building a better bay area for a safe and secure future, this is abc 7 news. >> we have breaking news in the south bay. evacuations are under way in morgan hill as a 40-acre fire burns close to homes. it's been a busy weekend for crews across the bay area, with dozens of fires, some caused by fireworks. good morning, everyone. it is sunday, july 5th. i'm accounts accounliz kreutz. we have a lot of pictures of the fire in morgan hill but before we do that, let's get a quick look at the weather. >> morgan hill it's 60 degrees right now and the winds are relatively calm, about 5 to 10 miles an hour and at the surface not looking at breezy winds but upper elevations is a different

story. live doppler 7, temperatures are warmer around the bay. 57 downtown. 61 in oakland. it is 62 in san jose. some 50s along the coast. this is walnut creek. no marine layer out there, with low 50s and low to mid-60s in our inland valleys, on our way to another warm day inland, eight to nine degrees warmer than we were 24 hours ago. as we go through the next few hours it's about sunny skies and temperatures in the 70s and 80s by noontime. 80s to the low 90s to mid-90s by 4:00, the sea breeze is with us, picking up the winds throughout the day. they'll be quite gusty at times. we tails on that and the cooler week ahead in a few minutes. >> lisa, thank you. let's get back to breaking news in the south bay where a brush fire is prompting evacuations near anderson lake east of morgan hill. this is a live look right now of what's being called the park fire. so you can see we're told that it's pretty steep terrain and you can see it there, burning

right now. i know it's been burning for the past few hours overnight, and cal fire says at least 40 acres have burned but that was as of 1:00 this morning. we will await upon update from cal fire and bring that to you as soon as we learn more. families living along finley ridge road are being evacuated. est dunn road before anderson lake is closed. cal fire says to avoid that area. this is park fire and morgan hill burning overnight. the cause of the fire is unknown. we have a live picture, a crew on the scene, and we'll bring you updates throughout our newscast this morning. contra costa county firefighterss responded to to tt of fires, as fireworks go off in the background.

it's unclear what started this fire. 16 fires were caused by fireworks last night in the span of five hours. there were 67 total fires, ten structure fires and 27 vegetation fires but some good news is that no homes were lost and no one was hurt. abc 7 news reporter ansar hassan has more from pittsburg. >> reporter: firefighters were requestic to contain a fire burning near classrooms at delta view elementary in pittsburg. firefighters say it was started by illegal fireworks. >> i know it's a holiday but they need to be careful. >> reporter: contra costa count y expect this to be a busy fourth of july. >> we will respond to probably 20 to 30 or more fires just here in the east portion of our county tonight. our resources are stretched thin. it's not even dark and we've

responded to three fireworks caused fires. >> typically the highway 4 corridor through pittsburg and antioch is typically busier for us and our fire district. >> reporter: it's also a saturday night, with so many people stuck home because of covid-19 and no public fireworks, chief bouchard says it's led to an increase in people using illegal fireworks >> with the noticeable uptick in fireworks usage, unfortunately it feels like it's in every city, in every community that we serve. >> reporter: pittsburg, ansar hassan, abc 7 news. ? san francisco, firefighters were busy all night as well responding to more than 20 fires. one happened at mclaren park in visitacion valley and another near the old site of candlestick park and hunter's point. the department staffed extra firefighters this weekend to handle the influx of calls.

those fires come hours after a fire spread to two acres before crews got it under control. fire department's warnings certainly didn't stop people from setting off illegal fireworks last night. we still heard some just a few minutes ago from our studio here on the embarcadero. video from the bay view shows colorful bursts lighting up the sky, and not far from power lines either. this is a time lapsed video the illegal fireworks in san jose. if you didn't know better, you would almost think that these are professional fireworks, but no, they were not. we've heard reports of about a dozen small brush fires in the city, but it's not certain that those are related to these fireworks. almost every fourth of july celebration canceled in the bay area, gilroy was the only official show in the area. abc 7 news reporter kris reyes was there and tells us why this year's celebration is to important to that community.

>> reporter: any other year this annual tradition of lighting up the skirz would have been one of many celebrations all over the bay area but we already know this year is unlike any more. notice the masks, the social distancing in the crowd. >> they're not planning to go there. we're planning to stay there in the car. >> reporter: the city of gilroy went ahead with their fireworks show to boost morale. in addition to dealing with closures and cancellation, it's still healing from the hooting at the gilroy garlic festival last year that killed three people and injured dozens. >> i think it's a great idea. i think morgan hill should have had theirs, too. >> we couldn't do fireworks in our town and this is like not as busy as santa cruz. >> we're trying to stay away from everyone, wearing masks when we're close to people so i think that would be okay. >> reporter: this is literally the only show in town. this year the parade was canceled, the pandemic turning

gilroy's counsel town into a ghost town. shuttered stores, barely anyone around. at this fireworks stand optim m optimism. they're raising funds for a local school and fireworks sold out fast. >> a lot of residents are coming to get fireworks, trying to give their children some more memories and make it a little bit more special for them while we're still in quarantine. >> reporter: this year's fireworks launch from gilroy high school is higher than last year, to give people the chance to spread out, so that homes within two and a half miles could see them. >> we're gilroy strong. we're making a comeback. gilroy ends, we stand together, we support each other and i think everything that has happened, we've just become a stronger community and we're here to stay. >> reporter: in gilroy, kris reyes for abc 7 news. >> here's a look at the bay area counties that closed beach parking lots in sonoma, marin, san francisco, san mateo, and

welcome back. here say live look at the fire in morgan hill. this burns overnight, there were some evacuations under way. we'll bring you more updates as we get them throughout our newscast this morning. breaking news out of south caolina, two people are dead and eight others are hurt after a shooting at a nightclub near greenville. the sheriff's office says deputies responded to a disturbance at a club called lavish lounge around 2:00 this mrning. they called for backup when they heard gunfire. no one was immediately taken into custody.

the coronavirus pandemic changed the way many americans are celebrating the fourth of july weekend. health officials are encouraging people to stay home as cases increase across the country. christine sloan has the details. >> reporter: independence day fets difficulties were drastically scaled down due to the ongoing coronavirus pandemic. president trump hosted a celebration on the south lawn of the white house. social distancing wasn't enforced and not everyone was wearing a mask. during his remarks, trump said his administration has tested 40 million people so far. >> we've made a lot of progress, our stat gee is moving along well. it goes out in one area and rears back its ugly face in another area. >> reporter: beaches that would normally be packed for the holiday closed in california, texas, and florida. >> we have to follow these rules but definitely here the beach with the young crowd, it's a good idea.

>> reporter: however, some decided to forego social distancing, scenes like this, hundreds of boaters forming an island on minnesota's lake minnetonka, and lake of the ozarks, concerning health officials. with cases increasing in 39 states, nationwide, 80% of fireworks displays are canceled. the daily nationwide death toll and the mortality rate have been on the decline, but deaths are rising in 14 states and hospitalizations are up in 27, and as professional sports looks for ways to return safely, legendary nascar champion jimmie johnson pulling out of today's race in indianapolis, after he and his wife both tested positive for the virus. >> we're trying to be as healthy as we can but, you know, on the home front with our kids, we're heartbroke n now to see the fea in their eyes. >> reporter: major league baseball announcing 31 players

happening today, a bay area protest demanding justice for vanessa guillen. a caravan will travel from concord to san francisco starting at 10:00 this morning. gillen is a ft. hood army specialist, missing since april. her family believes her remains were found this past week. they say guillen disappeared after she told them she was sexually harassed by a superior but didn't report it out of fear of retaliation. california congresswoman jackie speier is calling for an investigation. it 2-year-old cecily aguilar is accused of helping in the case and the other solder who was a suspect killed himself when confronted by authorities. new details about a story in the south bay. a restaurant in morgan hill serving customers outside for a month now is ordered by the state to stop, and that order could affect every restaurant in santa clara county. abc 7 news reporter deon lim got

the county's response. >> i have no idea why the state is doing this. >> reporter: these surveillance pictures provided by the owner of la dera grill show maebz members of alcohol beverage control abruptly shutting the restaurant down friday night. >> we were visited by two armed officers, everyone was worried. >> reporter: the close ucaused confusion and outrage at the restaurant which had been open for outdoor dining since june is ath. the police chief saying abc told him the county did not have approval from the state for dining outdoors. morgan hill city attorney vowing to find a solution. >> we want to do the right thing. we think we are doing the right thing and if we're not doing the right thing, somebody needs to tll us what we're doing wrong. >> reporter: while no citations were issued, abc informed us they visited numerous establishments and explained santa clara county had not received variance to open and

technically in violation of california's stay-at-home orders. >> i read everything i could find on the net, i see nothing that would be a directive that we could no longer have outside dining. >> reporter: the owner of the grill says this is yet another blow to his hbusiness after losing half a million dollars since shelter-in-place orders began. they say they'll continue until otherwise stated by governor newsom. >> i find this reprehensible and i'm not going to comply unless i get a clear directive. >> reporter: dion lim, abc 7 news. >> the county responded to us in a statement saying in part "the county's application for a variance was not approved by the state. the county is in continued conversations with the california department of public health regarding its application." adding to the confusion, the county did apply earlier this week for a different variance that would have allowed the reopening of hair salons, nail

salons and gyms. lots of confusion over what's open and what's not. tensions are running high in martinez, where a black lives matter mural was defaced. the words black lives matter were painted in front of the contra costa courthouse yesterday and one of the artists tells abc 7 news the mural is a direct response to white power flyers found in martinez early last week, but just an hour after it was painted on the street, another group covered it up with black paint, while shouting "all lives matter." >> i think that this is an indication of how much power white supremacy actually has, the fact that even having something on the street for one hour, they couldn't even tolerate that. it was such a threat to have anybody else's concerns represented by the city and represented by the community. >> the artists were able to fix the mural. the "martinez news gazette

reports police are investigating the incident. another check of the weather with lisa argen. it was a beautiful fourth of july yesterday. >> it was warm for once everywhere, and the winds really were subsiding. so we had clear conditions and go figure, right, clear fourth of july. but we are looking at clear conditions this morning as well. the low clouds and fog, the marine layer will return later on tonight to bring us a cooldown as we start the work week. a live look from live doppler 7. notice the absence of fog so there is nothing out there. it feels cool for sure, but as we widen the view here, satellite and radar, we have a system to the south that we're watching, the area of high pressure that after this week, where we have temperatures that are influenced by this trough to help us cool down, bring back the marine layer, i think this high will reexert itself for the weekend and looks like we'll bring back the warmth by then. right now it's all about this system that will slide a little bit further to the south and

east, and that's going to bring your return to the low clouds and fog. here is a look at the full moon. emeryville out there this morning, so very pretty, with temperatures in the 50s in san francisco, 61 in oakland and it's 55 in mountain view. 62 san jose. on the coast in the low 50s and the golden gate bridge nice and clear, and you can see just a very light breeze out there but the winds are going to get kind of giusty this afternoon along the shoreline in the city. we could see the gusts over 30 miles an hour. it's62 by the delta, light winds, 65 in concord. low 50s in santa rosa and with the clear sky, we are cooler, a lot cooler i should say in parts cooler. elsewhere starting out there's a look at san jose. we're going to warm up again pretty quickly. a clear start, warmer on the bay and inland with cooling temperatures throughout the week ahead. the south facing beaches from sonoma county to santa cruz

right now seven to nine-foot wave heights and continue to be dangerous throughout the afternoon. so we definitely have the parking lots closed and with the dangerous conditions out there, not a great idea to visit the shoreline. as we look at the fog today, notice that it's off the coast, but by your monday morning, it's back along the coast, and you'll feel that breeze. it's certainly going to cool down, maybe five to ten degrees in spots. here is a look at this afternoon, it will be breezy out there to gusty in spots. look at the coast but as we go through your overnight hours, winds back off, it's tomorrow afternoon that i want to show you into the early evening hours, it's a breezy to windy day out there. highs today in the upper 60s downtown to upper 70s over in oakland. so a little change there. we've got another 80 today in fremont, palo alto with mid 80s returning to the south bay. low 90s up in santa rosa. breezy to windy in the city there and numbers from the upper

children. >> reporter: protesters gathering at the park gates. ♪ about 3,700 people crowded the amphitheater, sitting inches apart. no social distancing, few masks in sight. the president only briefly touched on the virus, which he has said repeatedly might just disappear. news it is spreading in his inner circle. kimberly guilfoyle, donald trump jr.'s girlfriend and top fund-raising official testing positive for covid-19 in south dakota ahead of the event. the committee said guilfoyle who is asymptomatic was immediately isolated to limit any exposure and as a precaution will cancel all upcoming events adding donald trump jr. tested negative but as a precaution is also self-isolating. the couple did not travel on "air force one" or come into contact with the president. two weeks ago guilfoyle spoke at the president's rally in tulsa, seen here without a mask?

>> how are we doing, oklahoma? >> reporter: several campaign staffers and members of the secret service testing positive there, too. rachael scott, abc news, washingt washington. california is calling on labs to process coronavirus tests faster for people who are high risk, including those in hospitals, nursing homes or long-term care facilities as well as inmates as prisons and jails. health experts want to prioritize results for the groups because they are most likely to spread the virus to others. quicker turnaround times could help doctors isolate sick patients faster and make better treatment decisions. another death row inmate died of the coronavirus outbreak. dwayne carey died at an outside hospital, complications likely from covid-19. carey was sentenced to death in 1996 for a murder in los angeles county. is he the third death row inmate to die in two days. five died in the outbreak that has seen nearly 1,400 prisoners

get infected. protesters gathered in colorado for the second night in a row demanding justice for elijah mcclain an unarmed black man who died in police custody. selfies show police officers appearing to re-enact the type of neck hold used on mcclain during a violent takedown last year. stephanie ramos has the details. >> reporter: none straiters in colorado demanding justice for 23-year-old elijah mcclain. protesters facing off with police outside the station in aurora. outrage boiling over amid a new scandal rocking the department. ery is amarrero and kyle dietrich fired and officer jaron jones resigning over the selfies, smiling and simulating the choke hold. >> it is a crime against humanity and decency. >> reporter: he was walking home last august after buying iced tea when someone called 911 to report him as suspicious.

officers later putting him in a choke hold as he begged for his life. mcclain died days later at the hospital. police say during the confrontation with officers, mcclain tried to grab officer jason rosenblatt's gun. months later when rosenblatt received this picture in a text message, he replied "ha, ha." he, too, was fired friday. none of the officers have been charged in mcclain's death. colorado's attorney general is now investigating. stephanie ramos, abc news, new york. protesters in baltimore have torn down a statue there of christopher columbus. the man who took this cell phone video said at least 300 people took part in yesterday's protest. when they took the statue down, it did break into several pieces and protesters threw the statue then into the harbor. in san francisco, the arts commission removed the columbus statue in front of coyte tower last month as i'm sure you

remember. many say the statute is not aligned with the city's values. the president of the arts commission says columbus is a symbol of pain and oppression to indigenous people. kanye west said that he is going to run for president, and now it seems that maybe he is serious? unclear. the music mogul tweeted yesterday "i am running for president of the united states." then he used #2020vision. he announced in 2015 he'd run for the white house this year and with 121 days to go until election day t is late in the race obviously for west to do this, and definitely late in the game for him to get on the ballot, even as an independent. tesla ceo elon musk tweeted west has his full support. still ahead on "abc 7 mornings," growing concern as teachers plan a potential return to the classroom. what happens if they run out of sick days during a pandemic? and here is a live look from our golden gate bridge camera

those of you counting at home. sometimes that's tough video to watch. that's your look at sports. send it back to you. >> oh, you're telling me. i guess lisa, joey chestnut had nothing better to do during quarantine to practice and get his stomach ready. >> the reigning champ coming back year after year. good for him i guess. good morning, everyone. notice the haze behind me. we've got a ridge of high pressure overhead and that is putting a lid on the pollutants at the surface and a lot of that is from some of those fireworks that were going off in the past couple of days and without any mixing or any wind early this morning, looks pretty hazy. air quality looks moderate to unhealthy. it will stay that way until we get a little bit of wind out there and speaking of wind, check it out, as we go throughout the day, notice that the winds will continue to pick up out of the northwest, 12 to 15 miles an hour and we get the sea breeze up to about 20, maybe 25 miles an hour, but if you're right at the coast, it will be

stronger than that, and they go down a little bit and then we're looking for more wind as we go into your monday. so kind of a serene look there from the exploratorium camera but certainly you're noticing the air quality, the haze out there, and that is certainly trapped underneath that ridge of high pressure. first couple hundred feet of the atmosphere will looking rather gray. as we look at our satellite and radar composite, no fog to speak of, but we are watching this big ridge of high pressure that comes back to visit us from time to time, and when it does, it brings the heat. it will stay to the west but by the end of the week, this will expand. we'll sigh a return to hot weather. here is a look at pier 39, where you can see just a little bit what's left of the full moon out there, and that haze that i spoke of. temperatures are in the upper 50s downtown, 61 for you right now in oakland. mountain view is 55. it's 62 in san jose with low to mid-50s from gilroy and pacifica. our roof camera, sun coming up

in just about five minutes or so. it's kind of shaded there, looking at 53 in santa rosa. it's warmer this morning in the low 50s in petaluma. you had the 40s yesterday. 62 by the delta. very light winds and 65 in concord. livermore 62. this was a picture of the golden gate bridge. you can barely see it there with that haze. the high relative humidity, the pollutants there, so a clear, hazy start this morning, warm inland and around the bay. those warm temperatures return but closer to the coast, even though we don't have the fog, that sea breeze will be with us, the fog returns later on tonight. here is a look at the current wave heights, from seven to nine feet. the south facing beaches are looking at certainly an increased risk of sneaker waves and rip currents. so that's all up and down the coast. so as we look at the fog, it's not there right now but it comes back and that should help clean up the atmosphere, bringing a bit of a cooldown and the gusty winds at the coast. the cooldown begins tomorrow.

sick was that high likely hood there would be no substitute available to cover my class. >> reporter: olivia utevik gets ten paid sick days a year. teachers can roll them over. if they contract covid-19 they have to quarantine for at least 14 days. >> i think unlimited sick days during this time is going to be critical. we cannot have any staff members feeling pressured to come to work if they're feeling any symptoms. >> reporter: right now, school districts like oakland unified are negotiating with the teachers union new terms specific to covid-19. school districts would not comment on what they are proposing. the question is, where will districts find the extra money for any added paid sick days? >> the educators shouldn't have to pay for it with their sick days. the school district should not have to bear the front of it but the state and federal government should have a pool that we can draw from, in case that occurs.
