created at the bank over many years. authorities stay bank will pay $3 billion in penalties. good evening. >> thanks for joining us. today's announcement comes four years after we first learned of the bank's marketing strategy which attorneys say wells fargo claims is based on products they actually needed. >> in truth, however, the cross strategy and pressure from leadership of the community bank to meet aggressive sales goals led to widespread abuses, unethical conduct, and illegal activity that resulted in millions of accounts being fraudulently opened for customers. >> the settlement covers wells fargo as a company. individuals who violated bank laws could still face more punishment. >> that's right. and it doesn't do away with all the company's problems. it is still under probation with the federal reserve and faces other investigations. >> in a statement, wells fargo's

current ceo said in part, the conduct at the core of today's settlements and the past culture that gave rise to it reprehensible. >> the money will be distributed among several agencies. >> unfortunately, other than maybe some piece of mind that wells fargo is facing repercussions, there doesn't really mean. to consumers. here's how the settlement will be broken down. the bulk of the $3 billion penalty will go to the u.s. treasury. $500 million will go to the s.e.c. to be distributed to investors. that means zero will go to customers. this is not the first fine or settlement wes fargo has faced in the face of their scandal. some money has gone to those who suffered harm such as down grades to their credit. people are not happy pointing out, it may sound hefty but

wells fargo earned more than $4.5 billion last quarter alone. they say there should be much more punishment than that. >> they say it is a drop in the bucket. >> absolutely. it dth mean much. will it really change the actions in the future? consumer advocates don't think so. another major story. students and teachers at mcclymonds high school spent another day at home. the school has been closed since yesterday after a cancer causing chemical was found in the ground water nearby. an updiet when classes will resume. this is new information, chris. >> reporter: it is. it is eerily quiet here you can and imagine why parents are upset. they don't know if they've been breathing toxic air, they don't know when they're going back to class and they don't know when they'll get answers. >> ideally we want to keep all these kids in the same school, the same location.

>> reporter: there are about 350 children at mcclymonds high school. the options? >> it is a small black school. it is all we have down here. it seems like they're always trying to do something to shut it down. >> reporter: the school canceled classes after a ground water chemical was found. there are several sites near school that could be the source. this old plating plant about 600 meters from the school is one possibility west even found a hazardous waste sign right at the gate. the property has the same owner as this auto body shop next door west called the owner but didn't get a response. people who live there are not determined. it is not just the school that needs to be tested. >> so i'm concerned where is it underground. if it is covering the school, it must be under houses as well. >> we have gotten periodic updates about what they're

doing. they've never said there is any sort of alarms. and they said that we're safe and they said that our soil is safe. but you always have suspicions. >> reporter: suspicious, angry, confused and emotional. that's how parents were feeling at an emergency meeting for the families thursday night. the deaths of two students were repeatedly brought up. >> we have had a couple of high profile cancer cases related to mcclymonds high school. that's very much on our minds. we're very concerned. we want to make sure the school is safe. we'll be bringing in more experts. >> reporter: we do know that air testing will be happening inside the school this weekend. those results are expected in the next week or so. we heard from state officials who tell us, they are looking at other contaminated sites around the school to track down the source. abc7 news. meantime, sixth graders at a middle school in san diego walked out for one period today

over buttying concerns. as melanie explains, these students are demanding a better wellness center. >> reporter: dozens of middle school students walked out of class demanding a wellness center with a greater number of qualified social workers. some of the children's parents watched nearby in support. they say their children have described disturbing incidents this school year. >> kids that are choked by other kids, by their neck and lifted up off the floor repeatedly. my daughter and her friends have also articulated that walking along the halls, they are constantly called the b word. >> reporter: parents say the bad behavior has become normalized. they want change. >> well trained had therapists and a wellness center if they need to cool down or someone to talk to. >> reporter: the school district spokesperson said there are a

number of supports in place including a wellness center, social worker, counsellors and staff. >> the school is really committed to make sure this is a safe and healthy community for all. >> reporter: but they said there is a great need for more social workers as well as accountability for students who misbehave. >> i feel disappointed. >> reporter: a skol resource officer and teachers were outside with students during walkout to make sure they were safe. the school district says it has held community meetings for parents to express their concerns. abc7 news. in an unexpected decision that left a lot of people shocked, oakland police chief anne of kirkpatrick has been fired. they said a series of issues caused them to lose confidence and a police cadet graduation today, we talked with a city councilmember who. he was disappoint.

we also caught one the chair of the commission to get her response. >> the timing was wrong. i think the way we did it was completely uncalled for. >> this is a personnel matter. we were not allowed to speak to anybody else. i know that we have a perspective perhaps he didn't get an opportunity to see. >> mayor libby schaaf addressed them saying she wanted to keep attention on the graduates. a proposal to make highway 37 a toll road. this road often floods in the winter and sees big back-ups in the summertime. finding solutions for aging roads is part of our commitment to believe a better bay area. 40,000 cars and trucks travel highway 37 on most days between marin and solano counties. check out the friday slow and go commute. we are so glad we're not a part

of that today. proposed toll on highway 37 though could ease this congestion and praekt big stretch from sea level rise. >> it gets jammed. >> reporter: it seems like everybody has a horror story when it comes to highway 37. >> 37 going eastbound is stopped. >> reporter: a stretch of commuter weary highway not getting any better. >> commuters deserve better. >> reporter: easing congestion on 37 could cost billions. but he has a solution how to pay for it. a toll road between sears point and mare island. >> and providing with us a new roadway that will have sustainability and greater capacity. >> reporter: money from the tows could kick start fixes on 37 which is flooded several times in recent years, prompting full closures. on this highway, impacts from climate change are looming. by the end of the century, this roadway system will be under

water. >> reporter: dodd says a uc davis study indicates most of highway 37 will vanish due to sea level rise. >> we've been incredibly impacted by fires in this county bust we also have to recognize that sea level rise will present even greater challenges, even greater costs in the long term. >> a redesign of highway 37 could restore acres of wildlife habitat. many say it is time invest in the future. >> i think it is our responsibility as humans to do something about that. it is not working as it is. evidence points to it being under water very soon. >> they already charged for it. you might as well charge for the 37. >> reporter: but not serve willing to pay a toll to cross. >> i don't like that at all. >> reporter: they could help leverage state and federal funds on help design a new highway that would be elevated like a

applications to retrofit older thoems prevent them from being knocked off their foundations. david louie shows how the program works. >> too good to be true. perfect timing. it is something i've been wanting to do for years. >> leo is one happy homeowner. he just received a check for $3,000 that will cover about half the cost of hiring contractor christopher of san jose's construction cms. these photos show his 51-year-old house wasn't completely bolted to the foundation. this is what happens when a major earthquake knocks a house off its foundation. a state run program called earthquake brace and bolts provides grants up to $3,000 to do a retrofit. >> this is a typical half inch bolt that would be used in the '50s and '60s with a tiny washer and a little nut. this is what is required today when you build a hole. a much bigger bolt. 5/8 inch thick with a bigger washer and the spacing is now three or four feet apart.

in the '60s, they would be six feet apart, if that. >> the work typically takes a couple days and it is double by contractors certified by the state. it is done by fema. applications being accepted from select cities for this year's program. is goal is to retrofit 4,400 homes. >> i have the cripple wall, the area between the foundation and the florida. we add plywood on that and most homes don't have cripple because. so that was one day just doing plywood. the next day they did all the brackets. >> word of mouth and referrals is a big part of the program. as a matter of fact, while we were here shooting the story, one of the neighbors called to find out what we were covering. he told him about the program and now the neighbor is interested in the brace and bolt program. in san jose. david louie, abc7 news. >> this is important, obviously. to find out if you live in one

those crowds. here's another perspective from our east bay hills camera. isolated hills tomorrow morning. breezy sunday and a little cooler and we're looking at sunny and warmer weather next week. if you are getting out of town, here's a look at the bay area airports. upper 50s to the upper 60s as far as other locations, honolulu, isolated showers, 82 degrees. new york city, chilly but soinl. 48. chicago, 45, and los angeles, you're looking at showers with 65 degrees. you see the clouds in the southern part of the viewing area. into tomorrow morning, a few showers showing up at 6:30. this model isn't really picking up any moisture here locally but i'll keep it in an isolated shower, not out of the question. the rain continues right through

tomorrow evening in case you are heading out. as you take a look at the rainfall projections, yes, it will be measurable rain for a very dry state. santa barbara, a tenth of an inch. upper 30s to the upper 40s in the morning. a lot of clouds around. a lot more sun tomorrow afternoon. cooler and breezier in the city. upper 60s around santa rosa, fairfield. we can't rule out a few sprinkles tomorrow morning in the south bay. and then look at the temperatures next week. near 80. yeah. tuesday, wednesday, thursday, upper 70s inland. we already managed to get to 77 in fairfield. 60s, coast side. definitely more like spring. >> you kind of enjoy it but you fee so it goody because you want the rain. >> but we can't change it. we are so desperate for rain at this point. we'll just have to wait for
