so we're looking at a nice day. no rain to talk about if you are heading out for a run or jog or thinking about heading to a sunday service so you should be okay. a closer look at your seven day forecast coming up in just a bit here on your abc 7 mornings. a vigil is being held for the man killed trying to recover his stolen laptop in oakland. he went after the suspects who snatched his laptop at the month claire starbucks on new year's eve but he was hit by their get-away car and later died. organizers are asking people to wear purple to show solidarity. he received his doctorate at kansas state and the university's colors are purple. that's why they are asking people to wear purple. two men are charged in his death. if you would like to write a kind message to his parents, as so many have done, leaving those message notes on post-it notes

disappeared. his 1998 honda accord was parked on the bridge with very little clues as to where he might be. now to some breaking news to get to. the u.s. military confirming that there has been a terror attack on a military base in kenya where some u.s. military personnel were stationed. the terror group has claimed responsibility. it is unclear right now how many american personnel are stationed at that base at this point. there are no reported injuries. the u.s. military is saying it is moving from tactical to enduring operations. also earlier saying that the situation right now is fluid. we want to get you to the latest on the development in the high stakes standoff between the u.s. and iran this morning. here is what we know that's been happening across and over the weekend. moments after the sudden drone strike that killed the notorious iran general, we want to show you again the brand-new video we received from overnight.

hour. it is on the turnpike just outside of pittsburgh in the western part of the state. we're hearing weather could be a factor. slick roads reported. the temperatures there between 30 and 32 degrees. you know that can make for slick roads out there. we're also hearing a tour bus that was leaving new york and heading to ohio. the crash shut down an 86 mile stretch on the highway this morning. of course we will be following this with breaking updates as we get them through the news room. and of course always the very latest on ab the trial of a man accused of stabbing a woman at the bart station begins tomorrow. last week the lawyer filed a motion to move the trial out of the county. she said she does not think her client can get a fair trial pause of all the coverage this

his mental competency has also been in question. a hearing is scheduled for january the 15th. now to the south bay where we're learning new details about what led up to that officer-involved shooting at a san jose gas station. we cover this all as breaking news. abc 7 news reporter reports the suspect was allegedly trying to set fire at one of the gas station pumps. >> a male has driven away with a pump still attached to his vehicle. he has since returned, but now he has a lighter in his hand. unknown what he's going to do with the lighter. >> her employer called her at home asking what to do after reporting a driver threatening to set one of the gas nozzles on fire. >> i don't know. that's crazy. >> could have been dangerous. >> yeah. blow up. i don't see why he would want to set the gas station on fire. >> according to san jose police,

the man was armed with a metal bar and charged at officers. in an e-mail, san jose police say officers used multiple less lethal options that had no effect. the officers ultimately discharged their firearms in response. >> shots fired! shots fired. >> a couple gunshots to the torso. >> the area was liters with evidence markers including the nonlethal items. >> very dangerous. >> he lives just blocks away from the gas station. he says he's grateful that the gas station employee was able to shut off the gas. he says his neighborhood and the mall could have been at risk. >> everything is close to the shopping center. >> in san jose, abc 7 news. a great grandmother brutally

beaten as a park last january has passed away. the 89-year-old was out exercising when she was attacked at a play ground and then left to die. her family has tirelessly worked to raise awareness and make that community safer. they're now seeking assistance in paying for her funeral. a link to her gofundme account is up if you would like to donate. 20 electric scooters stolen from oakland. they have been found south of stockton. the county sheriffs office arresting this guy here for the theft. listen to this. deputies say he led them directly to him because the scooters' gps units were left on. dead give-away right there. mcman was already on probation, so deputies were able to search the rv in his driveway. and what did they find? all of the scooters there damaged, dismantled or altered in some way. but the gps was still intact.

in recent weeks we looked at the smart riders. riders is actually decreasing. there was some 721,000 riders. in its second year that number dropped down to 706,000. that's a decline of about 2%. there does appear to be changes in commuting habits, though. the average weekday riders have gone up steadily. now setting up to deliver a full report on wednesday. we'll let you know what's inside. happening today, the holiday spirit is still alive in the south bay. it is your last chance, though, to enjoy the san jose's christmas in the park. more than 60 musical and animated exhibits, glittering lights that light up the night sky and of course the iconic 55 foot tree. look at that thing. today it is open from 9:00 until midnight. then crews will clean

up and start cleaning for next november, the 41st year of christmas in the park. love this story right here, saying good bay to the golden state. more californians are moving out from the state than moving in. that's according to the state department of finance. in a new study, the golden state ranked among the top ten of the most moved from states last year. how is that for a title? new jersey came in first, though. california ranking seventh. this is a story that's been sparking a lot of buzz with so many of you. as you know, building a better bay area means making this a place where people want to stay and live. the high housing costs, crime and traffic are all factors we cannot ignore. some stories of some people who decided to make the move. >> reporter: the state motto of idaho means let it be perpetual in latin. appropriate now for the stream

so cal. the skid marks seen for hundreds of feet. questions leas to what went wrong leading to the pilot's death. good morning. thanks so much for joining us here on this sunday morning. it is january the 5th. we'll get to all those stories in a second. we start with a look at your forecast. there is not too much to talk about. you can see a little bit of shaking in the camera right there because there is some wind that you might have to deal with in our southeast bay. you can also see a peek of the sunrise coming up just above the hills right there. as you wake up, temperatures are in the upper 40s to low 50s and across much of the day will be topping out in the upper 50s to low 60s on this sunday. no rain to worry about. we'll get to that forecast, though, in just a bit. now we want to get to the state of emergency in australia this morning. the astonishing devastation now burning some 12 million acres in the land down under.

so far, 23 people have been killed in the fires, more than 1,500 homes have been destroyed and currently 140,000 residents are under evacuation orders. one world wild fund for nature expects believing half a billion, and that is billion with a b, animals are in danger or have been killed. conditions only being made this weekend by high temperatures and strong winds combined. now diane has the latest. >> reporter: firefighters are facing an uphill battle as devastating fires burn across australia. >> information of another life lost, and we extend once again our sympathies to the family of those who lost their lives. not just last night but now over many months. >> 140,000 residents have been told to evacuate.

>> i've never seen anything like this. >> reporter: hundreds of residents from the coastal town even had to evacuate on an australian navy ship. >> we slept on the beach the first night because we thought that was the best place. then a big sand storm came in. >> reporter: there was flames on either side of this highway right now. this is the main highway out of town. they're warning any residents who stay behind in those towns to shelter in place. there is no way out for them right now. >> reporter: the country is deploying 3,000 defense forces to help. >> the defense forces are doing that they possibly can to assist australians across the country who are in need. >> the united states is also sending help from the forest service and the department of the interior. >> firefighters have done an outstanding job in defending life and property. >> reporter: even celebrities are getting involved. pink is donating half a million dollars to local fire services in australia and providing links

to several fire departments. abc news new york. this morning the federal aviation administration is investigating a deadly plane crash in southern california. the single engine home built aircraft went down near highway 14 yesterday morning. the pilot who was the only person onboard was killed in the crash. you can see in the video, the plane hit the ground, slid hundreds of feet before hitting a tree and catching fire. >> we saw a big black plume of smoke and we thought, how could there be a fire when it is so wet up there on the top of the mountain. >> the faa has only identified the type of plane so far. no other details have been released. now to the new investigation into the gender of test dummies. consumer reports has been looking at them and believes there is a lack of diversity. michael finny explains.

>> you might think by the looks of this crash test dummy it would represent a wide range of drivers. but despite their blank faces and features, most dummies used in auto crash tests represent a very specific type of driver, an average adult male, which researchers say pose a safety risk to women. >> there are no crash test dummies that represent the average female in our country. that's despite the fact that women are nearly half the drivers and are more than half the population. >> results from safety crash tests like this one have a direct impact on how cars are designed to make them safer. but if safety tests prioritize adult men, what does that mean for women? a recent study from the university of virginia reveals as seat belt wearing woman is 73% more likely to be seriously injured in a frontal car crash than a man. >> this has been a clear problem since at least the 1980s back when the regulators first asked for there to be dummies starting to represent women.

bay area beautiful after he saw a need to bring awareness about electronic waste. >> they go near people that kids that have to work near those landfills. because of the chemicals in the electronic waste such as led and mercury, it is very harmful. this could even lead to death. >> reporter: he is tackling this big problem by creating dropoff centers for people to dispose of their electronics properly. his first location was at the library. >> i would have to come every single day to just collect electronic waste and drop it off. >> reporter: his efforts got attention and recognition from the mayor. in april of 2019, he received the community hero award by state assembly member cho. >> if someone lives far away, i will also find other customers that live near there so i could go around and collect all the waste from that area. >> reporter: he picks up e-waste materials from people's homes. he also holds dropoff drives at local parks. with the help from his website and social media, he's hoping to
