the fight between a silicon valley billionaire and the access to a bay area beach. and the grandmother oak. how sonoma county has lost one of its oldest trees. >> now news to build a better bay area from abc7. >> as we continue with our news coverage this evening, we are just now getting some answers about what happened at this gas station in san jose this weekend where police shot and wounded a man who was trying to light a gas pump on fire. good evening. i'm dan ashley. >> and i'm kristen sze. let's get right to chris nguyen. >> with new developments on this story. chris? >> well, tonight that suspect remains in stable condition at a local hospital. we spoke to the police chief. he says his officers had no choice but to open fire. this afternoon, customers at this typically busy gas station near east ridge mall say they're somewhat in shock. >> it was like wow. something like that happen

around here? it's like unheard of. >> chaos saturday morning as san jose police responded to the arco at quimby road and capitol expressway after learning a man was trying to light a gas pump on fire. manager veronica cortez was on the phone with her employee who watched it all unfold. >> the moment i called her about turning off the pumps, we hear the shooting. and i told her hiding. >> two officers tried to de-escalate the situation by using stun bags and a taser. but police say those efforts were unsuccessful as the suspect, 32-year-old jose antonio de los santos of san jose charged at them with a metal rod. he was shot three times by officers who have been placed on routine administrative leave. >> after being released from the hospital he will be booked for assault on a police officer with a deadly weapon and attempted arson. >> de los santos has been in trouble with the law before, and was out on parole after serving more than four years in prison. police say they aren't aware of

any mental health issues in the suspect's past, but say he seemed a little off during the confrontation. >> there is something going on, whether it's a mental health episode, stimulant influence of some sort, but it was very, very odd behavior. >> some customers praise the quick action of law enforcement and gas station personnel for putting a stop to what could have been a deadly situation. >> saved a bunch of lives, man. this place would have blew, who knows what else would have happened, you know what i'm saying? >> we have learned that both officers had their body worn cameras activated at the time of the shooting. police tell us they will be releasing the video in the coming weeks. live at san jose police headquarters tonight, chris nguyen, abc7 news news. backo you. >> thank you so much. right now we have breaking news in oakland. take a look. that big rig northbound 880. it had been uprighted, but it's jackknifed, and you can see it's stopped traffic in all lanes in

the northbound direction. this is just before 66th avenue in oakland. again, it's northbound. you can see chp there. the less a couple of other cars involved. you can expect this to last a while. so traffic is starting to back up all the way to davis street in san leandro. we are told. so that is many miles backed up and then stop traffic right there at 66th on 880 in northbound direction in oakland. so dan, at this point, people are being told to get alternate routes to get through. see how they're being forced off the freeway right there? >> absolutely. you can see the terrible damage to the right car there on the right-hand side of your screen and debris scattered all over the highway. a real mess. >> and even southbound direction is slow getting past that accident just because of people rubbernecking. you'll want to avoid this area, northbound 880 in oakland just before 66th avenue if you can. >> that's obviously going cause big traffic problems at the worst time of day for that.

more breaking news taking place in cow hollow. live from union street in sky 7. you can see a parking control vehicle's officer was overturned and at least one other car is damaged. right now union street is closed between van ness and franklin street. that's affecting muni service on the 41 and the 45 lines. there is no word if anyone has been hurt, and police are working to find out who was at fault here. one issue we're following as part of our commitment to building a better bay area is safety and car break-ins. in san jose, someone broke into about a dozen cars near del mar high school in the middle of the night. woman told police she saw three suspects, two men and a woman. they appeared to be in their late teens or early 20s. neighbors told abc7 news they believe the thieves are looking to steal electronics. meanwhile, police say car break-in criminals from the bay area are going to southern california now to go after cars against unsuspecting tourists down there. one commander says it was the number one crime trend in west l.a. in 2019.

abc7 news reporter wayne freedman is live on san francisco's lombard street with more. wayne? >> well, you can argue that in california, it might have started here at lombard street and tourist attractions like it. this is one of those places where if you stand in this spot long enough, the world will pass by. some of those folks are right here, right now. and little do they know that this crime is becoming a trend across the state. diamonds in the street, broken glass actually. a driver's worst friend, and these days they're the kind of calling card we don't want to see. >> common. >> very common. >> as in a crime epidemic. read the signs. and if you're parked in a popular tourist destination or on any public street, beware the smash and grab. >> don't they do that everywhere in any city? >> what have they told you? >> to don't leave anything in your car. maybe people are getting the message. san francisco police report that last year the number of break-ins declined by 3%. but that has meant bad news in

southern california where break-ins have increased by 30% or more. police say the culprits are some of the same gangs who have been working in northern california. >> they're becoming savvy. they know that this is very saturated out here, so they are trying to find different areas in california that are more saturated with vehicles and may not be expecting to be burglarized. >> in l.a.'s hollywood division, police say one oakland gang hit 40 different cars last april, breaking into them and handing the goods off to getaway specialists on scooters. >> it's our understanding that in the bay area, they're able the get about a thousand dollars for each bag of merchandise that they're able to trade. >> whether north or south, these crimes of opportunity leave victims feeling exactly the same. >> if i left this bag in there, nothing in it, they would break it just to see what was in it. they just don't care. there is no conscience. you know what it is? there is no consequences. >> though there may be some

changes and more consequences on the way. state senator scott wiener wants a change in the law that would make it easier to prosecute people who break into cars for felonies. in san francisco, wayne freedman, abc7 news. >> wayne, thanks very much. one of the toughest parts of building a better bay area is dealing with the housing crisis. but new numbers show the number of vacant homes in the bay area could make a difference here. this idea came to light because of a group of mothers occupying a vacant home in oakland, trying to challenge an eviction order. new data from the census bureau estimates there are just under 6,000 vacant homes in oakland, enough to house the city's roughly 4,000 homeless residents. by comparison, san francisco has well over 11,000 vacant homes with an estimated 8,000 homeless. and san jose is estimated to have just under 4,000 empty homes and roughly 1500 people who don't have homes. abc7 news reporter luz pena is

live in san francisco for us tonight. luz? >> you know san francisco is all about location. to my left right there, that is the bay bridge. now to my right, check it out. that entire building is vacant that one right there was taken after market in november. that's an example of many across the bay area. is too much money harming the bay area? well, according to the latest u.s. census, there are 46,000 vacant homes in our region, and some landlords want to keep it that way. >> generated by success in large part and our inability to accommodate that success and accommodate the growth that we've had in our economy. that's the basic problem we're experiencing. >> a problem that according to the bay area council has a lot of protagonists. >> a lot of landlords have markets off the market trying to figure out what's going on in the rental market going forward. >> there is also this. is it also greed? >> it's a market like any other,

the housing market. you will get individuals who will be greedy. that's human nature. but i think we create a situation. we've created an imbalance in the market that encourages greed. >> according to the census, san francisco has the most vacant homes in our region. san francisco 11,760. oakland, 5,898. san jose, 3,985. berkeley, 1,738. now let's move over to the east bay where there are close to 8,000 vacancies according to this census. >> what we typically see when a house stays vacant in our area it's just because the buyers have just started making it their own and have not moved in. we've seen them take up to a year sometimes. >> permits? that's another reason that experts say is a problem that's driving this all across the bay area. now at 6:00 p.m., we'll have data from real estate database

in oakland are looking very different this evening. all of the community's thoughts and wishes are now being organized into a book that will be given to the victim's family. >> no one deserves the loss of their life. >> sue graham never imagined the post-it note she put out the montclair starbucks in shuo zeng's honor would come to this. >> i came down here on the 2nd and put a post-it up and left some for others. i was hoping that one window pane would be covered. >> now they're taking down the memorial to zeng. the 34-year-old was killed on his birthday, december 31st as he attempted to recover his stolen laptop. they'll be turning all the post-it note sentiments and pictures into a scrapbook for zeng's family. >> it will be nice to have the memories, a and the community all came together to put these out here. so i thought they should be shaered with the family. >> over the weekend his parents arrived from china. yesterday's zeng's neighbors, coworkers, friends and family filled the space, sharing

the starbucks. live in montclair, melanie woodrow, abc7 news. >> melanie, thank you. all right. let's turn now to consumer news and a car recall you'll want to know about. >> 7 on your side's michael finney is here to tell us all about it. michael? >> if you own a mercedes with a sun roof or are driving behind a mercedes with a sun roof, you need to watch out. the automaker is recalling 3/4 of a million 2001 through 2011 c-class, e-class, clk and el class cars all because the sun roof can fly off. mercedes says the glue used to attach the glass can straight. owners will be notified and can take their cars to a dealer for inspection and if needed a repair. if you want to eat an inexpensive pizza, head to san jose. a new study by workwise software finds san jose was tied with six other cities for having the lowest priced pizza in the

nation. when figured by the slice, just $1.36. annual spending on pizza in san jose was found to be $500 a year, which is also tied for the lowest. memphis came out the most expensive pizza city, costing residents there an average of $1300 a year. i know. and talking about pizza, little caesar's pizza might need to change their tag line from pizza pizza to delivery delivery. thanks to a new deal between the country's third largest pizza chain and delivery service doordash, the new service begins today. little caesar's is the third largest pizza chain in the united states behind pizza hut and domino's. >> now we're hungry. thanks, michael. >> good job. let's turn our attention to the back to week forecast. >> really easing on in today. a lot of sunshine. really comfortable temperatures.

coliseum, as you look from sky 7. this is at 66th avenue. >> you can see there are at least two other cars that were involved as well. ambulance, drivers coming from east oakland and san leandro are just stuck in the backup. and as we pan, you can see it extends well past san leandro now. >> it's a mess. apparently it's a four-mile backup. of course, this is right in the heart of the evening commute. so it's causing a terrific traffic backup, four miles. look at that ribbon of headli t headlights winding down 880. >> since traffic is completely shut down at the accident site, northbound 880 there, they may be soon allowing trucks to get on 580, which they normally would not be allowed to do right now. but there is no getting past that area right now going northbound and even southbound a little slow getting to the scene and passing the scene there. >> and something else to notice. you can see the terrible damage to that white vehicle. we're still working to find out the extent of any injuries, if there are any injuries.
