these evidence has been turned over to the fbi. and i want to be clear, that regardless of the intentions of whoever put those nooses in our public trees in our sacred public space here in oakland, intentions don't matter. it is incumbent on us to know the actual history of racial violence of terrorism. that a noose represents. and that we as a city must remove these terrorizing symbols from the public view. and investigate these as hate crimes. until proven otherwise. these are extremely serious acts. we have to take into account the impact that they will have when viewed by members of the community that have been subject to racist attacks, terrorism and even violence.

so what are your rights? we spoke with an expert of the waivers. new york consumer and civil rights attorney. >> will covid-19 liability waivers become a part of new norm? >> very possibly they will. as long as the pandemic is with us. what consumers need to understand is that liability waivers they are only valid when a court says they are. just because you sign one doesn't mean it's necessarily valid. >> we don't really know until after we sign one and we end up in court. correct? >> very much so. that's correct. >> who is going to be handing these to us and what will they say? >> most likely someone in the front of the restaurant or the gym or the store. or the salon. and essentially it's going to say we are now waiving ourself out of liability if we're negligent. it has to be in simple language and big type.

essentially that's what the business thinks they're doing. that's what they'll tell you they're doing. bu like i said, it's subject to a court interpretation. >> what am i waiving when i sign a waiver? >> if the waiver is done correctly in terms of type and explanation. probably waiving right to have a successful lawsuit if the business has what's called ordinary negligence. some examples maybe that's there wasn't enough disinfectant. or they didn't watch everybody on the social distancing. however, the business cannot contract themselves out of gross negligence. that would be for example a restaurant putting tables two pete apart. or a gym letting an employee stay knowing he's sick. that's a different thing. >> they can avoid gross

negligence. can they avoid court by sneaking in arbitration costs? >> that is a question and that is a question that the courts are going to look at as well. because you have a public health and safety standard. there's a public interest of course of the government to make sure that someone is not doing things that is out of the norm. the public health. this is a pandemic. the public interest is a very high one. that will be another question for the court. >> who's being asked to sign them right now? what industries what businesses are using them as we speak. >> i have heard about restaurants and other states that have opened and gyms that are have opened. i think what the problem here is, is businesses think it's a cure all. it's not. it's going to subject to court interpretation. consumers may think well, i

could always sue for negligence if i get covid-19 from an establishment. that's a high standard of proof. it's not like a cruise ship or nursing home. we can trace it back to where it happened. even if you can sue, and even if you can prove negligence. you have to prove the cause of the covid-19 was that particular establishment and that is a high bar. >> would you sign a waiver? >> probably not. the first thing i would do is read it, inspect the premise. ask lots of questions. ask them why am i signing a waiver. is there something wrong with your health and safety precautions here. and i would say to myself, unless this is the most extremely necessary thing i need to do in my life at this moment, i'm in san francisco. i can go to a hundred different restaurants and gyms and hair salons.

a bear on the loose in the city. this bear was caught on camera in new york. they first spotted the back bear in a downtown parking garage kp chased it out. up a road. that bear looking for his car. eventually disappeared into the woods. officials say there have been multiple bear sightings in the area recently. officials in l.a. say a not so nice bear actually attacked and bit a woman who was sleeping in her backyard. the woman was able to fight it off with her laptop. this happened monday.
