ruled the trial will remain open. the judge said the public agencies can keep their policies secret. 7 on your side objected to that, too and still not clear what

a family is thankful to be alive after a one alarm fire destroyed their home early this morning. the christmas presents inside were also lost. they are on north 19th street. firefighters went back to donate gifts to the family. they posted these pictures on facebook. the gifts have been donated by the community as part of their holiday toy drive. an 11-year-old is being called a hero thanks to her fast thinking. >> i woke up and i went to check my elf on the shelf. i went back inside my room. then all i saw was black smoke.

i saw fire. >> thankful for that elf on the shelf. she immediately knew it was a fire when she saw the smoke and got her family out of the house. there's a go fund me page for the family. it raised more than $7,000. the good samaritan who comforted a man who was stabbed to death has been honored. we were there as it happened this morning. >> reporter: she isn't sure why she has this certificate. why she is being praised. sophia said rushing over to help a stabbing victim on a bart train should not be considered extraordinary. >> more people should have that sort of mindset to help others. whereas, so that it wouldn't necessarily be so amazing that just people naturally just help people. >> the board considers it amazing and called her a super hero today for what she did on the bart train last month.

>> while other passengers fled the train to avoid the incident, she stayed so she could contact the police and to help tell the story of what happened. >> she saw a man stab tyrone williams. she knew she needed to stop the bleeding. she talked with him to keep him alert. >> she lifted herself from her chair, lunged on the floor and wiggled over to the stab victim. >> she wanted to make sure during her moment of recognition today that her fellow passengers were not cast in a bad light. >> a lot of the people who fled while the stabbing was going on, that was the wisest decision for them. i don't think that they made a wrong choice. you do also have to keep your own safety in mind. >> ironically, tyrone was trying to help. she says he was trying to stop a man from stealing the shoes off a sleeping passenger. his intervention cost him his life. she hopes that won't discourage others. >> tragic and crazy he ended up

dieing because of it. don't be afraid to help. a majority of the time it's not going to end some something so tragic. >> she has met tyrone williams' family and she says they tell her they consider her part of the family. >> a remarkable person. an alternative to cars returned to the streets of san francisco. electric bikes are back in the bike share system called bay wheels. we spotted this one downtown. they were pulled off the streets in july because the batteries caught fire. no one was hurt. over the past few months, bay wheels decided to change battery suppliers. san francisco will get 4,000 bikes over the next six months. e-bikes returned to san jose last month. there's no timetable for their return to the east bay. good day to ride your bike, be outside.

go safely, california. now news to build a better bay area. from abc 7. >> a crackdown is expected to be proposed on dog training businesses in california. >> we have a follow-up on what is largely really an unregulated industry. >> yeah. our coverage on this issue has attracted the attention of a bay area assemblywoman who is calling for greater oversight of dog trainers. we know of at least tee cases where dog trainers are accused of either neglect or charging for services not fulfilled. >> what is your name? >> we caught up with this assembly woman. a dog owner herself, she's troubled by the bad experiences some of her constituents say

they have had with dog trainers. >> we aren't doing everything we can to protect animals the way we protect individuals. they deserve it. >> in july, she saw our story about gary reynolds and devondeo ashby. reynolds is facing eight felony counts of animal abuse and neglect. a ashby is expected to plead to a misdemeanor violation of animal cruelty. eight dogs under their care were found under duress and in poor health from neglect. one dog died. ashby's attorneys have not commented but reynolds' attorney said gunner's death was not for seeable because the temperature was only 74 degrees. we have learned that ashby agreed to testify against his co-defendant. depending on his testimony, his sentence could be reduced to

three years probation and 45 days in home detention. the assemblwoman saw our story about a family. jane and her husband. their dog died while being boarded and cared for by this woman last year after she was attacked by another dog. they say the other dog was critically injured. smith has previously told abc 7 she believes the dog escaped from the kennel while she was out shopping. abc 7 has not been able to make contact with smith since last summer. promised by smith to pay $26,000 in veterinary costs have been broken. >> it's bigger than that. what i'm concerned about for the general public is that dog trainers and borders apparently do not have to have any credentials or qualifications. >> we spoke with eight organizations which credential dog trainers. none of those could find any

certification for smith. none is required. she met with staff about a new bill likely to be introduced in january calling for greater oversight of the dog training industry. >> we are taking a look at how we can regulate the trainers to make sure animals are well taken care of. >> jordan operated innovative canine and is seen here in this security camera video with one of the client's dogs. he was sued alleging his dog almost died while being boarded and trained there. the suit alleged he returned from his stay untrained and underweight. she said she returned the dog at 11 points, less than half his weight. this is izzy at full weight. this is a photo when smith returned her. >> she could not climb shares. she couldn't go up a single step. we had to lift her. she couldn't jump on the couch.

great news. the number of robocalls you receive could drop. the senate voted unanimously to approve legislation to crack down on illegal robocalls. it would require phone companies to offer free call blocking apps. carriers will have to verify the numbers calling you are real. scammers fake numbers to look though they are coming from the irs or other agencies to trick you. it heads to president trump. he is expected to sign it into law. a day after the house voted to impeach the president, senate republicans are still denouncing the move. mitch mcconnell accused nancy pelosi of being afraid to send over her, quote, shoddy work
