a date for retrial has not been set for derrick almena. abc7 news reporter anthony covered the brief hearing which included a former juror, a woman who voted to acquit almena in september. >> reporter: she stood before reporters but didn't want her face shown. she was one of two jurors who voted for acquittal. juror number five described why she couldn't find almena guilty. >> in my heart, i do know it was the right thing. and in the end, i did what was right for me and something i could live with without compromising my integrity. >> reporter: almena's next trial begins in two months. the co-defendant will be called

gardener has put his own mine into replacing dead trees in the oakland hills. hundred of trees skirt the campus but tom o'neale estimates the school is losing ten to 12 trees a year due to drought or just old age. last year he planted 40 trees around the campus to make up for the loss. he started with seeds he found around the house and has spent with four years growing the trees around his own home. >> i feel like the district has given a lot to me and i want to give something back. we did plant a few around the building. and they're nice. i wish i had more. >> the trees he planted cedars and russian pines. he says these trees will not be infected with beetles and they're the semi drought tolerant. >> the weekend is upon us. >> it seems like we might get a few something, something. >> something, something?
