commute for drivers. >> 101, 92, 880, montague. it will be a hot mess. that's all i can say >> reporter: a crane traveling west on highway 237 near north 1st street swerved tipped over, landed in the eastbound lanes. many were surprised that no one on that side got hurt. >> i have lived here 19 years. i have never seen anything like this. never before. >> reporter: but the crash caused another collision moments later between a shuttle bus and pickup truck on the westbound side. the drivers suffered minor injuries. >> we were able to get traffic shutdown and stopped relatively quickly on the eastbound side and start moving the vehicles that became stuck in this area here. >> reporter: at least 100 gallons of fuel, oil and hydraulic fluid spilled because

topics you're interested in so when news affects your life, you will know about it right now. now to an abc 7 i team news exclusive. what will be the strategy for the young man in san francisco in the stabbing death of an italian police officer last summer. >> dan noyes joins us live with more. >> reporter: i have stayed in contact with them asking for an on-camera interview. for now they have sent written responses to the issues i have raised. i'm here at the airport. the press will ask three an elder if he wants to make my comments. i was there this summer when ethan elder arrived there from san francisco to see his son finn for the first time since the death of the police officer. i was there to see him leave the prison near the vatican offering no comments on the crowd of international media. upon returning home, the elder's

lawyer read a prepared statement on behalf of the family. >> we look forward to our truth coming out and to our son coming home. >> reporter: ethan writes finn was assaulted at 3:00 a.m. they had no guns, badges or handcuffs. finn was on his back being choked and was fighting for his life against a man nearly 100 pounds more than them he thought the man was trying to kill him. he panicked and fought. leah adds finn has told the same details since the moment he was arrested. he said we didn't know they were cops and hasn't changed the story at all. they were in rome on vacation when they went looking for cocaine. after police broke up a drug deal, they were caught on surveillance running with a backpack of a man police identify as a pusher. the pusher called police and set up a meeting with the teens to get the backpack back.

it was the officer and his partner who showed up. in the struggle, finn elder pulled out this marine-style combat knife and stabbed the officer. the autopsy shows 11 wounds. the elders told me it was like seeing their son in the prison for the first time. after being heartbroken five days before for the death of the officer, i did not realize my heart could break again. it did. at the end of it, i was glad to see my son alive and left realizing what had been put forth in the media wasn't true. leah wrote i am destroyed, utterly destroyed at a tragedy that can be undone. they want you to know their son is a kind, intelligent, caring person. finn is efpl net ig, highly emotionally intelligent and associatable. he has a wide group of friends, both male and female. he loves the ocean, cars, music, and sports. i have also reached out through

her lawyer to the officer's widow for an interview. she has not responded. they discussed how a classmate had to go to the hospital with a brain injury after an argument with finn when he was 16. dan, thank you. a class-action lawsuit claiming fast track unfairly charges toll evasion penalties is in limbo tonight. >> a judge "post" phoned the trial until she can decide whether to throw out the entire legal team that brought the action against fast track and golden gate district. >> we have the very latest on this fascinating case. >> can you hear the clock tick something. >> oh, yeah. >> absolutely. the judge set a new trial for january 2nd, just one day before the statute of limitations runs out. if the trial doesn't begin then, the case could be dismissed. fast track operators are claiming the legal team who brought the lawsuit should be

thrown off the case. the attorneys saying the lawyers improperly interviewed a former fast track employee. the class-action lawyers say they did nothing wrong, saying this is a delay tactic to jeopardize the case. you may remember the lawsuit claims fast track charged thousands of motorists who crossed the golden gate bridge unfair penalties. many never received toll invoices and penalties piled up, sometimes into the thousands of dollars. if the judge disqualifies the attorneys, it would probably mean the end of a class-action lawsuit altogether and would end the possibility of relief for thousands of motorists who believe they paid unfair penalties. the judge said she will rule by new year's eve. >> all right. thanks michael, very much. a look now at live doppler 7. it is clear now. that won't be the case for long. this weekend you will see it light up with green as the rain rolls in. abc 7 news weather anchor

spencer christian with a look at the timing of this. and you said you dream of a wet christmas? >> and it's going to be a long dream. we have a wet weather pattern coming our way. we just showed you live doppler 7 picking up no rainfall at the moment. we will start our forecast animation at noon tomorrow. notice the rain developing, a storm in fact, moving in the northwestern part of our viewing area. by 7:00 tomorrow evening, ukiah, clover detail and the north bay will be getting moderate rainfall, sometimes heavy, strong gusty wind. it will spread to all parts of the bay area. this will be a significant storm with lots of rain and wind. how long the wet weather will last in a few minutes. dan? spencer, thanks so much. people living with hiv/aids can apply for assistance as the latest as building a better bay area. they will announce a new subsidy

program at san francisco public library today. it aims to prevent homelessness and helps renters to secure new housing. >> this is the first time in 12 years that we've allocated a million dollars to provide subsidies which will help at least 120 individuals. >> the q foundation is accepting applications for the program. you must either be paying more than 70% of your income toward your rent to qualify for the program ar need help to afford below market rate housing. the foundation says almost 2,400 people with hiv need immediate help. it is making a huge difference the cost of living in the bay area is so high that people with decent jobs still have trouble putting food on the table. that's where our local food banks come in. this year they are falling short. alameda is short $2.5 million.

the san francisco marin food bank is short $4 million. eric thomas explains how you can change that. >> reporter: it's not that the shelves are empty at the alameda county food bank on the friday before christmas. supplies are good. but the need is great. even for people working one or two jobs. >> if they can keep a roof over their head, keep the lights on. at the end of the day there is not much left for a healthy meal. that's where we come in. >> reporter: it's the bank account that needs help. they have a goal of raising two-thirds of operating funds by december 31st. that's about $6 million. >> we're about $2.5 million short of that goal. it's about $500,000 more than we saw last year. >> so they need donations. >> since '83, i've been coming

>> kaiser permanente clinicians have been working without a contract over a year. they are demanding kaiser hire more staff, reduce patient wait times. kaiser says the union rejected a mediator's proposed agreement. vaping-related injuries are starting to go down. but the cdc says the majority of cases are now being blamed on vitamin e. that is a thickening agent apparently adding to vaping

liquids. it comes as authorities have shut down 44 websites advertising illegal vaping cartridges. health officials say it's not over yet. there have been 54 deaths so far, including one woman from vacaville. you're taking a live look at oakland international airport where today is expected to be the busiest day. an airport spokesperson said they don't expect the weekend storm to impact flights, but they are prepared if that changes. >> to the south bay, as we take a live look at mineta san jose airport, it is one of their busiest days as well. it is expected to be up 8% from last year. and a look at the busiest and biggest airport, san francisco international. flights were delayed or canceled because of the morning fog the delays, crowds, hassle of traveling, it's tough. but it's all worth it when you

with the wind picking up, there may be further delays during the day and the evening. we have calm weather. clouds are increasing. this is the exploratorium arm. temperature readings in a fairly narrow range. mid-50s in san francisco. redwood, 54 degrees. half moon bay it's 50. emoriville looking westward. temperatures are about 50, 51 at santa rosa, petaluma, napa and concord. sut sutro tower is unobstructed by clouds. but the next storm arriving tomorrow night. winter begins tomorrow night. 8:19 p.m. pacific standard time to be precise. that will be the beginning. tomorrow night will be the beginning of an unsettled

pattern that will continue through most of next week. overnight, as the crowds -- well, the crowds might increase too. but the clouds certainly will. low temperatures in the mid to upper 40s. tomorrow we will see rain developing way up north early in the day. it will sweep slowly southward. afternoon highs in the upper 50s to 61, 62 degrees. the approaching storm ranks 1 on the storm impact scale. we were undecided whether to give it a 1 or 2 because it will have a little oomph into it. rain moderate, maybe heavy at times. ponding on the roadways no doubt. gusts 25 to 30 miles per hour. starting noon tomorrow. by 7:00 p.m., the rain will be pushing through the north bay. just before midnight it will begin to touch all parts of the bay area. middle of the night, most of us probably won't be up, but there will be heavy rain with powerful

wind gusts that will continue into the early morning hours on sunday. and everything starts to sort of taper off. the wind and the rain late sunday. wind gust animation looks like this. 4:00 p.m. saturday, for example. gusts up to 40 miles per hour on the coast. overnight hours -- late night hours and into the overnight hours, gusts quite strong. then the wind will calm down a bit as the rain moves out of here. rainfall totals will be well over an inch in many locations. a soaker for much of the bay area. it will produce snow in the mountains in lake county. a winter weather advisory in those locations. accuweather 7-day forecast. we may get a break. maybe monday and tuesday from the rain. clouds will linger. and there could be rain developing tuesday night. then on wednesday, christmas day, whret weather again. this is what we mean when we say a wet unsettled pattern.

"star wars" the rise of skywalker brought in $40 million on its opening night last night, the fifth highest debut of all time. this is supposed to be the final chapter in the saga chronicled in a galaxy far, far away. cue t sugar plum fairies. i had a chance to meet the members of the oakland ballet performing nutcracker and are exposing young people to something they may never have seen before. dress rehearsal is supposed to be the last chance to get everything right. but there is so many graham has been getting right as artistic director of the oakland ballet company. >> he does everything. he's so out going and positive. >> his students are preparing for this season's performances

for the first time we're getting a look at what hppened between deputies and a driver that ended with his death. one of the deputies has lost his job and the victim's family may sue the sheriff's office >> a video has some disturbing scenes we should tell you. wayne freeman shows you today's new developments. >> reporter: california state law requires police agencies release body cam videos like this. you are watching sheriff's deputies at the end of a chase november 27th. they were trying to arrest a suspect who they thought had stolen this car. they did not know behind the wheel 357-year-old david ward was in fact, the rightful owner. >> get out of the car!

>> today mark essick said what happened here cost one of the deputies his job. that is him in the freeze frame. >> when they step out of line, i'm going to hold them accountable. >> nobody knows why they went on a chase and then wouldn't lead his car. instead of calling negotiators, they used an unsafe choke hold and excessive force as he slammed ward into the car's door pillar. we'll freeze the video here. >> is that appropriate? >> in what world could that be appropriate? >> the attorney will represent david ward's family. >> this is a very dangerous individual who should have been off the street a long time ago. >> it will not be the first time he has gone to court over detective blount's behavior. he represented a woman in 2015 who they charged with jaywalking. this was the deputy blount trying to sub due her.

it is a pattern of behavior he repeated in the video from november 27th. with david ward on the ground, we see and hear deputy blount's reaction when he learns for the first time that ward did, in fact, own the car. >> he said oh, well. and of course david dies seconds lar. oh, well. is that the kind of person you want in your community? >> well, i would say it was disturbing. >> no word whether the deputy will face criminal charges for what happened that night. there is more than one body cam video. it may reveal more about what happened. meantime, santa rosa police are conducting the investigation. wayne friedman abc 7 news. police in the north bay are investigating a tragic incident that claimed the life of a 7-year-old boy from green bray. it handled while the child was at school. he was struck by a section of moveable fence. abc 7 news reporter cornell bernard is on the story. >> mr. our hearts go out to the

family and everybody involved in this. i is just really tragic. >> reporter: flowers were left on the ground at a private school where a 7-year-old boy was playing during the lunch hour when he was critically injured by a section of school yard fence. >> it is a manual fence that slides on a track. we are investigating to try to find out how or why -- or how this happened. at some point the fence came off the track and hit the boy and took him to the ground. >> reporter: sky 7 was over the playground where they rushed to remove the child from the fence and called 911. sadly, he died later at the hospital. the school flag was lowered in memory of the little boy. the school made grief counselors available to students and staff on friday. even police and firefighters had their own debrief. >> we're human, obviously. it's a horrible thing to deal with were. and everybody's heart just really is going out to the family. everybody is just really devastated. >> reporter: parents and school staff declined to speak with abc 7 news.

what typically happens. >> this was the scene on new year's day this year. for next year's parade, there are changes their way to make sure this doesn't happen. >> sid garcia from los angeles has the story. >> reporter: final touches are being done. with less than two weeks to go for the city of pasadena, host the rose parade and football game, security measures are being finalized. nearly 1 million people are expected to watch in person. that means there's going to be thousands of law enforcement officers from the federal, state, and local levels keeping an eye on things. they want you to do the same. >> my plea to everyone watching this, not just for the day of the game but ahead of time if something seems out of place, if something is unusual, if it doesn't fit with the narrative of what you have seen, you have to let someone know. >> reporter: if you plan on

camping out around colorado boulevard, first thing you should know, no drones. the airspace is restricted. >> the number one concern is it could injure somebody falling from 50, 75 feet. that's the main issue we have. >> reporter: and last year one float caught fire and stopped the parade. first responders will be available to deal with something like this in case it happens and to also keep spectators safe. the new barriers will be put in place to keep traffic out of certain areas along the parade route. they're stronger than any other bare pasadena police have used. law enforcement wants you to be safe and enjoy the parade. according to the u.s. secret service, there is no credible threat against the parade and game. sid garcia, abc 7 news. >> a reminder you can watch new

websites mimicking top fashion brands scammed consumers out of $1.4 billion in a single year. >> incredible really. michael finney is here to show you what to look out for as we head into the last shopping weekend before christmas and hanukkah. >> the bad guys are out there with advances in digital imagery and technology, it is easy to get fooled if you're not careful. here's what you need to know to protect yourself. this may look like a legitimate rayban site but think again. this is fraudulent too. and so is this one. >> they are taking pictures from other websites and going through hundreds of websites putting them up and completely scamming customers. >> thieves are stealing photos off the home page and posting them on their own fake websites.

he knows of consumers who paid for orders but got nothing in return. in other instances he says customers received counterfeit merchandise. in just the month of november, overland believes it found 500 websites doing this. he said 91% of the images are hosted on shopify. it allows anyone to set up an online store. >> you have this bank of images they have stolen and as fast as we can put it down. >> he said shopify isn't moving fast enough to take them down. they have removed a number of them and they said they will continue to investigate. they said we have multiple teams who handle potential violations of shopify's policy.

he said there are thousands mimicking the sites of legitimate named brands. >> in november we found close to 15,000 websites targeting one brand, rayban. >> he said dyson and nike are two other big names among many hit with fake sites. to avoid getting scammed, look for this lock symbol next to the url. heed this warning from your browser about potential fraud. be aware of any site that doesn't charge you sales tax. and avoid those who offer single source of payment orbit coin. the last thing you want is to give your credit card information to a scammer. >> it is pretty dangerous. people can use it for nefarious purposes. >> let me warn you about incredible bargains. luxury brands do not offer 90%
